Argumentation is a form of communication, rather than an application of(formal) logic, and is used in communicative activity as a means forinquiry, although it is more typically thought of as bringing inquiry toclosure. Thus interpretation is an intrinsic and crucial aspect ofconversational (interactive) argumentation. In order to further thisunderstanding of argumentative activity, I propose a procedure forinterpretation that draws upon hermeneutic phenomenology. In response tocriticisms by argumentation theorists (and others) who understand thistradition as oriented to psychological, perceptual, or textual objects, Iargue that hermeneutic phenomenology supports methods for analysis ofpublic communicative activity. The resulting conception of thick argumentation responds to contemporary (postmodern) claims that argumentation valorizes univocity, stasis, and certainty at the expense ofthe pluralism, fluctuation, and range of epistemic results thatcharacterize discourse in the public sphere.  相似文献

Normative pragmatics can bridge the differences between dialectical and rhetorical theories in a way that saves the central insights of both. Normative pragmatics calls attention to how the manifest strategic design of a message produces interpretive effects and interactional consequences. Argumentative analysis of messages should begin with the manifest persuasive rationale they communicate. But not all persuasive inducements should be treated as arguments. Arguments express with a special pragmatic force propositions where those propositions stand in particular inferential relations to one another. Normative pragmatics provides a framework within which varieties of propositional inference and pragmatic force may be kept straight. Normative pragmatics conceptualizes argumentative effectiveness in a way that integrates notions of rhetorical strategy and rhetorical situation with dialectical norms and procedures for reasonable deliberation. Strategic effectiveness should be seen in terms of maximizing the chances that claims and arguments will be reasonably evaluated, whether or not they are accepted. Procedural rationality should be seen in terms of adjustment to the demands of concrete circumstances. Two types of adjustment are illustrated: rhetorical strategies for framing the conditions for dialectical deliberation and rhetorical strategies for making do with limitations to dialectical deliberation.  相似文献

This paper suggests a specific contribution of contemporary history and philosophy of science to the theory of history. The pragmatic in the technical sense of analysis of use and user aspects of scientific discourse, and the pragmatist, in the sense of a focus on utility as canon, dimensions of modern philosophy of science illumine the structure of historical inquiry. Simply put, the structure of writing produced by the historical discipline is argumentative. Further, the nature of the historical argumentative strategies is best described by reference to classical rhetorical, to topical modes of argument.  相似文献

In this paper, the author develops an instrument for the rational reconstruction of argumentation in which a judicial decision is justified by referring to the consequences in relation to the purpose of the rule. The instrument is developed by integrating insights from legal theory and legal philosophy about the function and use of arguments from consequences in relation to the purpose of a rule into a pragma-dialectical framework. Then, by applying the instrument to the analysis of examples from legal practice, it is demonstrated that the instrument can offer a heuristic and critical tool for the analysis and evaluation of legal argumentation that can ‘bridge’ the gap between more abstract discussions of forms of legal argumentation on the one hand, and legal arguments as they occur in actual legal practice on the other hand.  相似文献

