It has been argued that all compatibilist accounts of free action and moral responsibility succumb to the manipulation problem: evil neurologists or their like may manipulate an agent, in the absence of the agent’s awareness of being so manipulated, so that when the agent performs an action, requirements of the compatibilist contender at issue are satisfied. But intuitively, the agent is not responsible for the action. We propose that the manipulation problem be construed as a problem of deviance. In troubling cases of manipulation, psychological elements such as desires and beliefs, among other things, are acquired via causal routes that are deviant relative to causal routes deemed normal or baseline. We develop and defend rudiments of a baseline that is acceptable independently of whether one has compatibilist or incompatibilist leanings.  相似文献

How psychopaths and their capacity for moral action are viewed is not only philosophically interesting but is also important and relevant for policy. The philosophical discussion of psychopathy has focussed upon the psychological faculties that are prerequisites for moral responsibility and empirical findings regarding psychopathy that are relevant to philosophical accounts of moral understanding and motivation. However, there are legitimate worries about whether psychopathy is a robust scientific construct, and there are risks attached to reifying psychopathy or other psychiatric constructs. We defend the concept of psychopathy by pointing out the relevance of empirical studies about it for our ordinary practices of ascribing moral responsibility and folk psychological accounts of moral understanding and motivation.  相似文献

Fundamental beliefs about free will and moral responsibility are often thought to shape our ability to have healthy relationships with others and ourselves. Emotional reactions have also been shown to have an important and pervasive impact on judgments and behaviors. Recent research suggests that emotional reactions play a prominent role in judgments about free will, influencing judgments about determinism’s relation to free will and moral responsibility. However, the extent to which affect influences these judgments is unclear. We conducted a meta-analysis to estimate the impact of affect. Our meta-analysis indicates that beliefs in free will are largely robust to emotional reactions.  相似文献

Typical incompatibilists about moral responsibility and determinism contend that being basically morally responsible for a decision one makes requires that, if that decision has proximal causes, it is not deterministically caused by them. This article develops a problem for this contention that resembles what is sometimes called the problem of present (or cross-world) luck. I will argue that a desert-based justification for treating a person in a certain way is a justification that holds this treatment to be justified simply by what the person is like and what he or she has done, independent of (1) the fact that treating the person in this way will have good effects (or that treating people like him or her in this way will have such effects); (2) the fact that this treatment is called for by some (justified) institution or practice; or (3) the fact that the person could have avoided being subject to this treatment by choosing appropriately, and therefore cannot complain of it. I will explore the implications of this understanding of desert for the role of desert-based justifications of blame, punishment, and economic reward.  相似文献

This paper presents a new challenge to the thesis that moral responsibility for an omission requires the ability to do the omitted action, whereas moral responsibility for an action does not require the ability to do otherwise than that action. Call this the asymmetry thesis. The challenge arises from the possibility of cases in which an omission is identical to an action. In certain of such cases, the asymmetry thesis leads to a contradiction. The challenge is then extended to recent variations of the asymmetry thesis defended by John Martin Fischer and Carolina Sartorio. The principle of respect for autonomy has come under increasing attack both within health care ethics, specifically, and as part of the more general communitarian challenge to predominantly liberal values. This paper will demonstrate the importance of respect for autonomy for the social practice of assigning moral responsibility and for the development of moral responsibility as a virtue. An attempt is made to integrate Thomas Szasz's 0974) theory of personal conduct and George Kelly's (1955) theory of personal constructs (PCT). It is argued that PCT provides an alternative to the void left behind by Szasz's negation of mental illness. Because PCT is concerned with psychological, rather than physiological, constructions of problems in living, it is not compatible with the biological model associated with Diagnostic and Statistical Manual of Mental Disorders (DSM) diagnostic categories. Rather, it is in keeping with the views of Szasz. Kelly's and Szasz's writings are used to support this view. Kelly's transitive diagnosis approach to “mental illness”, wherein diagnosis and therapy are construed as process oriented as opposed to category driven, is described as an alternative to the biological model. A contextualist approach (Sarbin & Mancuso, 1980) is also discussed. These approaches not only empower clients and allow them to assert responsibility and control over their lives, but also provide an alternative system to the one rejected by Szasz.  相似文献
