The current study claims that measures of sexual recidivism provide a distorted view of the criminal activity of adult sex offenders. To address this important limitation, the criminal career perspective is presented and key concepts are defined and described. The study also provides an up-to-date review of the scientific literature on various criminal career parameters of the sexual criminal activity of adult sex offenders. Hence, current empirical knowledge on the prevalence, age of onset, frequency, continuity, versatility, and desistance from sex offending is presented. The findings highlight the complexities of the sexual criminal career of adult sex offenders, and most importantly, its dynamic aspect, both of which are not captured by traditional measures of sexual recidivism. The review also underscores the importance of recognizing that sexual offending develops according to a series of stages, that, if not recognized, may lead to the underestimation of risk for some and over-estimation of risk for others. The review provides a framework to stimulate new areas of research as well as policy-development that is not limited to the identification of the “high-risk” convicted sex offenders.  相似文献

Understanding public opinion about the causes of pedophilia and/or child sex offending is vital, as the views of the public influence how governments respond to sexual offenders. However, little research has been undertaken on this topic. This study addresses this gap by examining the causes that members of the public ascribe to pedophilia and/or child sexual abuse using qualitative data from online forums. The etiological accounts that the public gave provide important information for those developing public prevention policies and/or education campaigns about child sexual abuse. This study investigated how often and depending on which factors sexual offenders are examined by mental health experts regarding their criminal responsibility. Out of a total of 306 legal charges against sex offenders accused of child sexual abuse (CSA: n?=?145), rape or sexual assault (n?=?89), exhibitionism (n?=?39), sexual abuse of adolescents, mentally defective, physically helpless or warded persons (n?=?18) that were admitted by a criminal court in 2001 in the German federal state of Schleswig-Holstein, 209 (95.6 %) were analyzed regarding the following questions: how often was the accused examined by a mental health professional regarding mental responsibility? Was the chance of being examined systematically related to certain factors (e.g., personality of the accused)? Expert advice regarding the mental responsibility of the accused was obtained by the court in only 34 cases (11.7 %). No systematic relationships of personal variables as well as the modus operandi and the chance of commissioning a mental health expert were found. The main reason for assigning a forensic expert opinion was the vague impression of a psychic disorder. Re-offending increased the rate of a mental health examination only in CSA (34.6 % of re-offenders were examined compared to 9.2 % of first-time offenders), but not in rape or sexual assault. Also age does not predict the commissioning of an expert opinion. Only one fifth of all accused below the age of 21 were investigated by a mental health professional. Results are discussed in terms of legal background, consequences for risk assessment and relapse prevention.  相似文献

Using large sample archival data from the state of South Carolina’s juvenile justice agency and other state agencies, we examined the background, early experiential and delinquency-related variables predicting young adult (ages 17–30 years) offending among juvenile offenders. We also examined characteristics of juvenile offenders who committed only a single misdemeanor offense, compared to non-juvenile offenders. Finally, we examined the variables that accounted for group differences in persistence of juvenile offending. Early adverse experiences including family-related adversities, mental health problems, identification as having school-related disabilities and juvenile recidivism accounted for more than 20 % of the variance in adult offending. Cox proportional hazards analysis revealed several time-dependent covariates including gender, age at first offense and repeat versus one time offending. Contrary to the view that the one time, misdemeanor level juvenile offending represents only minor departure from normative adolescent behavior, we found that this group of offenders differed significantly from non-delinquents on every category of risk for adult offending and also were more likely than non-delinquents to commit felonies as adults. Finally, in comparing adolescence-limited offenders with life-course persistent offenders, we accounted for more than 50 % of the variance in criminal outcomes on the basis of measures of background, early adversity, psychological characteristics and age of first juvenile arrest or referral.  相似文献

