The first part of this paper contends that argumentation is central and essential to Aristotle's Rhetoric, and recounts a number of arguments in support of that view, particularly the recognition that deliberative rhetoric or the rhetoric of counsel is the primary concern of Aristotle's work. An extended version of Gieryn's notion of boundary-work, supplemented with insights of Thomas Goodnight, is used to represent the central role of rhetoric in disputes on the boundary of science and the public. From a study of the Tarasoff-case it is shown that the rhetorical process of turning obstacles into resources works to move the boundary between a science and the law. It is concluded that rhetorical scholars can and must play a part in the resolution of boundary disputes and that concrete case-studies of boundary-work may deepen criticism of argument. 相似文献

The topics is a theory of argumentation based upon topoi or in Latin loci. The medieval logicians used works by Aristotle and Boethius as their sources for this doctrine, but they developed it in a rather original way. The topics became a higher-level analysis of arguments which are non-valid from a purely formal point of view, but where it is none the less legitimate to infer the conclusion from the premiss(es). In this connection the topics give rise to a number of discussions about the form and the matter of arguments. Further the topic contribute to the elaboration of the important doctrine of the second intentions, i.e. higher-level concepts of the particular things. In some respects the topics may be said to form a link between formal and informal logic. The topics vanished as a part of logic at the end of the Middle Ages, perhaps because the medieval logicians never got rid of Boethius' claim to have compiled a complete list of the loci, which was an unlucky one. The topics does not have an exact parallel in modern formal logic, but some reflections on non-formal argumentation by recent authors contain certain resemblances to it. 相似文献

Polarization is a generalized feature of intellectual life. Few authors however have studied polarities as they actually occur in every day life and discourse. This paper proposes two hypotheses to account for the pervasiveness of polarities. The first relates to uncertainty. Almost everything that touches our lives is filled with irreducible uncertainty. As a rhetoric, polarization uses arguments from (future) consequences in order to manage the future. The second hypothesis relates to phenomenology: body and behavior incorporate tensions or dualistic properties which are easily reproduced in language and thinking. Polarized thinking helps people to imagine extremes so that they may better anticipate the spectrum of possibilities available for action. The article concludes with remarks on the dangers of (over)generalizing and universalizing particulars (or extremes) in polarity based argumentation. 相似文献

The main purpose of this paper is to explore the reasons Aristotle gives for being able to use rhetorical argumentation, which is obviously not a scientific mode of expression. This faculty which was condemned by Plato as lacking morality, is paradoxically regarded by Aristotle as necessary on moral grounds. For, according to him, it would be blameworthy to keep silent when being verbally assailed. The necessity of rhetoric is, however, more deeply founded. First, because justice has to be saved from its enemies in the City's courts of law. Secondly, because everyone has to be convicted to follow in practice the rules of the City's laws and such a conviction, in the case of the multitude, cannot be obtained by the means of scientific arguments. Thirdly and above all, because, in forensic disputes, characteristics of free political societies, the demagogic power, which regularly leads to tyrannical regimes, can only be avoided by the weapons of rhetoric. From these explanations, one does see that rhetoric, for Aristotle, seems to be the necessary substitute for ancient and traditional instruments securing obedience to legal justice, i.e. myths and pure constraint or coercion. In civilized and free political communities, rhetoric is required for civilization and freedom.

An appreciation of the ways in which clients and patients tell stories in psychotherapy is essential to an understanding of the therapeutic process. This paper reports findings arising from a programme of research into the analysis of patient narratives in psychotherapy sessions and diagnostic interviews. The focus of the current paper is on the analysis of the use of language in patient‐therapist interaction during the recounting in therapy of dream narratives. Dream‐telling follows certain rules of presentation that can be described as a set of specific rhetorical practices. The rhetoric of the dream‐teller reporting a dream is one of emotional distance, reflecting a narrative sequence which lacks a motivational framework. The report needs to be put into context by establishing a dialogue with the listener. The sharing of the dream with another, especially in the psychotherapeutic context, represents the dream‐teller's attempt to reproduce the dream experience. This attempt is made with reference to a responding and commenting other. The function — or dysfunction — of the assumption of hidden, non‐obvious, non‐recognisable wish‐fulfillment scenarios in patients' dreams is discussed. A method of working with dream material derived from narrative research is briefly described: the dramaturgical approach. This approach emphasises collaborative negotiation between client/patient and therapist, and combines the idea of free association with dream reconstruction and embedding the dream in current concerns, desires, and challenges. 相似文献

Abstract The erotic in clinical treatment, deeply embedded as it is in the transference-countertransference matrix, is delineated and explored in this paper. As we journey through Eros' mythic tradition, to Plato's symposium, and on to Freud's “Observations on Transference Love”, we discover and rediscover Eros' essentially paradoxical essence as both provocateur, dangerous “mischief maker” to cohesive force—a source of universal cohesion. Struggling with Eros' fundamental dialectics, we experience the rich potential of translating its “disruptive” reverberations into relational-dynamics. What has remained in the realm of the dangerous, an enemy to insight, the dread of acting out, is brought to light. We talk in complex ways of the unique impact one human being can have on another. This impact includes the erotic: a world of desire, longing, surrender; the wish for penetration, merger, intimacy; the fear of engulfment and ultimate rejection. 相似文献

