The perpetrator’s examination of his own criminal actions seems to be very important for the risk assessment by the German criminal justice and psychological and psychiatric experts. At the same time other risk factors like general dissociality, the structure of the future neighbourhood, the patterns of social bindings, and personal core competencies seem to be more important for the prevention of criminal recidivism. Anyway the analysis of one’s own criminal offence may enlighten the individual attitudes and behavioral problems and thus may become an important domain of cognitive restructuring. If a convict still denies his deed this not necessarily makes a parole impossible. Denial may indicate a general hostility against the law, but in other cases it is caused by overwhelming shame and indicates positive bindings to social norms.

Burnout is a process, in which dysfunctional interactions between a person and external stresses (professional, nonprofessional) play a central role in its development. It is accompanied by emotional and physical exhaustion, decreased productivity, and a negative attitude toward work, other stress factors, and people associated with work. Depressive disorders, anxiety disorders, other psychiatric and psychosomatic disorders, and physical and cognitive disorders are often observed as part of burnout. Differentiation from other (in particular psychiatric) diseases is mainly possible based on a history of a lengthy (months, years) process of development associated with external stress factors. This differentiation is essential to determine an appropriate, multiprofessional approach, in which drug treatment, psychotherapy, coaching, lifestyle modification, and methods of stress reduction are available and should be used in a coordinated manner.

Standards nichtstrafrechtlicher psychiatrischer Begutachtung

The introduction of the certificate for forensic psychiatry of the German Association of Psychiatry, Psychotherapy, Psychosomatics (DGPPN) in 2000 was a significant contribution to raising awareness of the formal and substantive requirements for forensic psychiatric evaluations and to develop a systematic quality improvement in forensic psychiatric expert services. By the special dominance of the certification in the field of penal law assessment, this proved to be problematic for many predominantly non-penal experts. This led to a requirement to develop a qualification for the non-penal expert opinions. In particular the increasing specialization of the psychiatric disciplines and the diversity of the legal issues and framework require a continuing education in the field of non-penal psychiatric assessments. Substantive and formal requirements are discussed and a continuous process of quality improvement and assurance is outlined. Last but not least a plea is made for close interdisciplinary exchange with the jurisprudence and the courts in the context of quality circles.

A variety of standardized instruments allows risk assessment based upon empirical data. This paper calls attention to the pitfalls immanent to the application of popular prognostic instruments (Violence Risk Appraisal Guide, Static-99, Historical Clinical Risk Management-20, Psychopathy Checklist-Revised). Psychopathological assessment, however, has not been superseded by standardized instruments but serves as a valuable addition in terms of an integrative approach.

Ohne Zusammenfassung Die folgende Abhandlung ist die bedeutend erweiterte Ausarbeitung eines Vortrages, welcher am 9. Januar 1929 in einer Allgemeinen Versammlung der Zoologisch-Botanischen Gesellschaft in Wien, am 15. Oktober 1929 vor der Gesellschaft für empirische Philosophie in Berlin und am 30. Oktober 1929 in der Kantgesellschaft Karlsruhe gehalten wurde. Bei der Ausarbeitung wurde vor allem Bedacht genommen, Tatsachen und Theorien, die sich bereits in des Verf.s „Kritischer Theorie der Formbildung” (Schaxels Abh. z. th. B. 27, Berlin 1928) dargestellt finden, nur kurz zu behandeln, andererseits aber das genannte Werk hier durch die Verarbeitung der dort noch nicht behandelten Ergebnisse zu erg?nzen. Auch in die Literaturangabe wurden im allgemeinen nur an jenem Orte nicht angegebene Werke aufgenommen. Auf das erw?hnte Buch, das eine umfassende, kritische Darstellung der Theorien der Formbildung zum Ziele hat, sei hier ein für allemal hingewiesen.     

Standards der sozialmedizinischen Leistungsbegutachtung in der Psychosomatischen Medizin und Psychotherapie

Sociomedical problems are playing an increasingly important role in both psychosomatic medicine and psychotherapy and in psychiatry. The present article examines the standards relating to content and method in sociomedical assessments, primarily in the discipline of psychosomatic medicine and psychotherapy. The focus is on the assessment of performance, highlighting the fact that performance and performance deficits cannot primarily be derived from the medical diagnosis; instead, psychosocial variables that influence the processes of dealing with disease in particular affect the actual performance status. The article pays particular attention to aspects that aggravate or dissimulate performance competence. Finally, the principles of integrating the various findings and results that are incorporated into the assessment report are outlined.
