在器官移植的供体来源为尸体器官时,无器官移植资质的医院常没有针对公民逝世后器官捐献做伦理审查。基于此现状,结合国内《执业医师法》《侵权责任法》《人体器官移植条例》《医疗机构管理条例》等有关法律法规,探讨在医疗机构环境下,公民逝世前后的器官捐献伦理审查和监督制度,以进一步尊重公民的尊严和意愿,保护隐私,避免医生职务利益冲突,规范和完善公民死亡判定与器官捐献工作流程,切实维护公民权益,增进社会公众对器官捐献伦理的认识和支持。  相似文献

《人体器官移植条例》颁布已有十余载,虽解决了器官捐献无法可依的问题,但因其内容不完备及严格的条件限制,已成为我国器官捐献发展的障碍。从人体器官捐献存在的主要问题及立法现状入手,借鉴国外器官捐献立法现状,论述该条例中器官捐献内容存在的问题,提出完善我国器官捐献的三条建议:(1)出台专门的《人体器官捐献法》;(2)从扩大活体器官捐献供体范围、适当放宽遗体器官捐献条件、建立器官捐献的有效激励机制、规范器官分配原则6个方面完善《人体器官移植条例》;(3)明确脑死亡标准,确立脑死亡立法。  相似文献

The shortage of organs for transplantation in Japan has alerted health professionals to the low organ donation rate among Japanese people. The unique cultural view of death and altruism has been suggested leading to their low intent to donate cadaveric organs. A cross‐sectional survey was conducted in Japan to investigate the interplay of death anxiety, altruism, and self‐efficacy in influencing Japanese college students' intention to sign donor cards, in order to mobilise this large potential source of organ donors in the future. Six hundred and seven Japanese non‐donor card signers voluntarily completed a self‐administered questionnaire. The results of mediation and moderated mediation analyses with bootstrap approach suggest that death anxiety indirectly hinders Japanese people's intention to become a donor card signer through lowering of self‐efficacy, while altruism intensifies the positive impact of self‐efficacy on signing intention. These findings provide useful insights for organ procurement organisations seeking behavioural change not only in Japan but also in multi‐ethnic societies with a substantial Japanese population.  相似文献

Although the number of patients needing organ transplantation systematically increases, recent years have seen a considerable shortage of donors. The level of knowledge and attitudes toward donation are critical factors in achieving the required balance between supply and demand. This pilot study assessed the knowledge, opinions, and behaviors related to organ donation and transplantation among 625 students representing eight different fields of study from the University of Rzeszow in south-eastern Poland. Although the participants provided evidence of knowledge about human organ donation and transplantation, they were aware of the main organs of the human body for potential transplants, and generally showed positive attitudes; only 24% of the subjects indicated their willingness to register as a donor; only 3% stated that they had already registered and had a donor card. The findings suggest that good intentions do not translate into action and that Poland needs to develop a nation-wide, up-to-date, and youth-oriented health education program that builds on favorable attitudes toward organ donation and transplantation.  相似文献

Anticipating the reevaluation of the Dutch organ procurement system, in late 2003 the Rathenau Institute published a study entitled 'Gift or Contribution?' In this study, the author, Govert den Hartogh, carries out a thorough moral analysis of the problem of organ shortage and fair allocation of organs. He suggests there should be a change in mentality whereby organ donation is no longer viewed in terms of charity and the volunteer spirit, but rather in terms of duty and reciprocity. The procurement and allocation of donor organs should be seen as a system of mutually assured help. Fair allocation would imply to give priority to those who recognize and comply with their duty: the registered donors. The idea of viewing organ donation as an undertaking involving mutual benefit rather than as a matter of charity, however, is not new. Notwithstanding the fact that reference to charity and altruism is not required in order for the organ donation to be of moral significance, we will argue against the reciprocity-based scenario. Steering organ allocation towards those who are themselves willing to donate organs is both an ineffective and morally questionable means of attempting to counter organ shortage.  相似文献

OBJECTIVE: Approximately 6,000 Americans die every year awaiting an organ transplant. Health promotion interventions may alleviate the shortage of viable organs by increasing the number of registered organ donors. This study is the first to evaluate the differential effectiveness of various organ donor messages in naturalistic settings. DESIGN: A 4 (Appeal)x4 (Exemplar)x4 (Location) counterbalanced quasi-experimental design was implemented. MAIN OUTCOME MEASURE: The behavioral outcome measure was the number of individuals who registered to be organ donors at computer kiosks. RESULTS: A number of significant main effects and interactions emerged. Most notably, of the 4 different appeals (counterargument, emotional, motivating action, dissonance), counterargument was by far the most efficacious, especially in academic-type settings (library, university, community college); the emotional appeal was most successful in hospitals. CONCLUSIONS: The findings from this study have implications for both organ donor investigations and health campaign research in general. Statistical interactions highlight the importance of evaluating multiple exemplars in multiple locations for each type of appeal when conducting health campaign research.  相似文献

目前,肝移植已成为治疗终末期肝病的有效手段,活体肝移植术部分解决了供肝短缺的问题,10多年来其发展迅速,并取得了良好的疗效,由于活体肝移植需从活的供体身上切取部分肝脏,且供体多为患者家属,故存在着供体的选择,供体的贡献与代价,患者的家庭,心理,社会等伦理等问题。因此在提高活体肝移植技术水平的同时,必须充分考虑活体肝移植的伦理学问题,遵守伦理原则,使活体肝移植不但能从技术上达到,在伦理学方面也是可行的。  相似文献

The issue of organ donation and of how the donor pool can or should be increased is one with significant practical, ethical and logistic implications. Here we comment on an article advocating a paradigm change in the so-called "dead donor rule". Such change would involve the societal and legal abandonment of the above rule and the introduction of mandated choice. In this commentary, we review some of the problems associated with the proposed changes as well as the problems associated with the current model. We emphasize the continuing problems with the definition of death and the physiological process of dying; we discuss the difficulties associated with a dichotomous view of death; we review the difficulties with non-beating heart donation and emphasize the current limitations of society's understanding of these complex issues. We conclude that public education remains the best approach and that such education should not be merely promotion of a particular ideology but honest debate of what is socially and morally acceptable and appropriate given the changes in vital organ support technology and the need to respect patient autonomy.  相似文献
