The Patient Self-Determination Act

The Patient Self-Determination Act was signed into law in November 1990 to take effect in December 1991. The Act marked Congress's first legislative action related to life-sustaining medical treatment. It requires every health care facility that participates in Medicare or Medicaid to inform adult patients about advance directives. McCloskey discusses the legislative process leading to passage of the Act; pro-life groups' opposition to federal support of advance directives; provider groups' skepticism toward the perceived administrative burden of federal intervention; and professor Alexander Capron's preference for existing voluntary efforts over premature legislation.     

The Jazz Solo as Virtuous Act

This article presents a new aesthetic of the improvised jazz solo, an aesthetic grounded in the premise that a solo is an act indivisible from the actor (the soloist) and the context. The solo's context includes the local and large‐scale conventions of jazz performance as well as the soloist's other work. The theme on which a solo is based serves not as a “work,” but as part of the solo's stylistic context. Knowledge of this context inheres directly into proper apprehension of the musical surface; it does not constitute a separate plane of appreciation. I begin by examining the improvisational error. This examination supports the position that the solo is an act, not a work. From this position, I detail a new aesthetic of the improvised solo, grounded in the soloist's virtues. In a successful solo, the soloist's actions display a balance of two aesthetic “virtues”: compositional skill and a commitment to the spirit of improvisation. Compositional skill manifests in a solo as coherence. The improvisational spirit manifests as courage, spontaneity, and related qualities. These virtues often come into conflict; each soloist negotiates this conflict differently.     

The Balancing Act: Concurrent Parent-Child Work

This article examines some of the challenges of parent work and the historical roots for why parent work has assumed a more marginal role in the treatment of children. The author contends that parent work is critical in the overall structure of a child’s treatment. The article describes concurrent parent psychotherapy, a psychoanalytically informed approach developed by Jack and Kerry Novick that emphasizes dual goals, two systems of self-regulation, and a framework for building and maintaining multiple therapeutic alliances. These principles are illustrated with a discussion of concurrent work with parents and their young son, who was prone to explosive behavior in school. Addressing parenthood as a developmental phase, the article covers typical anxieties parents bring to treatment and shows how the ongoing involvement of the boy’s parents helped him develop and consolidate inner controls and a more benign superego.

The Act Frequency Approach to the study of impulsivity

Though widely used in research on personality, the impulsivity construct is far from being well defined. Different ways of measuring and operationalizing this construct have led to contradictory empirical results. Nor is it clear where impulsivity belongs in multidimensional personality models. For instance, in Eysenck's original scheme it is treated as a component of extroversion, whereas in Costa and McCrae's (1992) NEO model it is a facet of the neuroticism dimension. In this study, we used Buss and Craik's Act Frequency Approach to investigate the components of impulsivity and its relationships (at both internal and manifested structure levels) with extroversion and neuroticism. A set of acts was identified, the frequency of commission of which correlated with other measures of impulsivity (especially its motor and cognitive aspects), and correlated better with neuroticism than with extroversion.

The DIAGNOSER project: Combining assessment and learning

DIAGNOSER is an Internet-based tool for classroom instruction. It delivers continuous formative assessment and feedback to high school physics students and their teachers about the correct and incorrect concepts and ideas the students may hold regarding physical situations. That is, it diagnoses misconceptions that underlie wrong answers of students, such as a confusion of velocity with acceleration. We use data about patterns of student responses, particularly consistency of errors from question to question, to improve the system’s understanding of student concepts.

The Origins and Legacy of the Civil Rights Act of 1964

Purpose

This paper provides a historical review of the origins and legacy of the 1964 Civil Rights Act through the lens of the African American Civil Rights and the Women’s Rights Movements.

Design/Methodology/Approach

The historical narrative was developed using psychological, historical, and legal source material.

Findings

While the Civil Rights Act did not immediately change the landscape of equality in the American workplace, it signaled a fundamental shift in the treatment of racial and gender diversity. In concert with other social, legal, and political shifts, it paved the way for progress on issues like affirmative action, pregnancy discrimination, and sexual harassment.

Implications

Without an understanding of the historical development and consequences of the Civil Rights Act, it is easy to lose sight of how the act has shaped the understanding of equality in the American workforce. Further, the way in which rights movements evolved alongside each other illuminates a need to focus not only on equality between majority and minority groups but also on issues of equality among minority groups.

Originality/Value

Previous reviews of the Civil Rights Act and rights movements tend to focus narrowly on one issue or group, and approach that concern from a single academic discipline. In contrast, we provide a review of the roots and consequences of the Civil Rights Act based on the developments of two rights movements, and draw from sources in psychology, history, political science, and legal perspectives to provide a broader picture of this landmark legislation.     

Combining Expectancies

Five experiments examine the combined effects of spatial and non-spatial cues on the latency of an orientation judgement. In Experiment 1 an interaction between position and form expectancies is observed: There is an unusual delay in response time (RT) when expectancies mismatch—that is, when an unexpected (uncued) form appears at an expected (cued) position or an expected (cued) form appears at an unexpected (uncued) position. This interaction is inconsistent with the spatial spotlight model's prediction that position and form expectancy effects will be additive. The position-form interaction is eliminated when target position discriminability is made difficult by adding a distractor item at the location not containing a target (Experiment 2) or by decreasing the validity of the positional cue (Experiment 3). Decreasing the validity of the form cue has no effect on the interaction. The mismatching expectancy interaction is not unique to combinations of position and form—it is also observed when temporal (Experiment 4) and colour (Experiment 5) expectancies are combined with form expectancies. The effects of advance knowledge of position therefore suggest no special status for location compared to other stimulus attributes. Thus, at least for combined expectancies, the notion of a uniquely spatial mental spotlight seems unjustified. It is hypothesized that expectancy interactions may reflect a hierarchical crosstalk relation between dimensions of encoding.     

To Act or Not to Act: Nonconsequentialism in Environmental Decision-Making

Research on environmental-decision making is usually based on utilitarian models, which imply that people's decisions are only influenced by the outcomes. This research provides evidence for values and moral positions that reflect nonconsequentialist rather than consequentialist views. In doing this, this article refers to “sacred values,” which are values that are seen as not-substitutable and nontradable. Two studies were designed to examine evidence for sacred values and their role on act versus omission choices within the environmental domain. The studies revealed that sacred values were closely associated with preferences for actions, trade-off reluctance, deontological focus, and position of moral universalism. The results suggest that it is important to account for sacred values and nonconsequentialist views in environmental decision-making research.     

The Annunciation and Nativity: Undoing the Sinful Act of Eve

Employing the writings of Bernard of Clairvaux (1090–1153) and Bonaventure (1217–1274), I will first examine the theology of the Annunciation. I will examine the Annunciation through the specific hermeneutical lens employed by Bernard and Bonaventure themselves, that is, the mystery of the Annunciation can only be clearly perceived and properly understood when it is viewed as the undoing of the sinful work of Eve. Moreover, I want to argue that, since the Annunciation is the foundational Marian mystery, all other mysteries pertaining to Mary must equally be viewed through this same hermeneutical lens, that is, as the undoing of Eve's sinful act. With this principle in mind, I will conclude by attempting to advance the thought of Bernard and Bonaventure, in a manner that they did not, with regards to the Nativity, that is, that the Nativity must also be seen as the undoing of the sinful action of Eve.