The move to Postmodernism in argumentation is often predicated on the rejection of the formal basis of argument in logic. While this rejection may be justified, and is widely discussed in the literature, the loss of logic creates problems that a Postmodern theory of argument must address without recourse to logic and its attendant modernist assumptions. This essay argues that conceiving of argument in terms ofpractices will address the key problematics of Postmodernism without abandoning those features of argumentation that make it an important social, cultural and political practice. Alternative dispute resolution occurs outside the litigation process. The alternative dispute resolution (ADR) movement in North America has emphasized viable alternatives to the litigation framework, such as arbitration, mediation, med-arb, multi-party facilitation, non-legal negotiation, mini-trials, administrative hearings, private judging (renta-judge), fact finding, and moderated settlement conferences. This essay addresses argument in the dominant alternatives: arbitration, mediation, and multi-party facilitation. The first part of this paper contends that argumentation is central and essential to Aristotle's Rhetoric, and recounts a number of arguments in support of that view, particularly the recognition that deliberative rhetoric or the rhetoric of counsel is the primary concern of Aristotle's work. Changes in the social, political, and intellectual climate worldwide portend radical changes in how humans view themselves and their world. This essay argues that the twenty-first century will usher in apost-postmodern age. The new epoch will be one in which argument practices more closely resemble their modernist forbears. The given of achievement will overcome the postmodern reluctance to assent. Argument will be practiced against the backdrop of realist philosophical frameworks and will be viewed as contributing to the accretion of knowledge.An earlier version of this paper was presented at the Speech Communication Association Annual Conference, Atlanta, Georgia, November 1991.To assert that moral, aesthetic, and factual arguments are statistically derived, is not to argue that there is no such thing as absolute goodness, beauty, or truth. The main purpose of this paper is to explore the reasons Aristotle gives for being able to use rhetorical argumentation, which is obviously not a scientific mode of expression. This faculty which was condemned by Plato as lacking morality, is paradoxically regarded by Aristotle as necessary on moral grounds. For, according to him, it would be blameworthy to keep silent when being verbally assailed. The necessity of rhetoric is, however, more deeply founded. First, because justice has to be saved from its enemies in the City's courts of law. Secondly, because everyone has to be convicted to follow in practice the rules of the City's laws and such a conviction, in the case of the multitude, cannot be obtained by the means of scientific arguments. Thirdly and above all, because, in forensic disputes, characteristics of free political societies, the demagogic power, which regularly leads to tyrannical regimes, can only be avoided by the weapons of rhetoric. From these explanations, one does see that rhetoric, for Aristotle, seems to be the necessary substitute for ancient and traditional instruments securing obedience to legal justice, i.e. myths and pure constraint or coercion. In civilized and free political communities, rhetoric is required for civilization and freedom.

This essay discusses the developments and trends of research in legalargumentation of the last 25 years. The essay starts with a survey of thevarious approaches which can be distinguished: the logical approach, therhetorical approach, and the dialogical approach. Then it identifies varioustopics in the research, which constitute the various components of aresearch programme of legal argumentation: the philosophical component, thetheoretical component, the reconstruction component, the empiricalcomponent, and the practical component. This is a critical examination of Antoine Arnauld's Logic or the Art of Thinking (1662), commonly known as the Port-Royal Logic. Rather than reading this work from the viewpoint of post-Fregean formal logic or the viewpoint of seventeenth-century intellectual history, I approach it with the aim of exploring its relationship to that contemporary field which may be labeled informal logic and/or argumentation theory. It turns out that the Port-Royal Logic is a precursor of this current field, or conversely, that this field may be said to be in the same tradition.  相似文献

The structure of this discussion will be tripartite. First it will set out a way of distinguishing between rhetoric and strictly rational argumentation. Next it will consider some of the ramifications of this proposed way of looking at the matter – in particular what its implications are for rationality and for rhetoric, respectively. Finally it examines how this perspective bears on the project of philosophizing. Stephen Toulmin once observed that ‘it has never been customary for philosophers to pay much attention to the rhetoric of mathematical debate’ [Toulmin et al., 1979, An Introduction to Reasoning, Macmillan, London, p. 89]. Might the application of Toulmin’s layout of arguments to mathematics remedy this oversight? Toulmin’s critics fault the layout as requiring so much abstraction as to permit incompatible reconstructions. Mathematical proofs may indeed be represented by fundamentally distinct layouts. However, cases of genuine conflict characteristically reflect an underlying disagreement about the nature of the proof in question.  相似文献

The Rhetoric to Alexander (second half of the fourth century B.C.) is among the oldest contributions to the study of argumentation. From antiquity on, this treatise, which abounds in opportunistic advice, has come under heavy criticism on normative grounds. And yet, as I shall maintain here, it clearly takes into account the requirements of rational argumentation which are still in use today. Moreover, it contains the seeds of a whole series of doctrines found in modern normative argumentation theory. There are reasonable grounds for maintaining that some of these modern doctrines stem indirectly from the tradition to which the Rhetoric to Alexander belongs.  相似文献