Estimating the risk of sexual recidivism for a juvenile sex offender is essential in order to protect public safety by identifying and evaluating high risk adolescents and to ensure the rights and welfare of juvenile offenders who will not likely reoffend. Empirically validated risk assessment methods are needed to aid in the classification and treatment of juvenile sex offenders. The present study utilized a dataset collected by Maricopa County, AZ, and aggregated by the National Juvenile Court Data Archive. The purpose of the study was to evaluate and characterize risk factors for juveniles who have been charged with a sexual offense in order to determine the predictive utility of these factors for subsequent offending, as well as offense trajectory, and to evaluate risk factors for nonsexual offenders who have committed crimes of various severities. The results of the present study show the strongest individual predictors of sexual recidivism to be prior nonsexual offending, prior sexual offending, hands‐off offending, offending against a child, younger school grade/age at time of initial offense, Asian or Hispanic ethnicity, and not attending school. A preliminary screening measure was developed from the seven positive risk factors, and ROC analysis produced an AUC indicating moderate predictive utility in discriminating between juvenile sex offenders who would sexually reoffend and those who would not. Working with adolescent sex offenders can be a difficult challenge. When an offender also suffers from mental retardation, this challenge increases. Unfortunately, this has been a largely ignored population, and clinicians working with this group often find little empirical work to assist them. Yet, many theorists posit that addressing sexual offending behavior when the offender is an adolescent may help prevent that behavior from continuing into adulthood. This is important because adult sexual offenders are often very difficult to treat. The current paper begins by reviewing literature on social deficits of individuals who have mental retardation. These deficits may contribute to aberrant sexual behavior among adolescents. The focus of the paper is then a review of literature on adolescent sex offenders, including those with mental retardation. We conclude this review with suggestions for assessment of adolescent sex offenders and with recommendations for future directions.  相似文献

A review of empirical studies of offenders—particularly sex offenders, and more particularly those who offend against children—demonstrates that denial of offenses and minimization of offending behavior are quite common at every stage of the criminal justice process. This is true during police interviews, during pretrial and presentencing mental health evaluations, among incarcerated offenders, among offenders seeking treatment, among offenders facing parole review, and among offenders already released into the community. This review highlights gaps in the research literature arising from inconsistencies in the definitions and measurement of denial and minimization, from the stage of adjudication or treatment at which measurements are made, and from the use of polygraphy to increase disclosures. Despite these limitations on the generalizability of empirical findings, it appears beyond dispute that many sex offenders maintain their innocence in the face of evidence to the contrary or even criminal conviction, and that many are able to recite additional crimes they have committed when they believe it is in their self-interest to do so.  相似文献

Although the recent revelations of clergy sexual abuse suggests an unusual and recent epidemic among the Catholic church, the historical record suggests this difficulty has plagued the church over the centuries. The recent effort of investigative reporters and adult survivors alleging sexual abuse by clergy, has led to an increased public awareness of the extent of illegal sexual activity occurring in the church. Opinion polls of Catholics in the United States have evidenced a critical view of the Church's administrative response to the crisis. Recently, criminal and civil cases have successfully challenged the negligence of the church hierarchy and the sexual misconduct by some of its members. Judicial decisions, however, tend to not hold churches liable for the sexual acts of their clergy. Despite continuing press coverage and civil/criminal litigation, research on priest offenders is virtually nonexistent The claims of unprecedented treatment success with clergy offenders has not been supported by published data. Given the high recidivism rates of sex offenders, the Catholic church should reconsider its policy of placing known sex offenders back into active ministry.  相似文献

Sex offenders have been singled out for differential treatment by the legal and mental health systems. This article attempts to inform law reform efforts and criminal justice mental health policy by examining the assumptions underlying differential legal and mental health treatment of sex offenders. These assumptions include the theories that sex offenders are mentally disordered and in need of treatment, specialists in sex crimes, and more dangerous than other criminal offenders. Empirical findings demonstrate that sex offenders are not specialists in sex crimes and are not mentally disordered. Examination of past research suggests that sex offenders are not at more risk than other criminal offenders to commit future sex crimes. Implications of research findings for selective prosecution of sex crime cases, mental health policy, sex offender legislation, and predictions of future dangerousness are discussed. Proposals for future research needs and law reform are presented.  相似文献

Studies of the dark figure of sexual offending using federal correctional clients reported significant evidence of previously unknown or hidden sexual violence, often among clients with no official criminal history. Unfortunately, research has produced variable estimates of how large the dark figure is. The current study sought to replicate recent studies of federal sexual offenders about the dark figure of sexual offending. We also extended the knowledge base by providing additional correlational analyses to see whether self-reported and official sexual offending have shared or divergent correlates. Overall, 73.8% of federal sexual offenders reported prior contact victims, which is higher than, but generally consistent with, prior prevalence estimates of 55–69% in studies of federal correctional clients. In the current data, clients convicted of child pornography possession or receipt and who had no official record of sexual abuse nevertheless reported contact sexual offenses in more than 59% of cases.  相似文献

