The purpose of this study was to investigate the impact of death qualification, belief in a just world (BJW), legal authoritarianism (RLAQ), and locus of control (LOC) on venirepersons' evaluations of aggravating and mitigating circumstances in capital trials. 212 venirepersons from the 12th Judicial Circuit in Bradenton, FL, completed a booklet that contained the following: one question that measured their attitudes toward the death penalty; one question that categorized their death-qualification status; the BJW, LOC, and RLAQ scales; a summary of the guilt and penalty phases of a capital case; a 26-item measure that required participants to evaluate aggravators, nonstatutory mitigators, and statutory mitigators on a 6-point Likert scale; sentence preference; and standard demographic questions. Results indicated that death-qualified venirepersons were more likely to demonstrate higher endorsements of aggravating factors and lower endorsements of both nonstatutory and statutory mitigating factors. Death-qualified participants were also more likely to have a high belief in a just world, espouse legal authoritarian beliefs, and exhibit an internal locus of control. Findings also suggested that venirepersons with a low belief in a just world and an external locus of control demonstrated higher endorsements of statutory mitigators. Participants with legal authoritarian beliefs revealed higher endorsements of aggravators and lower endorsements of nonstatutory mitigators. Past research examining the effects of actuarial and clinical expert testimony on defendants' dangerousness in Texas death penalty sentencing has found that jurors are more influenced by less scientific pure clinical expert testimony and less influenced by more scientific actuarial expert testimony (Krauss & Lee, 2003; Krauss & Sales, 2001). By applying cognitive-experiential self-theory (CEST) to juror decision-making, the present study was undertaken in an attempt to offer a theoretical rationale for these findings. Based on past CEST research, 163 mock jurors were either directed into a rational mode or experiential mode of processing. Consistent with CEST and inconsistent with previous research using the same stimulus materials, results demonstrate that jurors in a rational mode of processing more heavily weighted actuarial expert testimony in their dangerousness assessments, while those jurors in the experiential condition were more influenced by clinical expert testimony. The policy implications of these findings are discussed.  相似文献

Increased attention to family violence is reflected, in part, in the growing number of social scientists who have applied the results of their work in trials of battered women who have killed their husbands. Acting as expert witnesses, these individuals detail their knowledge and offer opinions in order to educate jurors about the social and psychological consequences of abuse within marital relationships. Little is known about the actual impact of expert testimony on jury deliberation in cases involving battered women. Those engaged in studying the interface of psychology and criminal justice have relied primarily on anecdotal evidence which suggests that expert testimony shapes jurors' attitudes and their ultimate decisions. (Ellison & Buckhout, 1981). This article summarizes psychological research on how individuals, including battered women, react to victimization and provides a preliminary theoretical formulation of this problem.  相似文献

Past research examining the effects of expert testimony on the future dangerousness of a defendant in death penalty sentencing found that jurors are more influenced by less scientific clinical expert testimony and tend to devalue scientific actuarial testimony. This study was designed to determine whether these findings extend to civil commitment trials for sexual offenders and to test a theoretical rationale for this effect. In addition, we investigated the influence of a recently developed innovation in risk assessment procedures, Guided Professional Judgment (GPJ) instruments. Consistent with a cognitive-experiential self-theory based explanation, mock jurors motivated to process information in an experiential condition were more influenced by clinical testimony, while mock jurors in a rational mode were more influenced by actuarial testimony. Participants responded to clinical and GPJ testimony in a similar manner. However, participants' gender exerted important interactive effects on dangerousness decisions, with male jurors showing the predicted effect while females did not. The policy implications of these findings are discussed.  相似文献

The prevalence and content of rape myth acceptance indicate a need for educational expert testimony in rape jury trials. It is proposed that expert testimony regarding common misconceptions about rape and rape victim behavior, conceptualized in terms of a social framework, would help to compensate for societal bias against the complainant in a rape trial. Rape trauma syndrome, eyewitness identification, and general educational testimony concerning rape are discussed. Evidence is presented that suggests inclusion of such testimony serves the purpose of expert testimony according to the Federal Rules of Evidence.  相似文献

This article discusses the legal admissibility of expert testimony and the ability of mental health professionals to detect malingering and deception among defendants. A legal analysis of the admissibility of expert testimony regarding malingering and deception in formal legal proceedings is presented. Some guidelines are provided to help mental health professionals and attorneys determine the admissibility of evidence they intend to introduce. Although psychologists and psychiatrists currently have a limited ability to identify accurately malingering and deception, expert testimony about the genuineness of a defendant's mental illness is likely to be held admissible for both practical and evidentiary reasons. In contrast, evidence about a witness' credibility is rarely admissible. In addition, psychologists are ethically obliged to recognize their limitations in making representations about their skills.  相似文献

Expert witnesses offering testimony in sexually violent predator civil commitment trials may use diagnostic labels that are either familiar (e.g. ‘psychopath’) or unfamiliar (e.g. ‘paraphilia’) to jurors. Using predictions based on cognitive experiential self-theory, we explored the influence of testimony type (clinical versus actuarial) and diagnostic label (psychopath versus paraphilia) on jurors motivated to adopt either an experiential processing mode (PM; in which heuristic cues may be strongly relied upon) or an analytic rational PM. Consistent with previous research, our results indicated that when given a psychopathic diagnostic label, mock jurors motivated to process information experientially were more influenced by clinical testimony, whereas mock jurors induced into a rational mode were more influenced by actuarial testimony. However, experientially oriented jurors given a paraphilia diagnostic label did not show the expected influence of clinical expert testimony, and instead were more persuaded by actuarial testimony. These findings are discussed from a judgement and heuristics cues framework. The implications of several procedural suggestions are examined. Copyright © 2009 John Wiley & Sons, Ltd.  相似文献

