There have recently been a number of high profile political incidents, and legal cases, that raise questions about hate speech. At the same time, the tensions, and perceived conflicts, between religion and sexuality have become controversial topics. This paper considers the relationship between religious freedom, free speech and equality through an analysis of recent case law in Great Britain, Canada and the United States. The paper starts with a discussion of how conflicts between these values arise in areas such as hate speech and explores the differences between the European and US approach to this issue. In Council of Europe member states there is an increasing use of the criminal law to regulate hate speech. This paper argues that criminalisation of hate speech poses a distinct risk to the values of free speech and proposes alternative non-legal responses such as a greater use of cultural policy. The paper also explores a range of cases where the religion and sexual orientation conflict has arisen in areas such as the workplace. An analysis of these cases suggests that although there is no perfect resolution of this issue, it is possible to develop a set of principles that encourage a balance between the values of religious freedom, free speech and equality even in difficult situations where there is a conflict between religion and sexuality. The paper concludes with some practical recommendations for managing the tensions or conflicts between religious freedom, free speech and equality in liberal democracies.  相似文献

I take it that liberal justice recognises special protections against the restriction of speech and expression; this is what I call the Free Speech Principle. I ask if this Principle includes speech acts which might broadly be termed ‘hate speech’, where ‘includes’ is sensitive to the distinction between coverage and protection, and between speech that is regulable and speech that should be regulated. I suggest that ‘hate speech’ is too broad a designation to be usefully analysed as a single category, since it includes many different kinds of speech acts, each of which involves very different kinds of free speech interests, and may cause very different kinds of harm. I therefore propose to disaggregate hate speech into various categories which are analysed in turn. I distinguish four main categories of hate speech, namely (1) targeted vilification, (2) diffuse vilification, (3) organised political advocacy for exclusionary and/or eliminationist policies, and (4) other assertions of fact or value which constitute an adverse judgment on an identifiable racial or religious group. Reviewing these categories in the light of the justifications for the Free Speech Principle, I will argue that category (1) is uncovered by the Principle, categories (2) and (3) are covered but unprotected, and that category (4) is protected speech.  相似文献

An experiment was designed to determine whether and in what way gender makes a difference in the ratings of advertising spokes-characters. It was hypothesized and results confirmed that gender and product type affect the likability of spokes-characters and perceptions of target audience. A male spokes-character is perceived as more appropriate for a male-oriented product; however, a female spokes-character and a male product created the impression that the product was not quite so male oriented. It was also hypothesized that the spokes-character with the most positive ratings would be the most memorable. Results did not bear this out.  相似文献

People living with HIV (PLWH) may experience death anxiety (DA), which can be detrimental to quality of life. Posttraumatic growth (PTG), however, is antithetical to DA, with its positive attributes at odds with negative psychosocial outcomes. Previous research has not examined the buffering effect of PTG on the association between DA and quality of life. Therefore, in addition to the direct effects of DA and PTG on health-related quality of life (HRQoL), we investigated the moderating role of PTG on the relationship between DA and HRQoL among people living with HIV/AIDS (PLWH) in Nigeria. Using cross-sectional design and availability sampling method, we selected 201 outpatients (men, n?=?63, 31.3%, women, n?=?138, 68.7%, mean age?=?40.1, SD?=?10.5) managed for HIV/AIDS in a Nigerian tertiary healthcare institution. Death Anxiety Inventory-Revised, Posttraumatic Growth Inventory-Short Form, and Patient-Reported Outcome Quality of Life-HIV were used to access DA, PTG and HRQoL, respectively. Results showed that while adjusting for socio-demographic factors (age, gender, time since diagnosis and educational status), DA was associated with physical health, mental health and social relationships domains of HRQoL as well as overall HRQoL. In contrast, PTG did not evidence significant association with HRQoL dimensions and overall HRQoL. The moderation effect of PTG on the association between DA and HRQoL was not supported. Independent of PTG, alleviating DA may be an important target in terms of therapeutic intervention towards improving quality life of PLWH.

I defend the claim that Kant held a wide-scope view of hypothetical imperatives, against objections raised by Mark Schroeder [2005 Schroeder, Mark 2005. The Hypothetical Imperative? Australasian Journal of Philosophy 83/3: 35772.[Taylor &; Francis Online], [Web of Science ®] [Google Scholar]]. There is an important objection, now commonly known as the ‘bootstrapping’ problem, to the alternative, narrow-scope, view which Schroeder attributes to Kant. Schroeder argues that Kant has sufficient resources to reply to the bootstrapping problem, and claims that this leaves us with no good reason to attribute to Kant the wide-scope view. I show that Schroeder's Kantian reply to the bootstrapping problem cannot fully answer it. Schroeder also offers three main textual arguments for attributing to Kant the narrow-scope view: from Kant's claim that the moral imperative is unique in virtue of its categoricity, from Kant's distinction between ‘problematic’ and ‘assertoric’ hypothetical imperatives, and from Kant's conception of analyticity together with his claim that hypothetical imperatives are analytic. I argue that each of these views can be understood as cohering with the more plausible wide-scope view of hypothetical imperatives.  相似文献

ABSTRACT— Compared to adolescents with low exposure to smoking in movies, those with high exposure are about three times as likely to try smoking or become smokers. We have observed this effect in nationally representative samples using cross-sectional and longitudinal designs. This effect remains statistically significant after controlling for numerous other traditional risk factors, such as personality, parenting style, and sociodemographics. Indeed, the movie-smoking exposure effect on adolescent smoking initiation is greatest among those traditionally considered at lower risk for smoking, such as those low in sensation seeking and those whose parents do not smoke. In this article, we consider possible moderators and mediators of this important media effect as well as health-policy implications. The take-home message is that eliminating smoking in movies may prevent a substantial number of adolescents from smoking.  相似文献

Most people are skeptical of the claim that the expectation that a person would have a life that would be well worth living provides a reason to cause that person to exist. In this essay I argue that to cause such a person to exist would be to confer a benefit of a noncomparative kind and that there is a moral reason to bestow benefits of this kind. But this conclusion raises many problems, among which is that it must be determined how the benefits conferred on people by causing them to exist weigh against comparable benefits conferred on existing people. In particular, might the reason to cause people to exist ever outweigh the reason to save the lives of existing people?  相似文献

The Cross-Cultural Speech Act Realization Project (Blum-Kulka, House, & Kasper, 1989a) has identified five components of an apology speech act set: five strategies that speakers use to apologize. This study examines the effects of four of those strategies (illocutionary force indicating device, expression of responsibility, promise of forebearance, and offer of repair) on the judgments made by hearers about the speaker and about the apology. Each of the strategies is shown to have an independent effect in improving reactions to the speaker. Further, the magnitude of these effects appear to be roughly similar for each of the strategies. The things people say to apologize do seem to be effective in accomplishing the self-presentational goals of apologizers.  相似文献

The present study was designed to investigate the relationships among mindfulness, happiness, and the expression of pet peeves. Previous research has established a positive correlation between happiness and mindfulness, but, to date, no research has examined how each of these variables is related to complaining in the form of pet peeves. Four hundred ten male and female college students listed the pet peeves they had with a current or former relationship partner. They also completed measures of happiness, positive and negative affect, depression, mindfulness, relationship satisfaction, and satisfaction with life. Pet peeves were negatively correlated with relationship satisfaction, well-being, and mindfulness. Consistent with hypotheses, support was found for the mediating role of mindfulness in the relationship between happiness and pet peeves.  相似文献
