Don Marquis offered the most famous philosophical argument against abortion. His argument contained a novel defence of the idea that foetuses have the same moral status as ordinary adults. The first half of this paper contends that even if Marquis has shown that foetuses have this status, he has not proven that abortion is therefore wrong. Instead his argument falls victim to problems similar to those raised by Judith Thomson, problems that have plagued most anti-abortion arguments since.
Once Marquis's anti-abortion argument is shown to fail, this raises the question of whether there is some way to circumvent the problems. The second half of the paper argues that this issue hinges on important questions about responsibility for risky behaviour and the duties of parenthood. Because we have yet to develop appropriate theoretical frameworks for judging such questions, we cannot yet know whether Marquis's anti-abortion argument — and indeed most other anti-abortion arguments — can be completed.  相似文献

In this article we examine stigma construction in “post abortion recovery groups.” We extend Goffman’s stigma framework by considering how stigma may operate on a continuum through increasingly public stigma rituals as group participants move through four stages: internalization; ingroup membership avowal; reconciliation with outgroup members; and finally, restitution via public activism. We also develop the concept of stigma convergence, noting that therapeutic disclosures in group settings may operate to homogenize participants’ understandings of their stigma. Data come from primary texts from post abortion group materials and an ethnographic study of a post abortion recovery group in Mississippi, one of the most religious and anti-abortion states in the United States.  相似文献

The role of beliefs in attitude formation and the impact of commitment to an attitude on its predictive validity were studied in the context of anti-abortion attitudes. Undergraduates (N= 152), identified as pro-choice or pro-life, expressed their beliefs, attitudes, intentions, and restriction preferences with respect to making abortion illegal. In addition, they indicated their commitment to their positions and their willingness to distribute a pro- or anti-abortion petition. Salient beliefs—identified in a pilot study—were found to predict attitudes, intentions, restriction preferences, and petition choice significantly better than nonsalient beliefs. Salient beliefs also discriminated significantly between pro-choice and pro-life respondents, providing useful information about the cognitive underpinnings of anti-abortion attitudes. In addition, accuracy of predictions increased significantly with commitment, even when attitude extremity was statistically controlled. These findings support the summation theory of attitude (Fishbein, 1963) and demonstrate the importance of attitude strength in determining the structure and predictive validity of attitudes.  相似文献

The present research examines psychological concomitants of support for anti-abortion laws in Poland in the wake of the Constitutional Tribunal’s 2020 ruling restricting access to abortion in cases of fetal malformations. Results of two cross-sectional studies conducted on representative samples of Poles (Study 1, N?=?994 and Study 2, N?=?432) indicated that support for an almost total abortion ban was associated with national narcissism – a belief in the national in-group’s greatness that is contingent on its external validation. In both studies, the relationship between national narcissism and support for anti-abortion laws was mediated by hostile, but not benevolent, sexism. Study 2 additionally showed that this effect remained significant even when we accounted for other important variables, such as individual narcissism or prejudice towards people with Down syndrome. Overall, our results indicate that national narcissism may play an important role in shaping anti-abortion attitudes.

The right of indigent women to have government-subsidized abortions is considered in light of the opposing societal opinions on the morality of abortion. Arguments for funding abortions as another facet of health care, and the welfare rights and freedom of indigents, are discussed. A compromise between pro- and anti-abortion factions in society is suggested--the elimination of government funding for elective abortions while continuing to allow them for those who can pay.  相似文献

ABSTRACT Abortion is a philosophically interesting issue because both sides seem so certain of their conclusions, yet the issue is at the same time clearly a derivative one. It is also highly political, and needs to be seen within the context of the growth of the women's movement. A philosophical overview of the issue in section 1 construes the central claims of the pro-choice and anti-abortion positions as moral and conceptual constructions, which extend everyday moral thinking into the area of abortion. It notes the interesting relation between such constructions and other arguments about abortion, and how this is responsible for their social and historical specificity. Section 2 defends the pro-choice position as a victory of moral sensitivity over linguistic guile. Section 3 situates the argument within the politics of feminism, and recognises the limited contribution which philosophy is able to make.  相似文献

