As it is traditionally conceived, Just War Theory is not well suited for dealing with nation vs non-nation wars. It thus makes sense to create a second Just War Theory to deal with these wars. This article explores the differences and similarities between the two theories.

Just wars are supposed to be proportional responses to aggression: the costs of war must not greatly exceed the benefits. This proportionality principle raises a corresponding ‘interpretation problem’: what are the costs and benefits of war, how are they to be determined, and a ‘measurement problem’: how are costs and benefits to be balanced? And it raises a problem about scope: how far into the future do the states of affairs to be measured stretch? It is argued here that weapons innovation always introduces costs, and that these costs cannot be determined in advance of going to war. Three examples, the atomic bomb, the AK-47 and the ancient Greek catapult, are given as examples. It is therefore argued that the proportionality principle is inapplicable prospectively. Some replies to the argument are discussed and rejected. Some more general defences of the proportionality principle are considered and also rejected. Finally, the significance of the argument for Just War Theory as a whole is discussed.  相似文献

Husserl the philosopher personally experienced World War I breaking out 100 years ago. Like most German and Austrian commoners, at the initial stage of the war, Husserl was extremely passionate for it. After undergoing the cruelty of war and losing many relatives and friends, he was once enmeshed in extreme confusion and disappointment, albeit he still made every effort to offer spiritual and ethical support to the soldiers at the front. Along with the proceeding of the war, he soon changed his views with respect to this war and confessed that more and deeper reflections were needed to address issues about problems of nationality, super-national ethics and about problems of wars relevant to them. He made philosophical theoretical reflections with regard to this war after it ended, and presented, eventually, requirements for himself: to be satisfied with taking the possibility of the practical activities of philosophy as the topic of philosophical theoretical study and to give up, in drastic fashion, the intention in such philosophical practices as providing political proposals and exerting political influences, "living purely as a scientific philosopher."  相似文献

In the early months of 1991, the United States—in alliance with a number of other nations—fought a large scale air and ground war to evict Iraq's occupying army from the emirate of Kuwait. In this paper, I will consider the question of whether this U.S. military campaign was a just war according to the criteria of traditional just war theory—the only developed moral theory of warfare that we have. My aim, however, is not so much to reach a verdict about the morality of the Gulf War, as it is to identify relevant moral issues, and to reveal certain serious problems of application that are inherent in just war theory itself. Just war theory divides into two parts concerning, respectively, the question of whether or not to fight a particular war (justice of war), and the question of how the war is conducted (justice in war). I begin by considering whether it was just, according to the justice of war criteria, for the U.S. to fight the Gulf War at all. I then turn to the question of whether the way the war was conducted satisfied the criteria of justice in war.  相似文献

While Michael Walzer's distinction between preemptive and preventive wars offers important categories for current reflection upon the Bush Doctrine and the invasion of Iraq, it is often treated as a modern distinction without antecedent in the classical Christian just war tradition. This paper argues to the contrary that within Augustine's corpus there are passages in which he speaks about the use of violence in situations that we would classify today as preemptive and preventive military action. While I do not claim that Augustine makes an explicit distinction between the two types of war (such would be anachronistic), I will argue that based on examinations of De libero arbitrio I.v.11–12 and De civitate Dei I.30 Augustine's discussions of hypothetical cases or actual wars in history provide insights helpful for contemporary reflection on preemptive and preventive wars.  相似文献

I address a foundational problem with accounts of the morality of war that are derived from the Just War Tradition (JWT). Such accounts problematically focus on ‘the moment of crisis’: i.e. when a state is considering a resort to war. This is problematic because sometimes the state considering the resort to war is partly responsible for wrongly creating the conditions in which the resort to war becomes necessary. By ignoring this possibility, JWT effectively ignores, in its moral evaluation of wars, certain types of past wrongdoing. I argue that we can address this problem by incorporating an account of compensatory liability into an account of the morality of war. Doing so yields the view that, if we have culpably failed to compensate victims for past wrongs, we might be morally required to weigh the well-being of those victims more heavily in our calculation of proportionality when determining the permissibility of a defensive act that harms the victim as a side-effect. This, in turn, makes satisfying the proportionality constraint more difficult. The upshot is that sometimes, in order to wage a defensive war permissibly, we first have to discharge compensatory duties. This has implications for how we evaluate ‘cycles of reprisals’ that plague warfare.  相似文献

