This research examines the relationship between childhood physical and sexual abuse and the types of crimes committed by male adult offenders. We use the method of discriminant prediction to determine whether independent and dependent variables are related in ways that theories predict. Our analyses of data from the Survey of Inmates in State and Federal Correctional Facilities suggest that offenders model specific behaviors to which they have been exposed. Male offenders who were sexually abused as a child are more likely to commit sexual offenses, particularly sexual offenses against children, than nonsexual offenses. Offenders who were physically abused are more likely to engage in violent offenses than nonviolent offenses. Further analyses show that sexual offenders, and to a lesser extent violent offenders, are likely to specialize in those offenses. Our results are consistent with a social learning approach. The National Registry of Exonerations tracks cases of individuals who have been wrongly convicted and exonerated since 1989. Their most recent report revealed that 12% of those exonerated gave false confessions. The current study used data from the National Registry of Exonerations and focused on a sample of 2,378 individuals convicted of felonies with a focus on sexual offenses, as such crimes tend to be viewed as particularly heinous with increased consequences for those convicted. After examining various legal and extralegal factors, the results showed that those accused of sexual offenses, particularly sexual murders, had a greater likelihood of giving a false confession than those accused of non-sexual offenses. The likelihood of falsely confessing was higher among juveniles, those with mental illness and intellectual disabilities, and cases with multiple suspects. Females had a greater odds of falsely confessing to murder than males. Implications and recommendations are discussed.  相似文献

This article examines a process of behavioral analysis, referred to as linkage analysis, used in identifying sexual offenses that have been committed by the same offender. This type of analysis examines behavior that is contained in three distinct components of a crime, i.e., the modus operandi (MO) or the “how to” of a crime; the ritual or fantasy-based behaviors for a particular type or series of sexual crimes; the signature or unique combination of behaviors, which suggests that a series of crimes has been perpetrated by the same offender. Linkage analysis involves five assessment procedures: (1) gathering detailed, varied, and multisource documentation; (2) reviewing the documentation and identifying significant features of each crime individually across the series; (3) classifying the significant features of the crime as either MO and/or ritualistic constructs; (4) comparing the combination of MO and ritualistic features across the crimes to determine if a signature exists; (5) compiling a written analysis that details the conclusions derived from the available information. Results of this type of analysis can be used for investigative purposes and, in some instances, can help to inform the decision-making of the courts.  相似文献

The causes of sexual misconduct by analysts are discussed, as is the viability of rehabilitation for different types of transgressors. Common misunderstandings about the transgressor (such as the assumption of psychopathy and the likelihood of multiple offenses) are countered with a summary of data derived from the evaluation and/or treatment of over two hundred cases, most of them one-time transgressors. The typical characteristics of the analyst or therapist who engages in sexual misconduct are presented and discussed as qualities that are to some extent present in analysts generally. The temptation to deny this universal vulnerability is viewed as effectively replicating the kind of vertical splitting or compartmentalization that makes one vulnerable to sexual misconduct in the first place.  相似文献

Examination of societal reaction to sexual offenders reveals a history of harshness exemplified by the sexual psychopath laws of the 1930s. The latest round of legal attempts to control sex offenders uses Severe sentencing laws, civil commitment procedures and community notification statutes to confine and shame sex offenders. This paper shows these laws to be based on popular beliefs about the predatory nature of these men, the probability of their re-offense and their amenability to treatment rather than the facts about the sex offenses and offenders. The severe reaction to sexual offenders is a vindictive one based on myth and misunderstanding that serves many interests. The paper exposes the contradictory myths and skewed emotions that guide our view of sex crimes and compares these with the facts about re-offense rates and the effects of treatment.  相似文献