This paper explores the rhetoric of obstetric ultrasound technology as it relates to the abortion debate, specifically the interpretation given to ultrasound images by opponents of abortion. The tenor of the anti-abortion approach is precisely captured in the videotape, Ultrasound: A Window to the Womb. Aspects of this videotape are analyzed in order to tease out the assumptions about the (female) body and about the access to truth yielded by scientific technology (ultrasound) held by militant opponents of abortion. It is argued that the ultrasound images do not offer transparent confirmation of the ontological status of the embryo and fetus. Rather, the window of ultrasound is constructed through a complex combination of visual and verbal devices: ultrasound images, photographic images, verbal argument, and emotional appeal.  相似文献

Don Marquis’s “future-like-ours” argument against the moral permissibility of abortion is widely considered the strongest anti-abortion argument in the philosophical literature. In this paper, I address the issue of whether the argument relies upon controversial metaphysical premises. It is widely thought that future-like-ours argument indeed relies upon controversial metaphysics, in that it must reject the psychological theory of personal identity. I argue that that thought is mistaken—the future-like-ours argument does not depend upon the rejection of such a theory. I suggest, however, that given a widely-accepted view about contraception and abstinence, the argument is committed to contentious metaphysics after all, as it relies upon a highly controversial assumption about mereology. This commitment is not only relevant for those who are inclined to endorse the argument but reject the mereological view in question, but in addition entails dialectical and epistemological liabilities for the argument, which on some views will be fatal to the argument’s overall success.  相似文献

Racialized and class specific as well as gendered heterosexuality is compulsory for young women. Substantial academic literature addressed the incidence of premarital adolescent heterosexual intercourse paying particular attention to young working-class women and (especially in the US) to young women of color. During the 1980s, journals and academic texts in the US debated the so-called black underclass disregarding the effects of Reaganomics: increasing poverty, homelessness, ill health, and unemployment, which affected young African-American women. From a traditional (hetero)patriarchal standpoint, any teenage pregnancy is a problem. Hence pregnancy avoidance and planned parenthood focus on young working-class women and young women of color presumed to constitute the problem of the (hetero)sexually active teenager. The ideology of fetal rights as used in anti-abortion and pro-life arguments represents the life of a pregnant woman as in direct opposition to that of her fetus. The ideology of adolescence constructs all young people as inherently prone to irresponsibility, especially if they are female, working-class, and black. In the Third World, young women considered as irresponsible mothers more likely face enforced sterilization than access to abortion in the guise of genetic counseling for disabilities or without explicit consent during other gynecological operations. Feminists point out that under current legislation in England and Wales, fetuses defined as seriously handicapped can be aborted up to the moment of birth. The legacy of eugenicist ideas lives on in assumptions about the inherent deficiencies of young working-class women, young women of color, and young women with disabilities as potential mothers. Yet despite the institutional, cultural, and ideological force of appropriate heterosexual and reproductive activity, young women continue to challenge common sense definitions of normality and deviance.  相似文献

Macleod (2009) criticizes Boulind and Edwards (2008) for using the concept of post-abortion syndrome (PAS) in their conceptualization of the case of Grace. This article responds to this by arguing the following points: 1) the appropriation of PAS into anti-abortion rhetoric is not sufficient reason to abandon it since this rhetoric distorts the facts, 2) methodological difficulties cited by Macleod in identifying the nature of the distress experienced by some women post-abortion are an artifact of the use of multivariate statistical methods which are not appropriate for answering these questions; 3) the well documented process of maternal foetal attachment, which has a neurobiological basis, shapes a pregnant women's experience of the foetus in the direction of experiencing it in personal terms; 4) the incorporation of this into the clinical concept of PAS carries no implications about foetal personhood; 5) there is considerable documentation of the loss of a foetus being experienced as a bereavement by some women and giving rise to a traumatic grief response; 6) there is a difference between a formal diagnosis in a diagnostic manual and a clinical syndrome which can guide case formulation. It is concluded that the presentation of the case of Grace, rather than offering evidence that supports a pro-life stance on abortion, is an example of the kind of emancipatory theory and practice that is advocated by Macleod.  相似文献

