According to John Rawls's ideal of liberal public reason, comprehensive moral, religious and philosophical doctrines should play no more than an auxiliary or marginal role in the political life of constitutional democracies. David Reidy has recently claimed that since liberal public reason is incomplete, comprehensive doctrines, and non-public reasons, must play a wider role than Rawls admits. In response, I argue that Reidy's arguments do not establish that liberal public reason is incomplete. Furthermore, even if the substantive values embodied in liberal public reason were insufficient to determine certain fundamental decisions, such indeterminacy need not be eliminated by recourse to comprehensive doctrines. In this paper I argue that in order to secure the commitment of believers in reasonable comprehensive doctrines to political liberalism a third principle of justice needs to be adopted in the Original Position. Rawls acknowledges that neutral legislation by the liberal state may negatively affect some reasonable comprehensive doctrines, and I offer a third principle of justice to help alleviate this problem. This principle, which I believe is in keeping with the United States constitutional history especially where church-state relations are concerned, maintains that a constitutional regime should, insofar as possible, avoid adopting rules with harmful effects upon those comprehensive doctrines which satisfy the conditions of reasonable pluralism.  相似文献

Modem moral and political theorists make a sharp separation between justice and civic friendship, arguing that justice deals with the fair terms of co-operation in the social sphere whereas civic friendship is about an individual's contingent affections in the political domain. In addition, they also argue that the principles of justice must determine the nature and function of civic friendship in modem liberal society. Even though the historical origin of the above view can be traced to the writings of Immanuel Kant (2007), John Rawls provides us with its most cogent formulation in recent times. In his book A Theory of Justice (1971), Rawls argues that the considerations of right are prior to the considerations of good; therefore the principles of justice must determine the limits of civic friendship. Against RaMs, I argue that justice and civic friendship are intrinsically connected and that they cannot be separated in experience. I draw upon Aristotle's theory of virtue to strengthen my arguments. Following Aristotle, I show that both justice and friendship are virtues and that all virtues hold together. The Aristotelian coherence of virtues, I argue, can be useful in redefining the obligations of justice and civic friendship in contemporary liberal democracies.  相似文献

Contextualist moral philosophers criticise hands-off liberal theories of justice for abstracting from the cultural context in which people make choices. Will Kymlicka and Joseph Carens, for example, demonstrate that these theories are disadvantageous to cultural minorities who want to pursue their own way of life. I argue that Pierre Bourdieu's critique of moral reason radicalises contextualist moral philosophy by giving it a sociological turn. In Bourdieu's view it is not enough to provide marginalised groups or subgroups with equal access to public institutions and specific cultural rights—in some cases this may in fact be detrimental. He contends that scientists, politicians and other intellectuals have a duty to take seriously the social presuppositions of free deliberate choice and public opinion and to support cultural minorities with instruments to liberate themselves from their often precarious situation.  相似文献

This essay explores the degree to which public reason can sustain political liberalism's commitment to justice and pluralism without attending to the role of what Jeffrey Stout calls “cultural inheritance” in shaping and justifying political commitments. At issue is whether public reason is the best resource for guiding conversations on political matters that are enmeshed in religious commitments and moral beliefs. Unless public reason can account for cultural inheritance, and foster a deliberative context in which political actors might grapple with the relationship between overlapping political claims and comprehensive doctrines, public reason will remain narrow and inadequate in a contemporary world where epistemic diversity is increasingly at odds with political liberalism's normative model of social cooperation and public deliberation.  相似文献

I examine the role of the burdens of judgement argument in Rawls's defence of the claim that liberalism cannot be based on a comprehensive doctrine. According to Rawls, the burdens of judgement make it very unlikely that most individuals can agree on anything more than a purely political morality. I argue that the argument does not succeed. I concentrate on the last three burdens which are specifically about problems of reaching normative agreement. Firstly, I argue that Rawls's claim that modern society inevitably gives rise to a diversity of values is not convincing since for every claim of divergence a counterclaim of convergence can be provided. Secondly, I provide examples of plausible agreement on partial comprehensive doctrines. Thirdly, I argue that liberalism must rely on at least one partial comprehensive doctrine, namely, the value of autonomous choice. I conclude that the burdens of judgement argument does not demonstrate that liberalism cannot be based on comprehensive moral foundations.  相似文献

Abstract:  In this paper, I argue that John Locke's account of knowledge coupled with his commitments to moral ideas being voluntary constructions of our own minds and to divine voluntarism (moral rules are given by God according to his will) leads to a seriously flawed view of moral knowledge. After explicating Locke's view of moral knowledge, highlighting the specific problems that seem to arise from it, and suggesting some possible Lockean responses, I conclude that the best Locke can do is give us a trivial account of moral knowledge which cannot avoid problems with subjectivity and relativism.  相似文献

