I take it that liberal justice recognises special protections against the restriction of speech and expression; this is what I call the Free Speech Principle. I ask if this Principle includes speech acts which might broadly be termed ‘hate speech’, where ‘includes’ is sensitive to the distinction between coverage and protection, and between speech that is regulable and speech that should be regulated. I suggest that ‘hate speech’ is too broad a designation to be usefully analysed as a single category, since it includes many different kinds of speech acts, each of which involves very different kinds of free speech interests, and may cause very different kinds of harm. I therefore propose to disaggregate hate speech into various categories which are analysed in turn. I distinguish four main categories of hate speech, namely (1) targeted vilification, (2) diffuse vilification, (3) organised political advocacy for exclusionary and/or eliminationist policies, and (4) other assertions of fact or value which constitute an adverse judgment on an identifiable racial or religious group. Reviewing these categories in the light of the justifications for the Free Speech Principle, I will argue that category (1) is uncovered by the Principle, categories (2) and (3) are covered but unprotected, and that category (4) is protected speech.  相似文献

The main goal of quantum logic is the bottom-up reconstruction of quantum mechanics in Hilbert space. Here we discuss the question whether quantum logic is an empirical structure or a priori valid. There are good reasons for both possibilities. First, with respect to the possibility of a rational reconstruction of quantum mechanics, quantum logic follows a priori from quantum ontology and can thus not be considered as a law of nature. Second, since quantum logic allows for a reconstruction of quantum mechanics, self-referential consistency requires that the empirical content of quantum mechanics must be compatible with the presupposed quantum ontology. Hence, quantum ontology contains empirical components that are also contained in quantum logic. Consequently, in this sense quantum logic is also a law of nature.  相似文献

The President’s Council on Bioethics has addressed the moral status of human preembryos in its reports on stem cell research and human therapeutic cloning. Although the Council has been criticized for being hand-picked to favor the right-to-life viewpoint concerning human preembryos, it has embraced the idea that the right-to-life position should be defended in secular terms. This is an important feature of the Council’s work, and it demonstrates a recognition of the need for genuine engagement between opposing sides in the debate over stem cell research. To promote this engagement, the Council has stated in secular terms several arguments for the personhood of human preembryos. This essay presents and critiques those arguments, and it concludes that they are unsuccessful. If the best arguments in support of the personhood of human preembryos have been presented by the Council, then there are no reasonable secular arguments in support of that view.  相似文献

Putnam famously attempted to use model theory to draw metaphysical conclusions. His Skolemisation argument sought to show metaphysical realists that their favourite theories have countable models. His permutation argument sought to show that they have permuted models. His constructivisation argument sought to show that any empirical evidence is compatible with the Axiom of Constructibility. Evaluating Arguments Based on Toulmin’s Scheme   总被引:2,自引:0,他引:2  
Toulmin’s scheme for the layout of arguments (1958, The Uses of Argument, Cambridge University Press, Cambridge) represents an influential tool for the analysis of arguments. The scheme enriches the traditional premises-conclusion model of arguments by distinguishing additional elements, like warrant, backing and rebuttal. The present paper contains a formal elaboration of Toulmin’s scheme, and extends it with a treatment of the formal evaluation of Toulmin-style arguments, which Toulmin did not discuss at all. Arguments are evaluated in terms of a so-called dialectical interpretation of their assumptions. In such an interpretation, an argument’s assumptions can be evaluated as defeated, e.g., when there is a defeating reason against the assumption. The present work builds on recent research on defeasible argumentation (cf. e.g. the work of Pollock, Reiter, Loui, Vreeswijk, Prakken, Hage and Dung). More specifically, the author’s work on the dialectical logic DEFLOG and the argumentation tool ARGUMED serve as starting points.  相似文献

A variation of Fitch’s paradox is given, where no special rules of inference are assumed, only axioms. These axioms follow from the familiar assumptions which involve rules of inference. We show (by constructing a model) that by allowing that possibly the knower doesn’t know his own soundness (while still requiring he be sound), Fitch’s paradox is avoided. Provided one is willing to admit that sound knowers may be ignorant of their own soundness, this might offer a way out of the paradox.  相似文献

It is known that for any subdirectly irreducible finite Heyting algebra A and any Heyting algebra B, A is embeddable into a quotient algebra of B, if and only if Jankov’s formula χ A for A is refuted in B. In this paper, we present an infinitary extension of the above theorem given by Jankov. Despite frequent calls by players, managers and fans, FIFA's resistance to the implementation of goal-line technology (GLT) has been well documented in national print and online media as well as FIFA's own website. In 2010, FIFA president Sepp Blatter outlined eight reasons why GLT should not be used in football. The reasons given by FIFA can be broadly separated into three categories; those dealing with the nature and value of the game of football, those related to issues of justice, and those concerned with the practical implementation of GLT. This paper intends to evaluate these eight reasons in order to assess whether there are, indeed, any good arguments against GLT in football.  相似文献

