This research examined the impact of defendant/complainant alcohol consumption and prior sexual history evidence on mock jurors' evaluations of a sexual assault trial. Participants (N = 196) were provided with a simulated trial in which the beverage consumption of both targets and the sexual history between them was manipulated. The results displayed a complex interplay between target beverage consumption and gender of participant. Typically observed gender effects—that is, women, compared to men, were more supportive of the complainant and less supportive of the defendant—was contingent upon target beverage consumption. Depending on how aggressive participants perceived the defendant to be, women were more sympathetic to the complainant, with this being contingent upon complainants' and defendants' beverage consumption.  相似文献

The present study investigates the impact of participant gender, rape-myth beliefs, and alcohol intoxication on the part of either the defendant and/or alleged victim on mock jurors' decisions within the context of a sexual-assault trial. Participants ( N = 152) were exposed to a sexual-assault case in which the beverage consumption (alcohol, cola) on the part of both the defendant and complainant prior to the sexual intercourse was varied systematically. Results indicated that when the defendant had consumed alcohol, as opposed to cola, participants were more likely to view the case as one of assault, to perceive the defendant as less credible, and to find the defendant guilty. When the complainant had consumed alcohol, as opposed to cola, participants found the complainant's claim less credible and were less likely to view the defendant as guilty. In addition, participants' rape-myth acceptance, which was related to guilt, mediated the relation between gender of participant and guilt.  相似文献

Limited research exists on the impact of contextual factors such as victim intoxication and victim attire on police processing of a case of sexual assault. The effects of these variables were examined in a simulated sexual assault case. Participants were 125 detectives from the New South Wales Police Department. Officers read controverted witness statements and viewed photographs pertaining to an investigation of a report of date rape. Contrary to findings in earlier studies, complainant intoxication, ‘provocative’ dress, and gender of the officer had no influence on the likelihood of charging the alleged offender. Factors predictive of pressing charges were the perceived credibility of the complainant and culpability of the alleged offender. Credibility and guilt judgements were themselves influenced by the level of rape myth acceptance endorsed by the officers. Rape myth acceptance also exerted a number of other effects on case evaluations. Implications for future studies and education and training programmes for police on sexual assault were discussed. This study investigated the knowledge and misconceptions of jury‐eligible citizens about children's reliability as witnesses and responses to child sexual assault (CSA), and examined the influence of expert evidence and judicial directions in challenging common misconceptions. Community volunteers (N = 130) read one of five versions of a simulated jury trial, and completed a pre‐ and post‐trial questionnaire to provide measures of their knowledge of children's responses to sexual abuse, perceptions of victim credibility, and verdict. Results revealed that endorsement of CSA misconceptions negatively impacted ratings of complainant credibility and verdicts. Judicial directions provided before the child complainant testified enhanced complainant credibility, which in turn predicted guilty verdicts. Comparisons of the effectiveness of two procedural legal mechanisms to manage juror misconceptions and improve knowledge about CSA provide guidance for future researchers investigating ways to increase fairness in cases of CSA. Mental pain is hypothesized to manifest an adaptation for analyzing and coping with social problems that would have reduced inclusive fitness in human (Homo sapiens) evolutionary history. We examined this hypothesis in the psychological pain of 790 rape victims. Reproductive-aged and postreproductive-aged victims were more likely than prereproductive-aged victims to have experienced vaginal intercourse and to have had sperm present in the reproductive tract. As predicted, vaginal intercourse constituted the most psychologically devastating form of sexual assault for reproductive-aged women. Nonreproductive-aged victims were not more traumatized by vaginal rapes. When rapes included ejaculation in the victim's reproductive tract, reproductive-aged victims may have been more traumatized. These results suggest that the psychology that regulates mental pain processes information about the nature of the sexual act in the event of a woman's rape.  相似文献

