The authors describe the American Psychological Association's (APA's) efforts to affect social policy and judicial decision making by delineating APA's participation as amicus curiae in five cases concerning the civil rights of lesbians and gay men. They discuss the function and importance of amicus briefs, review the legal principles used to advance the constitutional rights of lesbians and gay men, outline the facts in the cases APA entered, sketch the legal theories and scientific evidence that APA brought to the courts' attention, and relate the courts' decisions in those cases. They conclude with recommendations for the use of such briefs in future litigation and legislative efforts to advance the rights of lesbians and gay men.  相似文献

During the AIDS crisis, natural law arguments have turned up again not only in relation to anti-sodomy arguments, but even as parts of important claims about AIDS prevention made by the medical and scientific community. Such arguments were invoked by the state of Georgia in the 1986 Supreme Court case, Bowers v. Hardwick , in which the Court held that the Constitution does not confer a fundamental right upon homosexuals to engage in sodomy. As we shall see, the Court accepted a version of legal moralism ignoring both the relevance of a right to privacy and two friend-of-the-Court briefs urging them to consider the public health implications of prohibiting homosexual sodomy. I want to argue against legal moralism both in its standard form and in a more sophisticated version that permits natural law arguments a place in legal reasoning. Natural law arguments have aggravated the AIDS crisis by contributing not only to bad law but to bad science.  相似文献

This article examines the legal histories and social contexts of testimony and interrogation involving minors, developmental research on suggestibility and judgment, interactions between development and legal/sociological contexts, and the reasoning behind how minors are treated in different legal contexts. The authors argue (a) that young witnesses, victims, and suspects alike possess youthful characteristics that influence their ability to validly inform legal processes, some of which were recently recognized by the Supreme Court as they apply to the juvenile death penalty, and (b) that consideration should be given to reforming current practices in the context of juvenile interrogation. Psychologists testified at the trials of Brown v. Board of Education and helped write briefs that were submitted to the Supreme Court on appeal. Psychologists were once proud of what they did in Brown but are now seen as liberal reformers who masked their political wishes in the guise of social science. The argument that psychologists involved with Brown were social reformers rather than objective scientists dates to the segregationist critique of Brown. The author traces the history of the critique of the Brown psychologists from its segregationist origins to its acceptance by mainstream social scientific and historical scholars. The author concludes that the critique is based on a misreading of what the Brown psychologists did during the litigation.  相似文献

采用父母冲突儿童知觉量表(CPIC)、父母关系安全感量表(SIS Scale)和社交焦虑分量表调查480名高中生,运用偏差矫正的百分位Bootstrap方法探索青少年对父母冲突的威胁知觉和情绪不安全感在父母冲突水平与青少年社交焦虑之间的序列中介作用。本研究同时检验认知情境理论和情绪安全感理论,发现青少年对父母冲突的威胁知觉对其情绪不安全感的不同维度存在不同影响,从而更为完善地揭示父母冲突影响青少年社交焦虑的内部机制。具体来说,父母冲突主要通过三条途径影响青少年社交焦虑:通过威胁知觉的中介作用;通过情绪不安全感,特别是消极表征的中介作用;通过依次影响威胁知觉和情绪不安全感(特别是消极表征和情绪失调)而正向预测青少年社交焦虑。  相似文献

将中学生科学创造力测验施测于英国6所中学的1190名青少年及中国2所中学的1087名青少年的研究,得出如下结论:第一,青少年的科学创造力存在显著的年龄差异。随着年龄的增大,青少年的科学创造力呈持续上升趋势,但在14岁时要下降;11-13岁、14-16岁是青少年的科学创造力迅速发展的关键时期;第二,青少年的科学创造力存在性别差异。英国女生的科学创造力比男生强,差异显著;中国男生的科学创造力比女生强,差异不显著;第三,中英青少年的科学创造力存在显著的差异。在创造性的问题解决能力方面,中国青少年明显高于英国青少年,但中国青少年在其它方面的科学创造力及总成绩则明显低于英国青少年;第四,中国青少年的科学创造力存在显著的学校类型差异。重点中学学生的科学创造力显著高于普通中学学生的科学创造力。  相似文献