This paper investigates the prospects for skepticism once we distinguish between bare skeptical theses and arguments and mature philosophical theory. If all skeptics have to offer is bare theses and arguments, skepticism presents only a challenge of reflective equilibrium. But if skeptics can move toward developed theory, then skeptics have, as I will put it, earned their keep. Just as foundationalism should be taken seriously in part because theory development goes well beyond a mere regress argument for the view, just so skepticism needs theory development to be taken seriously as well. The problem is that it is not clear that theory development is possible for skeptics. Here I articulate this concern and give some grounds for thinking that it can be overcome.  相似文献

The concept of jus post bellum deals with moral considerations in the aftermath of conflict and is concerned with how a just peace should look like. This paper analyses the concept of jus post bellum as developed by contemporary Just War theorists. Its aim is to provide a critical perspective on the proposed substantial scope of this concept. In other words, it will consider the question: in restoring peace after war, is it justified for just combatants to change the political structure of a defeated aggressor? The piece will be divided into two main parts. First, through a review of the literature, I define the current state of the art on jus post bellum thinking in relation to a number of key aspects of this concept. What does241 it entail? Which principles is it made of? What sort of activities do just war theorists speak about when they speak of creating a just peace? Second, I focus on the principle of ‘political rehabilitation’ of the defeated state: is it permissible? Under what circumstances? While considering these questions and authors' views on this matter, the paper will provide a critical reappraisal of the current debate on the justifiability of political reconstruction in post-conflict states.  相似文献

Augustine famously defends the justice of killing in certain public contexts such as just wars. He also claims that private citizens who intentionally kill are guilty of murder, regardless of their reasons. Just as famously, Augustine seems to prohibit lying categorically. Analyzing these features of his thought and their connections, I argue that Augustine is best understood as endorsing the justice of lying in certain public contexts, even though he does not explicitly do so. Specifically, I show that parallels between his treatments of killing and lying along with his “agent (auctor)–instrument (minister)” distinction, in which God is the true agent or “author” of certain acts and humans are merely God's instruments, together imply that he would regard certain instances of public lying as permissible and even obligatory. I buttress my argument by examining several key but neglected passages and by responding to various objections and rival interpretations. Throughout, I challenge standard interpretations of Augustine's ethics of killing and lying and seek to deepen our overall understanding of these dimensions of his thought. In so doing, I contribute to ongoing discussions of public and private lying and to the task of relating Augustine's thought to contemporary debate and deliberation on war, killing, and lying.  相似文献

Abstract

Just War Theory (JWT) replaced an older ‘warrior code,’ an approach to war that remains poorly understood and dismissively treated in the philosophical literature. This paper builds on recent work on honor to address these deficiencies. By providing a clear, systematic exposition of ‘Honor War Theory’ (HWT), we can make sense of paradigm instances of warrior psychology and behavior, and understand the warrior code as the martial expression of a broader honor-based ethos that conceives of obligation in terms of fair competition for prestige. Far from being a romantic and outmoded approach to war, HWT accounts for current conflicts and predicts moral intuitions that JWT either rejects or cannot comfortably accommodate. So although it is not recommended as a replacement for JWT, there is good reason think that a fully mature, realistic, and yet properly normative theory of war ethics will incorporate a variety of insights from HWT.  相似文献

According to “epistemic-based contingent pacifism” a) there are virtually no wars which we know to be just, and b) it is morally impermissible to wage a war unless we know that the war is just. Thus it follows that there is no war which we are morally permitted to wage. The first claim (a) seems to follow from widespread disagreement among just war theorists over which wars, historically, have been just. I will argue, however, that a source of our inability to confidently distinguish just from unjust wars lies in how we evaluate “morally heterogeneous” wars—i.e., wars with just and unjust aims. Specifically, the practice of reaching a univocal evaluation of a morally heterogeneous war as a whole by aggregating the evaluations of that war’s just and unjust aims is wrongheaded, because it undermines the action-guiding character of jus ad bellum. We ought instead to adopt what I call the “disaggregate approach” to jus ad bellum, according to which we evaluate the various aims of a war individually, without aggregating them into an evaluation of the war as a whole. Adopting this approach will eliminate a source of our disagreement over which wars have been just, and will ipso fact eliminate a basis for epistemic-based contingent pacifism.  相似文献

The American experience of war is ironic. That is, there is often an intimate and unexamined relationship between seemingly contrary elements in war such as morality and politics. This article argues that without understanding such irony, we are unlikely to reflect in morally comprehensive ways on past, present, or future wars. Traditional schools of thought, however, such as moralism and political realism, reinforce these apparent contradictions. I propose, then, an alternative—“ethical realism” as informed by Reinhold Niebuhr—that better explains the irony of war. Through an ethical realist examination of the U.S. Civil War, World War II, and the Iraq War, I consider how American political interests have been inextricably linked with deep moral concerns. Ethical realism charts a middle path that ennobles traditional realpolitik while eschewing certain perfectionist tendencies of moralism. Ethical realism provides a conceptual framework for evaluating these other frameworks—a distinct form of moral‐political deliberation about war.  相似文献