The psychological functioning of 29 women who had successfully prevented conception during four years after an induced abortion was studied, focusing on those who were using less effective contraception methods and who were less regular and responsible in birth control, i.e. who were "subtly" unreliable in the use of contraception. These women were found to be less compentent also in their work, to have a lower emotional stability and self-esteem, to be less realistic about life and to have a less satisfying sexual relationship with less open communication. The purpose of this study was to investigate social perceptions of a man who impregnated a woman and advised her to have an abortion, and those of a woman who had an abortion. Each subject rated one of four persons on a social distance measure: either a man involved in an abortion, a woman having had an abortion, a male control target, or a female control target. Both abortion targets were perceived less favorably than the control targets. The female abortion target was rejected more by male subjects than by female subjects, and the male abortion target was more rejected by females than by males. While holding permissive attitudes toward abortion was related to willingness to meet the female abortion target, restrictive attitudes toward abortion predicted willingness to meet the male abortion target. Variables related to stigmatization of the man were lack of identification, restrictive attitudes toward abortion, and perceived responsibility. Restrictive attitudes toward women's rights and roles in this society and restrictive attitudes toward abortion predicted stigmatization of the woman. It is suggested that shifting one's attention from characteristics of the stigmatized to observers' characteristics provides a useful perspective on the stigmatization process.  相似文献

Participants who varied in their levels of sex guilt and sexual knowledge indicated the extent of their approval for abortion in response to 10 case histories of abortion applicants. The case histories were varied in terms of the circumstances under which conception had occurred. Sex guilt was significantly related to abortion decisions while sexual knowledge registered little effect. Low sex guilt students were more favorable toward abortion requests than were high sex guilt students, but both groups were more favorable toward abortion when conception was the result of failure of a contraceptive method than when it was due to the applicant's inconsistent use of the method. In addition, high sex guilt students' abortion decisions were significantly influenced by the relationship of the applicant to her coital partner. When the relationship was “steady,” they approved the request, whereas abortion was denied to the applicant who conceived with a casual partner. The results were discussed within the context of the debate over the morality of abortion and the problem of unwanted adolescent pregnancy. It was suggested that sex guilt may play a larger role in these issues than has been previously recognized, and that presenting the “facts” (sexual knowledge) may have little impact in abortion related decisions.  相似文献

A dominant trend in the philosophical literature on abortion has been concerned with the question of whether the fetus has moral status and how such a status might or might not conflict with women's liberties. However, a new and powerful trend against abortion requires philosophical examination. We refer to this trend as the paternalistic argument (PA). In a nutshell, this argument holds that, insofar as motherhood is a constitutive end of women's well‐being, abortion harms women; thus, abortion is wrong and should be prohibited, restricted, or avoided when possible regardless of the moral status of the fetus. In this article we undertake three tasks. First, we analyze four variations of this reasoning: what we call the Kantian PA, the Aristotelian PA, the Catholic Church PA, and the Psychological PA. Second, we show how some public policies that regulate or prohibit abortion around the world are now in fact following paternalistic justifications and imposing distinctive paternalistic restrictions (hard, soft, or libertarian); we refer to these policies as “the new abortion laws.” Finally, we argue that both the four paternalistic arguments presented and the new abortion laws are at times ill‐intentioned, comprehensive in nature and thus unsuited for guiding public policy, empirically flawed, or else unjustified.  相似文献

CONTEXT: Each year, thousands of Nigerian women have unintended pregnancies that end in illegal abortion. Many such procedures occur under unsafe conditions, contributing to maternal morbidity and mortality. METHODS: In a 2002-2003 survey of women and their providers in 33 hospitals in eight states across Nigeria, 2,093 patients were identified as being treated for complications of abortion or miscarriage or seeking an abortion. Women's abortion experiences and the health consequences and associated costs were examined through bivariate analysis. Multivariate analysis was used to examine the characteristics of women by type of pregnancy loss and to compare characteristics among three groups of women who had induced abortions in differing circumstances. RESULTS: Among women admitted for abortion-related reasons, 36% had attempted to end the pregnancy before coming to the hospital (including 24% with and 12% without serious complications), 33% obtained an induced abortion at the facility (not withstanding the country's restrictive law) without having made a prior abortion attempt and 32% were treated for complications from a miscarriage. Of women with serious complications, 24% had sepsis, 21% pelvic infection and 11% instrumental injury; 22% required blood transfusion and 10% needed abdominal surgery. The women in this group were poorer and later in gestation than those who sought abortions directly from hospitals. They paid more for treatment (about 13,900 naira) than those who went directly to the hospital for an abortion (3,800 naira) or those treated for miscarriage (5,100 naira). CONCLUSIONS: Policy and program interventions are needed to improve access to contraceptive services and postabortion care in order to reduce abortion-related morbidity and mortality.  相似文献

