This paper discusses the legal, ethical and professional issues encountered in forensic psychology. Psychological theory and research potentially have much to contribute to legal questions. The paper presents examples of psychology's contributions in the areas of risk assessment, the reliability of children's evidence and the assessment of sexual interest. Furthermore, it is suggested that psychological understanding of personality disorder should inform legal processes to a greater degree than at present. The paper therefore both describes and challenges the current relationship between psychology and the law.  相似文献

In a 1987 American Psychologist article, Tom Grisso summarized the state of forensic psychological assessment, noted its limitations and potential, and offered suggestions for researchers and practitioners interested in contributing to its future. Since that time, there have been many important developments in the field of forensic psychology, as well as in clinical psychology more generally, some of which were anticipated and recommended by Grisso, and some of which were not. Forensic psychology is now at a crossroads, and the specialty must make an effort to respond to current challenges if it is to aid in the administration of justice by assisting legal decision makers. The need to distinguish between and identify levels of forensic knowledge and practice, establish guidelines for practice, educate legal consumers, and devote more attention to treatment issues in forensic contexts is highlighted.  相似文献

After providing an overview of the family psychology landscape and the competencies-based movement in professional psychology, attention is paid to eight family-specific competencies in the following areas: the application of scientific knowledge to practice, psychological assessment, psychological intervention, consultation and interprofessional collaboration, supervision, professional development, ethics and legal issues, and individual and cultural diversity. Effective strategies for providing family-focused education and training to psychology trainees at the doctoral, internship, and postdoctoral levels and to psychologists through continuing professional education in these core competency domains are provided.  相似文献

This paper explores the interface between psychology and the law as it relates to the informed consent doctrine and adolescents' legal competency to make informed decisions regarding birth control and pregnancy terminations. The complicated developmental, clinical, ethical, and legal issues have stimulated the courts to express their need for empirical evidence on the issue. To date, no such investigation has been reported in the literature. A research strategy is proposed which could address the courts' need for substantive data upon which to base legal decisions regarding adolescents' competency to reach reproductive decisions.  相似文献

The controversial practice of using unlicensed individuals to administered psychological tests has been questioned by some psychologists, professional organizations, state and provincial boards of psychology, state governments, departments of education, and third-party health care providers. This article provides an overview of the ethical, legal, and technical issues surrounding the controversy. On the basis of a review of these issues, recommendations are offered that are directed toward state and provincial boards of psychology, developers and publishers of psychological tests, and licensed psychologists.  相似文献

The mapping of the human genome has reawakened interest in the topic of race and genetics, especially the use of genetic technology to examine racial differences in complex outcomes such as health and intelligence. Advances in genomic research challenge psychology to address the myriad conceptual, methodological, and analytical issues associated with research on genetics and race. In addition, the field needs to understand the numerous social, ethical, legal, clinical, and policy implications of research in this arena. Addressing these issues should not only benefit psychology but could also serve to guide such thought in other fields, including molecular biology. The purpose of this special issue is to begin a discussion of this issue of race and genetics within the field of psychology. Several scholars who work in the fields of genetics, race, or related areas were invited to write (or had previously submitted) articles sharing their perspectives.  相似文献

When claims of amnesia are made in legal cases, it is necessary to determine whether they are genuine or simulated. This article assesses current knowledge of the relation between genuine and simulated amnesia and discusses issues that are critical to understanding of the problem. It is argued that there are few well established facts regarding the nature of simulated amnesia, and no evidence that experts can distinguish accurately between genuine and simulated amnesia. Suggestions are made for future research that draw upon recent advances in cognitive psychology, social psychology, and neuropsychology.  相似文献

Theoretical investigation has a contested focus on conceptual, philosophical and non‐empirical issues in psychology that is rarely examined empirically. This paper explores the status of theoretical psychology as scholarly research and its location in the curricula of Australian and New Zealand psychology departments. Nine self‐identified theoretical psychologists and 2 psychological society representatives were interviewed. Participant responses and an examination of department websites indicated that theoretical psychology and advanced theoretical units are offered mainly in third year and honours levels. Thematic analysis of the interviews revealed contrasting views of theoretical psychology as a subdiscipline or distributed throughout the curriculum, challenges to theoretical psychology as teaching and research activities, and a need for debate about the place of theoretical teaching and research in the discipline. The study recommends further empirical investigations to evaluate the presumed utility of reflexive, critical and metatheoretical skills and to assess anecdotal reports of “theory in decline”.  相似文献

