This study examined the quality of interview instructions and rapport-building provided by prosecutors to 168 children aged 5–12 years testifying in child sexual abuse cases, preceding explicit questions about abuse allegations. Prosecutors failed to effectively administer key interview instructions, build rapport, or rely on open-ended narrative producing prompts during this early stage of questioning. Moreover, prosecutors often directed children's attention to the defendant early in the testimony. The productivity of different types of wh- questions varied, with what/how questions focusing on actions being particularly productive. The lack of instructions, poor quality rapport-building, and closed-ended questioning suggest that children may not be adequately prepared during trial to provide lengthy and reliable reports to their full ability. Intellectualism about knowledge‐how is the view that practical knowledge is a species of propositional knowledge. I argue that this view is undermined by a difference in properties between knowledge‐how and both knowledge‐that and knowledge‐wh. More specifically, I argue that both knowledge‐that and knowledge‐wh are easily transmitted via testimony while knowledge‐how is not easily transmitted by testimony. This points to a crucial difference in states of knowledge. I also consider Jason Stanley's attempt to subsume knowledge‐how under an account of de se knowledge. I argue that there are crucial differences between de se knowledge and knowledge‐how. Thus, this paper advances both the discussion of intellectualism and the literature on the nature of de se knowledge.  相似文献

This article argues that investigators doing developmental and social research with children have, for the most part, failed to acknowledge the inherent implications of their work for children's rights. The impact of these studies upon children's rights occurs at every stage; from hypothesis formulation to hypothesis testing to dissemination of findings. This paper addresses the issue in the context of developmental research on children's ability to report experienced events accurately. This particular research area has generated data that has been extrapolated to legal contexts and created a foundation for assumptions about the credibility of child witnesses. This in turn has had profound effects on children's right to be heard and the weight given to their testimony. The argument is made that there is a need for social scientists to explicitly articulate how their work may impact upon children's rights and what is in fact the social agenda in this regard underlying their research.  相似文献

The manner in which teachers mediate children's learning varies across early childhood classrooms. In this study, we used a multielement design to evaluate the efficacy of three commonly implemented strategies that varied in teacher directedness for teaching color‐ and object‐name relations. Strategy 1 consisted of brief exposure to the target relations followed by an exclusively child‐led play period in which correct responses were praised. Strategy 2 was similar except that teachers prompted the children to vocalize relations and corrected errors via model prompts. Strategy 3 incorporated the same procedures as Strategy 2 except that a brief period of teacher‐initiated trials was arranged; these trials involved the use of prompt delay between questions and prompts, and correct responses resulted in tokens and back‐up activity reinforcers. Children's preferences for the different teaching strategies were also directly assessed. Strategy 3 was most effective in promoting the acquisition and generalization of the color‐ and object‐name relations and was also most preferred by the majority of children, Strategy 1 was the least effective, and Strategy 2 was typically the least preferred. Implications for the design of early educational environments based on evidence‐based values are discussed.  相似文献

Psychological experts have been used increasingly to testify in child sexual abuse cases, yet little research has investigated what specific factors make experts effective. This study examined the potential effects that credentials, evidence strength and coherence may have on juror decision making. Sixty‐four mock jurors read cases of child sexual abuse, followed by experts' testimony and rated guilt of the defendant, effectiveness of the expert testimony and credibility of the victim. Evidence strength and coherence of the testimony affected all dependent variables, and the interaction was significant. Guilt ratings of the defendant were lower and the victim was rated as less credible when both evidence strength and coherence were low. The credentials of the expert, however, had negligible impact. These findings indicate that experts can be effective and impact jurors when testimony is either high in coherence or high in evidence. Copyright © 2009 John Wiley & Sons, Ltd.  相似文献

This special issue addresses a neglected but important topic in our field: strengthening the child‐ and youth‐serving workforce. Investing in this workforce should be a national priority because considerable evidence has shown that investments in early childhood education and development, particularly in low‐resource contexts, that are reinforced through skills‐based programs in adolescence and adulthood, have beneficial impacts throughout life. Investing in quality child‐ and youth‐serving programs also has the additional benefit of creating a productive and capable future workforce. The editors and authors of the special issue should be commended for producing the first special issue on this topic in our field or in related fields, one that is long overdue. Articles in this issue survey the landscape of an amorphous and complex area of practice and research and describe key challenges for the field. In this commentary, I offer organizing frameworks to characterize the child‐ and youth‐serving workforce, note emerging issues when addressing specific challenges, and identify areas for future research.  相似文献

