随着人工生殖技术的飞速发展,其导致的伦理和法律问题层出不穷。目前迫切需要制定一套能够适应中国现实和发展的人工生殖技术伦理原则,以指导立法、引导社会舆论,并最终促进该技术的健康发展。通过人工生殖技术伦理的哲学、历史传统、宗教、社会制度等多学科渊源的考察,给正确、有效的伦理原则的确立提供启示。  相似文献

辅助生殖技术的开展为医学伦理带来了新的内容和挑战。我国卫生部于2001年2月20日发布的《人类辅助生殖技术管理办法》中规定,人类辅助生殖技术的应符合有利于患者的原则、知情同意的原则、保护后代的原则、社会公益原则、保密原则、严防商业化的原则和伦理监督的原则。开展辅助生殖技术的条件之一是医疗机构建立生殖医学伦理委员会。伦理委员会是教育性、咨询性、义务性及独立组织。生殖医学伦理委员会应依据上述原则对人类辅助生殖技术的全过程和有关研究进行监督,开展生殖医学伦理宣传教育,并对实施中遇到的伦理问题进行审查、咨询、论证和建议。  相似文献

人类辅助生殖技术对人类自然出生方式和自然生命的深度干预与技术控制,使儒家传统生命伦理观遭遇伦理挑战,以致儒家生命伦理难以对人类辅助生殖技术的应用提供及时有效的价值引导。人类辅助生殖技术的临床应用也受到以儒家为主导的传统价值理念的诘难。人类辅助生殖技术作为人类精神文化的产物,应当接受儒家生命伦理理念的价值引导和约束。同时儒家生命伦理理念也应当归纳、包容新的科技价值理念,在科技与伦理之间寻找平衡点,发展出新的伦理原则和哲学基础来应对人类辅助生殖技术引发的诸多伦理困境。  相似文献

人类辅助生殖技术给不孕不育症患者带来了福音,但在一定程度上改变了人类的自然生殖过程,同时也为医务工作人员在实施该项技术的过程中增添了新的伦理困惑.通过比较研究,拟从伦理法规制定机构、单一精子供应上限、精子库精源、受者范围、捐献目的、捐献方式等对中美两国在人类辅助生殖技术方面伦理规范的差异进行阐述,为我国提高此项技术的伦理审查能力、增强政策研究、保证伦理监督的公平和客观提供科学合理的借鉴.  相似文献

被广泛应用于生殖技术的基因科技影响了人类社会的进程,更带来了诸多伦理的、道德的难题。基因增强、基因改良本质上是一个优生学的问题,需要通过回溯优生学的历史来阐释对其加以禁止的原因。优生学的支持者认为基因科技介入生殖工程会让人类更完美,但是用基因技术介入人类生殖过程来打造理想的孩子,破坏了原本平等的代际关系,侵害了下一代的自由选择权和平等权利。以哈贝马斯为代表的学者对此给出了充分的论证。出生是自然的事实,人类的出生是一个无法控制的开端,在对待下一代的问题上,先天的完美设计无法完全取代后天的辛苦努力。人类需要从生命的终极价值角度出发,尊重生命的偶然性。  相似文献

Recently, the attitude and performance of the physician have been questioned and new codes of medical ethics have been introduced. Any ethics proposed for the future is a scenario reflecting the composer's selectivity. Envisaged ethics of truthful, non-paternalistic, responsible physician-patient interaction will have far-reaching implications for autopsy, euthanasia, abortion, suicide, genetic engineering, transplantation, clinical trials, status of the psychiatric patient, physician immunity and liability. Conflicts between personal and societal medical ethics may continue to be insoluble. A possible projection of the physician's ethics on that of the politician is discussed. A new medical ethics should encompass principles of different creeds and be supranational.  相似文献