Many in the informal logic tradition distinguish convergent from linked argument structure. The pragma-dialectical tradition distinguishes multiple from co-ordinatively compound argumentation. Although these two distinctions may appear to coincide, constituting only a terminological difference, we argue that they are distinct, indeed expressing different disciplinary perspectives on argumentation. From a logical point of view, where the primary evaluative issue concerns sufficient strength of support, the unit of analysis is the individual argument, the particular premises put forward to support a given conclusion. Structure is internal to this unit. From a dialectical point of view, where the focus concerns how well a critical discussion comes to a reasoned conclusion of some disputed question, the argumentation need not constitute a single unit of argument. The unit of dialectical analysis will be the entire argumentation made up of these several arguments. The multiple/co-ordinatively compound distinction is dialectical, while the linked/convergent distinction is logical. Keeping these two pairs of distinctions separate allows us to see certain attempts to characterize convergent versus linked arguments as rather characterizing multiple versus co-ordinatively compound arguments, in particular attempts of Thomas, Nolt, and Yanal, and to resolve straightforwardly conflicts, tensions, or anomalies in their accounts. Walton's preferred Suspension/Insufficient Proof test to identify linked argument structure correctly identifies co-ordinatively compound structure. His objection to using the concept of relevance to explicate the distinction between linked and convergent structure within co-ordinatively compound argumentation can be met through explicating relevance in terms of inference licenses. His counterexample to the Suspension/No Support test for identifying linked structure which this approach supports can itself be straightforwardly dealt with when the test is explicated through inference licenses.  相似文献

This paper describes the development of pragma-dialectics as a theory of argumentative discourse. First the development of the pragma-dialectical model of a critical discussion is explained, with the rules that are to be complied with in order to avoid fallacies from occurring. Then the integration is discussed of rhetorical insight in the dialectical framework. In this endeavour, the concept of strategic manoeuvring is explained that allows for a more refined and more profoundly justified analysis of argumentative discourse and a better identification of fallacies. The paper ends with a brief overview of current research projects.  相似文献

In this paper, I explore connections between two disciplines not typically linked: argumentation theory and urban design. I first trace historical ties between the art of reasoned discourse and the idea of civic virtue. I next analyze discourse norms implicit in three theories of urban design: Jane Jacobs' The Death and Life of Great American Cities (1961), Christopher Alexander's A Pattern Language: Towns, Buildings, Construction (1977), and Peter Katz's The New Urbanism: Toward an Architecture of Community (1994). I then propose a set of settlement issues of potential interest to both urban designers and argumentation theorists: size, density, heterogeneity, publicity, security, and identity. I conclude by suggesting that the good city be seen as both a spatial and a discursive entity. From such a perspective, good public discourse is dependent, at least in part, on good public space; and good public space is defined, at least in part, as a context conducive to good public discourse.  相似文献

This paper examines the functions of narrative within legal argumentation. My purposes are these: 1) to repudiate common assumptions that differentiate argumentation and storytelling in the law; 2) to begin to theorize anew how legal argumentation functions; 3) to explore the difficulties of evaluating the law's argumentative narratives; and 4) to trace some of the anxiety that judges themselves reveal about their roles as storytellers. I conclude that narrative is necessary to law's claims to authority, even as it complicates our understandings about how legislative policy decisions produce effects, and even as judges themselves seek to mask its importance.  相似文献

This paper analyses the way in which discourse and argumentation may vary depending on participants educational level and gender. Men and women from three different educational levels (literacy, advanced level and university students) participated in discussion groups that debated about women and work, the sharing of housework and the way in which girls and boys are educated. The results showed important differences depending on participants educational level and gender. In general, the main differences were related to educational level, while gender tended to interact with educational level, as a moderating factor.  相似文献

In The Myth of Morality Richard Joyce presents a simple and very influential argument for the truth of moral error theory. In this paper I point out that (i) the argument does not have the form Joyce attributes to it, (ii) the argument is not valid in an extensional propositional logic and (iii) on the most natural way of explicating the meanings of the involved terms, it remains invalid. I conclude that more explanation is needed if we are to accept this particular argument for moral error theory.  相似文献