Forensic Psychology is a recognised and important sub‐specialty of the Psychology discipline. However, after an expansion in the number of training places that were offered when programmes were first developed, recent years have seen these diminish in response to changes in university policies, resulting from reformulated Federal government funding models. In this article, we argue that it is important for the future of specialist areas of professional psychology to not only articulate the core skills and competencies that are associated with specialist practice but also to develop unique and distinctive approaches to teaching and learning signature pedagogies. Based on the premise that forensic psychological practice is, indeed, a distinctive activity that requires different skills and, importantly, different ways of thinking about the work from other areas of professional psychology, it is suggested that professional training in this area should aim to develop a signature pedagogy which combines methods of teaching and learning that have been developed in legal training programmes with principles of problem‐based learning.  相似文献

School psychologists have been encouraged to become actively involved in facilitating organizational change in public schools. Activities such as organization development, administrative-centered consultation, training of multidisciplinary teams, program planning, and program evaluation have been considered as important aspects of school psychology. However, when the practice of school psychology at the organizational level of public schools is considered as a distinct area, a range of conceptual and practical issues become apparent: (a) What is the nature and scope of organizational-level practice of school psychology? (b) Under what conditions may this kind of professional effort be useful, to whom, in what ways? (c) What are the knowledge and skills necessary for effective organizational-level practice? These issues are addressed in this article through delineation of the emerging area of “organizational school psychology (OSP),” an approach to school psychology practice which complements more established approaches that focus directly on the individual child or on groups of children.  相似文献

The history of psychological science in the Philippines is considered as a case of cultural diffusion from the West through the English language and the institutions (educational and legal, business and industry, the media, government and the bureaucracy) which adopted the language. The development of academic and professional psychology and of psychology-related services has been phenomenal, particularly in the last decade. It has however, given rise to problems of (1) standards and validity in testing and research, and (2) applicability of concepts and methods in social psychology the roots of which are from another culture. Doctoral recipients in clinical psychology scored higher than doctoral recipients in counseling psychology on the national licensing exam, the Examination for Professional Practice in Psychology. The largest discrepancies between the 2 groups were on Subtest I (diagnosis), Subtest II (intervention), and Subtest III (research). The differences were less large for Subtest IV (professional/ethical/legal issues) and for Subtest V (social application). The authors recommend that both counseling and clinical psychology graduate students take more course work in the department of the other discipline.  相似文献

This article presents a set of pedagogical approaches and suggested topics and materials for teaching gender issues in Asian American psychology. The experiences of contemporary Asian American women and men must be understood with an appreciation for the larger social, political, and historical contexts in which they live. Thus, several topics designed to "set the stage" for exploration of gender issues are presented. Central issues in teaching gender-related topics within Asian American psychology are discussed under the categories of gender roles, gender stereotypes, and gender differences. Instructors are encouraged to use multimedia resources and interdisciplinary approaches to promote critical thinking about the complex interactions of ethnicity, gender, and the larger sociocultural forces that shape Asian American women and men's psychological experiences.  相似文献

The use of amnesia as a legal defense raises complex issues for both psychology and jurisprudence. Our review of the legal literature suggests that recent advances in the understanding of clinical disorders of memory have not yet found their way into the courtroom. In this paper, we address the assumptions that amnesia means simply having a very bad memory and that amnesia is a unitary syndrome. We then review recent neuropsychological research on amnesia and its implications for the judicial process. Emphasis is placed on describing the amnesic disorders that most often arise in criminal proceedings. It is concluded that both psychologists and legal professionals should ensure that research findings from the clinic and the laboratory are applied appropriately in cases of defendants claiming amnesia.  相似文献

Comparative psychology emerged as part of the "new psychology" that took hold in the United States around 1900. Many of the issues that have occupied comparative psychologists throughout the 20th century were developed as research problems during this period. In some respects, comparative psychology was then an integral and widely respected part of psychology at large; in others, it was already marginalized. Issues emerging during this critical period set the program for the upcoming century and included those of methodology in the conduct of experiments and conceptual issues related to evolution, development, intelligence, and higher processes.  相似文献

This paper outlines the background, process and outcomes for a project that delineated a set of graduate attributes of the 4‐year Australian undergraduate psychology program. The nature of the current undergraduate psychology program and its quality assurance system is described, followed by a consideration of current issues in psychology education and training. The processes involved in delineating the six graduate attributes (i.e., knowledge and understanding, research methods, critical thinking, values, communication, and application) are then described. Some issues and suggestions related to their implementation are then outlined. Finally, the authors summarise what has been accomplished in delineating the graduate attributes, and what still needs to be achieved.  相似文献
