Among the numerous moral commodities that political orders can produceand protect, classical liberalism assigns primacy to liberty, understoodas noninterference. As the nineteenth century advanced into its secondhalf, this primacy was increasingly seen as myopic. A more defensibleliberalism will devote itself to a wider range of basic human interests:this critique gained virtually unanimous acceptance within the newliberalism. Yet, surprisingly, during the past two decades classicalliberalism seems to have enjoyed a resurrection. This essay arguesthat it is well merited, that the superficial plausibility of the newliberal critique shielded a confusion between the questions of whichgoods matter and how they are properly to be afforded politicalrecognition.  相似文献

Critics have charged that John Stuart Mill's discussion as of paternalism in On Liberty is internally inconsistent, noting, for example, the numerous instances in which Mill explicitly endorses examples of paternalistic coercion. Similarly, commentators have noted an apparent contradiction between Mill's political liberalism – according to which the state should be neutral among competing conceptions of the good – and Mill's condemnation of non-autonomous ways of life, such as that of a servile wife. More generally, critics have argued that while Mill professes an allegiance to utilitarianism, he actually abandons it in favor of a view that values personal autonomy as the greatest intrinsic good. This paper presents an interpretation of Mill that provides a viable and consistent treatment of paternalism, thereby refuting each of the aforementioned critiques. Mill's views, it argues, are consistently utilitarian. Moreover, the interpretation accounts for all of Mill's departures from his otherwise blanket prohibition of paternalistic legislation. In particular, it explains his most notorious example, the condemnation of voluntary contracts for slavery. The interpretation emphasizes Mill's conceptual linkage between autonomy and utility, noting his implicit use of at least three different senses of the notion of autonomy.  相似文献

This article considers the difficult question of whether there are any reasons for theocratic religious devotees to affirm liberalism and liberal institutions. Swaine argues not only that there are reasons for theocrats to affirm liberalism, but that theocrats are committed rationally to three normative principles of liberty of conscience, as well. Swaine subsequently discusses three institutional and strategic implications of his arguments. First, he outlines an option of semisovereignty for theocratic communities in liberal democracies, and explains why an appropriate valuation of liberty of conscience may justify a standard of that kind. Second, he addresses the question of permissible government aid for religion and symbolic endorsement of religious groups. Third, Swaine considers innovations and new approaches that could be employed internationally to better display liberal government's affirmation of religiosity, to promote liberty of conscience, and to help improve relations between liberal and theocratic parties around the globe.  相似文献

Although Isaiah Berlin's critique of positive liberty has achieved canonical status, its place within his wider political philosophy remains obscure. However, the re-publication of one of his most important philosophical essays, From Hope and Fear Set Free, as part of a new edition of Four Essays on Liberty, simply entitled Liberty, has opened the door to a re-evaluation of Berlin's political project.

At the heart of Berlin's argument, which gains its fullest expression in From Hope and Fear Set Free, stands his contention that positive liberty, in its incarnation as self-realisation, conflates liberty with knowledge, which leads to the distortion of our phenomenologically inescapable structure of experience. This transgression against the conceptual framework in terms of which we think, Berlin argues, played its desolate part in linking the ‘totalitarian temptation’ latent in liberty as self-realisation with the totalitarian politics of the mid-twentieth century.  相似文献

It is argued that the moral theory undergirding J.S. Mill's argumentin On Liberty is a species of perfectionism rather than any kind of utilitarianism. The conception of human flourishing that itinvokes is one in which the goods of personal autonomy and individualityare central. If this conception is to be more than the expression ofa particular cultural ideal it needs the support of an empiricallyplausible view of human nature and a defensible interpretation ofhistory. Neither of these can be found in Mill. Six traditionalcriticisms of Mill's argument are assessed. It is concluded thatin addition to depending on implausible claims about human natureand history Mill's conception of the good contains disablingincommensurabilities. It is argued that these difficulties andincommensurabilities plague later liberal thinkers such as IsaiahBerlin and Joseph Raz who have sought to ground liberalism in avalue-pluralist ethical theory. No thinker in Mill's liberal posterity has been able to demonstrate the universal authority of liberal ideals.  相似文献

Many people in the animal welfare communityhave argued that the use of nonhuman animals inmedical research is necessarily based onspeciesism, an unjustified prejudice based onspecies membership. As such it is morally akinto racism and sexism. This is misguided. Thecombined capacities for autonomy and sentiencewith the obligations derived from relationssupport a morally justifiable rationale forusing some nonhuman animals in order to limitthe risk of harm to humans. There may be a fewcases where it is morally better to use a neversentient human than a sentient animal, butthese cases are few and would not fulfill thecurrent need for research subjects. The use ofnonautonomous animals instead of humans inrisky research can be based on solid moralground. It is not necessarily speciesism.  相似文献

