Rae Langton and Jennifer Hornsby have argued that pornography might create a climate whereby a woman's ability to refuse sex is literally silenced or removed. Their central argument is that a failure of 'uptake' of the woman's intention means that the illocutionary speech act of refusal has not taken place. In this paper, I challenge the claims from the Austinian philosophy of language which feature in this argument. I argue that uptake is not in general required for illocution, nor is it required for refusal in particular. I conclude with remarks on the relationship between illocutionary and perlocutionary speech-acts.  相似文献

Catharine MacKinnon has pioneered a new brand of anti‐pornography argument. In particular, MacKinnon claims that pornography silences women in a way that violates their right to free speech. In what follows, we focus on a certain account of silencing put forward by Jennifer Hornsby and Rae Langton, and we defend that account against two important objections. The first objection contends that this account makes a crucial but false assumption about the necessary role of hearer recognition in successful speech acts. In response, we argue that, as silencing primarily concerns communication, Hornsby and Langton are perfectly correct to treat hearer recognition as they do. The second objection contends that their particular account of silencing has the unacceptable result of undermining the responsibility of rapists. Silencing is a speech‐related harm. We here focus on one particular account of silencing offered by Jennifer Hornsby and Rae Langton. According to this account, silencing is systematically generated, illocutionary‐communicative failure (of a very specific sort). We here raise an apparent challenge to that account. In particular, we offer an example—the drowning case—that meets these conditions of silencing but does not intuitively seem to be an instance of it. First, we explore several conditions one might add to the Hornsby‐Langton account, but we argue that none are satisfactory. Then, we further explore the systematicity condition, which is insufficiently characterized in the current literature. Although we explore several promising ways to further characterize this condition, we ultimately conclude that more work needs to be done. Consequently, because this systematicity condition is under‐specified, the Hornsby‐Langton account of silencing is incomplete.  相似文献

Catharine MacKinnon claimed that pornography silence's women's speech where this speech is protected by free speech legislation. MacKinnon's claim was attacked as confused because, so it seemed, pornography is not the kind of thing that can silence speech. Using ideas drawn from John Austin's account of speech acts, Rae Langton defended MacKinnon's claim against this attack by showing how speech can, in principle, be silenced by pornography. However, Langton's defence requires us to deviate from a widely held understanding of what kind of speech is protected; namely the expression of opinions, ideas, and thoughts. In this paper I provide an alternative defence of MacKinnon's claim which requires no such deviation. I argue that because the truth‐conditions of sentences are context‐sensitive it is possible for there to be contexts in which, when those in attendance believe rape myths, it is not possible to express certain opinions, ideas, or thoughts. Given that pornography is a significant contributor to rape myth acceptance, this argument addresses the accusation of confusion facing MacKinnon without the need for deviation. The cross‐examination of a complainant in a rape trial is used as an illustration.  相似文献

Recently, several philosophers have recast feminist arguments against pornography in terms of Speech Act Theory. In particular, they have considered the ways in which the illocutionary force of pornographic speech serves to set the conventions of sexual discourse while simultaneously silencing the speech of women, especially during unwanted sexual encounters. Yet, this raises serious questions as to how pornographers could (i) be authorities in the language game of sex, and (ii) set the conventions for sexual discourse—questions which these speech act-theoretic arguments against pornography have thus far failed to adequately answer. I fill in this gap of the argumentation by demonstrating that there are fairly weak standards for who counts as an authority or convention-setter in sexual discourse. With this analysis of the underpinnings of a speech act analysis of pornography in mind, I discuss a range of possible objections. I conclude that (i) the endorsement of censorship by a speech act analysis of pornography competes with its commitment to the conventionality of speech acts, and, more damningly, that (ii), recasting anti-pornography arguments in terms of linguistic conventions risks an unwitting defence of a rapist's lack of mens rea—an intolerable result; and yet resisting this conclusion requires that one back away from the original claim to women's voices being ‘silenced’.  相似文献

Catharine MacKinnon claims that pornography silences women in a way that violates the right to free speech. This claim is, of course, controversial, but if it is correct, then the very free speech reasons for protecting pornography appear also to afford reason to restrict it. For this reason, it has gained considerable attention. The philosophical literature thus far focuses on a type of silencing identified and analyzed by Jennifer Hornsby and Rae Langton (H&L). This article identifies, analyzes, and argues for the importance of a different type of silencing. As we shall see, there are compelling reasons in favor of regarding H&L silencing as a free speech violation and, as I argue here, the same can be said for sincerity silencing. Although additional work needs to be done to show that either one actually is a free speech violation, I demonstrate here that both types of silencing equally warrant this further attention. Moreover, I show that sincerity silencing is a fairly widespread phenomenon; so, therefore, is the harm it constitutes. As a result of these considerations, then, we can safely conclude that sincerity silencing also requires our attention.  相似文献

