Traditionally, logicians construed fallacies as mistakes in inference, as things that looked like good (i.e., deductively valid) arguments but were not. Two fallacies stood out like a sore thumb on this view of fallacies: the fallacy of many questions (because it does not even look like a good argument, or any kind of argument) and the fallacy of petitio principii (because it looks like and is a good argument). The latter is the concern of this paper. One possible response is to say that the tradition is right about the concept of fallacy but wrong about its extension: petitio principii is not a fallacy. If the only proper ways to criticize an argument are to say that it is invalid or that it is unsound, and petitio principii is not criticisable on either of these counts, then calling it a fallacy is tantamount to saying we should prefer invalid or unsound arguments Robinson (Analysis, 31(4): 114 ,1971). I will present a third way to logically criticize arguments and show that fallacious instances of petitio principii are so criticisable while other instances of petitio principii are non-fallacious; hence, this fallacy is not a reductio of the Standard Treatment. It is not my intention in this paper to come out on the side of any of the competing theories—the Standard Treatment, the dialectical theories, and the epistemic theories—as general theories of fallacy. I show only that petitio principii can be handled by something closely resembling the Standard Treatment in so far as that, on entirely logistical principles, there can be made a distinction such that circular arguments form at best a degenerate kind of argument. Circular arguments look like good arguments but are not, not because they are deductively invalid (which they are not) but because they do not deserve to be called arguments at all.  相似文献

Abstract

Few theoretical insights have emerged from the extensive literature discussions of petitio principii argument. In particular, the pattern of petitio analysis has largely been one of movement between the two sides of a dichotomy, that of form and content. In this paper, I trace the basis of this dichotomy to a dualist conception of mind and world. I argue for the rejection of the form/content dichotomy on the ground that its dualist presuppositions generate a reductionist analysis of certain concepts which are central to the analysis of petitio argument. I contend, for example, that no syntactic relation can assimilate within its analysis the essentially holistic nature of a notion like justification. In this regard, I expound a form of dialectical criticism which has been frequently employed in the philosophical arguments of Hilary Putnam. Here the focus of analysis is upon the way in which the proponent of a position proceeds to explain or argue for his/her own particular theses. My conclusion points to the use of such dialectic within future analyses of petitio principii.  相似文献

Classical informal reasoning "fallacies," for example, begging the question or arguing from ignorance, while ubiquitous in everyday argumentation, have been subject to little systematic investigation in cognitive psychology. In this article it is argued that these "fallacies" provide a rich taxonomy of argument forms that can be differentially strong, dependent on their content. A Bayesian theory of content-dependent argument strength is presented. Possible psychological mechanisms are identified. Experiments are presented investigating whether people's judgments of the strength of 3 fallacies--the argumentum ad ignorantiam, the circular argument or petitio principii, and the slippery slope argument--are affected by the factors a Bayesian account predicts. This research suggests that Bayesian accounts of reasoning can be extended to the more general human activity of argumentation.  相似文献

The fallacy of many questions or the complex question, popularized by the sophism ‘Have you stopped beating your spouse?’ (when a yes-or-no answer is required), is similar to the fallacy of begging the question orpetitio principii. Douglas N. Walton inBegging the Question has recently argued that the two forms are alike in trying unfairly to elicit an admission from a dialectical opponent without meeting burden of proof, but distinct because of the circularity of question-begging argument and noncircularity of many questions. I offer a reconstruction of the many questions fallacy according to which it is just as circular as begging the question, concluding that many questions begs the question. The same analysis contradicts Walton's claim that questions can beg the question, drawing a distinction between questions as the instruments of question-begging, and as vehicles for categorical noninterrogative presuppositions that beg the question.  相似文献

In this paper we discuss the relevance of considering context for critical thinking. We argue that critical thinking is best viewed in terms of ‘critical inquiry’ in which argumentation is seen as a way of arriving at reasoned judgments on complex issues. This is a dialectical process involving the comparative weighing of a variety of contending positions and arguments. Using the model which we have developed for teaching critical thinking as critical inquiry, we demonstrate the role played by the following aspects of context: (1) knowledge of the dialectical context (the debate around an issue, both current and historical); (2) an understanding of the current state of practice and belief surrounding an issue; (3) an understanding of the intellectual, political, historical and social contexts in which an issue is embedded; (4) knowledge of the relevant disciplinary context; (5) information about the sources of an argument; (6) awareness of one’s own beliefs and biases.  相似文献

In his works on argumentation, Aristotle develops three main forms: apodeictical, dialectical, and rhetorical argumentation; dialectic is subdivided into several subspecies. The purpose of this paper is to discuss all of the forms described by Aristotle, to examine their differences and to point out their interrelations. This leads to an examination of the differentiating criteria and their applicability in the case of each argumentation form—and in particular to the question regarding the number of criteria that are necessary to describe each form clearly and unambiguously. It is argued that Aristotle’s works on argumentation contain an implicit system of argumentation forms that is based on no more than three criteria.  相似文献

