The purpose of this research was to investigate the role of hindsight bias in application of the felony‐murder law, a controversial rule stating that felons can be held responsible for any foreseeable deaths that occur as a result of their felony. Some versions of the rule involve notions of proximate cause requiring legal decision makers to determine foreseeability and assess case evidence. Those judgments may be biased by outcome information and the process of cognitive sense‐making. Jury eligible participants read a crime vignette modeled on an actual felony‐murder case manipulated with regard to outcome information and relevant case facts. They made likelihood judgments and rated felons on intent and culpability. Results indicated that outcome information biased death likelihood ratings in hindsight but did not significantly affect assessments of case evidence. Implications for further applied cognitive research regarding the felony‐murder rule are discussed. Copyright © 2013 John Wiley & Sons, Ltd.  相似文献

The authors report a clinical trial (N = 43 couples) that compares a hope‐focused marital enrichment (E. L. Worthington et al., 1997) with empathy‐centered forgiveness‐based marital enrichment (M. E. McCullough, 1997; E. L. Worthington, 1998a) and a wait‐list control. Treatment group couples improved relative to the wait‐list control group in observational measures of communication. Hope‐focused marital enrichment produced clinically relevant changes in marital communication, increasing the ratio by 3 to 5 positive to negative interaction ratio units. Hope‐focused marital enrichment is discussed in comparison with previous research, which was conducted with couples meeting conjointly. The forgiveness‐based marital enrichment psychoeducational group is one of the 1st studies of forgiveness interventions in couples research.  相似文献

The relative validities of forced‐choice (ipsative) and Likert rating‐scale item formats as criterion measures are examined. While there has been much debate about the relative technical and psychometric merits and demerits of ipsative instruments, the present research focused on the crucial question of whether the use of this format has any practical benefit – in terms of improved validity. An analysis is reported from a meta‐analysis data set. This demonstrates that higher operational validity coefficients (prediction of line‐manager ratings of competencies) are associated with the use of forced‐choice (r=.38) rather than rating scale (r=.25) item formats for the criterion measurement instrument when performance is rated by the same line managers on both formats and where the predictor is held constant. Thus the apparent criterion‐related validity of a predictor can increase by 50% simply by changing the format of the criterion measurement instrument. The implications of this for practice are discussed.  相似文献

This paper reports the findings of a study investigating interpretations of driver behavior during a traffic accident. Using authentic road‐accident reports including figurative depictions of the accident and a photograph of the car involved, participants were asked to make judgments of the driver's carelessness and aggression before and during the accident. Contextual factors were manipulated by altering the type of car driven (following Davies, 1999) and the sex of the driver. Results showed that car type influenced the allocation of cause of the accident, with drivers of a BMW being described as having acted more aggressively, and drivers of Smart Cars having been depicted as acting more carelessly, despite the actions of both drivers being held constant. In addition, the actions of the female driver were interpreted as more attributable to driver carelessness than driver aggression or external factors. Results are discussed with reference to car‐type stereotypes. Ways in which such biased interpretations could influence how drivers respond to other road users in real‐life situations are suggested.  相似文献

Metaphysical theories are often counter‐intuitive. But they also often are strongly supported and motivated by intuitions. One way or another, the link between intuitions and metaphysics is a strong and important one, and there is hardly any metaphysical discussion where intuitions do not play a crucial role. In this article, I will be interested in a particular kind of such intuitions, namely those that come, at least partly, from experience. There seems to be a route from experience to metaphysics, and this is the core of my interest here. In order to better understand such ‘arguments from experience’ and the kind of relationship there is between this type of intuitions and metaphysical theories, I shall examine four particular cases where a kind of experience‐based intuition seems to motivate or support a metaphysical theory. At the end of the day, I shall argue that this route is a treacherous one, and that in all of the four cases I shall concentrate on, phenomenological considerations are in fact orthogonal to the allegedly ‘corresponding’ metaphysical claims. An anti‐realist view of metaphysics will emerge.  相似文献

This article examines the potential theoretical and practical contributions that thin‐slice judgments may offer to consumer psychology. We begin by exploring thin‐slice judgments in the context of existing consumer information processing research. Then, we discuss the antecedents of thin‐slice judgments, the type of processing that may underlie and impact thin‐slice judgment formation. A successful sale depends on a customer's perception of the salesperson's personality, motivations, trustworthiness, and affect. Person perception research has shown that consistent and accurate assessments of these traits can be made based on very brief observations, or “thin slices.” Thus, examining impressions based on thin slices offers an effective approach to study how perceptions of salespeople translate into real‐world results, such as sales performance and customer satisfaction. The literature on the accuracy of thin‐slice judgments is briefly reviewed. Then, 2 studies are presented that investigated the predictive validity of judgments of salespeople based on thin slices of the vocal channel. Participants rated 20‐sec audio clips extracted from interviews with a sample of sales managers, on variables gauging interpersonal skills, task‐related skills, and anxiety. Results supported the hypothesis that observability of the rated variable is a key determinant in the criterion validity of thin‐slice judgments. Implications for the use of thin‐slice judgments in salesperson selection and customer satisfaction are discussed.  相似文献