Extralegal factors, including physical attractiveness, may bias juristic opinions. The present study provided 450 university students with hypothetical scenarios of physical, domestic, and sexual assault in which complainant’s attractiveness and other legal and extralegal characteristics were independently varied. Results indicate complainant’s attractiveness mattered in sexual assault scenarios only for guilt of the defendant, but not for physical or domestic assault. Complainant’s attractiveness was not related to perceptions of blameworthiness of complainant or punishment of defendant. Overall, legal factors of injury level, prior offending, and intoxication mattered more than attractiveness or race of the victim. Implications are discussed.  相似文献

Associations of sexual assault history with reproductive and sexual symptoms were evaluated in 3,419 women randomly selected from two communities. Sexual assault was associated with excessive menstrual bleeding, genital burning, and painful intercourse (whether or not attributable to disease or injury), medically explained missing two menstrual periods, and medically unexplained dysmenorrhea, menstrual irregularity, and lack of sexual pleasure. Physically violent assaults and those committed by strangers were most strongly related to reproductive symptoms. Multiple assaults, assaults accomplished by persuasion, spouse assault, and completed intercourse were most strongly related to sexual symptoms. Assault was occasionally associated more strongly with reproductive symptoms among women with lower income or less education, possibly because of economic stress or differences in assault circumstances. Associations with unexplained menstrual irregularity were strongest among African American women; ethnic differences in reported circumstances of assault appeared to account for these differences. Assault was associated with sexual indifference only among Latinas.  相似文献

Congressional enactment of Federal Rules of Evidence 413-415 changed centuries of the law which had excluded evidence by the state that the defendant had committed other bad acts and was therefore the sort of person who would be more likely to commit the act charged. The passage of Rules 413-415 opens the door to this type of character evidence in sexual assault and child molestation cases and requires trial judges to assess the probative value of this propensity evidence offered. Yet, neither these rules nor their legislative history offer much guidance in this assessment. This article offers guidance to trial judges and lawyers to assess the probative value of propensity evidence offered under these rules.  相似文献

Surveys are among the most common methods for evaluating military sexual assault experiences among members of the U.S. military; however, little research has examined how receiving surveys about such sexual assaults might affect recipients. In the present sample of 530 active duty and veteran military personnel, just 10% reported unexpected upset, 11% reported regretting participation in the survey, and 22% reported benefitting from that participation overall. A minority of respondents with a history of sexual assault while in the military reported unexpected upset, although the prevalence was three times higher than that of participants without such history (24% vs 8%). There were no statistically significant differences in perceived regret and benefit of participation in the survey between those with and without a history of sexual assault while in the military. Although limited in number, male military sexual assault survivors (n = 8) were significantly more likely than female survivors to report being more upset by the survey than they had anticipated. Implications for future research are discussed.  相似文献

Both children and adults with disabilities face increased prevalence of abuse and assault, including sexual assault. Women and girls are disproportionately the victims of sexual assault in both disabled and nondisabled populations. Communication difficulties have been identified as a factor that may increase the vulnerability of individuals with disabilities to sexual assault. However, few studies have examined whether language impairment increases risk for sexual assault. This study reports on a community sample of children with speech or language impairment, followed to age 25. Sexual assault history was assessed based on two questions from the Composite International Diagnostic Interview Posttraumatic Stress Disorder module. Women with language impairment (n = 33) were more likely than women with unimpaired language (n = 59) to report sexual abuse/assault, controlled for socioeconomic status. Sexual assault was associated with higher rates of psychiatric disorders and poorer functioning. Women with neither language impairment nor a history of sexual assault had fewer psychiatric disorders and higher functioning than women with language impairment and/or a history of sexual assault.  相似文献

This paper examines the reactions of college men and women (primarily white) to scenarios depicting non-consensual intercourse between men and women with varying levels of prior intimacy. Women were more likely than men to consider the scenarios unacceptable, and the gender difference increased with the level of prior intimacy between the victim and the offender in the scenario. Respondents who reported knowing a rape victim were also more likely to consider the scenarios unacceptable, and this effect was significantly larger for men. We consider the implications of these results for understanding the role of salience of sexual assault and self-interest in shaping men's and women's reactions to non-consensual intercourse.  相似文献