During the 1990s, the United States enacted several punitive sex crime laws. Contemporary scholarship suggests this shift can be understood as a modern “witch hunt.” However, theoretical accounts have yet to examine systematically the emergence of such legislation. This study applies two theories—the first by Erikson and the second by Jensen—to assess whether they accord with known facts about the proliferation of these laws. Broad support for the theories as accounts for the punitive trend in sex crime legislation exists, but the inclusion of information dissemination as an additional factor would strengthen these accounts. The debate between ‘inclusive’ and ‘dominant’ interpretations of Aristotle's concept of happiness (eudaimonia) has become one of the thorniest problems of Aristotle interpretation. In this paper, I attempt to solve this problem by presenting a multi-step argument for an ‘all-inclusive’ thesis, i.e., the Aristotelian philosopher or contemplator, in the strict sense, is someone who already possesses all the intellectual virtues (except technē), all the moral virtues (by way of the possession of phronēsis), and considerable other goods. If this thesis is correct, the inclusive and dominant interpretations will converge, for the philosopher turns out to be the happiest human being both in the inclusive and dominant senses.  相似文献

Male-dominated industries such as sport contain stereotypical and subjective notions of leadership ability (Burton et al. 2009; Fink 2008). These gender stereotypes often manifest themselves within varying levels of leadership, but specific to the sport industry, they are the most visible within the head coach role. Men hold the majority of head coach positions within the professional and amateur levels of sport, and these hiring practices can be based on gender-role stereotypes (Acosta and Carpenter 2014). In an attempt to challenge stereotypical gender based leadership preferences, leadership ability and performance should be objectively examined. Therefore, in the present investigation we aimed to examine the presence of gender stereotypes in the sport industry by determining whether the gender of a head coach for two women’s basketball leagues, the Women’s National Basketball Association (WNBA) and the National Intercollegiate Athletic Association (NCAA), impacted individual player performance. Data were collected for 1522 players for 19 WNBA seasons (1997–2015) and 4000 players for three seasons of NCAA Women’s Basketball (2013–2016). Results indicated that head coach gender does not appear to impact individual player performance in the WNBA or in the NCAA thereby providing objective evidence to challenge the traditional gender stereotypes found within the sports industry.  相似文献

In 1926, Ernst Mally proposed a number of deontic postulates. He added them as axioms to classical propositional logic. The resulting system was unsatisfactory because it had the consequence that A is the case if and only if it is obligatory that A. We present an intuitionistic reformulation of Mally’s deontic logic. We show that this system does not provide the just-mentioned objectionable theorem while most of the theorems that Mally considered acceptable are still derivable. The resulting system is unacceptable as a deontic logic, but it does make sense as a lax logic in the modern sense of the word.  相似文献

Many speech-language pathologists assume that parent-child communicative interactions are critical precipitating or maintaining factors in the onset and development of stuttering. Although parents are frequently counseled to alter their attitudes or behaviors, no studies have pinpointed specific parental behaviors as increasing children's disfluency. The purpose of this study was to analyze differences between 12 mothers of stutterers and 12 mothers of nonstutterers in their social-communicative interactions with their own child, an unfamiliar stutterer, and an unfamiliar nonstutterer. Ten minutes of free-play interaction between each mother and child were video recorded from behind a one-way mirror. Results indicate that the two groups of mothers differed significantly only in their use of routine statements. Other findings indicate that stuttering children used significantly more positive and imperative statements than nonstuttering children. All children asked significantly more questions of their own mothers than of unfamiliar mothers.  相似文献

A successful declaration of one’s identity in saying “ahaṃ Brahmāsmi” is a result of knowing one’s own self as indistinguishable from Brahman. The non-difference between oneself and the Brahman is one’s true identity, and it goes without saying, knowledge of one’s true identity constitutes the correct knowing of one’s own self. That the said non-difference is upheld by vedānta, and we need to put this ideal non-difference into practice is the crux of Vivekananda’s practical vedānta. Vivekananda gives certain reasons for the practicability of vedānta. This paper’s part I is an exposition of Vivekananda’s practical vedānta, focussing on those reasons for practical vedānta and orienting each towards an analytical understanding. In part II, a linguistic analysis of Vivekananda’s approach to one’s identity has been carried out after introducing J. Hintikka’s interpretation of Descartes’ “I think, therefore, I am” and G. Misra’s interpretation of sat (existence, reality or being) cit (consciousness, knowledge or cognition) ānanda (bliss, intense happiness or felicity). The latter’s interpretation displays a positivist’s linguistic analysis of vedānta, whereas the former’s does a speech act theorist’s analysis of Descartes’ cogito principle. The present analysis indicates that practical vedānta can be read in the light of analytic philosophy and Vivekananda’s approach to one’s identity can be understood in terms of speech acts.
