This article supports the position that the 1989 United Nations Convention on the Rights of the Child (CRC) articulates a prohibition of capital punishment of juveniles that now must be considered a norm of jus cogens. The article provides statistics and trends regarding juveniles who commit capital crimes and describes how the U.S. justice system handles such juveniles, including Eighth Amendment analyses of juvenile executions under the U.S. Constitution. The article also discusses community consensus regarding evolving standards of decency, describes international law on the capital punishment of juveniles, and outlines worldwide trends in juvenile executions. It then defines and describes the concepts of customary international law and jus cogens, applying these concepts to the problem of the execution of juveniles in the United States. The article concludes by suggesting that there is a moral imperative for universal prohibition of juvenile capital punishment and by speculating about the domestic effects of applying such a jus cogens norm in the United States.  相似文献

An effort is underway in the Asia-Pacific region to carry out multidisciplinary prevention research, with an emphasis on understanding health-related behaviors. In partnerships with the U.S. Centers for Disease Control, the U.S. Public Health Service, international health agencies, governments, and universities in the region, researchers at the University of Hawaii are pursuing a paradigm for international, multicultural prevention research in the field of health promotion and disease prevention. An integrated framework for guiding a program of research is discussed along with several factors that present challenges to the conduct of prevention research in the Asia-Pacific region.  相似文献

The practice of research is full of ethical challenges, many of which might be addressed through the teaching of responsible conduct of research (RCR). Although such training is increasingly required, there is no clear consensus about either the goals or content of an RCR curriculum. The present study was designed to assess community standards in three domains of research practice: authorship, collaboration, and data management. A survey, developed through advice from content matter experts, focus groups, and interviews, was distributed in November 2010 to U.S. faculty from 50 graduate programs for each of four different disciplines: microbiology, neuroscience, nursing, and psychology. The survey addressed practices and perceived standards, as well as perceptions about teaching and learning. Over 1,300 responses (response rate of 21 %) yielded statistically significant differences in responses to nearly all questions. However the magnitude of these differences was typically small, leaving little reason to argue for community consensus on standards. For nearly all questions asked, the clear finding was that there was nothing approaching consensus. These results may be useful not so much to teach what the standards are, but to increase student awareness of the diversity of those standards in reported practice.  相似文献

The question of whether U.S. employment discrimination laws apply to international employers is complex and involves multiple sources of legal authority including U.S. statutes, international treaties, and the laws of non-American host countries. This article provides detailed and simplifying guidance to assist employers in working through that complexity. Based on an examination of 98 federal courts cases, this article identifies and explains 8 general guidelines for determining when U.S. laws apply to international employers (e.g., U.S. employees working abroad or "foreign" employees working in the United States). These guidelines are incorporated into an organizing framework or "decision tree" that leads employers through the various decisions that must be made to determine whether U.S. discrimination laws apply in a wide range of international employment situations. Guidance for industrial and organizational (I-O) psychologists who advise international employers is provided and summarized in terms of general recommendations and conclusions.  相似文献

A task like “moving a meeting forward” reveals the ambiguity inherent in temporal references. That speakers of U.S. English do not agree on how to solve it is well established: Roughly one half moves the meeting futurewards, the other half pastwards. But the extent to which individual speakers, rather than groups of speakers, consider such phrases as ambiguous has not been scrutinized. Does the split in readings result from a lack of intraindividual consistency or from a lack of interindividual consensus? And how specific is U.S. English in this regard when compared to other closely related Germanic languages? Based on a taxonomy of spatiotemporal frames of reference (FoRs), we conducted two experiments with speakers of Swedish, U.S. English, and German to assess individual preferences for temporal FoRs, intra- and cross-linguistic variability, consistency and long-term stability of these preferences, and possible effects of priming a spatial FoR. The data reveal cross-linguistic differences, both in terms of which temporal FoRs speakers prefer (the absolute FoR in Sweden, the intrinsic FoR in German, and both of these in the US) and in terms of the extent to which these preferences are shared and stable (high consensus and consistency in Sweden and Germany, and low consensus and partial consistency in the US). Overall, no effect of spatial priming was observed; only speakers of U.S. English with a baseline preference for the absolute temporal FoR seemed to be susceptible to spatial priming. Thus, the assumption that temporal references are affected by spatial references is only weakly supported.  相似文献