All participants, regardless of gender, made more positive judgements toward the female as opposed to male perpetrator. Only a few studies have examined the characteristics of sexual assault based on the tactics used by the perpetrator. In this study we compared the experiences of women who were forced to engage in vaginal, anal, or oral intercourse due to verbal coercion, physical force, or intoxication. Random-digit dialing was used to obtain a sample of 272 single African American and Caucasian women between the ages of 18 and 49 from the Detroit metropolitan area. Participants completed a computer-assisted self-interview that asked detailed questions about a past sexual assault and their reactions to it. Among the 139 women who were forced to engage in vaginal, anal, or oral intercourse, sexual assaults that involved physical force produced the most severe negative outcomes. Situations that involved the woman being too intoxicated to resist differed from others primarily in terms of how much alcohol the man and woman consumed. Although all types of sexual assault were perceived as being at least moderately serious, verbally coerced assaults were on average perceived as being least serious. These findings suggest that the perpetrators' tactics affect women's responses to sexual assault.  相似文献

This study examined the link between ethnicity, early sexual victimization experiences and college sesual assault in a sample of 383 undergraduate women. One third of the sample (32.9%) had experienced some form of sexual assault during college (22% of whom reported that they had been raped), and 52 percent had experienced unwanted sexual activity before the age of 18 (17.5% of whom reported that a family member or trusted family friend asked for or forced sexual activities). There were substantial differences among the Black, White, Hispanic and Asian women on two of four measures of college sexual assault. Black women had the highest and Asian women the lowest incidence of forced intercourse through verbal threats or pressure. Hispanic women had the highest and Black women the lowest incidence of attempted rape. Black and White women were almost three times as likely as Hispanic women to have had experiences that meet the legal definition of rape, but do not consider themselves rape victims. There were significant differences in college victimization experiences as a result of experiencing incest before age 18, experiencing extrafamilial sesual abuse before age 18, and the use of alcohol. Ethnicity interacted with alcohol use and early experiences with extrafamilial sexual abuse. However, the effect of incest on college victimization was similar for the women in the study, regardless of ethnicity.  相似文献

Relations between (a) serious suicidal ideation and attempts and (b) demographics, trauma history, assault characteristics, post‐assault outcomes, and psy‐chosocial variables were examined among female adult sexual assault survivors. Younger, minority, and bisexual survivors reported greater ideation. More traumas, drug use, and assault disclosure related to greater attempts, whereas perceived control over recovery was related to fewer attempts. Child sexual abuse and some assault characteristics predicted suicidal behavior. Depression was related to suicidal behavior until psychosocial variables were accounted for. Specifically, using substances to cope and self‐blame predicted greater ideation, whereas receiving aid/information support was related to less ideation. Implications for research and treatment are discussed.  相似文献

Extant research demonstrates that a history of military sexual trauma (MST) is associated with PTSD and depression diagnoses as well as heightened risk for suicidal ideation and death by suicide. Past studies of MST and its sequelae typically collapse harassment-only and assault MST screening items into a single response, recorded as positive or negative for a history of MST. It is presently unclear whether assault is associated with poorer mental health outcomes relative to harassment-only MST. Female service members/Veterans (n = 656) completed an online survey assessing history (present, absent) and type (harassment-only, assault) of MST, PTSD, depression, sexual satisfaction and function symptoms, as well as suicidal ideation. Findings revealed that those who reported a history of MST, and assault more specifically, were more likely to report higher PTSD symptoms and probable PTSD diagnosis, higher depression symptoms and probable depression diagnosis, worse sexual function and probable sexual function diagnosis, lower sexual satisfaction, and presence of suicidal ideation. Those who reported harassment-only MST also reported higher PTSD severity and probable PTSD diagnosis, but the magnitude of the association of harassment-only MST and PTSD severity relative to assault MST and PTSD severity was substantially lower. Findings suggest it is critical to distinguish between history and type of MST during screening as a combined screening item loses sensitivity to identify those at heightened risk for distress and dysfunction.  相似文献