ABSTRACT

“Concept creep” is the gradual semantic expansion of harm-related concepts such as bullying, mental disorder, prejudice, and trauma. This review presents a synopsis of relevant theoretical advances and empirical research findings on the phenomenon. It addresses three fundamental questions. First, it clarifies the characterisation of concept creep by refining its theoretical and historical dimensions and presenting studies investigating the change in harm-related concepts using computational linguistics. Second, it examines factors that have caused concept creep, including cultural shifts in sensitivity to harm, societal changes in the prevalence of harm, and intentional meaning changes engineered for political ends. Third, the paper develops an account of the consequences of concept creep, including social conflict, political polarisation, speech restrictions, victim identities, and progressive social change. This extended analysis of concept creep helps to understand its mixed implications and sets a multi-pronged agenda for future research on the topic.  相似文献

“Liberty” is a core, prior value of modern Western culture, and particularly of Anglo-American political and economic discourse. For more than a century, the US and other Western countries have been doing their utmost to promote the value of liberty around the world. However, different nations and cultures have different value priorities. Considering “liberty” as the essential, unassailable prior value is an Anglo-American cultural particularity without universal applicability. In China, “liberty” as a high value is a new idea imported from the West at the beginning of the modern era which never enjoyed a very important position in ancient China. Generally speaking, in Chinese culture, the value of “ping an,” with its connotations of peace, safety, equality, health, harmony, and tranquility, is obviously a prior value. Different value priorities have different impacts on culture. This paper tries to compare the American value priority of “liberty” with the Chinese value priority of “ping an,” while discussing their different historical backgrounds and cultural impacts. It argues that values and value priorities are neither absolute nor universal, but that they are rather historical, situational, and dynamic. Value priority in a society should be based on that society’s particular social reality and on the stage of development and the life requirements of its people, rather than on an outside imperative. In the era of globalization, different and even sometimes contradictory human values may actually mutually complement and counterbalance one another.  相似文献

For many years the prevailing paradigm for medical decision making for children has been the best interest standard. Recently, some authors have proposed that Mill’s “harm principle” should be used to mediate or to replace the best interest standard. This article critically examines the harm principle movement and identifies serious defects within the project of using Mill’s harm principle for medical decision making for children. While the harm principle proponents successfully highlight some difficulties in present-day use of the best interest standard, the use of the harm principle suffers substantial normative and conceptual problems. A medical decision-making framework for children is suggested, grounded in the four principles. It draws on the best interest standard, incorporates concepts of harm, and provides two questions that can act as guide and limit in medical decision making for children.  相似文献

I attempt to show that toleranceis part of the idea of American law: for any legalsystem must incorporate the capacity toaccommodate differences in order to meet theminimal standards necessary to apply a rule. There are multiple forms of tolerance, however, some ofwhich are inconsistent with liberal principles.By examining several lines of jurisprudencerelating to speech and privacy, I show thatAmerican law reflects elements of bothliberalism and conservative communitarianism. I attempt to reconcile these by suggesting they actuallyreflect a perfectionist foundation of liberalautonomy. That is to say, American law doesnot value moral autonomy and reasoned discoursebecause they protect neutrality betweendifferent ideas of the good life: rather, thelaw reflects an idea of the good life that seesmoral autonomy as advancing well being.This perfectionist liberal foundation oftolerance reflects the evolution of Americanlaw. Through slavery, sexism and the controlof erotic speech we see how it expanded theideas of who is capable of rationaldiscourse and what activities incorporatethe exercise of reasoned moral autonomy;and how the law imposes this autonomouscapacity on individuals as the price ofcitizenship, even if they belong to groups whodeny the value of reason or autonomy.  相似文献

Those found liable for negligently injuring others are required to compensate them, but current practices permit most tort feasors to spread the costs of their liability burdens through the purchase of insurance. Those found guilty of criminal offences, however, are not allowed to shift the burdens of their sentences onto others. Yet the reasons for not allowing criminal offenders to shift such burdens – harm reduction, retribution, and moral education – also appear to retain some force in relation to negligent tort feasors. Arguments for and against limiting the abilities of negligent tort feasors to spread such costs, thus imposing a penalty on them, are discussed. The conclusion reached is that further consideration of such a penalty is warranted. This revised version was published online in August 2006 with corrections to the Cover Date.  相似文献

