A practicing physician reviews the contribution of Jewish ethics, as it relates to the structure of Jewish law, to the issue of abortion. The topics approached include the status of the fetus, the relationship of fetus to mother, abortion and murder, therapeutic abortion, and the rights of the mother. The discussion describes rabbinic answers to abortion requests and is followed by a summary of the Jewish attitudes toward termination of fetal life. An appendix is provided, dealing with central aspects of Jewish ethics, the structure of Jewish law, their relationship, and a note on abortion legislation in Israel.  相似文献

The issue of smoking and Jewish law is explored. After the dangers from smoking are cited, various precedents in Jewish law are presented as the basis for confronting the matter of smoking. Arguments are suggested for strictly prohibiting smoking. The matter of the effects of smoking on the non-smoker is the subject of much research, and the dangers posed to the innocent bystanders are an added dimension pointing to the hazards of smoking and therefore indicating that it should be prohibited.Rabbi Dr. Reuven P. According to Jewish law, there is a clear obligation to try to heal, and this duty devolves upon both the physician and the society. Jewish sources make it clear that health care is not only an individual and familial responsibility, but also a communal one. This social aspect of health care manifests itself in Jewish law in two ways: first, no community is complete until it has the personnel (and, one assumes, the facilities) to provide health care; second, the community must pay for the health care of those who cannot afford it as part of its provision for the poor. The community, in turn, must use its resources wisely, which is the moral basis within the Jewish tradition for some system of managed care. The community must balance its commitment to provide health care with the provision of other services.  相似文献

This paper examines the legal, moral, ethical, and Jewish religious issues involved inin vitro fertilization and surrogate motherhood. Also briefly discussed are the topics of artificial insemination and sex organ transplants. Jewish views on these subjects are based on the cardinal principles that life is of infinite value, that human life is sacred, and that the divine license to heal granted to the physician carries with it certain well-defined obligations and restrictions.  相似文献

This paper examines the main Jewish sources relevant to end-of-life ethics, two Talmudic stories, the early modern code of law (Shulhan Aruch), and contemporary Halakhaic (religious law) responsa. Some Orthodox rabbis object to the use of artificial life support that prolongs the life of a dying patient and permit its active discontinuation when the patient is suffering. Other rabbis believe that every medical measure must be taken in order to prolong life. The context of the discussion is the most recent release of the "Steinberg Report," which proposes a law regulating end-of-life issues in Israel. It is argued that the Orthodox rabbis base their views on a strongly positivist concept of religious law. The rabbis deliberate the law as a manifestation of the will of God and try to stretch the law as much as possible in order to benefit the patient, even when it is good for the patient to die. Direct and active actions that kill are prohibited; certain forms of passive euthanasia and contrivances that terminate life support without needing direct human action are accepted.  相似文献

The narrative responses of 32 people with AIDS or cancer with survival prognoses of 6 months to a year to monthly interview questions about their daily lives were analysed with a team-based qualitative methodology. Two groups emerged: (a) a Maintained Lifeworld Group characterised by one or more of the following: continued engagement with family, friends, and community; the ability to relinquish untenable goals and substitute new, realistic ones; engagement in spirituality and a spiritual practice; and, (b) a Lifeworld Interrupted Group characterised by one or more of the following: relocation just before or during the study, cognitive impairment, commitment to untenable goals, ongoing substance abuse. Understanding how people with a terminal illness can maintain a lifeworld and experience well-being while also managing the physical challenges of their illness could help inform the support offered by professional and family caregivers to improve care recipients’ quality of life.  相似文献

The truth value assigned to a proposition is treated by philosophers, logicians, and most psychologists as an abstract construct, a theoretical object outside the cognitive system. Breaking away from this consensus, we propose to carry out a psychological investigation to analyse the objective, verifiable properties of representations categorized as true by human individuals. We shall reject the conception whereby attributing a truth value to a proposition is the result of the activation of knowledge about the truth of that proposition. We shall also exclude the conception of truth as the result of the establishment of a correspondence with the world. We propose that truth be understood as the result of a decision about the values taken on by the conditions for fulfilment of the act of referencing in a mental model. Our cognitive model of propositional truth attribution is built on the assumption that the truth value of a proposition is determined by the ability of that proposition to fit into the theory of the field to which it refers. This attribution is viewed as a two-stage cognitive activity. During the first stage, the features defining the coherence of the proposition in the activated mental model determine its plausibility value. This defines a generally inconsistent set of truth candidates. The second stage involves selecting the subset containing all propositions which, in context, will be considered true. Two selection criteria are used: maximum consistency and connectivity. The preliminary experimental results proved to be compatible with the proposed model.  相似文献

Recent work on testimony has raised questions about the extent to which testimony is a distinctively second-personal phenomenon and the possible epistemic significance of its second-personal aspects. However, testimony, in the sense primarily investigated in recent epistemology, is far from the only way in which we acquire knowledge from others. My goal is to distinguish knowledge acquired from testimony – learning from being told – from knowledge acquired from teaching – learning from being taught, and to investigate the similarities and differences between the two with respect to the interpersonal dimensions of their structures.  相似文献

按照对"真"的结构分析,真理论可分为:内在论、符合论、融贯论和紧缩论。这四种方案各有其适用范围,但经过深入研究发现,除符合论以外的三种方案都存在棘手的难题。融贯论不能证成逻辑上的不矛盾律,不能合理地解决如何选择"支配性"信念系统的问题,并且它和内在论都不能解决偶然真问题。紧缩论的问题则是:若将"真"理解为提供一种认知担保,与其所主张的等值图式相结合,就可推出:信念p没有认知担保当且仅当非p有认知担保,这与实际情形不相符——关于p和非p,我们有可能都没有认知担保。为摆脱传统符合论的困境,可以通过列举"老生常谈"的方式,发展一种多元真理论:"真"在不同领域取决于不同的事物——在一个区域内取决于符合,在另一个领域内取决于融贯。"超可断定性"这一概念可以解释这种多元真理论的可行性。  相似文献

Facing a terminal illness is an unimaginably difficult experience, yet many individuals intend to work despite their prognosis. However, research has not systematically examined the potential antecedents underlying such intentions. Using behavioral intention theory as an underlying framework, this study hypothesized that reasons for working (intrinsic and extrinsic), the will to live, disability severity, accessibility of travel, and age would predict intentions to work during terminal illness. A representative sample of medically diagnosed amyotrophic lateral sclerosis (a.k.a. Lou Gehrig's disease) patients with a mean life expectancy of approximately 3 years participated (mean age=57.8 years). Controlling for length of diagnosis, employment status, and demographic variables, results indicated that intrinsic reasons were particularly strong predictors of intentions, followed by age, disability severity, and accessibility of travel. Exploratory findings also indicated that behavioral intentions were positively related to future employment status, consistent with past theory. ((c) 2005 APA, all rights reserved).  相似文献