The goals of the present study were to examine the recidivism rates of two matched samples of sexual offenders, those released prior to and after sex offender registration and notification (SORN) in New Jersey. The pre-SORN group (1990-1994) included 247 offenders, while the post-SORN group (1996-2000) included 248 offenders. The longitudinal analysis demonstrated that for sex offenders released from prison both prior to and after implementation of SORN, there are clearly two distinguishable groups of sex offenders in relation to patterns of recidivism. More than three-quarters of sex offenders were identified as at low risk of recidivism, with low rates of repeat criminal offenses. By contrast, the high-risk group of offenders was not only more likely to commit future criminal offenses, including sex offenses, but they were also more likely to commit significantly more offenses and to do so fairly quickly following release. Analyses also include an examination of the influence of demographics, substance abuse and mental health issues, treatment history, sex offense incident characteristics, and criminal history on recidivism. Finally, SORN status was not a significant predictor of sex or general recidivism. The study limitations and policy implications are discussed.  相似文献

In the last decade, it has become clear that the sexual abuse of children is much more prevalent than previously realized and that such abuse has extensive mental health sequelae. Females are reported victims of sexual abuse much more often than males. The peak age of onset of sexual abuse for females is prepubertal—7 or 8 years of age—and the average duration tends to he about 2 years. The basic theme of this article is that there may he directly traceable mechanistic relationships between the impact of sexual abuse on specific psychological and biological developmental processes for females and some of the adult outcomes of that abuse. Specifically, it is proposed that, to understand the long-term impact of sexual abuse, it is necessary to investigate how it may interfere with both the psychological and the biological processes of pubertal development.  相似文献

The criminal career paradigm focuses on the prevalence and frequency of crime along with an emphasis on offense specialization, age of onset and desistance, offense seriousness, and career length. Coinciding with the criminal career framework, developmental/life-course criminology offers more complex theoretical explanations for crime which highlight the importance of age-graded developmental risk factors that affect offending over the course of a criminal career. This review provides a systematic examination of the role of violence in criminal career and developmental/life-course research with a specific focus on its prevalence and frequency and its share of the offense repertoire. The results show that the incidence of violence is rare in one's criminal career except for a small group of chronic offenders who are responsible for a majority of the violent offenses. Regarding specialization, evidence suggests that offenders are spectacularly non-specialized and violent offenders can primarily be characterized as frequent offenders who offend more often and thereby have a higher probability of committing a violent offense in their criminal career. Since 1984, sexual abuse by Catholic clergy has captured public attention and resulted in a stream of criminal and civil lawsuits. The hierarchy has been defensive in the face of constant accusations and criticism. As part of a general theory of sexual offending, it is suggested that the failure to achieve intimacy in relations with adults produces emotional loneliness, which leads to an aggressive disposition, and a tendency to pursue sex with diverse partners in the hope of finding intimacy through sexuality or through less threatening partners. The development of intimacy and its benefits are described, as are the consequences that befall those who fail to achieve it. The history of sexual offenders illustrates why they fail to develop the attitudes and skills necessary to attain intimacy, and why this failure leads to sexual abuse. Finally, suggestions are made for the modification of programs for the assessment and treatment of sexual offenders, in order to include problems of intimacy and loneliness.  相似文献

Controversies exist about the diagnostic validity of sexual sadism and its relation to sadistic personality disorder in sex offenders. The aim of this study was to investigate which diagnostic, developmental, and criminal characteristics differentiate sexual sadistic from non-sadistic sexual homicide perpetrators. Psychiatric court reports on 166 men who had committed a sexual homicide were evaluated regarding psychiatric, sexual and criminal history. Sixty-one offenders (36.7%) with sexual sadism (SeSd) were compared with 105 (63.3%) offenders without this diagnosis (NSeSd). Besides the sexual sadistic symptoms, there were seven factors that discriminated best between the two groups (sexual masochism, sadistic personality disorder, isolation in childhood, multiple sexual homicide, previous rape, previous tendencies for similar behavior, and long duration of the homicidal act). Sexual sadism is connected with circumscribed other characteristics and has to be considered in risk assessment and treatment of sex offenders.  相似文献