I explore how gender can shape the pragmatics of speech. In some circumstances, when a woman deploys standard discursive conventions in order to produce a speech act with a specific performative force, her utterance can turn out, in virtue of its uptake, to have a quite different force—a less empowering force—than it would have if performed by a man. When members of a disadvantaged group face a systematic inability to produce a specific kind of speech act that they are entitled to perform—and in particular when their attempts result in their actually producing a different kind of speech act that further compromises their social position and agency—then they are victims of what I call discursive injustice. I examine three examples of discursive injustice. I contrast my account with Langton and Hornsby's account of illocutionary silencing. I argue that lack of complete control over the performative force of our speech acts is universal, and not a special marker of social disadvantage. However, women and other relatively disempowered speakers are sometimes subject to a distinctive distortion of the path from speaking to uptake, which undercuts their social agency in ways that track and enhance existing social disadvantages.  相似文献

In a recent article in this journal, Nellie Wieland argues that silencing in the sense put forward by Rae Langton and Jennifer Hornsby has the unpalatable consequence of diminishing a rapist's responsibility for the rape. We argue both that Wieland misidentifies Langton and Hornsby's conception of silencing, and that neither Langton and Hornsby's actual conception, nor the one that Wieland attributes to them, in fact generates this consequence.  相似文献

The present essay takes as its point of departure the resurgence of the anti-porn argument claiming that pornography is harmful. It focuses especially on philosopher Rae Langton’s attempt to use speech act theory to defend the anti-porn position of Catherine MacKinnon. Langton’s argument is critiqued for assuming that we can ascertain the function of pornography without considering the situations of its use. It hence runs counter to the particularizing intent of speech act theory as such, which emphasizes the need to study speech in context. Rather than dismiss the anti-porn position Langton defends as faulty, the essay suggests that it remains an incontrovertible facet of the pornographic situation, and as such should be dialectically engaged. In the second half of the essay, therefore, the reasoning that informs the antiporn position is shown to be incompatible with the recurrent claim that porn is the expression of a male desire to dominate women. Rather, a closer look at Langton’s defense of the anti-porn argument helps us see that pornography is the expression of cognitive possibilities unique to the historical conditions that have brought it forth, and as such is every bit as self-conflicting as is capitalism itself.  相似文献

Although others have focused on Catharine MacKinnon's claim that pornography subordinates and silences women, I here focus on her claim that pornography constructs women's nature and that this construction is, in some sense, false. Since it is unclear how pornography, as speech, can construct facts and how constructed facts can nevertheless be false, MacKinnon's claim requires elucidation. Appealing to speech act theory, I introduce an analysis of the erroneous verdictive and use it to make sense of MacKinnon's constructionist claims. The Supreme Court dismissed the Pornography/Civil Rights Ordinance as an unconstitutional restriction of speech. The Court's dismissal itself violates the free speech of the proposers of the Ordinance. It is not possible for both pornographers to perform the speech act of making pornography and feminists to perform the speech act of proposing the Ordinance. I show that the speech act of proposing the Ordinance takes First Amendment precedence over the speech act of making pornography.  相似文献

C.M. Conception's review of “Pornography: An Uncivil Liberty 1 1 See Steinem (1986, 250); discussed in Carse (1995, 175-76, n. 15).
” ( Carse 1995 ) fundamentally misconstrues the position defended in that article. This paper examines possible sources of this misconstrual, focusing critical attention on the narrowly crafted, morally loaded notion of “pornography” that figures centrally in the original argument under review. Pornography is not a category of speech that can be charaC' terized as having one crucial meaning or message, nor is the message of pornography easily identifiable in instances of pornographic speech. This raises the problem of interpretive privilege, which haunts many of the antipomography arguments being offered in the contemporary debate, including the author's own earlier argument.  相似文献

Pervasive feminism is a component located in emotionality—feminist emotion—and contains women's primary agency. Because affect and emotions are elusive, an interpretive conceptual tool is necessary and is key to making use of their potential for feminist politics aimed at women's empowerment and well‐being and to build gender equality. This essay builds on contemporary feminist theory and affect theory and draws from multidisciplinary research. It presents a new theoretical framework anchored in hermeneutics and phenomenology to pin down the affective component of women's multifaceted, intersectional emotional experiences of gender. A case study also illustrates how the theoretical premises around the concept of feminist emotion are compatible with and useful for feminist praxis.  相似文献