The present study examined age‐related differences in the misinformation effect for objects that were consistent or inconsistent with their environmental settings. Young and older adults viewed one of two slide sequences, each containing context‐consistent items (e.g., a blender in a kitchen setting or a saw in a woodshop setting) and context‐inconsistent items (a saw in a kitchen setting or a blender in a woodshop setting). After receiving misinformation through post‐event narratives, participants received tests of yes/no recognition requiring remember/know judgments (Experiments 1–3) and source monitoring (Experiments 2 and 3) for slide details. Although age‐related differences in the misinformation effect were nonreliable, older adults tended to report misinformation as remembered more often than young adults, and source monitoring tests reduced the misinformation effect for both age groups. Misinformation effects were equivalent or larger for inconsistent objects than for consistent objects. Theoretical and practical implications of these results are discussed. The potential for applicant response distortion on personality measures remains a major concern in high‐stakes testing situations. Many approaches to understanding response distortion are too transparent (e.g., instructed faking studies) – or are too subtle (e.g., correlations with social desirability measures as indices of faking). Recent research reveals more promising approaches in two methods: using forced‐choice (FC) personality test items and warning against faking. The present study examined effects of these two methods on criterion‐related validity and test‐taker reactions. Results supported incremental validity for an FC and Likert‐scale measure in warning and no‐warning conditions, above and beyond cognitive ability. No clear differences emerged between the FC vs Likert measures or warning vs no‐warning conditions in terms of validity. However, some evidence suggested that FC measures and warnings may produce negative test‐taker reactions. We conclude with implications for implementation in selection settings.  相似文献

Consumers making repeat consumption choices often need to decide whether to stick to their favorite option or to select something different. Understanding the situational factors that influence their willingness to seek more or less variety in consumption is of both theoretical and practical importance. The current research proposes that a salient relationship state—romantic crush—can increase consumers' variety‐seeking tendency in unrelated consumption situations. Building on the compensatory consumption literature, we suggest that the lack of reciprocal response in the romantic crush experience may lower consumers' sense of control in the romantic relationship. Therefore, they are motivated to restore their sense of control by making more varied choices in consumption domains. Five studies provide support for this hypothesis. In line with our control‐restoration account, the effect disappears when consumers' sense of control is boosted via other means. Moreover, the effect is specific to the experience of a romantic crush and cannot be generalized to other types of romantic relationship (e.g., initial stage of love).  相似文献

The authors investigated the effects of hybrid third‐party procedures on constituents' procedural and distributive fairness judgments. In Experiment 1, three independent variables were manipulated: third‐party procedure (Med–Arb vs. Arb–Med), concession making during mediation (concessions vs. no concessions), and role (labor vs. management). Participants viewed Med–Arb as fairer than Arb–Med. In Experiment 2, three factors were again manipulated: third‐party procedure (Med–Arb vs. Arb–Med), whether confidential information was revealed during mediation (confidential information revealed vs. not revealed), and arbitration outcomes (winning vs. losing). Results suggest that when no confidential information was revealed, Med–Arb was significantly fairer than Arb–Med, but if confidential information was revealed, then both procedures were equally fair. The claim that humans adapt their actions in ways that avoid effortful processing (whether cognitive or physical) is a staple of various theories of human behavior. Although much work has been carried out focusing on the determinants of such behaviors, less attention has been given to how individuals evaluate effort. In the current set of experiments, we utilized the general evaluability theory to examine the evaluability of effort by examining subjective value functions across different evaluation modes. Individuals judged the anticipated effort of four task‐specific efforts indexed by stimulus rotation, items to be remembered, weight to be lifted, and stimulus degradation across joint (i.e., judged comparatively) and single evaluation modes (i.e., judged in isolation). General evaluability theory hypothesizes that highly evaluable attributes should be consistently evaluated (i.e., demonstrate similar subjective value functions) between the two modes. Across six experiments, we demonstrate that the perceived effort associated with items to be remembered, weight to be lifted, and stimulus degradation can be considered relatively evaluable, while the effort associated with stimulus rotation may be relatively inevaluable. Results are discussed within the context of subjective evaluation, internal reference information, and strategy selection. In addition, methodological implications of evaluation modes are considered. We examined the interaction of testimonial consistency and witness group identity on mock jurors' judgments of witness effectiveness, probability that the defendant committed the crime, and verdict. In a 3 × 2 (Witness Group Identity × Testimonial Consistency) between‐groups design, 180 mock jurors heard a trial of a person charged with assault. Although both variables affected judgments, group‐identity effects were weak when testimony was characterized by inconsistencies, and they were stronger when testimony was internally consistent but ambiguous. The judgment patterns were consistent with predictions from Chaiken, Liberman, and Eagly's (1989) heuristic‐systematic processing theory, suggesting that heuristic processing would bias systematic processing when the evidence was not decisive.  相似文献
