Counseling Minors: Ethical and Legal Issues

This article discusses the ethical and legal dilemmas facing counselors who work with minors in the school system. From an ethical perspective, minors should be able to expect confidentiality; however, parents and guardians have certain legal rights that limit the rights of minors. The author uses a hypothetical case to address these concerns and offers intervention strategies used for empowering minor clients in counseling.     

Academic Dishonesty at Universities: The Case of Plagiarism Among Iranian Language Students

This study investigated Iranian language students’ perception of and familiarity with plagiarism, their attitudes toward their professors regarding this issue, and their reasons for doing so. The participants were 122 undergraduate and graduate language students in Translation, Literature, TEFL, and Linguistics who filled out a validated and piloted questionnaire. Overall, the results indicated that students had different views about the definition of plagiarism and plagiarism was mostly perceived by students as using someone else’s words as if they were their own rather than taking someone’s ideas without permission. It was also found that in their academic career, students mostly consider copying a completed assignment of their friend as an act of academic dishonesty. In addition, they mostly argued that professors at universities guess about who might have done plagiarism instead of checking it themselves and they used different strategies to detect plagiarism. The study also indicated that Iranian students had different reasons for plagiarism but they mostly plagiarize because of easiness of plagiarism. Finally, the results of the survey showed that the majority learned about plagiarism from their university professors.     

Academic Ethics at the Undergraduate Level: Case Study from the Formative Years of the Institute

Academic ethics among students at an undergraduate level are dictated by a variety of factors. Institutional cultures, personal preferences and notions of ethics, external factors, and peer-pressure are some of the factors that play an important role in the ethical behavior of an undergraduate student. The present study is an attempt to understand the student behavior in a three year old technical Institute in India. At a time when the higher technical education sector in India is rapidly expanding, the study presents trends in undergraduate students regarding academic ethics. The study highlights the factors that are most important in governing ethical behavior of students, and allow for corrective measures at a formative stage in the Institute’s life.

Faculty Perceptions of Student Self Plagiarism: An Exploratory Multi-university Study

The purpose of this research study was to evaluate faculty perceptions regarding student self-plagiarism or recycling of student papers. Although there is a plethora of information on plagiarism and faculty who self-plagiarize in publications, there is very little research on how faculty members perceive students re-using all or part of a previously completed assignment in a second assignment. With the wide use of plagiarism detection software, this issue becomes even more crucial. A population of 340 faculty members from two private universities at three different sites was surveyed in Fall 2012 semester regarding their perceptions of student self-plagiarism. A total of 89 faculty responded for a return rate of 26.2 %. Overall, institutional policies on self-plagiarism did not exist and faculty did not clearly understand the concept and believed their students did not either. Although faculty agreed students need to be educated on self-plagiarism, faculty assumed students had previously been educated on plagiarism as well as self-plagiarism; only 13 % ensured students understood this concept.     

Legal and Ethical Issues in the Court-Mandated Treatment of Batterers

Summary

In the following article, we will explore the nature of the therapeutic relationship as it relates to batterers' treatment programs. We will consider the impact of obligations created by forces outside the relationship, such as those imposed by legal proceedings. We will discuss the concepts of confidentiality, privilege, and agency and their impact on the therapeutic relationship and the extent to which the therapists' understanding of the role these concepts play may be altered by court orders that impose treatment on a client/patient. Finally, we examine the issues and choices a therapist must make when engaging in court-ordered treatment of batterers, and the implications of those choices for both therapist and client; we will also suggest guidelines to help therapists sort through the often conflicting goals of therapy and the legal process.     

Legal and Ethical Issues in the Treatment of Multiply Victimized Children

Abstract

The article discusses several common legal and ethical issues faced by clinicians when treating families where singular and multiple child victimization is an issue. The authors differentiate between legal requirements and ethical mandates, explore factors affecting reporting decisions, how dual relationships compromise treatment process, and clinicians' scope of competence and professional knowledge in child maltreatment cases. Each issue is addressed within the context of responding to cases where a child(ren) has been multiply victimized.     