Research on error management theory indicates that men tend to overestimate women's sexual interest and women underestimate men's interest in committed relationships ( Haselton & Buss, 2000 ). We test the assumptions of the theory in face‐to‐face, stranger interactions with 111 man‐woman dyads. Support for the theory emerges, but potential boundary conditions are observed. In addition, we find that women's perceptions of men's desire for commitment is related to the women's own self‐reported sexual interest but that the reverse does not hold for men. Finally, we find evidence consistent with the proposition that people project their own level of interest in sex or in a committed relationship onto their interaction partners.  相似文献

This article looks at the inadequacy of space available to women in the two most holy sites for all Muslims: Masjid al‐Haram in Makkah and Masjid anNabawi in Madinah, Saudi Arabia. I argue that religious discourse, shaped by geopolitical factors, has framed piety for women primarily in terms of modesty, such that a woman is often considered a good Muslim if she is visible only within her female community but invisible to the larger society. Furthermore, I argue that the allocation of meager space affects not only the perception of women's religious standing in society, but also women's own perception about their moral selves. The article claims that by being relegated to small sections within religious spaces, women's collective worship is evident neither to the community at large nor can it be fully experienced by individual women, thus placing obstacles in women's path to seek to closeness to God.  相似文献

The Assurance View, as advanced by Angus Ross and Richard Moran, makes the epistemology of testimony a matter of interpersonal commitments and entitlements. More specifically, I argue, their position is best understood as claiming that for someone’s belief to be testimonially justified is for some speaker to bear illocutionary responsibility for its truth (while background conditions are met). With this understanding in hand, I present a problem for the view that has so far escaped attention, a problem deriving from the wide freedom we have to retract our assertions. Retraction dissolves the illocutionary responsibilities that were set up by preceding speech acts; but in some circumstances the epistemic significance of a retraction is effectively nil. We can therefore construct cases in which the responsibilities undertaken in testimony have been canceled, while the justification for belief based on it remains in place—and that shouldn’t be possible, if the Assurance View has things right. I present one such case and press its implications.

It is well established that variation in caregivers’ speech is associated with language outcomes, yet little is known about the learning principles that mediate these effects. This longitudinal study (n = 27) explores whether Spanish‐learning children's early experiences with language predict efficiency in real‐time comprehension and vocabulary learning. Measures of mothers’ speech at 18 months were examined in relation to children's speech processing efficiency and reported vocabulary at 18 and 24 months. Children of mothers who provided more input at 18 months knew more words and were faster in word recognition at 24 months. Moreover, multiple regression analyses indicated that the influences of caregiver speech on speed of word recognition and vocabulary were largely overlapping. This study provides the first evidence that input shapes children's lexical processing efficiency and that vocabulary growth and increasing facility in spoken word comprehension work together to support the uptake of the information that rich input affords the young language learner.  相似文献

Women's exclusion from political enfranchisement in Kant's political writings has frequently been noted in the literature, and yet has not been closely scrutinized. More often than not, commentators suggest that this reflects little more than Kant's sharing in the prejudices of his era. This paper argues that, for Kant, women's civil incapacities stem from defects relating to their capacities as moral agents, and more specifically, to his teleological account of the conditions within which we, as imperfect beings, develop our moral capacities. Women are not incidentally or tangentially excluded from the boundaries of political and moral agency, but rather must adopt an explicitly nonmoral character if we are to understand humanity as moving toward its naturally given, moral ends. I argue (1) that Kant's teleological view of human development requires women to develop an explicitly nonmoral character; (2) that this teleology is inextricable from his view of the moral agency that human—and not merely rational—beings are capable of; and (3) that taken together, these suggest that women's subordinate status is internally connected to Kant's view of moral personhood.  相似文献

This article is a critical examination of Nancy Fraser's contrast of early second‐wave feminism and contemporary global feminism in “Feminism, Capitalism and the Cunning of History,” (Fraser 2009 ). Fraser contrasts emancipatory early second‐wave feminism, strongly critical of capitalism, with feminism in the age of neoliberalism as being in a “dangerous liaison” with neoliberalism. I argue that Fraser's historical account of 1970s mainstream second‐wave feminism is inaccurate, that it was not generally anti‐capitalist, critical of the welfare system, or challenging the priority of paid labor. I claim Fraser mistakenly takes a minority feminist position as mainstream. I further argue that Fraser's account of feminism today echoes arguments from James Petras and Henry Veltmeyer (2001) to Hester Eisenstein ( 2009 ), but such arguments ignore contemporary feminist minority positions. I challenge Fraser's arguments that feminism legitimates neoliberalism to women, that women's NGOs are simply service‐providers enabling the state to withdraw services, and that criticisms of microcredit lending programs can be generalized into criticisms of women's feminism and women's NGOs today. I argue that these claims are vast over‐generalizations and ignore countertrends. I give empirical evidence to support my objections by considering women's activities in post‐communist European countries, which Fraser discusses.  相似文献