Within three of the most well-known contemporary approaches to argumentation, the notions of solo argumentation and arguing with one’s self are given little attention and are typically argued to be able to be subsumed within the dialectical aspects of the approach being propounded. Challenging these claims, this paper has two main aims. The first is to argue that while dialogical argumentation may be most common, there exists individual (monological) dialectical argumentation, which is not so easily subsumed within these theories. Second, in order characterize this type of argumentation the paper also offers distinctions between the interrelated notions of dialectical, dialogical, and quasi-dialogical, reasoning and argumentation, within an individual or between multiple participants, which I hope provide useful precision for the field.  相似文献

The concept of burden of proof is used in a wide range of discourses, from philosophy to law, science, skepticism, and even in everyday reasoning. This paper provides an analysis of the proper deployment of burden of proof, focusing in particular on skeptical discussions of pseudoscience and the paranormal, where burden of proof assignments are most poignant and relatively clear-cut. We argue that burden of proof is often misapplied or used as a mere rhetorical gambit, with little appreciation of the underlying principles. The paper elaborates on an important distinction between evidential and prudential varieties of burdens of proof, which is cashed out in terms of Bayesian probabilities and error management theory. Finally, we explore the relationship between burden of proof and several (alleged) informal logical fallacies. This allows us to get a firmer grip on the concept and its applications in different domains, and also to clear up some confusions with regard to when exactly some fallacies (ad hominem, ad ignorantiam, and petitio principii) may or may not occur.  相似文献

In recent and not so recent years, fallacy theory has sustained numerous challenges, challenges which have seen the theory charged with lack of systematicity as well as failure to deliver significant insights into its subject matter. In the following discussion, I argue that these criticisms are subordinate to a more fundamental criticism of fallacy theory, a criticism pertaining to the lack of intelligibility of this theory. The charge of unintelligibility against fallacy theory derives from a similar charge against philosophical theories of truth and rationality developed by Hilary Putnam. I examine how Putnam develops this charge in the case of the conception of rationality pursued by logical positivism. Following that examination, I demonstrate the significance of this charge for how we proceed routinely to analyse one informal fallacy, the fallacy of petitio principii. Specifically, I argue that the significance of this charge lies in its issuance of a rejection of the urge to theorise in fallacy inquiry in general and petitio inquiry in particular. My conclusion takes the form of guidelines for the post-theoretical pursuit of fallacy inquiry.  相似文献

Toulmin’s scheme for the layout of arguments (1958, The Uses of Argument, Cambridge University Press, Cambridge) represents an influential tool for the analysis of arguments. The scheme enriches the traditional premises-conclusion model of arguments by distinguishing additional elements, like warrant, backing and rebuttal. The present paper contains a formal elaboration of Toulmin’s scheme, and extends it with a treatment of the formal evaluation of Toulmin-style arguments, which Toulmin did not discuss at all. Arguments are evaluated in terms of a so-called dialectical interpretation of their assumptions. In such an interpretation, an argument’s assumptions can be evaluated as defeated, e.g., when there is a defeating reason against the assumption. The present work builds on recent research on defeasible argumentation (cf. e.g. the work of Pollock, Reiter, Loui, Vreeswijk, Prakken, Hage and Dung). More specifically, the author’s work on the dialectical logic DEFLOG and the argumentation tool ARGUMED serve as starting points.  相似文献

In this paper, the author develops an instrument for the rational reconstruction of argumentation in which a judicial decision is justified by referring to the consequences in relation to the purpose of the rule. The instrument is developed by integrating insights from legal theory and legal philosophy about the function and use of arguments from consequences in relation to the purpose of a rule into a pragma-dialectical framework. Then, by applying the instrument to the analysis of examples from legal practice, it is demonstrated that the instrument can offer a heuristic and critical tool for the analysis and evaluation of legal argumentation that can ‘bridge’ the gap between more abstract discussions of forms of legal argumentation on the one hand, and legal arguments as they occur in actual legal practice on the other hand.  相似文献

In this article I subject to criticism Field's argument, according to which field theory takes space‐time to be à substance since it ascribes field properties to space‐time points. There is petitio principii error made in this reasoning because Field does not give any justification for his controversial assumption that fields are properties of space‐time points. What is more, I suggest, Field's interpretation of field theory is incompatible with the way this theory is understood and utilized by its users, namely scientists. My criticism is based on the assumption that one cannot propose an ontology of a given scientific theory, at the same time imposing on it an interpretation which clashes with the interpretation current among its users. I also suggest that in order to establish the ontology of a scientific theory one should also take into account the way it has been constructed. According to this criterion, field theory does indeed take space‐time to be a substance.  相似文献