In this paper, I question the view that liberal perfectionism and neutrality are mutually exclusive doctrines. I do so by criticizing two claims made by Jonathan Quong. First, I object to his claim that comprehensive anti-perfectionism is incoherent. Second, I criticize his claim that liberal perfectionism cannot avoid a paternalist stance. I argue that Quong’s substantive assumptions about personal autonomy undermine both of his arguments. I use the discussion of Quong to argue that the standard assumption in liberal theory about mutual exclusivity of liberal perfectionism and neutrality needs to be reconsidered, and I show why the argument about the convergence of perfectionism and neutrality makes conceptual sense.  相似文献

John Rawls has recently shifted to a "freestanding" or "political" liberalism from his earlier "comprehensive" and "moral" liberalism. I argue that this move is based on several key features that make Rawlsian liberal pluralism indelibly postmodern. Two of the more obvious features are the denial of foundationalism and the rejection of a truth status for public-sphere justifications of the basic political structure. In conclusion, I suggest that a late-modern postliberalism is a viable alternative. This revised version was published online in August 2006 with corrections to the Cover Date.  相似文献

MacIntyre’s critique of liberalism relies crucially on a distinctive moral particularism, for which morality and rationality are fundamentally tradition-constituted. In light of this, some have detected in his work a moral relativism, radically in tension with his endorsement of a Thomist universalism. I dispute this reading, arguing instead that MacIntyre is a consistent universalist who pays due attention to the moral-epistemic importance of traditions. Analysing his teleological understanding of rational enquiry, I argue that this approach shows how it is possible, dialectically, to reconcile the particularity of our starting-points with the assertion of universal truths. What MacIntyre offers, I contend, is a moral universalism that avoids the pitfalls of its liberal counterpart, and invites an important meta-theoretical shift with respect to the scope for toleration and social critique and toleration in contemporary pluralist society.  相似文献

Ethical relativism is the thesis that ethical principles or judgments are relative to the individual or culture. When stated so vaguely relativism is embraced by numerous lay persons and a sizeable contingent of philosophers. Other philosophers, however, find the thesis patently false, even wonder how anyone could seriously entertain it.
Both factions are on to something, yet both miss something significant as well. Those who whole-heartedly embrace relativism note salient respects in which ethics is relative, yet erroneously infer that ethical values are noxiously subjective. Those who reject relativism do so because they think ethics is subject to rational scrutiny, that moral views can be correct or incorrect. But in rejecting objectionable features of relativism they overlook significant yet non-pernicious ways in which ethics is relative.
In short, each side harps on the opponent's weaknesses while overlooking its own flaws. That is regrettable. We are not forced to choose between relativism and rationality. We can have both. There are ways in which ethical principles and behavior vary legitimately from culture to culture and individual to individual. That we must recognize. However this in no way suggests we cannot reason about ethics. Rather we should strive for a rational yet relativistic ethic which emphasizes the exercise of cultivated moral judgment rather than the rote application of extant moral rules. Though moral relativism has had its supporters over the years, it is not a dominant position in philosophy. I will argue here, though, that the view is an attractive position. It evades some hardcore challenges that face absolutism, and it is reconcilable with an appealing emotivist approach to moral attitudes. In previous work, I have offered considerations in favor of a version of moral relativism that I call “perspectivalism.” These considerations are primarily grounded in linguistic data. Here I offer a self‐standing argument for perspectivalism. I begin with an argument against moral absolutism. I then argue that moral terms, such as ‘wrong’ and ‘right’, require for their application that the moral judge instantiate particular affective states, and I use this claim to provide further defense of moral relativism.  相似文献

Rationalism in political philosophy is the view that politics should be governed by moral principles and that those principles can and should be justified independently of the situations and circumstances that make up political reality. This traditional view of political philosophy implies that the meaning of right political action is determined by moral principles the rational authority of which derives from abstract philosophical reasoning, not from the situations and circumstances that are the substance of political reality. In this essay I argue that rationalist moralities must presuppose the understanding of particular situations and circumstances for their meaningful and correct interpretation. This means, I argue, that the rightness of political judgement and action is immanent in particular situations, not in abstract moralities. And this, I argue, suggests a shift from the traditional view of political society as the embodiment of abstract principles, towards a view of political society as the embodiment of the activity of situational judgement. A society worth hoping for, then, is one in which we can live in the light of our understanding of the situations and circumstances that are the substance of everyday life, rather than in the shadow of abstract moralities. Such a society would be sensitive to the particularities and complexities of political reality, but at the same time it does not succumb to moral relativism and skepticism.  相似文献

