In response to the dilemma of management of mentally ill persons who commit crimes, Oregon has created the Psychiatric Security Review Board (PSRB) to administrate the supervision and treatment of insanity acquittees. This paper presents an overview of the PSRB structure and examines the quasi-criminal justice features of Oregon's Insanity Sentence. The primary goal of the PSRB is the protection of societý. The maximum sentence, had the individual been found guilty, becomes the PSRB's jurisdictional period for that former defendant. A review of the administrative rules for conditional release and revocation of release that the PSRB is now in the process of adopting are described. The authors conclude that the PSRB is a promising approach which offers better community protection and better treatment for mentally ill offenders (NGRIs) than does the present prison parole system.  相似文献

The National Instant Criminal Background Check System (NICS) Improvement Amendments Act of 2007 encouraged states to create processes by which individuals who have lost their rights to firearm possession for mental-illness-related reasons could receive relief from restrictions. Over 20 states have created relief processes for this sub-group, but there still exists considerable state-by-state heterogeneity. The spectrum ranges from states that require a physician's opinion regarding appropriateness for restoration to those that rely solely on judicial proceedings without input from psychiatrists or other mental health professionals. This article reviews the restoration process in New York State, a model in which psychiatrists participate in the process of assessing whether an individual's firearm rights can be restored. It discusses the legislative background of these regulations, the specific policies and procedures governing the restoration process, and clinical considerations for the forensic evaluation. The right to refuse treatment seems well established for psychiatric patients. Individual states, however, have very different procedures for managing this right and for overriding the refusal. Oregon's administrative procedure for override depends on an evaluation by an independent examining psychiatrist. This article empirically examines the 432 refusals leading to override requests in three Oregon psychiatric institutions in 1983 and 1984. Treatment refusal was found to be a common occurrence in all age groups. Those who refused treatment were seriously ill, unemployed, single individuals with previous psychiatric hospitalizations. Most refused treatment because of denial of their illness or delusional thinking about medication. Most refusals were overridden following the independent psychiatrist's examination. Because of the significant cost of the override procedure to the patient and the mental health system, the authors propose a new procedure which combines parts of the current procedure with a requirement that, at the time of the civil commitment hearing, the judge makes a separate decision as to the patient's competency to make treatment decisions.  相似文献

当前关于亲社会违规行为的研究主要集中于个体层面,但实践和理论都表明我们有探究团队亲社会违规氛围的必要性。为此,本研究聚焦于团队亲社会违规氛围这一概念,以和谐管理理论为基础,分别引入团队和谐作为中介变量和团队互依性作为调节变量,探讨团队亲社会违规氛围对团队绩效的影响机制和作用边界。本文以74个团队和334名团队成员为研究对象,通过对三阶段所获取的数据进行分析,结果显示:(1)团队互依性对团队亲社会违规氛围与团队和谐的关系具有调节作用:当团队互依性高时,团队亲社会违规氛围对团队和谐的负向影响更强;(2)团队和谐对团队绩效具有显著的正向影响;(3)团队互依性调节了团队亲社会违规氛围通过团队和谐对团队绩效的间接效应:当团队互依性水平较高时,团队亲社会违规氛围通过团队和谐对团队绩效的负向效应会被增强。本研究证实了团队亲社会违规氛围对团队绩效的作用机制与边界条件,拓宽了亲社会违规行为和团队和谐的相关研究。  相似文献

Over the last few years we have had a debate regarding the role of government in providing healthcare. There has been a question as to whether or not the state's proper role requires protection of its subjects from the calamities associated with a lack of healthcare. In this article, I will argue that straightforward Hobbesian principles require the state to provide healthcare. It might seem odd (or, at the very least, anachronistic) that such a positive right can be justified by a philosopher who famously conceives of individuals as motivated by self‐interest. Nonetheless, Hobbes's political theory provides the framework for such a right.  相似文献

The gun violence restraining order (GVRO) is a new tool for preventing gun violence. Unlike traditional approaches to prohibiting gun purchase and possession, which rely on a high threshold (adjudication by criminal justice or mental health systems) before intervening, the GVRO allows family members and intimate partners who observe a relative's dangerous behavior and believe it may be a precursor to violence to request a GVRO through the civil justice system. Once issued by the court, a GVRO authorizes law enforcement to remove any guns in the respondent's possession and prohibits the respondent from purchasing new guns. In September 2014, California's governor signed AB1014 into law, making California the first U.S. state to enact a GVRO law. This article describes the GVRO and the rationale behind the concept, considers case examples to assess the potential impact of the GVRO as a strategy for preventing gun violence, and reviews the content of the California law. Abstract