This study sought to determine if narcissism was a factor in Lutheran clergy who self-reported committing sexual misconduct. Sexual misconduct was defined as any activity in which a clergyperson, single or married, engaged in sexual behavior (sexual intercourse, kissing, touching or hugging with sexual intent, use of sexually explicit language) with a parishioner, client, or employee of the church (Francis & Turner, 1995). The results indicated that clergy who self-reported having committed sexual misconduct and had high levels of narcissism were not significantly different from those clergy who self-reported not having committed sexual misconduct. Demographic and related findings are also discussed. Sexual offenses committed by women are likely underestimated and under-reported. This exploratory study compares and contrasts women accused of sexual offenses and their male counterparts. Data were retrospectively compiled on all alleged female and age-matched male sex offenders who were referred for psychiatric evaluation to a large Midwestern city's court psychiatric clinic over a six-year period. Data were abstracted regarding their crimes, charges, demographics, social history, medical history, legal history, violence history, substance use, sexual history, psychiatric history and their victims. Like the men, women were most frequently referred for sexual predator classification evaluations. Ages ranged from 19 to 62 years, and the majority had children. Most had prior arrests. One-third had a past history of psychiatric hospitalization, and most were given a non-paraphilic psychiatric diagnosis. The majority of the women reported past histories of sexual or physical victimization. While there were many similarities between female and male sex offenders in this psychiatric sample, women more frequently had victims of both genders.  相似文献

Evolutionary psychology accounts of gender differences in sexual behaviors in general and men's sexual aggression, in particular, has been criticized for legitimizing males' sexual misconduct. To empirically assess such critiques, two studies examined how men's judgments of male sex crimes (solicitation of sex from a prostitute; rape) are influenced by exposure to (a) evolutionary psychological theories and (b) social‐constructivist theories. Across two studies, a consistent pattern emerged compared with a control condition (a) exposure to evolutionary psychology theories had no observable impact on male judgments of men's criminal sexual behavior, whereas (b) exposure to social‐constructivist theories did affect judgments, leading men to evaluate sex crimes more harshly. Additional results (from Study 2) indicate that this effect is mediated by perceptions of male control over sexual urges. These results have implications for journalists, educators, and scientists. This article reviews the empirical research on the prediction of reoffending among sexual offenders. The major predictors of sexual-offense recidivism are factors related to sexual deviance (e.g., deviant sexual preferences, previous sex crimes) and, to a lesser extent, criminal lifestyle (e.g., antisocial personality disorder, total number of prior offenses). The factors that predict general recidivism among sex offenders are the same as the factors that predict general recidivism among nonsexual criminals (e.g., juvenile delinquency, prior violent offenses). Given that there are special predictors of sexual recidivism, evaluators should consider separately the risk for sexual and nonsexual recidivism.  相似文献

Research on the treatment and programs for people who have committed sexual offenses has greatly increased in the past decade. The aim of this review is to discuss research that has been published over that period (2010–2019) that is relevant for treatment providers. The articles included in this review were found through PsycINFO and PubMed (Medline) using the keywords “treatment or therapy” and “sex offen*”. The inclusion criteria were publications that discuss treatment of persons who have committed sexual offenses (written in the English language only). Any articles that examined only special populations were excluded, such as those that examined persons who committed sexual offenses who were female, had intellectual disabilities, deafness, juveniles, etc., because these groups will likely have needs and responsivity factors that differ from the “average” natal-born male sex offender. Results showed that several meta-analyses indicate that treatment is effective in reducing sexual recidivism. The most frequently used treatment for sex offenders is cognitive behavioral therapy, which is often provided in conjunction with pharmacological treatment to reduce sexual impulsivity and/or sex drive. This review is limited to the specific key search terms. The findings of this review support the use of treatment and a community reintegration approach when treating persons who have committed sexual crimes to prevent sexual recidivism.  相似文献

