The example of a political leader who has to decide whether he would allow the torture of a suspect in order to get information about a ticking bomb has become notorious in ethical discussions concerning the tension between moral principles and political necessity. The relation between these notions must be made as clear as possible before a sincere moral evaluation of ticking bomb situations can be given. The first section of this article considers whether the concept of political obligation is different from moral and legal obligations or whether it is a special kind of moral obligation. In the second section, the idea that the dirty hands problem confronts us with the ambiguities of moral life is rejected because it would imply an untenable moral paradox. The thesis that is developed is, namely, if there is such a thing as political necessity, it must be some form of moral obligation. The third section analyses the concept of political necessity and concludes that it cannot overrule basic moral principles and that the international legal prohibition of torture must be considered to be a categorical imperative. In the last section, these ideas concerning political and moral necessity are brought in against the defence of torture, which should be tolerated in the ‘War on Terror’. There it will be argued that the use of the ticking bomb argument not only supports a highly hypocrite political practice but is also deceptive as a moral and political argument.  相似文献

Properly understood, Kant’s moral philosophy is incompatible with constitutivism. According to the constitutivist, being subject to the moral law cannot be a matter of free choice, and failure to comply with it is to be understood as a deficiency in one’s integrity as an intentional agent. I reconstruct Kant’s arguments to the conclusion that immorality, moral evil, consists in choosing to give one’s unity as an intentional agent supremacy over the moral law, and that one’s being subject to the moral law must be one’s own free choice. And I explain how Kant’s doctrine of radical evil, according to which we cannot be subject to the moral law without actually being morally evil, protects this conclusion from entailing the denial of the unconditionally binding character of moral principles, which character constitutivists correctly identify as the central concern of Kant’s – or any – moral philosophy.  相似文献

Emotions play a crucial role in moral behavior. The present paper does not contest this point but argues that qualifications of certain feelings such as shame and guilt as moral emotions should not exclusively be based on a proximal analysis of their function. A proximal analysis details how moral emotions produce moral behavior. Emotions are qualified as moral when they are elicited by concerns for others rather than the self and produce prosocial action tendencies. Although researchers have acknowledged that moral emotions may also have an ultimate function that details why it is in the individual interest that these moral effects occur, they have neglected to translate such ideas into testable hypotheses. Using guilt and shame as an example, we show how an analysis of ultimate functions accommodates recent findings, which contest the view that guilt is more moral than shame and provides new insights as to when and why moral emotions will produce moral effects.  相似文献

Belief in moral luck is represented in judgements that offenders should be held accountable for intent to cause harm as well as whether or not harm occurred. Scores on a measure of moral luck beliefs predicted judgements of offenders who varied in intent and the outcomes of their actions, although judgements overall were not consistent with abstract beliefs in moral luck. Prompting participants to consider alternative outcomes, particularly worse outcomes, reduced moral luck beliefs. Findings suggest that some people believe that offenders should be punished based on the outcome of their actions. Furthermore, prompting counterfactuals decreased judgements consistent with moral luck beliefs. The results have implications for theories of moral judgement as well as legal decision making.  相似文献

The importance of including cultural perspectives in the study of human cognition has become apparent in recent decades, and the domain of moral reasoning is no exception. The present review focuses on moral cognition, beginning with Kohlberg's model of moral development which relies heavily on people's justifications for their judgments and then shifting to more recent theories that rely on rapid, intuitive judgments and see justifications as more or less irrelevant to moral cognition. Despite this dramatic shift, analyses of culture and moral decision-making have largely been framed as a quest for and test of universal principles of moral judgment. In this review, we discuss challenges that remain in trying to understand crosscultural variability in moral values and the processes that underlie moral cognition. We suggest that the universalist framework may lead to an underestimation of the role of culture in moral reasoning. Although the field has made great strides in incorporating more and more cultural perspectives in order to understand moral cognition, theories of moral reasoning still do not allow for substantial variation in how people might conceptualize the domain of the moral. The processes that underlie moral cognition may not be a human universal in any simple sense, because moral systems may play different roles in different cultures. We end our review with a discussion of work that remains to be done to understand cultural variation in the moral domain.  相似文献

I develop resources from Hume to account for moral knowledge in the qualified sense developed by Bernard Williams, according to which the proper application of thick ethical terms constitutes moral knowledge. By applying to moral discernment the criteria of the good aesthetic critic, as explained in Hume's “Of the Standard of Taste”, we can see how Humean moral knowledge might be possible. For each of these criteria, an analogous trait would contribute to moral discernment. These traits would enable moral judges to distinguish valid from invalid uses of thick moral terms. The deliverances of such judgments constitute mitigated moral knowledge, as opposed to knowledge in the stricter sense that Hume clearly says cannot be had of moral distinctions. This account has the potential to explain how moral judgments may be valid or invalid without appealing to unique operations of the understanding and how moral knowledge might escape the threat, identified by Williams, of reflective destruction.  相似文献