This study examined the free book giving program of Dolly Parton's Imagination Library and its influence upon storybook reading and early literacy within one county-wide setting in the United States. Family literacy and early literacy experiences are known to be critical to young children's literacy development. The study found that childre who received the Imagination Library books were statistically different from those children who did not participate in the free book giving program. This study has implications for the early literacy outcomes for young children and their families, as well as other communities who utilize Dolly Parton's Imagination Library.  相似文献

A history of commitment to a mental health facility disqualifies applicants for gun licenses. Identifying such a history has become increasingly complex as the locus of confinement has become more diversified and privatized. In Massachusetts, prior to 2014, the databases used to identify individuals who would be disqualified on such grounds had not contemporaneously matched the evolution of the state's mental health systems. A survey of Massachusetts police chiefs, who, as in many jurisdictions, are charged with certifying qualification, indicates that some have broadened the scope of their background checks to include the experience of their officers with respect to certain applicants. The survey identifying these patterns, conducted in 2014, preceded by one month significant legislative reforms that mandate the modification of the reporting into a centralized database commitments to all types of mental health and substance use facilities, thus allowing identification of all commitments occurring in the state. The anticipated utilization of a different database mechanism, which has parallels in several other states, potentially streamlines the background check process, but raises numerous concerns that need to be addressed in developing and using such databases. Student E s delivered persuasive communications against U.S. involvement in S.E. Asis to community residents in the residents' homes. The S s received either a written communication (a pamphlet), or a verbal communication (a talk with a student E), or, on successive occasions, both. A control group received neither communication. Later all the Ss were approached by other student Es with a relevant opinion inventory. At this time they were also offered a choice of contrasting petitions to sign. The attitude measure reflected no difference as a result of the written communication, and a negative persuasion effect for the verbal communication. Also Ss signed significantly fewer petitions, whether pro or con, after the vcrbal communication. The pragmatic implications of these results are discussed as they relate to student canvassers in the community.  相似文献

Rereading the opening question of the Westminster Catechism, “What is the chief end of man?”, I contend in this essay that the act of invocation — giving God thanks, praise, and petitions — is the act in and through which human being itself is founded, constituted and achieved. I take important cues from Karl Barth's Church Dogmatics and The Christian Life, and from sociologist Erving Goffman's work on the shifting “footings” involved in everyday interactions. I argue for an account of the human being as a being‐with‐God, human acting as acting‐with‐God, and human salvation as a restoration to the genuine human partner's work — indeed, the true leitourgia— of thanks, praise and petition to God.  相似文献

Though the prevalence of gun possession and carrying among juveniles is now fairly well documented (at least among non-serious offenders), little research has examined juveniles' reasons for possessing and carrying guns beyond noting that youth who report robbery and assaultive behavior have higher rates of gun and other weapon possession than do non-violent youth. The present study examines the question of motivation behind gun possession and carrying by criminally-inclined youths through analysis of survey data collected from juveniles incarcerated in maximum security reformatories. The findings support the popular fear that juvenile offenders are heavily involved in gun-related crime, though the same findings point to multiple needs and uses for guns. Using a number of measures—reasons for carrying guns, for using them during the commission of crimes, for purchasing them, etc.—it appears that the primary reason for gun possession and carrying is the juvenile's perception of the need to be armed for protection. This is the case even among those who were involved in such predatory crimes as armed robbery prior to incarceration. Thus, legislative attempts to dissuade youth from obtaining guns to commit crimes are likely misplaced, since the guns eventually used in crime are usually obtained for protective purposes. Only when firearms are perceived as no longer needed can we expect a serious drop in gun-related offenses among youth.  相似文献

Before the Supreme Court's 2008 decision in District of Columbia v. Heller, the American Psychiatric Association's position on gun policy reflected the strong gun control perspective championed by the nation's public health establishment. After Heller declared that an individual's right to bear arms is constitutionally protected, the APA refocused its attention on the specific aspects of firearm policy that implicate the interests and rights of persons with mental illness. Psychiatrists are mindful of the need to curtail firearm access by persons with mental disorders that elevate the risk of suicide or violence to others, but they are also opposed to stigmatization, discrimination, and unfair treatment of individuals based on mental illness. Although civil commitment is an acceptable basis for prohibiting access to firearms, other adjudications of conduct indicative of elevated risk should also be included. Every state should provide a fair and reasonable process for restoring firearm rights after a suitable waiting period based on individualized assessment of whether the person remains at an elevated risk. However, restricting firearm rights of persons solely on the basis of a diagnosis of a mental disorder or voluntary treatment, whether in-patient or outpatient, discourages treatment and would be counterproductive. The authors studied the employment of counselors with master's degrees in multiservice mental health agencies. The study focused on the types of clients seen, the direct care services provided, and the administrative duties performed. Results suggested that the employment of counselors does not differ significantly from the employment of individuals with master's degrees in psychology and social work. Also, the data indicated that counselors are delivering direct care services that traditionally have been offered in mental health centers, that clients seen by counselors demonstrate a range of mental disorders, and that counselors are responsible for fulfilling various administrative duties.  相似文献