Two experiments demonstrate that 14‐ to 18‐month‐old toddlers can adaptively change how they categorize a set of objects within a single session, and that this ability is related to vocabulary size. In both experiments, toddlers were presented with a sequential touching task with objects that could be categorized either according to some perceptually salient dimension corresponding to a taxonomic distinction (e.g. animals vs. vehicles) or to some less obvious dimension (e.g. rigid vs. deformable). In each experiment, children with larger productive vocabularies responded to both dimensions, showing evidence of sensitivity to each way of categorizing the items. Children with smaller productive vocabularies attended only to the taxonomically related categorical grouping. These experiments confirm that toddlers can adaptively shift the basis of their categorization and highlight the dynamic interaction between the child and the current task in early categorization.  相似文献

Why are some young children consistently willing to believe what they are told even when it conflicts with first‐hand experience? In this study, we investigated the possibility that this deference reflects an inability to inhibit a prepotent response. Over the course of several trials, 2.5‐ to 3.5‐year‐olds (N = 58) heard an adult contradict their report of a simple event they had both witnessed, and children were asked to resolve this discrepancy. Those who repeatedly deferred to the adult's misleading testimony had more difficulty on an inhibitory control task involving spatial conflict than those who responded more skeptically. These results suggest that responding skeptically to testimony that conflicts with first‐hand experience may be challenging for some young children because it requires inhibiting a normally appropriate bias to believe testimony.  相似文献

Testimony is the mainstay of human communication and essential for the spread of knowledge. But testimony may also spread error. Under what conditions does it yield knowledge in the person addressed? Must the recipient trust the attester? And does the attester have to know what is affirmed? A related question is what is required for the recipient to be justified in believing testimony. Is testimony‐based justification acquired in the same way as testimony‐based knowledge? This paper addresses these and other questions. It offers a theory of the role of testimony in producing knowledge and justification, a sketch of a conception of knowledge that supports this theory, a brief account of how trust of others can be squared with critical habits of mind, and an outline of some important standards for intellectual responsibility in giving and receiving testimony.  相似文献

Recent research indicates that preschoolers make sophisticated choices in accepting testimony as a source of knowledge. Nonetheless, many children accept fantastical beings as real based on misleading testimony. The present study probes factors associated with belief in a novel fantastical figure, the Candy Witch, that 3‐ to 7‐year‐olds heard about at school. Short‐term belief was predicted by an interaction of age, existing beliefs in fantastical figures, and whether the child was ‘visited’ by the Candy Witch. Stability of belief was assessed over the course of 3 weeks and again 1‐year later. First year results revealed three patterns of belief: stable belief, wavering belief and stable non‐belief. First year belief status was not related to age, but older children from the stable belief group were more likely than younger children to disbelieve 1‐year later. The discussion presents a new proposal for the trajectory from belief to disbelief and an updated perspective on the role of individual differences in belief.  相似文献

Children often learn about the world through direct observation. However, much of children's knowledge is acquired through the testimony of others. This research investigates how preschoolers weigh these two sources of information when they are in conflict. Children watched as an adult hid a toy in one location. Then the adult told children that the toy was in a different location (i.e. false testimony). When retrieving the toy, 4- and 5-year-olds relied on what they had seen and disregarded the adult's false testimony. However, most 3-year-olds deferred to the false testimony, despite what they had directly observed. Importantly, with a positive searching experience based on what they saw, or with a single prior experience with an adult as unreliable, 3-year-olds subsequently relied on their first-hand observation and disregarded the adult's false testimony. Thus, young children may initially be credulous toward others' false testimony that contradicts their direct observation, but skepticism can develop quickly through experience.  相似文献

