abstract   In this paper I take seriously von Hirsch's view that sanctions imposed on offenders need to be compatible with their dignity, and argue that some versions of restorative justice — notably that defended by Braithwaite — can put offenders in the humiliating position of having to make apologies that they do not believe in in order to avoid further bad consequences. Drawing on recent work by Duff I argue that this problem can be avoided by conceiving of restorative justice as an apologetic ritual. This view gives some ground to von Hirsch but presents a view of criminal justice that is distinctively restorative. I conclude by drawing out the differences between my account and that of Duff.  相似文献

The subject of this paper is sentimentalism. In broad terms this is the view that value concepts, moral concepts, practical reasons—some or all of these—can be analysed in terms of feeling, sentiment or emotion. More specifically, the paper discusses the following theses:
  1. there are reasons to feel (‘evaluative’ reasons) that are not reducible to practical or epistemic reasons
  2. value is analysable in terms of these reasons to feel.
  3. all practical reasons are in one way or another grounded in evaluative reasons.

This essay focuses on what patriotism is, as opposed to the value of patriotism. It focuses further on the basic patriotic motive: one acts with this motive if one acts on behalf of one’s country as such. I first argue that pre-theoretically the basic patriotic motive is sufficient to make an act patriotic from a motivational point of view. In particular the agent need not ascribe virtues or achievements to his country nor need he feel towards it the emotions characteristic of love. Why should one ever act on behalf of one’s country as such, if one does not particularly admire it or feel a special affection for it? In answer to this question I offer a further articulation of the basic patriotic motive, invoking a particular understanding of what it is to be the member of a political society. Building on this articulation I then consider how one might characterize a patriotic act, a patriotic person, and the relationship of patriotism and pride.  相似文献

Several conjectures by A. S. Iberall on life and mind are used as a backdrop to sketch a theory of mental activity that respects both the contents of thought and the dynamics of thinking. The dynamics, in this case, refers fundamentally to animated, meaningfully coupled self-organizing processes (coordination dynamics) and exhibit multistability, switching, and, because of symmetry breaking, metastability. The interplay of 2 simultaneously acting forces underlies the metastable mind: the tendency for the coordinating elements to couple together (integration) and the tendency for the elements to express their individual autonomy (segregation). Metrics for metastability are introduced that enable these cooperative and competitive tendencies to be quantified. Whereas bistability is the basis for polarized, either/or thinking, the metastable régime—which contains neither stable nor unstable states, no states at all, in fact—gives rise to a far more fluid, complementary mode of operation in which it is possible for apparent contraries to coexist in the mind at the same time.  相似文献

Creativity and innovation are at the core of important outcomes such as economic and sales growth, production of articles and students' learning. Thus, it is not surprising to find research articles on creativity and innovation across different disciplines such as business, psychology, and education. Given the importance of understanding creativity and innovation, we reviewed the empirical literature examining the antecedents and consequences of creative self-efficacy in the work domain. Our review used the theory of individual creative action and social cognitive theory as guiding frameworks to place creative self-efficacy in the creativity and innovation process, define creativity and innovation, explore how creative self-efficacy has been measured, examine the antecedents and consequences of creative self-efficacy, point out gaps in knowledge and offer suggestions for future research and provide some applied implications. One important finding was that creative self-efficacy has made a significant contribution as a process variable explaining how several organizational and personal factors influence creative outcomes via their influence on creative self-efficacy.  相似文献

Philosophers have taken little heed of the fact that people often act contrary to their better judgment not because they suffer a volitional infirmity like weakness of will or compulsion but instead because they care too little about what they judge best (they are unconcerned) or they care too much about something else (they are compromised). Unconcerned and compromised action, being varieties of akratic action that do not involve volitional infirmity, are phenomena worth examining not only in their own right but also for what they reveal about the better known varieties of akratic action for which they might easily be mistaken, such as weak-willed action and action (or inaction) that stems from accidie. Unconcern and compromise also are worth examining for what they reveal about a topic beyond philosophical psychology, namely, moral and legal accountability. Forgiveness, resentment, and retributive punishment each may have less to do with what an offender (morally) believes than with what he cares about.  相似文献

Theories of deindividuation predict that the formation of a group serves to decrease the inhibitions of the constituent members and increase the probability of aggression in situations where the group must compete, or interact, with nongroup members. This prediction is tested in a real-world confrontation situation-that of police on patrol. It was hypothesized that the level of violence individual officers encounter in the performance of specific activities will vary according to the nature of the activity and the degree of anxiety associated with that activity, the number of officers present, and the number of civilian bystanders. The data of the study provide support for each of these predictions and demonstrate the extent to which social psychological theory can provide useful insights into day-to-day behaviors.  相似文献

Bhikhu Parekh is an internationally renowned political theorist. His work on identity and multiculturalism is unquestionably thoughtful and nuanced, benefiting from a tremendous depth of knowledge of particular cases. Despite his work’s many virtues, however, the normative justification for Parekh’s recommendations is at times vague or ambiguous. In this essay, I argue that a close reading of his work, in particular his magnum opus Rethinking Multiculturalism and the selfproclaimed “sequel” A New Politics of Identity, reveals that his claims frequently rely upon a Kantian account of moral dialogue and indeed moral personhood that he remains unwilling to claim. Recognizing this latent Kantianism is essential to a thorough assessment of Parekh’s work on identity, and his criticisms of other theorists. It is only because of his ambiguity that his multiculturalism is able to avoid the sort of charges that he levels against other responses to diversity, including those of such authors as Rawls, Habermas, Kymlicka, and Raz.  相似文献

In this introductory article to the special issue, I explore the trope of paradox to think through the idea of creativity. Traditionally, metaphor has been the favored trope to conceptualize creativity: the combination of two existing elements into something different, something new. In this special issue, we focus on the trope of paradox as a trope defined by juxtaposition and an apparently irresolvable conflict to delineate creativity. Glossing the usefulness of paradox for artistic as well as scientific creativity, I show how the idea of Janusian thinking or being in two minds holds great potential to bridge creativity research in the humanities and social sciences. This issue starts building that bridge with multidisciplinary perspectives on creativity that, first, deconstruct apparent dichotomies in creativity research and, second, approach creativity as a situated, distributed concept.  相似文献