Psychocultural analysis stands as a signal accomplishment of the 1930s U.S. assimilation of European refugee-intellectuals. Scholars in the U.S. had been moving toward a kind of psychocultural analysis well in advance of the Great Migration--the U.S. was not an intellectual vacuum or wasteland--nevertheless, it was through their interdisciplinary collaboration, fueled by the specter of war, that these international peers stimulated one of the most wide-ranging, dynamic, and productive exchanges of ideas of the century. The relationships among acculturation, internalization of U.S. sociocultural standards of female beauty, and body dissatisfaction were examined in a sample of 211 Mexican American college women. Structural equation modeling was used to identify the paths among these three factors. Results demonstrated that there are two distinct types of body dissatisfaction: global evaluations and composite site-specific evaluations. The relationships between acculturation toward dominant U.S. culture and both types of body dissatisfaction were found to be fully mediated by internalization of U.S. standards of female beauty. There were no relationships between Mexican orientation and any of the study variables. The results from this study imply that it is important for therapists working with Mexican American female clients to assess the client's level of acculturation, examine the cultural (U.S. and Mexican) messages the client receives, and explore how these messages impact her body image.  相似文献

There is an international consensus that medical research involving humans should only be undertaken in accordance with ethical principles. Paradoxically though, there is no consensus over the kinds of activities that constitute research and should be subject to review. In the UK and elsewhere, research requiring review is distinguished from clinical audit. Unfortunately the two activities are not always easy to differentiate from one another. Moreover, as the volume of audit increases and becomes more formal in response to the demand for evidence-based practice in medicine, the overlap between research and audit grows more acute. Arguably, similar ethical standards and systems for ensuring that those standards are met should be applied regardless of whether or not a project is classified as research or audit. At a time when the research ethics review system in the UK is undergoing significant reform it is important that the opportunity is not missed to address the longstanding research-audit problem. We discuss suggestions for further reform that addresses this issue.  相似文献

IOWA incident provides a case study of the problems with reconstructive psychological evaluations. The US. Navy attributed the explosion on board the U.S.S. IOWA to the intentional suicidal acts of Gunner's Mate Clayton Hartwig, a conclusion supported primarily by an Equivocal Death Analysis (EDA) conducted by the FBI. Systematic analysis of the reports of the expert panelists who consulted to the NASC reveals that 11 of the 14 panelists were critical of the conclusions reached by the Navy/FBI. There was considerable variability among the judgments of the panelists, who reached consensus only for broad categories. Because the reliability and validity of postmortem psychological reconstructions such as EDA and psychological autopsy have not been established, clinicians are urged to exercise caution in the use of such procedures and to be sensitive to ethical obligations to consumers when using such techniques.  相似文献

Bauer, Taub, and Parsi's review of an international sample of standards on informed consent, confidentiality, commercialization, and quality of research in tissue banking reveals that no clear national or international consensus exists for these issues. The authors' response to the lack of uniformity in the meaning, scope, and ethical significance of the policies they examined is to call for the creation of uniform ethical guidelines. This raises questions about whether harmonization should consist of voluntary international standards or international regulations that include an official oversight mechanism and sanctions for noncompliance, and about who should participate in the harmonization process. Moreover, the normative assumptions and political dynamics that shape global policymaking need to be addressed. This commentary explores the policy implications and normative questions raised by the idea of international ethical guidelines for the use of biotechnologies and biotechnological resources such as stored samples of human tissue.  相似文献