“de-extinction” refers to the process of resurrecting extinct species by genetic methods. This science-fiction-sounding idea is in fact already in early processes of scientific implementation. Although this recent “revival of the dead” raises deep ethical questions, the ethics of de-extinction has barely received philosophical treatment. Rather than seeking a verdict for or against de-extinction, this paper attempts an overview and some novel analyses of the main ethical considerations. Five dimensions of the ethics of de-extinction are explored: (a) the possible contribution of de-extinction to promoting ecological values, (b) the deontological argument that we owe de-extinction to species we rendered extinct, (c) the question of “playing God” through de-extinction, (d) the utilitarian perspective, and (e) the role of aesthetic considerations in the ethics of de-extinction. A general feature arising from the paper’s discussion is that, due to de-extinction’s special character, it repeatedly tests the limits of our ethical notions.  相似文献

There is a general consensus in the medical and medical ethics communities against predictive genetic testing of children for late onset conditions, but minimal consideration is given to predictive testing of asymptomatic children for disorders that present later in childhood when presymptomatic treatment cannot influence the course of the disease. In this paper, I examine the question of whether it is ethical to perform predictive testing and screening of newborns and young children for conditions that present later in childhood. I consider the risks and benefits of (1) predictive testing of children from high-risk families; (2) predictive population screening for conditions that are untreatable; and (3) predictive population screening for conditions in which the efficacy of presymptomatic treatment is equivocal. I conclude in favor of parental discretion for predictive genetic testing, but against state-sponsored predictive screening for conditions that do not fulfill public health screening criteria.  相似文献

Over the last several years, direct to consumer(DTC) genetic testing has received increasing attention in the public, healthcare and academic realms. DTC genetic testing companies face considerable criticism and scepticism,particularly from the medical and genetic counseling community. This raises the question of what specific aspects of DTC genetic testing provoke concerns, and conversely,promises, for genetic counselors. This paper addresses this question by exploring DTC genetic testing through an ethic allens. By considering the fundamental ethical approaches influencing genetic counseling (the ethic of care and principle-based ethics) we highlight the specific ethical concerns raised by DTC genetic testing companies. Ultimately,when considering the ethics of DTC testing in a genetic counseling context, we should think of it as a balancing act. We need careful and detailed consideration of the risks and troubling aspects of such testing, as well as the potentially beneficial direct and indirect impacts of the increased availability of DTC genetic testing. As a result it is essential that genetic counselors stay informed and involved in the ongoing debate about DTC genetic testing and DTC companies. Doing so will ensure that the ethical theories and principles fundamental to the profession of genetic counseling are promoted not just in traditional counseling sessions,but also on a broader level. Ultimately this will help ensure that the public enjoys the benefits of an increasingly genetic based healthcare system.  相似文献

Ethical dilemmas are encountered commonly in the setting of the clinical genetic testing laboratory due to the complexity of genetic testing and the number of relevant stakeholders involved in the genetic testing process. Based on their clinical training and role within the laboratory, genetic counselors are uniquely equipped to identify and facilitate management of ethical dilemmas. This paper reviews the historical context of ethical theory and its application to the field of genetic counseling. Theoretical and applied ethics are explored in the context of dilemmas arising in the laboratory setting, with a focus on the role of the laboratory genetic counselor in managing ethical dilemmas. Attention deficit hyperactivity disorder (ADHD), its existence and treatment, is a contentious matter. The dominant view in medicine considers that ADHD is a psychiatric disorder. My position is to challenge this from a social relational orientation. I explore here a critique of the psychiatric disease model of causation and treatment, particularly the use of medication. A series of prejudices based on a political and social constructionist orientation are offered to address the ethics, politics and practice implications of the practitioner critical of the biomedical model of diagnosis and treatment especially the use of medication. This device is employed in order to invite critical reflection and further debate in a field dominated by the medical and genetic arguments in support of ADHD as a psychiatric disease. The implications of more open debate are explored, together with directions for more politically and ethically informed practice with children and their families.  相似文献

Freedman and others, the author evaluates some of the criticisms of Wilson's theories on sociobiology and ethics, genetic determinism, ideology, biological diversity, and human equality.