Each E received more signatures from S s of like dress only when the petition was neutral. There were no significant differences between the E s or S s for the two politically stronger petitions. Three studies tested whether perceived consensus affects selective reinforcement of other people's stated opinions on important social issues. Participants who perceived relatively high consensus for their opinions were more likely than participants who perceived low consensus to reward another person's agreeing statements more than the person's disagreeing statements about gun control (Study 1) and to prolong interrogating another student about abortion (Study 2). In Study 3, participants who were told they were in a two-thirds majority regarding gay scout troop leaders were more likely than participants who were told they were in a one-third minority to practice selective reinforcement. The results have implications for settings in which interrogators believe they can exercise power over the person who is being questioned.  相似文献

In a policy arena characterized by polarized debate, such as the consideration of legal interventions to prevent gun violence, research evidence is an important tool to inform decision-making processes. However, unless the evidence is communicated to stakeholders who can influence policy decisions, the research will often remain an academic exercise with little practical impact. The Educational Fund to Stop Violence's process of “unfreezing” individual perceptions and conventional interpretations of the relationship between mental illness and gun violence, forming a consensus, and translating this knowledge to stakeholders through state discussion forums is one way to inform policy change. The recent passage of gun violence prevention legislation in California provides an example of successfully closing the knowledge translation gap between research and decision-making processes. Hypotheses derived from the Harvey, Hunt and Schroder personality organization system were tested in an attitude change situation. Female subjects selected for extremeness of conceptual structure and negative attitude toward women's equality were subjected to a sensory deprivation, a normal control or an overstimulation environment in which a high salience (HS) or a low salience (LS) communication was presented. The main prediction of a three-way interaction among conceptual structure, communication salience and environmental complexity received some support. Concrete individuals who received the HS communication showed significantly more change than those who received the LS communication. The expected reversal of this effect for abstract individuals was not found. The HS communication produced significantly greater change than the LS communication, and this difference was significantly related to environmental complexity. These findings were discussed in terms of McGuire's and Berlyne's respective proposals concerning comprehension-yielding, and arousal reduction.  相似文献

Under Title I of the ADA, individuals who believe they have been subjected to disability-based employment discrimination may file an administrative charge. This article looks at who files charges; over what issues, and with what outcomes in both Equal Employment Opportunity Commission (EEOC) field offices, and state and local fair employment practice agencies (FEPAs). The data for the article are computerized records of all ADA charges filed through March 31, 1998. The data indicate that individuals who rely on a FEPA to investigate their charge have a greater likelihood of obtaining a beneficial outcome than individuals who rely on the EEOC, but proportionately more individuals receiving a beneficial outcome are likely to receive monetary benefits from the EEOC than from a FEPA. Further, those who receive beneficial outcomes will probably receive greater monetary benefits from charges investigated by the EEOC than from those investigated by a FEPA.  相似文献

Francis Bacon often is depicted as a patriarch of modernity who promotes human rational action over faith in divine Providence and as a secular humanitarian who realized that improvement of the human condition depended on human action and not on God's saving acts in history. Bacon's New Atlantis is usually described as a “scientific utopia” because its ideal order, harmony, and prosperity are the result of the investigations of nature conducted by the members of Solomon's House. I challenge these characterizations by showing that Bacon's so‐called scientific utopianism is grounded in his religious convictions that his age was one of Providential intervention and that he was God's agent for an apocalyptic transformation of the human condition. I examine the centrality of these religious themes in two of his philosophical works, The Advancement of Learning and The Great Instauration, which are well known for setting out Bacon's critique of the state of learning and for presenting the principles of his epistemology. Analysis of The Advancement of Learning demonstrates Bacon's conviction that his reform of natural philosophy was part of a Providentially guided, twofold restoration of the knowledge of nature and the knowledge of God. Examination of The Great Instauration reveals that Bacon sees his age as one of apocalyptic transformation of the human condition that restores humanity to a prelapsarian state. Analysis of the New Atlantis shows that utopian perfection can be achieved only through a combination of right religion and the proper study of nature. Moreover, when the “scientific” work of Solomon's House is recontextualized within the religious themes of salvation and deliverance that permeate the New Atlantis, the full scope of Bacon's “scientific utopianism” can be seen, and this project is not the one usually portrayed in scholarly treatments. Bacon's program for rehabilitating humanity and its relation to nature is not a secular, scientific advance through which humanity gains dominion over nature and mastery of its own destiny but rather one guided by divine Providence and achieved through pious human effort.  相似文献