Abstract:  It appears that one of the aims of John Rawls' ideal of public reason is to provide people with good reason for exercising restraint on their nonpublic reasons when they are acting in the public political arena. I will argue, however, that in certain cases Rawls' ideal of public reason is unable to provide a person with good reason for exercising such restraint, even if the person is already committed to Rawls' ideal of public reason. Because it is plausible to believe that such cases are widespread, the issue I am raising represents a serious problem for Rawls' account of public reason. After posing this problem, I consider potential responses on behalf of Rawls' view, and I reply to those responses. The moral of this story, as I see it, is that the kind of duty an ideal of public reason aims to place on citizens must be more modest than Rawls supposes.  相似文献

This paper comprises a critical examination of foundationalist conceptions of comprehensive doctrines in the religion in politics-debate. I argue that John Rawls, the towering figure of this debate, operates with a foundationalist conception of comprehensive doctrines that has shaped the debate’s view of relevant alternatives (often referred to as exclusivism and inclusivism). However, there are several problems with foundationalist conceptions, and the most serious is that they are empirically inadequate in relation to modern Western societies. I conclude that participants of the exclusivist/inclusivist debate ought to look closer at alternative, non-foundationalist conceptions, and I supply a brief sketch of one such approach, inspired by American pragmatism.  相似文献

My aim is to defend Winch's view that morality must be autonomous from religion. I defend him from Mounce's criticism, who claims that unless morality is supported by divine law, moral relativism cannot be avoided. Winch considers the Samaritan's behaviour and says (i) that the background of divine law is irrelevant to the parable; (ii) that we do not need divine law to understand the Samaritan's impossibility to ignore the victim; (iii) and that the absolute moral ought requires no external support provided by religion. Winch adds that God cannot make any moral demand on humans, and thus He cannot reward them with salvation or punish them, without turning Himself into a means of moral corruption. All this spells the end of religion at least as far as the relation between God and man's moral and spiritual life is concerned; while relativism is shown to be morally corrupt and internally inconsistent.  相似文献

Educational neutrality states that decisions about school curricula and instruction should be made independently of particular comprehensive doctrines. Many political philosophers of education reject this view in favor of some non-neutral alternative. Contrary to what one might expect, some prominent liberal neutralists have also rejected this view in parts of their work. This paper has two purposes. The first part of the paper concerns the relationship between liberal neutrality and educational neutrality. I examine arguments by Rawls and Nagel and argue that some of the same arguments they use to justify liberal neutrality also justify educational neutrality; thus, if we accept these arguments for liberal neutrality, we should also accept educational neutrality. The second part of the paper defends educational neutrality against objections that it is impossible and objections that it is undesirable.  相似文献

While most people may initially agree that justice is fairness,as an evangelical Protestant I argue that, for many religiouscomprehensive doctrines, the Rawlsean model does not possessthe resources necessary to sustain tolerance in moral decisionmaking. The weakness of Rawls's model centers on the reasonablepriority of convictions that arise from private comprehensivedoctrines. To attain a free and pluralistic society, peopleneed resources sufficient to provide reasons to tolerate actionsthat are otherwise intolerable. In addition to arguing for thedeficiency of the Rawlsean political model, I sketch out a preliminarymodel of ambassadorship that offers religious communities, andin particular Protestant evangelicals, the necessary resourcesto engage the broader society tolerantly while maintaining theirreligious convictions. As a citizen of the church and a memberof another kingdom, Christians serve as ambassadors to thosewho are not of the heavenly kingdom. I take this model to bemore ambitious than that of a sojourner who lives in the landbut is isolated as much as possible from society, while moremodest than that of reconstructionists who seek to implementtheir own sacred law on all others.  相似文献

Abstract: Kant has argued that moral requirements are categorical. Kant's claim has been challenged by some contemporary philosophers; this article defends Kant's doctrine. I argue that Kant's claim captures the unique feature of moral requirements. The main arguments against Kant's claim focus on one condition that a categorical imperative must meet: to be independent of desires. I argue that there is another important, but often ignored, condition that a categorical imperative must meet, and this second condition is crucial to understanding why moral requirements are not hypothetical. I also argue that the claim that moral requirements are not categorical because they depend on desires for motivation is beside the point. The issue of whether moral requirements are categorical is not an issue about whether moral desires or feelings are necessary for moral motivation but are rather an issue about the ground of moral desires or moral feelings. Moral requirements are categorical because they are requirements of reason, and reason makes moral desires or feelings possible.  相似文献