The present study sought to determine the role that knowledge of abortion information and various demographic variables play in discriminating between those who approve and those who disapprove of abortion. Four hundred and fifty-four college students completed the Abortion Knowledge Test, constructed by the researchers, as well as an abortion attitudes questionnaire which asked subjects to indicate their degree of approval or disapproval of abortion in the case of 7 different scenarios. Attitudes toward abortion were significantly predicted by knowledge of abortion-related information above and beyond the significant influence of degree of religiosity, religion, and age. No significant gender differences were found. Respondents who indicated approval of abortion scored significantly higher on the Abortion Knowledge Test and tended to be older, less religious, and non-Catholic compared to those who disapproved of abortion.  相似文献

The present investigation of adolescent and young adult women's reasoning, and decision-making about abortion was conducted to determine whether reasoning about abortion could be described by moral, social-conventional, and personal concepts and to examine relationships between domain of reasoning and action choices. Seventy single women, ranging in age from 13 to 31 and divided between 25 women having abortions, 23 women continuing their pregnancies, and 22 never-pregnant women, were administered a semi-structured clinical interview about abortion and two hypothetical moral judgement dilemmas. A classification task was developed to provide an additional measure of reasoning in different domains. Another 29 single, first-pregnant women provided a comparison of the effects of these procedures on decision-making. Content analysis of the protocols revealed that responses to the abortion interview could be reliably distinguished between concepts of morality and personal issues and their coordination or lack of coordination. Subjects treating abortion as a moral issue were more likely to continue their pregnancies while subjects treating abortion as a personal issue were more likely to obtain an abortion. Differences in reasoning between pregnant and nonpregnant subjects were not observed. Moral responses to the abortion interview were found to be highly related to hypothetical moral judgments.  相似文献

Catholic doctrine’s strict prohibition on abortion can lead clinicians or institutions to conscientiously refuse to provide abortion, although a legal duty to provide abortion would apply to anyone who refused. Conscientious refusals by clinicians to end a pregnancy can constitute murder or reckless homicide under American law if a woman dies as a result of such a refusal. Such refusals are not immunized from criminal liability by the constitutional right to the free exercise of religion or by statutes that confer immunity from criminal homicide prosecution. Core principles of the rule of law require the state to protect the lives of all persons equally and to place the life and health of persons above any the interests of providers have in moral integrity or in respecting the moral status of prenatal humans. In some states criminal liability related to conscientious objection also applies to corporate hospital officials.  相似文献

While literature characterizing individual genetic counselors’ abortion attitudes is sparse, the National Society of Genetic Counselors takes a clear stance for reproductive autonomy. To determine genetic counselors’ views, this study compared (1) genetic counselors’ abortion attitudes to those of women from the general population and (2) genetic counselors’ professional abortion attitudes to their personal abortion attitudes. Genetic counselors were invited to complete an online survey. Response rate was 44.3% (709/1,601). Compared to women from the general population, female genetic counselors were significantly more likely to agree abortion should be an option in all cases (p < .001). Controlling for other possible confounders, regression analyses revealed that being a genetic counselor, religious service attendance and age were significantly predictive of abortion attitudes. Although the vast majority of genetic counselors agree that abortion should be available, they are significantly less likely to personally consider abortion under all circumstances presented (p < .001), and the percentage of genetic counselors who would consider terminating in the case of a severe birth defect is similar to studies of other women.  相似文献

The purpose of this study was to compare adolescent and adult reactions to abortion. A sample of 252 women from 42 states was obtained from a national survey of organizations serving as support groups for women who have had negative reactions to abortion. The age analysis was run using t-tests. Results indicated that the adolescents were significantly more likely to be dissatisfied with the choice of abortion than were the older subjects, to have abortions later in the gestational period, to be dissatisfied with services at the time of the abortion, to feel forced by circumstances to have the abortion, to report being misinformed at the time of the abortion, and to report greater severity of psychological stress. The conclusions suggest that the adolescents' problems may be due to a combination of developmental limitations and the nature of counseling at the time of the abortion.  相似文献