A sample of 476 male sexual offenders, seen at a university psychiatric hospital for forensic assessment, was examined for the incidence of traumatic head injuries. A total of 49.3% had sustained head injuries that led to unconsciousness and of these 22.5% sustained significant neurological insults. A major causative factor was motor vehicle accidents, but lifestyle variables including alcohol and drug abuse and history of violence also contributed. The brain-injured group was convicted for a wide range of sexual offenses and was comparable to the non-injured group in this respect, but tended more often to offend against adults than against children and to show somewhat more exhibiting and polymorphous sexual behavior. In spite of the serious legal implications for these men and the additional distress to their families, psychologists, psychiatrists, and the professional literature have been relatively silent on the subject which calls for more attention to sexual behavior as part of assessments and treatment planning.  相似文献

Understanding antisocial behavior and organizational misconduct is an important objective, because these maladaptive behaviors are disruptive and costly to organizations and to society as a whole. The objective of this study was to identify psychosocial risk factors for misconduct and antisocial behavior in a sample of Navy personnel. A group of sailors (n = 158) who had engaged in significant misconduct were compared with a demographically similar group of sailors (n = 288) who had not engaged in misconduct and who were in good standing with the Navy. The psychosocial variables that emerged as the most important risk factors for antisocial behavior were alcohol use (odds ratio [OR] = 2.42), high impulsivity (OR = 2.20), high trait hostility (OR = 1.79), and antisocial behavior of friends (OR = 1.65). The implications of these results for the military and for research on antisocial behavior are discussed.  相似文献

For this article, we examine gender differences in how staff members address inmate misconduct. Using in-depth interviews with forty-three correctional employees, we focus on how their various disciplinary styles create interpersonal conflict between staff members. We find that over half of interviewees are identified as “formal responders” who consistently punish inmate misconduct with formal sanctions, even if doing so creates conflict within the organization. However, female formal responders also claim that they work closely with male inmates to explain the importance of following the rules. They state that this puts them at odds with their male co-workers who misinterpret this behavior as instigating sexual relationships.  相似文献

The author argues that sexual misconduct is better referred to as ethical or sexual misconduct rather than combining a fragile metaphoric construct—boundary—with forensic jargon. His argument rests on a few points that intersect. One objection to the term “boundary violation” involves a matter of scale in which the notion of exploring psychic boundaries, the essential context for psychoanalysis, is obliterated by sexual misconduct. The enormous scale of sexual misconduct is better labeled with behavioral referents rather than a moniker that combines forensic violation and the subtleties of analytic process. The author would reserve the term boundary difficulties for analytic process related to more subtle problems in analysis and the use of boundaries embedded in the work. Another objection relates to our responsibility to those outside our community to refrain from using our sophisticated understanding of the play of boundaries in analytic work in ways that are too often unintentionally confusing and mystifying.  相似文献

The authors of this article surveyed a national sample of male counselors and educators (N = 366) on both attitudes toward and participation in sexual misconduct with clients, students, and students under supervision. Although relatively few respondents (1.7%) reported having engaged in sexual misconduct with clients during a professional relationship, the prevalence rate increased to 17% when the definition of sexual misconduct was expanded to include (a) students and students under supervision and (b) occurrences of sexual misconduct after the professional relationship. Respondents who indicated that erotic sexual conduct may not constitute professional misconduct were more likely to report having engaged in such behavior.  相似文献