This paper shows how complex argumentation, analyzed as dialectical structures, can be evaluated within a Bayesian framework by interpreting them as coherence constraints on subjective degrees of belief. A dialectical structure is a set of arguments (premiss-conclusion structure) among which support- and attack-relations hold. This approach addresses the observation that some theses in a debate can be better justified than others and thus fixes a shortcoming of a theory of defeasible reasoning which applies the bivalence principle to argument evaluations by assigning them the status of being either defeated or undefeated. Evaluation procedures which are based on the principle of bivalence can, however, be embedded as a special case within the Bayesian framework. The approach developed in this paper rests on the assumptions that arguments can be reconstructed as deductively valid and that complex argumentation can be reconstructed such that premisses of arguments with equivalent conclusions are pairwise independent.  相似文献

The interpretation of discourse covers a continuum with two extremes: on the one hand, a text considered as an ideal, distant object, and on the other hand, a conversation regarded as a real, present event. On the basis of a distinction between relatively context-invariant propositions and relatively context-dependent statements, it is argued that statements in conversational discourse are easier to interpret than statements in texts, whereas only propositions in symbolic logic can be interpreted with exactitude. In the same way, the interpretation of dialogical arguments proceeds more easily than the interpretation of arguments in texts. While dialogical argumentation requires a dialectical approach, textual argumentation necessitates an imaginative reconstruction of the argument. From this it can be concluded that for different sorts of argumentative discourse diverse sorts of interpretative activities have to be used.  相似文献

In this contribution, I will develop a comprehensive tool for the reconstruction and evaluation of argumentation from expert opinion. This is done by analyzing and then combining two dialectical accounts of this type of argumentation. Walton’s account of the ‘appeal to expert opinion’ provides a number of useful, but fairly unsystematic suggestions for critical questions pertaining to argumentation from expert opinion. The pragma-dialectical account of ‘argumentation from authority’ offers a clear and systematic, but fairly general framework for the reconstruction and evaluation of this type of argumentation. The tool is developed by incorporating Walton’s critical questions into a pragma-dialectical framework.  相似文献

Is there a duty to respond to objections in order to present a good argument? Ralph Johnson argues that there is such a duty, which he refers to as the “dialectical tier“ of an argument. I deny the (alleged) duty primarily on grounds that it would exert too great a demand on arguers, harming argumentation practices. The valuable aim of responding to objections, which Johnson 's dialectical tier is meant to satisfy, can be achieved in better ways, as argumentation is a social-epistemic activity.  相似文献

This article analyses the fallacy of wrenching from context, using the dialectical notions of commitment and implicature as tools. The data, a set of key examples, is used to sharpen the conceptual borderlines around the related fallacies of straw man, accent, misquotation, and neglect of qualifications. According to the analysis, the main characteristics of wrenching from context are the manipulation of the meaning of the other’s statement through devices such as the use of misquotations, selective quotations, and quoting out of context. The theoretical tools employed in the analysis are pragmatic theories of meaning and a dialectical model of commitment, used to explain how and why a standpoint is distorted. The analysis is based on a conception of fallacies as deceptive strategic moves in a game of dialogue. As a consequence, our focus is not only on misquotations as distortions of meaning, but on how they are used as dialectical tools to attack an opponent or win a dispute. Wrenching from context is described as a fallacy of unfairly attributing a commitment to another party that he never held. Its power as a deceptive argumentation tactic is based on complex mechanisms of implicit commitments and on their misemployment to improperly suggest an attribution of commitment.  相似文献

After integrating the main lines of argumentation developed in the special issue, this paper makes a balance of the question on the public role of the university. Furthermore, the paper focuses on the discussion underlying the articles collected in the issue. A distinction is made between “comprehending” the past and present of the university on the one hand and “justifying” the university and its public role on the other hand. In view of this distinction, it is argued that the question concerning the value of a (normative) idea of the university and its public role is related to the question of democracy. The question is, however, not only whether we live in a democracy, but whether we may still speak of a “commitment to democracy”. An inquiry into the meaningfulness of a (normative) “idea” of the university arises directly from this question. At this point, the viewpoint of Derrida is introduced to discuss the question of the democracy and university of the future.  相似文献

Decision aiding can be abstractly described as the process of assisting a user/client/decision maker by recommending possible courses of his action. This process has to be able to cope with incomplete and/or inconsistent information and must adapt to the dynamics of the environment in which it is carried out. Indeed, on the one hand, complete information about the environment is almost impossible, and on the other hand, the information provided by the user is often affected by uncertainty; it may contains inconsistencies and may dynamically be revised because of various reasons. The aim of this paper is to present a model of the decision aiding process that is amenable to automation. The main features of the approach is that it models decision aiding as an iterative defeasible reasoning process, and it uses argumentation for capturing important aspects of the process. More specifically, argumentation is used for representing the relations between the cognitive artefacts that are involved in decision aiding, as well as for modelling the artefacts themselves. In modelling the cognitive artefacts, we make use of the notion of argument schemes and specify the related critical questions. More specifically, the work reported here aims at initiating a systematic study of the use of argumentation in future decision aiding tools. Our ambition is twofold: (i) enhance decision support capabilities of an analyst representing explicitly and accountably the reasons for which he recommend a solution for a decision maker and (ii) enhance decision support capabilities of an (semi) automatic device to handle (at least partially) the dialogue with the user.