Achieving a Maximum Level of Vaccination for Medical Students: a Rigourous Ethical and Legal Framework Procedure

The Faculty of Medicine and Health Sciences (FMHS) of the University of Sherbrooke has observed year after year, that certain students have not started and or completed their immunizations for common infectious diseases, which in effect makes them inadmissible for their clinical internships in healthcare establishments. The program administrators have posed a series of questions on the best way to proceed with these students as, a certain number remain reluctant to vaccination. They are often confronted with ethical dilemmas, are not necessarily comfortable with their rights and responsibilities and wish to be guided throughout the process. This article aims to put forth a procedure that would be put in place to support the administrators in a way for them to obtain a more favorable vaccination level for all of their students in the most reasonable amount of time possible. The interest of the procedure is to move forward in a few simple and well defined steps that are supported by a rigorous legal framework, while respecting the rights and freedoms of the students. It is also designed so that it could be replicated in other faculties of medicine.     

Selected Ethical Issues in the Analysis and Reporting of Research: Survey of Business School Faculty in Malaysia

This study reports the perceptions of business school faculty on ethical behaviors related to data analysis and research reporting as well as the prevalence of such behaviors in their academic environment. Survey data for the study were obtained from a sample of 102 business school faculty from five government-funded universities in Malaysia. Study results showed that a majority of the respondents considered practices such as fabrication, manipulation, and distortion of data to be ethically unacceptable, and these behaviors were reported to be least prevalent. In contrast, the practice of misapplying statistical techniques was considered ethically acceptable and reported to be quite prevalent. On research reporting, although a majority of the respondents agreed that plagiarism and taking undeserved authorship credit were ethically unacceptable, they also reported having observed the frequent occurrence of such behaviors. Finally, practices such as cutting up research data and simultaneous submissions to more than one publication outlet at the same time were less likely to be viewed as unethical and seen to be quite a common practice. In general, the findings of this study indicate that the perceptions of the ethicality and frequency of occurrence of behaviors related to data analysis and research reporting vary among business school faculty.

The focus is on three key questions: Is it permissible to deny counseling services to a homosexual client on the basis of a counselor's values? Can referrals be made at any time a counselor wishes to do so? When is a client a client?     

Ethical,Legal, and Psychosocial Issues in Care of Transgender Adolescents

SUMMARY

Complete care for transgender adolescents must be considered in the context of a holistic approach that includes comprehensive primary care as well as cultural, economic, psychosocial, sexual, and spiritual influences on health. Not all transgender adolescents have gender dysphoria or wish to undergo sex reassignment. In this article we focus on general care of transgender adolescents by the non-specialist working in primary care, family services, schools, child welfare, mental health, and other community settings.     

Power Dynamics between Administrators and Faculty on a Unionized Campus: A Case Study

This article offers a case study of labor relations in a higher education setting. The University of Bridgeport's faculty union was certified in May 1973 and decertified in August 1992. Contract negotiation disputes centered on shared governance, managing faculty reductions during a time of inflation and declining enrollments, and determining fair wages. The private university experienced four faculty strikes, culminating in a two-year faculty strike – the longest in U.S. higher education history. The university was also the first institution of higher education in the United States to hire permanent replacement faculty during a strike. In 1990, leaders of the locked-out striking faculty unsuccessfully lobbied for a state government takeover of the nearly bankrupt university. The case study highlights a plethora of complex ethical issues faced by administrators, faculty, and unions during times of economic decline.

Ethical and Legal Issues in Publication and Dissemination of Scholarly Knowledge: A Summary of the Published Evidence

Research publication and dissemination of scholarly knowledge in Higher Education Institutions (HEIs) are among the most influential roles of many academic scholars in both industrialised and developing nations, but such experience and skills are rarely taught, transferred and shared in the real world. Dealing with issues of research misconduct might be challenging as well as learning opportunities for new academics while conducting research and scholarship teaching and publication in HEIs. In this review paper, I will discuss some concepts of research misconduct, highlighting some relevant ethical and legal concerns in publication. This paper concludes that continued education and support on ethical research to graduates and scholars might help to prevent research misconduct related to publications and dissemination through developing appropriate strategies in practice.     

Academic Integrity in Higher Education: The Case of Plagiarism of Graduation Reports by Undergraduate Seniors in Vietnam

Plagiarism in higher education has become widespread among students in Vietnam. This paper aims to examine the seriousness of the problem by comparing the severity of plagiarism in two universities, one of which uses Turnitin software to check its student reports. For that purpose, 977 samples have been drawn from 1434 required graduation reports written by senior undergraduates in the economics and management field from 2013 to 2015. Turnitin’s “Similarity Index” (SI) was used to check for alleged plagiarism, which was found to be more widespread at the university not using Turnitin. At that university, 91.7% of the graduation reports were defined as plagiarized, while 61.7% of the reports were plagiarized at the university using the software. The main source of this problem was the use of information from the internet without citing the original authors.