目的:研究蓄意创伤受害者的PTSD症状及影响因素。方法:采用事件冲击问卷、创伤经历揭露问卷、受害人认可问卷和攻击描述问卷等测查工具对163名蓄意创伤受害者进行调查。结果:(1)蓄意创伤受害者的PTSD三大症状之间相关显著,且方差分析结果差异显著,闯入性症状>回避症状>高警觉症状;(2)创伤严重程度与PTSD三大症状的相关显著;(3)创伤揭露中情绪反应对PTSD三大症状都有显著的预测作用;(4)社会认可度中的一般性排斥对PTSD三大症状都有显著的预测作用。结论:蓄意创伤受害者有着较强的PTSD症状,且以闯入性症状最为严重,回避和高警觉症状次之;创伤的严重程度、揭露时的情绪反应和社会认可度中的一般性排斥等都对蓄意创伤受害者的PTSD症状有影响作用。  相似文献

It is conventional to think of modernity as being characterised by the irremediable separation of philosophy and theology, of reason and faith. Failing to reconsider the idea of such a divorce, post-modernity has pushed this postulate to its very limits by attempting to abolish all types of normativity whether on the grounds of reason or any other basis. Against these prevailing conceptions, we argue that there exist, within philosophy and theology, processes of differentiation as well as original combinations. To illustrate the possibility of mutually enriching exchanges between the philosophical and the theological ethical traditions we will call upon the historical example of solidarism. This will enable us to show that the two traditions are not so heterogeneous as may be first thought by those who underestimate the importance of identifying the conditions, both pragmatic and ideological, that govern practical in situation ethical judgements.  相似文献

伤害回避是指个体对厌恶刺激信号做出强烈的反应,并学会被动地回避惩罚的一种倾向,这一倾向使得个体反复思考未来的结局,并谨慎小心地对待不确定情景中的事件,进而更有可能诱发情感障碍。伤害回避涉及的神经网络包括三个子网络,即额顶叶-前扣带皮层的连接、皮层-杏仁核的连接和白质通道的结构性连接,这三个子网络分别与羞怯感-易疲劳性、预期担心以及不确定环境中的害怕情绪有关。而其生物基础则包括单一基因多态性和基因多态间的交互作用。今后的研究应该集中在深化伤害回避神经网络与生物基础间的联合机制、研究三种及以上基因多态间的交互作用、考察其他因素对基因效应的调节作用、注重伤害回避四种亚型相关神经网络之间的连接、探讨5-HT4等其他几种5-羟色胺受体多态性与伤害回避的关系以及分析伤害回避内部机制在抗抑郁治疗中的作用等方面。  相似文献

This study experimentally tests a theoretical framework for moral judgment in politics, which integrates two research traditions, Domain‐Theory and Sentimentalism, to suggest that moral judgment is bidimensional, with one dimension pertaining to harm and the other to moral emotions. Two experiments demonstrate that priming harm associations and the moral emotion of disgust prior to a political issue facilitates moral conviction on the political issue as well as a harsher moral judgment compared to no‐prime and to nonmoral emotional and cognitive negative primes (sadness and damage to objects). In addition, harm cues and disgust, but not sadness or damage, interact with the preexisting attitude toward the political issue in affecting moral conviction.  相似文献

In this essay, Paul Lauritzen examines Richard B. Miller's liberal account of pediatric ethics by asking if the duty to promote a child's basic interests is substantial enough to secure the well‐being of children. This question is raised in light of two case studies: daytime TV talk shows that broadcast interviews with sexually active children, and a medical study conducted to test the effect of growth hormone treatment on adult height in peripubertal children. In both cases, Lauritzen argues, children are subjected to potential harms that are not easily explained, and therefore not easily prevented, by appeals to basic interests.  相似文献

In this paper, I question the view that liberal perfectionism and neutrality are mutually exclusive doctrines. I do so by criticizing two claims made by Jonathan Quong. First, I object to his claim that comprehensive anti-perfectionism is incoherent. Second, I criticize his claim that liberal perfectionism cannot avoid a paternalist stance. I argue that Quong’s substantive assumptions about personal autonomy undermine both of his arguments. I use the discussion of Quong to argue that the standard assumption in liberal theory about mutual exclusivity of liberal perfectionism and neutrality needs to be reconsidered, and I show why the argument about the convergence of perfectionism and neutrality makes conceptual sense.  相似文献

设计并采用“换位体验”的社会互动范式,结合自陈报告法和情感错误归因程序的内隐态度研究范式,通过2个实验比较了面对不同程度的人际伤害,自发性观点采择和语言劝说这两种不同的人际伤害消解方式分别对外显和内隐宽恕的影响。结果发现:无论面对何种程度的人际伤害,(1)与自发性观点采择相比,语言劝说可以有效的促进外显宽恕;(2)自发性观点采择可以有效减少负面内隐态度,促进内隐宽恕,而语言劝说会提高负面内隐态度,阻碍内隐宽恕。该研究结果说明不同人际伤害消解方式对内隐和外显宽恕的影响是不同的,同时也证明了观点采择可以在人际互动中自发产生,并且会对人际关系产生隐性影响。  相似文献
