Gewirth has argued that rights are justified by their role in the “generic features” of action. Simply by virtue of being a purposive agent capable of voluntary action, one must accept the logic that all persons with such characteristics have certain moral rights. But the language of rights theories does not deal with the process by which rights are acknowledged. How do we go about recognizing those characteristics of human life that underlie the logic Gewirth claims is necessary? By what process do I recognize, for example, your “right” to be told the truth? Acknowledging someone else's right involves two elements: a recognition of the content of the right and a recognition of the binding power of the right which is experienced by the agent as a sense of obligation. Analyzing the process by which these two factors are recognized and examining the foundation for that process will clarify some of the assumptions utilized in rights theories.  相似文献

Abstract: This article explores certain issues that arise at the borderline between conceptual analysis and metaphysics, where answers to questions of a conceptual nature compete with answers to questions of an ontological or metaphysical nature. I focus on the way in which three philosophers, Kant, Collingwood and Davidson, articulate the relationship between the conceptual question “What are actions?” and the metaphysical question “How is agency possible?” I argue that the way in which one handles the relationship between the conceptual and the ontological question has important implications for one's conception of the nature of philosophy, and that thinking hard about what it takes to defend the autonomy of the mental and of the agent‐centred perspective should force us to think about our underlying conception of philosophy and to choose between one that understands it as first science and one that understands it as the under‐labourer of science.  相似文献

This essay examines the function of the concept of human dignity (both as an inherent feature of human existence and as an ideal achievement) in the United Nations's 1948 Universal Declaration of Human Rights. It explains why the key framers of the document affirmed an inherent human dignity in order to provide an explanatory basis for the validity of universal human rights while eschewing any religious or metaphysical justification for this affirmation. It argues that the key framers, while aware of the Christian anthropology informing the modern Western concept of the dignity of the person, grasped (1) that the Declaration, to be ratifiable, would need to be free of religious reference, and also (2) that the notion of inherency suffices to suggest heuristically not only a universal human nature but also, crucially, a transcendent reality in which all persons participate.  相似文献

Forty normal male volunteers were randomly assigned to one of four experimental conditions and instructed to raise and lower their systolic blood pressure. Subjects received either beat-to-beat feedback contingent on pressure changes, noncontingent beat-to-beat feedback, noncontingent feedback presented randomly with respect to the occurrence of each heart beat, or instructions alone. The order of increase and decrease trial blocks was counterbalanced across groups. Subjects receiving contingent feedback were monetarily rewarded for appropriate pressure changes. Subjects receiving noncontingent feedback received rewards and feedback equal to the mean received by the contingent group. Subjects in the instructions-only condition were also paid this bonus but were informed of their earnings only at the conclusion of the experiment. Results indicated that in the presence of instructions, feedback, whether contingent or noncontingent, added little to subjects' ability to control pressure during a single session. Theoretical and clinical implications are discussed.  相似文献

William James's The Varieties of Religious Experience is one of the world's most popular attempts to meld science and religion. Academic reviews of the book were mixed in Europe and America, however, and prominent contemporaries, unsure whether it was science or theology, struggled to interpret it. James's reliance on an inherently ambiguous understanding of the subconscious as a means of bridging between religion and science accounts for some of the interpretive difficulties, but it does not explain why his overarching question was so obscure, why psychopathology and unusual experiences figured so prominently, or why he gave us so many examples and so little argument. To understand these persistent puzzles we need to do more than acknowledge James's indebtedness to Frederic Myers's conception of the subconscious. We need to read VRE in the context of the transatlantic network of experimental psychologists and psychical researchers who provided the primary intellectual inspiration for the book. Doing so not only locates and clarifies the underlying question that animated the work but also illuminates the structural and rhetorical similarities between VRE and Myers's Human Personality and Its Survival of Bodily Death. In contrast to the individual case studies of hysterics, mediums, and mystics produced by others in this network, both Myers and James adopted a natural-history approach in which they arranged examples of automatisms to produce a rhetorical effect, thus invoking science in order to evoke a religious response. Where Myers organized his examples to make a case for human survival of death, James organized his to make a case for the involvement of higher powers in the transformation of the self. Read in this way, VRE marks a dramatic shift from a religious preoccupation with life after death to a religious preoccupation with this-worldly self-transformation.  相似文献

Abstract Philip Hefner's work on created co‐creator is presented for consideration as a contemporary theological anthropology. Its reception within the Evangelical Lutheran Church in America falls into three main lines, which are reviewed here because they are suggestive of its potential impact on Christian thinking. This review raises two major questions and leads to a critique. The first question is whether created co‐creator should be replaced by another term for the sake of more clearly encapsulating the ideas represented in Hefner's work. The second question concerns the moral “payoff” of created co‐creator. Such questions lead to the critique that Hefner's corpus gives insufficient attention to responsibility as integral to freedom and that it lacks a theory of obligation. I then sketch the amenability and benefit of linking created co‐creator with “responsibility ethics,” exemplified by the work of Hans Jonas.  相似文献