This essay argues that the ethics of humanitarian intervention cannot be readily subsumed by the ethics of just war without due attention to matters of political and moral motivation. In the modern era, a just war draws directly from self-benefitting motives in wars of self-defense, or indirectly in wars that enforce international law or promote the global common good. Humanitarian interventions, in contrast, are intuitively admirable insofar as they are other-regarding. That difference poses a challenge to the casuistry of humanitarian intervention because it makes it difficult to reason by analogy from the case of war to the case of humanitarian intervention. The author develops this point in dialogue with Michael Walzer, the U.S. Catholic bishops, and President Clinton. He concludes by showing how a casuistry of intervention is possible, developing a motivational rationale that draws on the Golden Rule.  相似文献

Thaddeus Metz argues against our position that ubuntu has reached its end. He rejects our recommendation that ubuntu both as a way of life and as an ethical theory must be jettisoned as it is no longer applicable to modern conditions. He thinks that both our recommendations are wrong. Hence he seeks to show that ubuntu is defensible both as an ethical theory and as a way of life. Further, he thinks there is a role to be played by ubuntu in how life could be lived in modern day (South) Africa. He also seeks to offer a defence of the relevance of ubuntu theorists. For these reasons he couches his responding title with the phrase ‘Just the beginning of ubuntu [?…?]’. In this paper I continue the debate by seeking to show that Metz's response poses no threat to our original position. I then endeavour to show that my assessment of his position puts him in an unenviable position of defending the indefensible. I further suggest that Metz's current defence of ubuntu is not philosophical but dogmatic.  相似文献

abstract   David Rodin has recently put forward a compelling but disturbing argument to the effect that the traditional justification in Just War Theory of a state's right to self-defence (what Rodin calls national-defence), which is derived from the legitimate case of personal self-defence, fails. He concludes that the only way to justify forceful responses to aggression against states by other states or non-state groups is by viewing the right to do so as falling under a form of law-enforcement, which in turn requires the existence of some overarching universal state. In this paper I argue that there exists a possible justification for national-defence that Rodin has overlooked due to an underlying commitment to what Charles Taylor calls 'the primacy of rights thesis'. My claim is that a particular family of views that see human identity as being crucially bound up with society offers the resources to avoid the pitfalls that Rodin points out befall other attempts to justify national-defence.  相似文献

The desire to defend a state against attacks by a non-state actor requires thinking about counter-attacking without violating the sovereign equality of the territorial state because targeting a non-state actor on the territory of that state may violate its sovereignty. This paper evaluates the main views on self-defense by states against non-state actors by studying the Just War Theory and argues that self-defense against a non-state actor is allowed if the counter-attack complies with the principle of sovereign equality. Sovereign equality is the prohibition of states from dominion over other states because states are equal to one another. This principle can be respected by allowing self-defense against non-state actors to occur only if the state consented to the use of force on its territory or if that state is incapable of controlling or unwilling to control the non-state actor.  相似文献

J. Robert Oppenheimer was among the most important and enigmatic figures in 20th century science. He is best known for successfully directing the Manhattan Project that produced the first atomic bombs that were dropped on Japan at the end of World War II. Subsequently, he became a scientist and statesman who advised the United States government in the areas of atomic weapons development and public policy. He later became subject to an investigation in 1954 into his previous political affiliations and his personal behavior that ended in the revoking of his security clearance. This essay seeks to chronicle Oppenheimer’s coming of age as a public intellectual with a view toward his own psychological history and most especially in relationship to the stages of faith development articulated by James Fowler and colleagues. Moreover, though not conventionally religious, Oppenheimer’s life and thought were permeated with themes and ideas of a religious and ethical nature that shaped his adult character and informed his view of the world. Recent events led this author to realize that an error made during the Vietnam War by him and others had been due to focusing too narrowly on predisposing factors for PTSD while failing to consciously acknowledge acute systemic stressors. In not accepting that along with the stress of combat, Black troops daily experienced acute pervasive systemic racism, he failed to understand correctly their disproportionately higher levels of PTSD when compared to white troops. Motivating factors to examine this error included a recent movie by Spike Lee. Oral histories of Black veterans were then used to research the experience of Blacks in the military in two world wars and the Vietnam War. Little change in the treatment of Black service members was evident across the time frame which included WWI, WWII and the Vietnam War. An understanding of Shay’s concept of moral injury was found very valuable in understanding the consequences of PTSD.