Normative pragmatics can bridge the differences between dialectical and rhetorical theories in a way that saves the central insights of both. Normative pragmatics calls attention to how the manifest strategic design of a message produces interpretive effects and interactional consequences. Argumentative analysis of messages should begin with the manifest persuasive rationale they communicate. But not all persuasive inducements should be treated as arguments. Arguments express with a special pragmatic force propositions where those propositions stand in particular inferential relations to one another. Normative pragmatics provides a framework within which varieties of propositional inference and pragmatic force may be kept straight. Normative pragmatics conceptualizes argumentative effectiveness in a way that integrates notions of rhetorical strategy and rhetorical situation with dialectical norms and procedures for reasonable deliberation. Strategic effectiveness should be seen in terms of maximizing the chances that claims and arguments will be reasonably evaluated, whether or not they are accepted. Procedural rationality should be seen in terms of adjustment to the demands of concrete circumstances. Two types of adjustment are illustrated: rhetorical strategies for framing the conditions for dialectical deliberation and rhetorical strategies for making do with limitations to dialectical deliberation. 相似文献

This article is a Gadamer-Perelman's debate. The author points out the limits of the gadamerian's hermeneutic conception of philosophy and criticizes this conception from Perelman's new rhetoric point of view. Instead of speaking of truth as an ontological originary experience, the rhetorical foundation of philosophy allows us to say that in philosophy the important is the contrastation and the confrontation of criteria and that, for that reason, philosophy is above all characterized by discussibility.Philosophical argumentation, like juridical argumentation, constitutes applications, to different domains, of a theory of argumentation which we consider as a new rhetoric.By identifying this theory with the general theory of persuasive speech, which seeks to obtain the intellectual as well as the emotional adherence of an audience, no matter which, we state that all speeches which do not aspire to an impersonal validity proceed from rhetoric. Perelman,L'empire rhétorique, p. 177).But, if one does not admit that the philosophical thesis may be founded on evident intuitions, it will be necessary to reccur to argumentative technics to make them prevail. This paper examines the functions of narrative within legal argumentation. My purposes are these: 1) to repudiate common assumptions that differentiate argumentation and storytelling in the law; 2) to begin to theorize anew how legal argumentation functions; 3) to explore the difficulties of evaluating the law's argumentative narratives; and 4) to trace some of the anxiety that judges themselves reveal about their roles as storytellers. I conclude that narrative is necessary to law's claims to authority, even as it complicates our understandings about how legislative policy decisions produce effects, and even as judges themselves seek to mask its importance. 相似文献

This paper analyses the way in which discourse and argumentation may vary depending on participants educational level and gender. Men and women from three different educational levels (literacy, advanced level and university students) participated in discussion groups that debated about women and work, the sharing of housework and the way in which girls and boys are educated. The results showed important differences depending on participants educational level and gender. In general, the main differences were related to educational level, while gender tended to interact with educational level, as a moderating factor. 相似文献

The paper reacts against the strict separation between dialectical and rhetorical approaches to argumentation and argues that argumentative discourse can be analyzed and evaluated more adequately if the two are systematically combined. Such an integrated approach makes it possible to show how the opportunities available in each of the dialectical stages of a critical discussion have been used strategically to further the rhetorical aims of the speaker or writer. Islamisation project, I shall highlight the ways in which issues such as Malay rites, rituals and cultural practices, and
what constitutes bid’ah (sinful innovations) in Islam are elucidated. The works and sermons of three key Ulama in contemporary Malaysia—Nik Aziz, Mohd Asri, and Harussani Zakaria—shall be treated as case studies. Their attitude towards
other key markers of Malayness, such as the Malay Royalty and Malay language, and how they are negotiated in relation to Islam

This paper responds to two issues in interpreting George Berkeley’s Analyst. First, it explains why the text contains no discussion of religious mysteries or points of faith, despite the claims of the text's subtitle; I argue that the subtitle must be understood, and its success assessed, in conjunction with material external to the text. Second, it’s unclear how naturally the arguments of the Analyst sit with Berkeley’s broader views. He criticizes the methodology of calculus and conceptually problematic entities, and the extent to which they require one to bend the rules of classical mathematics. Yet, elsewhere, Berkeley’s opinion of classical mathematics and its intelligibility is low, and he defends a pragmatic approach to word meaning that should not find fault with so functionally successful a theory. The ad hominem intention of the text makes it difficult to discern to what extent Berkeley is committed to the sincerity of these criticisms. This component of the text is rarely discussed, but I argue that when trying to decide what Berkeley’s true position is in the Analyst, we should treat its ad hominem component as its primary intention. 相似文献

Because of the increasing number of man-made hazards in contemporary life, as well as the growing number of disastrous industrial accidents, interest in risk communication has burgeoned. Consequently, scholars and practitioners need to understand two of the more common responses to risk situations, the technical and democratic. This paper describes these two responses, identifies types of individuals likely to prefer each, and explains why, historically and sociologically, they are so intuitively compelling for many people. Arguing that both responses to risk situations are ultimately unconducive to rational discourse, the paper identifies problematic assumptions about communication that underlie both. The paper then sketches an alternative model of risk communication that recognizes the distinct features of communication in risk-ridden situations, describes ways in which communicators can identify characteristic tensions and goals in these situations, and specifies how to use research-supported heuristics for diagnosing the principal obstacles to their communicative goals and selecting the best strategies to address these obstacles. 相似文献

The thesis is defended that rhetoric is not, as is often said, a discipline which is hierarchically subordinate to dialectic. It is argued that the modalities of the links between rhetoric and dialectic must be seen in a somewhat different light: rhetoric and dialectic should be viewed as two complementary disciplines. On the basis of a historical survey of the views of various authors on the links between rhetoric and dialectic, it is concluded that efforts to establish clear boundaries or unequivocal conceptual or moral hierarchical relationships between the two disciplines have failed and that therefore, they must be conceived as being mutually dependent. 相似文献