An association between childhood gender atypical behaviour (GAB) and a negative parent–child relationship has been demonstrated in several studies, yet the causal relationship of this association is not fully understood. In the present study, different models of causation between childhood GAB and parent–child relationships were tested. Direction of causation modelling was applied to twin data from a population‐based sample (n= 2,565) of Finnish 33‐ to 43‐year‐old twins. Participants completed retrospective self‐report questionnaires. Five different models of causation were then fitted to the data: GAB → parent–child relationship, parent–child relationship → GAB, reciprocal causation, a bivariate genetic model, and a model assuming no correlation. It was found that a model in which GAB and quality of mother–child, and father–child relationship reciprocally affect each other best fitted the data. The findings are discussed in light of how we should understand, including causality, the association between GAB and parent–child relationship.  相似文献

Conventional research programs adopt efficient cause as a metaphor for how mental events affect behavior. Such theory-constitutive metaphors usefully restrict the purview of research programs, to define the space of possibilities. However, conventional research programs have not yet offered a plausible account of how intentional contents control action, and such an account may be beyond the range of its theoretical possibilities. Circular causality supplies a more inclusive metaphor for how mental events might control behavior. Circular causality perpetuates dynamic structures in time. Mental contents are seen as emergent dynamic constraints perpetuated in time and vertically coupled across their multiple timescales. Intentional contents are accommodated as extraordinary boundary conditions (constraints) that evolve on timescales longer than those of motor coordination (Kugler & Turvey, 1987). Intentional contents, on their longer timescales, are thus available to control embodied processes on shorter timescales. One key assumption-that constraints are vertically coupled in time-is motivated empirically by correlated noise, long-range correlations in the background variability of measured laboratory performances.  相似文献

Cognitive research on metaphoric concepts of time has focused on differences between moving Ego and moving time models, but even more basic is the contrast between Ego‐ and temporal‐reference‐point models. Dynamic models appear to be quasi‐universal cross‐culturally, as does the generalization that in Ego‐reference‐point models, FUTURE IS IN FRONT OF EGO and PAST IS IN BACK OF EGO. The Aymara language instead has a major static model of time wherein FUTURE IS BEHIND EGO and PAST IS IN FRONT OF EGO; linguistic and gestural data give strong confirmation of this unusual culture‐specific cognitive pattern. Gestural data provide crucial information unavailable to purely linguistic analysis, suggesting that when investigating conceptual systems both forms of expression should be analyzed complementarily. Important issues in embodied cognition are raised: how fully shared are bodily grounded motivations for universal cognitive patterns, what makes a rare pattern emerge, and what are the cultural entailments of such patterns?  相似文献

Summary

Prosecution of crimes involving child victims and witnesses is particularly difficult because of the age of the children involved. Facing the alleged offender in court and the experience itself of testifying in an open court with dozens of onlookers are acutely difficult. The effect on children may be traumatic, with the potential to produce substantial psychological and emotional harm. Various court procedures have been implemented in the United States in an effort to minimize these effects. Court procedures can include erecting screens to shield the child victim or witness, presenting videotaped testimony, or testifying via one-way or two-way closed-circuit television. Closed-circuit television (CCTV) testimony, which is especially controversial, involves both legal issues surrounding the constitutionality of such testimony and social issues regarding the effectiveness of closed-circuit television testimony. Substantial variation across states in provisions for closed-circuit television testimony for child witnesses is problematic. Consideration is given to how social science research directly influenced the Supreme Court's decision in Maryland v. Craig(1990), and the current state of research regarding use of CCTV and court outcomes. Some research suggests a pro-defense bias when CCTV is used.  相似文献

The capability of adult and child witnesses to accurately recollect events from the past and provide reliable testimony has been hotly debated for more than 100 years. Prominent legal cases of the 1980s and 1990s sparked lengthy debates and important research questions surrounding the fallibility and general reliability of memory. But what lessons have we learned, some 35 years later, about the role of memory in the judicial system? In this review, we focus on what we now know about the consequences of the fallibility of memory for legal proceedings. We present a brief historical overview of false memories that focuses on three critical forensic areas that changed memory research: children as eyewitnesses, historic sexual abuse and eyewitness (mis)identification. We revisit some of the prominent trials of the 1980s and 1990s to not only consider the role false memories have played in judicial decisions, but also to see how this has helped us understand memory today. Finally, we consider the way in which the research on memory (true and false) has been successfully integrated into some courtroom procedures.  相似文献