This article describes the education portion of an ongoing grant-sponsored education and research project designed to help graduate students in all engineering disciplines learn about the basic ethical principles, rules, and obligations associated with engineering practice in the United States. While the curriculum developed for this project is used for both domestic and international students, the educational materials were designed to be sensitive to the specific needs of international graduate students. In recent years, engineering programs in the United States have sought to develop a larger role for professional ethics education in the curriculum. Accreditation requirements, as well as pressures from the private sector, have helped facilitate this shift in focus. Almost half of all engineering graduate students in the U.S. are international students. Further, research indicates that the majority of these students will remain in the U.S. to work post-graduation. It is therefore in the interest of the profession that these students, coming from diverse backgrounds, receive some formal exposure to the professional and ethical expectations and norms of the engineering profession in the United States to help ensure that they have the knowledge and skills—non-technical as well as technical—required in today’s engineering profession. In becoming acculturated to professional norms in a host country, international students face challenges that domestic students do not encounter; such as cultural competency, language proficiency, and acculturation stress. Mitigating these challenges must be a consideration in the development of any effective education materials. The present article discusses the project rationale and describes the development of on-line instructional materials aimed at helping international engineering graduate students acclimate to professional engineering ethics standards in the United States. Finally, a brief data summary of students’ perceptions of the usefulness of the content and instructional interface is provided to demonstrate the initial effectiveness of the materials and to present a case for project sustainability.  相似文献

The ethics-related beliefs of Chinese international graduate students are heavily influenced by their academic cultural background, and given the nature of that culture, they often face challenges when adapting to the U.S. academic environment. This qualitative study examines Chinese graduate students’ perceptions of the differences between Chinese and American academic integrity practices and the effects of those differences on their ethical practices and adaptations in a graduate program in the United States. Data were collected via semistructured interviews in a public university in the United States. Findings suggest that perceptions of academic integrity in Chinese universities are influenced by Confucian philosophy, collectivist assumptions, and a resultant convenience mind-set. These cultural premises clash with academic expectations in the United States. Participants describe how they, and their Chinese peers, navigate U.S. integrity standards and provide recommendations for ways that U.S. schools can help them better adjust. Realizing the ideal of democracy requires political inclusion for citizens. A legitimate democracy must give citizens the opportunity to express their attitudes about the relative attractions of different policies, and access to political mechanisms through which they can be counted and heard. Actual governance often aims not at accurate belief, but at nonepistemic factors like achieving and maintaining institutional stability, creating the feeling of government legitimacy among citizens, or managing access to influence on policy decision-making. I examine the traditional relationship between inclusiveness and accuracy, and illustrate this connection by discussing empirical work on how group decision-making can improve accuracy. I also advance a Generic Epistemic Principle that any evidence-based decision-making procedures must embrace. Focusing on policy-making, I then measure the distance between these standards and the ones actually implemented in U.S. political settings. Psychological research on individual and group decision-making is a source of normative assessment for existing policy judgment, but it neither rationalizes nor legitimates the actual and typical processes used in U.S. institutions of political decision making. To establish this point, I focus on one characteristic government institution—the U.S. House of Representatives Committee on Science, Space, and Technology—that displays deliberative processes at odds with the sciences they advocate, and with the Generic Epistemic Principle. I explain this discouraging condition in terms of several inveterate factors in U.S. politics: a limitlessly money-driven and endless campaigning process that effectively forces elected representatives to align themselves with money and vote strategically, the use of procedural arrangements known to make people feel politically included when they are not, and the unresponsiveness of a majoritarian (vs. consensus) democracy.  相似文献

International students face social, psychological and academic challenges upon moving to a foreign country to pursue higher education. Clinical disciplines such as genetic counseling present additional challenges adapting to an unfamiliar health care system and different interactions and expectations with patients and colleagues. This study used semi-structured interviews to identify challenges that international genetic counseling students face during training in the United States. Eight international genetic counseling alumni who graduated from U.S.-accredited programs were interviewed. Participants stated that the U.S. academic system was unfamiliar—class participation and paper-writing required the greatest adjustment. There was a need for help in understanding social norms in academic settings. Clinically, they were unfamiliar with the dynamics and communication style of U.S. families. Non-native English speakers experienced greater difficulty in all areas. Most participants reported that they were uncomfortable asking for help in transitioning to life, study and work. Participants identified mentorship programs for international students as potentially useful in clarifying expectations in academic and clinical settings. These results may assist international students preparing to study genetic counseling in the U.S. and may help genetic counseling training programs identify the academic and clinical challenges faced by international students.  相似文献