Taking blame for another person's misconduct may occur at relatively high rates for less serious crimes. The authors examined individual differences and situational factors related to this phenomenon by surveying college students (n = 213) and men enrolled in substance abuse treatment programs (n = 42). Among college students, conscientiousness and delinquency predicted their likelihood of being in a situation in which it was possible to take the blame for another person's misconduct. Situational factors, including the relationship with the perpetrator, the seriousness of the offense, feelings of responsibility for the offense, and differential consequences between the offender and the blame taker, were associated with college students’ decisions to take the blame. Among substance abuse treatment participants, individuals who took the blame for another person's misconduct were more extraverted, reported feeling more loyalty toward the true perpetrator, and indicated more incentives to take the blame than individuals who did not take the blame. In trying to understand and explain clergy sexual misconduct, this article seeks the help of two interrelated interpretive frames: (1) social structures and other network of relationships that immediately surround or embed persons, and (2) human behavior which is expressed through and because of social rules and resources, groups and grids, structures and systems. It presupposes that the not-so predictable and less-visible sexual misbehavior could be brought into discussion with the help of other ideas: habitus (enduring predispositions) and limen (threshold). Through these ideas, covert behavior may become less hidden for it will be conceptually gathered from its entangled condition between the psychological and socio-cultural factors. In its more integrated psycho-social environmental way of explaining, this essay avoids both the overly psychological and the too-sociological approaches of interpreting behavior. In other words, it avoids a single manner of viewing sexual misconduct. This manner of understanding misconduct is a way of broadening the canvass and giving up an outdated either-psychology-or-sociology strokes. Reported instances of clergy sexual misconduct have risen significantly in recent years. Allegations of sexual misconduct have long lasting effects on the career of the clergy, the persons involved, and the congregations. A distinction is made between those clergy who engage in this behavior due to a personality disorder, and those who engage in sexual misconduct as a response to spousal or congregational conflict. In working with the women who have been sexually involved with the clergy, there needs to be a recognition of both the damage done to the woman and the woman's perception that some benefits may have resulted from this relationship. Congregations who have been through this experience will be reluctant to deal with it Unless there is ongoing consultation, there is an increased risk that the congregation will project their unresolved issues on the subsequent clergyperson thereby severely jeopardizing his or her chances of succeeding in the position. This study explored relationships between “highly probable” neuropathology in the limbic system (as gauged by clinically elevated scores on the Limbic System Check-list-33, or LSCL-33, a screening index for limbic system dysfunction developed by medical researchers at Harvard and Dartmouth) and inventoried psychopathology (as gauged through scores on the MMPI) among a group of adjudicated pedophiles incarcerated for treatment in a specialized prison for criminal sexual psychopaths in a mid-Atlantic state. Principal findings: Only 33 percent of this sample of incarcerated pedophiles exhibits scores on the LSCL-33 at a level high enough to warrant a medical conclusion of “probable” limbic system dysfunction. When scores on the MMPI are grouped according to critical values for clinically relevant scores on the LSCL-33, significant F ratios in one-way analyses of variance are observed on L, F, K, Hs, D, Hy, Pa, Pt, Sc, and Ma. Mean T scores for “probable” dysfunctionals simultaneously reach elevations at or above the threshold of clinical significance for Pd, Pa, and Sc. On that basis, the categorization psychopathic paranoid schizophrenia readily applies to limbic system dysfunctional child sexual abusers studied in this inquiry, but not to their nondysfunctional counterparts. But significant F ratios are observed neither for the age of the victim(s) in the instant offense(s), for the number of prior arrests for sex offenses, for the number of prior arrests for any and all felony offenses, including sex offenses, nor for the offender's current age. However, a stepwise multiple regression between gross number of prior arrests for any and all offenses (including sex offenses) as the most robust of the indices of past criminal activity and both LSCL-33 and MMPI scores across all offenders represented in this inquiry (i.e., the limbic system dysfunctional, the nondysfunctional, and a mid-range group) proceeds to four steps, achieving a multiple R of .575 and encompassing Pd, Mf, Pa, and LSCL-33 scores as the most efficient interactive post-dictive set. Stepwise multiple regression analyses of past arrest record computed independently for limbic system dysfunctionals and nondysfunctionals progresses among dysfunctionals to seven steps, achieving a multiple R of .867 and encompassing Pd, Hy, Ma, Mf, Si, Pa, and Sc scores as the most efficient interactive post-dictive set; and among nondysfunctionals, to six steps, achieving a multiple R of .797 and encompassing Mf, D, Pt, Hy, Pa, and over-controlled hostility scores as the most efficient interactive post-dictive set. The latter results are interpreted as suggesting that neuropathology and psychopathology interact with and potentiate each other in post-dicting criminal behavior among the pedophiles studied in this inquiry.