At first glance, one of the most obvious places to look for moral progress is in individuals, in particular in moral development from childhood to adulthood. In fact, that moral progress is possible is a foundational assumption of moral education. Beyond the general agreement that moral progress is not only possible but even a common feature of human development things become blurry, however. For what do we mean by ‘progress’? And what constitutes moral progress? Does the idea of individual moral progress presuppose a predetermined end or goal of moral education and development, or not? In this article we analyze the concept of moral progress to shed light on the psychology of moral development and vice versa; these analyses are found to be mutually supportive. We suggest that: moral progress should be conceived of as development that is evaluated positively on the basis of relatively stable moral criteria that are the fruit and the subject of an ongoing conversation; moral progress does not imply the idea of an end-state; individual moral progress is best conceived of as the development of various components of moral functioning and their robust integration in a person’s identity; both children and adults can progress morally - even though we would probably not speak in terms of progress in the case of children - but adults’ moral progress is both more hard-won and to a greater extent a personal project rather than a collective effort.  相似文献

Moral abolitionists recommend that we get rid of moral discourse and moral judgement. At first glance this seems repugnant, but abolitionists think that we have overestimated the practical value of our moral framework and that eliminating it would be in our interests. I argue that abolitionism has a surprising amount going for it. Traditionally, abolitionism has been treated as an option available to moral error theorists. Error theorists say that moral discourse and judgement are committed to the existence of moral properties, and that no such properties exist. After error theory is established, abolitionism is one potential way to proceed. However, many error theorists suggest that we retain moral discourse as a sort of fiction. I evaluate some attractions of both fictionalism and abolitionism, arguing that abolitionism is a plausible position. No one doubts that error theorists can be abolitionists. However, what has gone largely undiscussed is that it is open to others to be abolitionists as well. I argue that moral realists of a metaphysically robust sort can and perhaps should be abolitionists. ‘Realist abolitionism’ makes for a surprisingly neat theoretical package, and I conclude that it represents an interesting new option in the theoretical landscape.  相似文献

According to moral sentimentalism, there are close connections between moral truths and moral emotions. Emotions largely form our moral attitudes. They contribute to our answerability to moral obligations. We take them as authoritative in guiding moral judgement. This role is difficult to understand if one accepts a full-blown moral realism, according to which moral truths are completely independent of our emotional response to them. Hence it is tempting to claim that moral truths depend on our emotional responses. I outline a problem for this view: we are adamant that, if our moral sentiments were different, things would be the same, morally speaking. Moral truth does not seem to counterfactually depend on moral sentiments. I show how this independence can be reconciled with the role of moral sentiments in guiding our moral outlook. I draw on Yablo’s distinction between response-dependent and response-enabled properties. I propose that moral truths are response-enabled: their supervenience base does not include anything about our emotions. Hence they do not counterfactually depend on changes in our emotional response. However, their factual supervenience base being naturally ineligible, it is ultimately our response that enables them to play their role as an independent moral compass.  相似文献

It is widely acknowledged that moral principles are not sufficient to guide moral thought and action: they need to be supplemented by a capacity for judgement. However, why can we not rely on this capacity for moral judgement alone? Why do moral principles need to be supplemented, but are not supplanted, by judgement? So-called moral particularists argue that we can, and should, make moral decisions on a case-by-case basis without any principles. According to particularists, the person of moral judgement is a person of empathy, sensibility and virtue, rather than a person of principle. In this paper I argue that this is a false dichotomy. The person of good moral judgement is a person of principle. I propose that we think of moral principles as internalised long-term commitments that form our moral character and sensitivity, and, as such, are constitutive of moral judgement.  相似文献

Many moral philosophers in the Western tradition have used phenomenological claims as starting points for philosophical inquiry; aspects of moral phenomenology have often been taken to be anchors to which any adequate account of morality must remain attached. This paper raises doubts about whether moral phenomena are universal and robust enough to serve the purposes to which moral philosophers have traditionally tried to put them. Persons’ experiences of morality may vary in a way that greatly limits the extent to which moral phenomenology can constitute a reason to favor one moral theory over another. Phenomenology may not be able to serve as a pre-theoretic starting point or anchor in the consideration of rival moral theories because moral phenomenology may itself be theory-laden. These doubts are illustrated through an examination of how moral phenomenology is used in the thought of Ralph Cudworth, Samuel Clarke, Joseph Butler, Francis Hutcheson, and Søren Kierkegaard.  相似文献