Ease of processing—cognitive fluency—is a central input in assessments of truth, but little is known about individual differences in susceptibility to fluency-based biases in truth assessment. Focusing on two paradigms—truthiness and the illusory truth effect—we consider the role of Need for Cognition (NFC), an individual difference variable capturing one’s preference for elaborative thought. Across five experiments, we replicated basic truthiness and illusory truth effects. We found very little evidence that NFC moderates truthiness. However, we found some evidence that (without an experimental warning), people high on NFC may be more susceptible to the illusory truth effect. This may reflect that elaborative thought increases the fluency with which encoded statements are processed after a delay (thus increasing the illusory truth effect). Future research may fruitfully test whether the influence of NFC and other individual difference measures depends on whether people are making immediate or delayed truth judgments.  相似文献

Mental health evaluations at capital sentencing represent a complex and specialized arena of practice. The moral culpability focus of capital sentencing is distinct from guilt-phase considerations of criminal responsibility, and has a specialized literature. Capital violence risk assessment is uniquely oriented to a prison context, relying on past adjustment to incarceration, as well as group statistical data specific to capital offenders and other inmate groups. Personality testing is a more complex consideration in capital sentencing evaluations. The implications of interviewing the defendant, as well as the parameters and documentation of an interview, make full disclosure and informed consent of particular importance. Defense- and prosecution-retained experts are subject to specific ethical vulnerabilities. These are examined in this paper through the lens of current professional standards.  相似文献

We proposed that intermittent evaluations of performance could be used to promote the acquisition of a complex skill. We also hypothesized that trainees low in need for cognition (NFC) would benefit more from intermittent evaluations compared to trainees high in NFC. Accordingly, 106 young adult males participated in 5 h of training in order to learn a complex computer task that simulated the demands of a dynamic aviation environment. Trainees’ performance was assessed either intermittently during training or at the end of training. Results indicated that intermittent performance evaluations enhanced the skill-based learning of trainees low in NFC, whereas intermittent skill evaluations tended to undermine the skill-based learning of trainees high in NFC. The findings are discussed in relation to Deci’s (1975) theory of intrinsic motivation and the need for more research examining attribute–treatment interactions with respect to training and skill acquisition.  相似文献

The Need for Cognition Scale-Short Form (NCS-SF; J. T. Cacioppo, R. E. Petty, & C. F. Kao, 1984) is a commonly administered measure in the behavioral sciences, but little research has assessed its applicability across cultures. A sample of undergraduates in the southeastern United States and a sample of undergraduates at a southwestern U.S. university completed the NCS-SE Hispanic respondents did not differ from Anglos in their mean NCS-SF scores. Confirmatory factor analysis revealed that factor parameter estimates and item intercepts were partially measurement invariant across samples.  相似文献

Participants acting as mock jurors made inferences about whether a person was a suspect in a murder based on an expert's testimony about the presence of objects at the crime scene and the disclosure that the testimony was true or false. Experiment 1 showed that participants made more correct inferences, and made inferences more quickly, when the truth or falsity of the expert's testimony was disclosed immediately after the testimony rather than when the disclosure was delayed. Experiment 2 showed no advantage for prior disclosure over immediate disclosure. Experiment 3 showed that the pattern of inferences when there was no disclosure mirrored the pattern when it was disclosed that the expert's testimony was true rather than false. Participants made more correct inferences from true conjunctions than disjunctions, and from false disjunctions than conjunctions. We discuss the implications for theories of the mental representations and cognitive processes that underlie human reasoning.  相似文献

We tested the hypothesis that Faith in Intuition (FI) would moderate implicit–explicit attitude relationship strength for attitudes formed via associative processes, but not propositional processes. Experiments 1 and 2 demonstrated that FI moderated I–E relationship strength for attitudes formed via evaluative conditioning. High FI people had stronger I–E correlations. Experiment 2 showed that FI did not moderate I–E relationship strength for attitudes formed via propositional reasoning. Those low in Need for Cognition (NC), however, showed stronger I–E correlations than those high in NC. The importance of considering trait variables in combination with the method of attitude formation is discussed.  相似文献

A great deal of research has been devoted to developing process models of expert memory. However, K. J. Vicente and J. H. Wang (1998) proposed (a) that process theories do not provide an adequate account of expert recall in domains in which memory recall is a contrived task and (b) that a product theory, the constraint attunement hypothesis (CAH), has received a significant amount of empirical support. We compared 1 process theory (the template theory; TT; F. Gobet & H. A. Simon, 1996c) with the CAH in chess. Chess players (N=36) differing widely in skill levels were required to recall briefly presented chess positions that were randomized in various ways. Consistent with TT, but inconsistent with the CAH, there was a significant skill effect in a condition in which both the location and distribution of the pieces were randomized. These and other results suggest that process models such as TT can provide a viable account of expert memory in chess.  相似文献