Research on adolescent social cognition has had an enormous impact on how the justice system conceptualizes adolescent legal responsibility and deals with adolescents who commit crimes. Such research also has broader implications for adolescent legal socialization, which have been largely underdeveloped. A renewed effort to connect psychological research with legal policy must expand beyond these beginnings to focus on all adolescents and their engagement in broader social institutions. Specifically, a consideration of the unique capacities for growth and development during the adolescent years should be leveraged toward fostering positive outcomes like community identity, academic and social achievement, and the development of an orientation toward law based upon legitimacy and trust. Studies suggest that a key component of positive socialization is dealing with authorities one experiences as procedurally just. Researchers focused on issues of juvenile justice should also expand their focus to consider how the social climate in institutions such as schools can be designed to take advantage of the unique capacities adolescents have for exploring identity and connecting with peers in developing their orientation to the law and legal authorities.  相似文献

采用问卷法,以339名中学生为被试,通过无拘束结构方程模型分析方法探讨了神经质人格特征与互联网服务偏好的交互作用对网络成瘾的影响。研究发现在对网络成瘾的影响上,神经质人格与互联网社交、娱乐和信息使用偏好存在显著的交互作用,但与互联网交易服务不存在显著的交互作用:(1)从平均影响来看,互联网社交、娱乐和交易使用偏好以及神经质人格对网络成瘾有显著的正向影响,而互联网信息使用偏好对网络成瘾没有显著影响;(2)在神经质高分组中,互联网社交、娱乐和信息服务偏好与PIU的正向关系都是最强的;在神经质低分组中,互联网社交服务偏好与PIU的正向关系最弱,而互联网娱乐和信息服务偏好与PIU甚至呈现出微弱的反向关系;(3)即便是高神经质人格类型的青少年,对信息服务的偏好也不容易使其卷入PIU;而对于低神经质人格类型的青少年来说,即便是偏好社交和娱乐服务,也不容易卷入PIU  相似文献

Whether the US Constitution guarantees a right to conduct scientific research is a question that has never been squarely addressed by the United States Supreme Court. Similarly, the extent to which the First Amendment protects the right to communicate the results of scientific research is an issue about which there is scant judicial authority. This article suggests that a crucial guidepost for exploring both these uncharted areas of constitutional law should be whether restrictions on scientific research or communication truly implicate fundamental individual rights or instead primarily concern issues of general social welfare—issues that in a democracy are properly decided by the representative branches of government or their delegates, not by the judiciary.  相似文献

以675名初中和高中学生为被试,采用社会网络分析方法,获得506名青少年在其班级中的网络中心度,并确定他们所属的同伴团体,在此基础上考察同伴团体的行为规范对其问题行为的影响。结果发现:(1)在控制了班级层次的问题行为水平和其他相关变量后,同伴团体的问题行为水平能够正向预测青少年自身的问题行为;(2)青少年在同伴团体内部的地位能负向预测青少年的问题行为,青少年在班级社交网络中的度数中心度能正向预测其问题行为,而中介中心度能负向预测其问题行为;(3)交互作用分析表明:同伴团体的问题行为水平主要对低中介中心度的青少年产生显著影响;仅在问题行为水平较高的同伴团体中,青少年的度数中心度正向预测其问题行为。  相似文献

As part of the International Self-Identity Research Project, this study explored sources of identity among Turkish adolescents. The interview sample consisted of three male and three female high school students in Ankara, Turkey. The results indicated that social, familial, personal, physical, and moral-ethical dimensions contributed to adolescents' definitions of self, but to different degrees. Social and familial dimensions were very influential and were used as reference points for defining self in other areas. Physical and personal aspects of identity were also apparent, but were not as salient as social and familial dimensions. Patriotism and religion played a role in moral-ethical identity. Overall, self-identity influenced emotional state, cognitive and behavioral functioning, and social relations to a significant degree.  相似文献