Are there good grounds for thinking that the moral values of action are to be derived from those of character? This ‘virtue ethical’ claim is sometimes thought of as a kind of normative ethical theory; sometimes as form of opposition to any such theory. However, the best case to be made for it supports neither of these claims. Rather, it leads us to a distinctive view in moral epistemology: the view that my warrant for a particular moral judgement derives from my warrant for believing that I am a good moral judge. This view seems to confront a regress-problem. For the belief that I am a good moral judge is itself a particular moral judgement. So it seems that, on this view, I need to derive my warrant for believing that I am a good moral judge from my warrant for believing that I am a good judge of moral judges; and so on. I show how this worry can be met, and trace the implications of the resulting view for warranted moral judgement.  相似文献

Evolutionary accounts of the origin of human morality may be speculative to some extent, but they contain some very plausible claims, such as the claim that ethics evolved as a response to the demands of group living. Regarding the phenomenon of moral progress, it has been argued both that it is ruled out by an evolutionary approach, and that it can be explained by it. It has even been claimed that an evolutionary account has the potential to advance progress in the moral domain. This paper explores the complex relationship between evolutionary explanations of morality and the possibility of moral progress. It seeks to answer the question as to what these explanations are able to tell us about the possibility of moral progress and the ways in which such progress can be achieved. It is argued that evolutionary explanations can inform moral education and other forms of moral enhancement, and that increased evolutionary knowledge figures among the changes in the circumstances of morality that can lead to moral progress. Evolutionary explanations can show us certain limits to the possibility for humans of progressing morally as well as certain enabling conditions. It is argued that both aspects – enhancement and changes in the circumstances – are equally important for the achievement of moral progress. This is illustrated by means of two examples of areas in which moral progress seems possible: our relationship towards the distant poor and our relationship towards non-human animals.  相似文献

Abstract. We can usefully draw an analogy between ethics and science, despite the significant differences between them. We can then see the ways in which moral theories can indeed be "tested," not by empirical experience but by moral experience. This can be expected to lead to rival moral theories, but in science also we have rival theories. I argue that we should demand more than coherence of our moral theories, as we do of our scientific theories. I try to show how the "testing" of moral theories can be carried out and how this can allow us to accept some moral theories as valid.  相似文献

In this article, I present a neo‐Confucian answer, by Cheng Hao and Cheng Yi, to the question, “Why should I be moral?” I argue that this answer is better than some representative answers in the Western philosophical tradition. According to the Chengs, one should be moral because it is a joy to perform moral actions. Sometimes one finds it a pain, instead of a joy, to perform moral actions only because one lacks the necessary genuine moral knowledge—knowledge that is accessible to every common person as long as one makes the effort to learn. One should make the effort to learn such knowledge—to seek joy in performing moral actions—because to be moral is a distinguishing mark of being human. This neo‐Confucian answer seems to be egoistic, as its conception of motivation for morality is based on self‐interest: to seek one's own joy. However, since it emphasizes that one's true self‐interest is to seek joy in things uniquely human, which is to be moral, self‐interest and morality become identical; the more a person seeks one's self‐interest, the more moral the person is, and vice versa.  相似文献

Among the available metaethical views, it would seem that moral realism—in particular moral naturalism—must explain the possibility of moral progress. We see this in the oft-used argument from disagreement against various moral realist views. My suggestion in this paper is that, surprisingly, metaethical constructivism has at least as pressing a need to explain moral progress. I take moral progress to be, minimally, the opportunity to access and to act in light of moral facts of the matter, whether they are mind-independent or -dependent. For the metaethical constructivist, however, I add that moral progress ought also mean that agents come to be or could come to be motivated to act in light of the right kind of moral judgments. Together I take this to mean that, for all forms of constructivism, moral progress must be explained as a form of moral improvement, or agents aspiring to be better sorts of moral agents. In what moral improvement consists differs for various forms of constructivism. Here I distinguish between three different versions of metaethical constructivism: Humean constructivists as represented by Street (2008, 2010, 2012), Kantian constitutivist constructivists as represented by Korsgaard, and constructivists about practical reason as represented by Carla Bagnoli (2002, 2013). I conclude by showing that only constructivism as a view about practical reason can fully account for moral progress qua the opportunity for moral improvement.  相似文献

Why do people act morally – when they do? Moral philosophers and psychologists often assume that acting morally in the absence of incentives or sanctions is a product of a desire to uphold one or another moral principle (e.g., fairness). This form of motivation might be called moral integrity because the goal is to actually be moral. In a series of experiments designed to explore the nature of moral motivation, colleagues and I have found little evidence of moral integrity. We have found considerable evidence of a different form of moral motivation, moral hypocrisy. The goal of moral hypocrisy is to appear moral yet, if possible, avoid the cost of being moral. To fully reach the goal of moral hypocrisy requires self-deception, and we have found evidence of that as well. Strengthening moral integrity is difficult. Even effects of moral perspective taking – imagining yourself in the place of the other (as recommended by the Golden Rule) – appear limited, further contributing to the moral masquerade.  相似文献