International students have unique personal and academic challenges during their training in genetic counseling programs across the United States (U.S.). Previous research has explored their motivations and experiences; however, there is scant research on how their international status affects the post-graduate experience. The current study used semi-structured phone interviews to explore the professional issues that international students face throughout their educational and professional careers. Twenty-six participants were interviewed including international genetic counseling students in their second years of training and international genetic counselors who graduated from a U.S.-accredited program. Participants included six, second-year students, twelve genetic counselors employed in the U.S., six employed in Canada, and one employed in the United Kingdom (U.K.). Qualitative analysis of interviews captured the common experiences and challenges international students faced during their training and post-graduation. Participants stated that they applied to programs in the U.S. because there is wide transferability of qualifications across the world, and there is limited or no opportunities for masters level genetic counseling training in their home country. Most participants who had applied for jobs in the U.S. experienced difficulties regarding unfamiliarity of human resources (HR) departments and Border Control Officers with international genetic counselors (GCs) and their visa requirements. The results suggest that currently there are insufficient job resources tailored to international genetic counselors, and an inadequate availability of peer support. The results also speak to the need to develop resources for prospective international students and for international GCs seeking jobs, and establishment of a peer support network. These resources may also provide assistance to genetic counseling training programs and employers to address the challenges faced by international genetic counselors.  相似文献

This research examines propositions of international image theory in the context of Turkey‐U.S. relations. Study 1 derives and tests hypotheses regarding the interrelationships among theory components—perceived strategic relations, images, and behavioral tendencies. In addition, it extends image theory research by examining (1) the role of emotions, as well as (2) how variations in the strength of ingroup identifications (national and religious identity) inform our understanding of international images. Study 2 extends the findings of Study 1 by considering different dimensions of cultural status (cultural heritage vs. modernity) and by differentiating two targets of emotion: the U.S. government versus American citizens. Evidence is provided regarding the need for incorporation of emotions and group identifications onto the image theory framework. The results point to the need for more investigation of images and their relationships with other components of the theory in various intergroup contexts.  相似文献

Using a sample of 982 leader-subordinate dyads drawn from nine different organizations in the Republic of China (i.e., Taiwan), self-ratings of performance were compared with supervisory ratings of subordinate performance. Results indicated that Chinese employees rated their job performance less favorably than did their supervisors (i.e., they exhibited a modesty bias). This modesty bias occurred relatively uniformly across gender, various educational levels, and age groups. These results are contrary to the typically reported U.S. finding that self-ratings of performance are more lenient than are supervisory ratings. A further comparison of the means of supervisory and self-ratings between this study and previous U.S. research revealed that the modesty bias appeared to be produced by the lower self-ratings made by Chinese workers as compared to their U.S. counterparts. The findings suggest that culture plays a critical role in shaping workers' perceptions of their own work performance. Results of this study are discussed in terms of their implications for future research and practice in international human resource management.  相似文献

The purpose of this paper is to consider whether standards-based school reform is an acceptable strategy for achieving a politically legitimate school system according to a principle of personal liberty. First, it briefly describes the purpose and implementation of standards-based school reform in the U.S. It then considers the ramifications of the principle of personal liberty for the conduct of public schooling, arguing that it requires children’s access to and appreciation of a variety of liberty-consistent cultures in their society coupled with the development of children’s ability to think critically about those cultures and their meaning as possibilities for their own lives. Third, it considers whether some standards for public education might be consistent with this purpose of education and finds that certain outcome and process standards may be appropriate. Finally, it considers whether these kinds of standards are included in standards-based reform as it is currently practiced or proposed in the U.S. and concludes that they are not. Workplace mentoring in the international context is an emerging research area with significant potential for global integration. However, although measurement equivalence is a prerequisite for examining cross-cultural differences, this assumption has yet to be examined in mentoring research. This study contributes to the mentoring literature by assessing the measurement equivalence of the Mentoring Functions Questionnaire (MFQ-9) across two diverse cultural settings, the U.S. and Taiwan. Results of a series of multi-group confirmatory factor analyses supported full configural invariance, full metric invariance, and partial scalar invariance across the two groups. These findings suggest MFQ-9 may provide acceptable comparisons and meaningful interpretations across cultures. Implications for future international mentoring research and managerial practice are discussed.  相似文献