The relationship of characteristics of the social environment to the adaptation of adolescents from high-risk predisposing environments was examined. Specifically, the degree to which adolescents' perceptions of various dimensions of their family and school environment as well as sources of social support related to differential levels of personal well-being and academic adjustment was explored. Multiple regression analyses revealed differences in the salience of the dimensions of the social environment as a function of the particular sphere of functioning under consideration. Implications of the findings for developing a model for understanding the relative vulnerability of individuals at risk as well as of the design of preventive interventions are discussed.  相似文献

During these 20 years the rights of patients and the autonomy of the person have been considerably strengthened. This study examined whether justification of violence beliefs and social problem solving mediated between maltreatment experiences and aggressive and delinquent behavior in adolescents. Data were collected on 191 maltreated and 546 nonmaltreated adolescents (ages 14 to 17 years), who completed measures of justification of violence beliefs, social problem-solving dimensions (problem orientation, and impulsivity/carelessness style), and psychological problems. Findings indicated that maltreated adolescents' higher levels of delinquent and aggressive behavior were partially accounted for by justification of violence beliefs, and that their higher levels of depressive symptoms were partially mediated by a more negative orientation to social problem-solving. Comparisons between boys and girls indicated that the model linking maltreatment, cognitive variables, and psychological problems was invariant.  相似文献

互联网上的信息服务为青少年的个性化学习提供了可能,如何使青少年健康地进行网上冲浪,使他们在冲浪的过程中增强自律意识,就需要我们深入地了解互联网信息服务在哪些方面能够满足青少年的需要。该研究通过对339名中学生进行问卷调查,对青少年的人格特征、社会支持与互联网信息服务之间的关系进行了探讨,结果表明:(1)开放性、客观社会支持和对社会支持的利用对互联网信息服务的使用偏好有直接而显著的影响。(2)宜人性和外向性通过社会支持的三个方面间接地对互联网信息服务的使用偏好产生影响。(3)客观社会支持会影响主观社会支持,主观社会支持对社会支持的利用水平也有影响。  相似文献

In this study a mediational model was constructed to examine relationships between refined measures of childhood and adolescent social capital and the aspirations of adolescents with varying academic capital and from differing social status and ethnic backgrounds. Longitudinal data were collected from 460 16-year-old Australians and their parents from Anglo-Australian, Greek, and Southern Italian groups. Using partial least squares path modeling the findings suggest: (a) family background, childhood social and academic capital, and adolescents' social capital combine to have medium to large associations with adolescents' aspirations, and that the associations are larger for educational aspirations than for occupational aspirations and stronger for males than for females; (b) the mediational model is more successful in explaining family background differences in educational aspirations than variations in occupational aspirations; and (c) after taking into account social and academic capital, Greek males continue to have higher occupational aspirations than do Anglo-Australian and Southern Italian males, and sons of fathers with high social status continue to have higher occupational aspirations than do other male adolescents. The investigation indicates that within encompassing family backgrounds, differences in educational outcomes should be examined in relation to children's and parents' perceptions of social and cultural capital and to variations in children's academic capital.  相似文献

以来自河南省农村的400名双亲外出、单亲外出和非留守青少年为被试,考察了他们的社会支持网络状况,及其与青少年抑郁、孤独的关系.变量中心和个体中心的分析均表明,青少年所知觉的来自父亲、母亲、同学和老师的支持具有一致性,同一环境中各类社会支持的一致性更高.变量中心的分析发现,总体上,老师支持和父亲支持能够显著地预测青少年的抑郁水平,母亲支持和同学支持能够显著地预测青少年的孤独.但是,不同社会支持源的预测作用因青少年留守状况的不同而不同.个体中心的分析发现,处于高母亲/高父亲/高同学/高老师支持网络下青少年的抑郁和孤独水平低于其他支持网络中的青少年.  相似文献
