Equal employment opportunity (EEO) law is constantly evolving and many changes can happen in 50 years. Title VII of the Civil Rights Act of 1964 has always been the most comprehensive law related to workplace discrimination. Like all laws, Title VII has matured over time, including amendments by Congress, refinement by the courts, and creation and updates of regulations by enforcement agencies. However, there are several controversies that have endured during this maturation process, and this article focuses on four of them: (1) adverse impact theory, (2) reverse discrimination, (3) sexual harassment, and (4) retaliation. There are common issues across these controversies. However, for purposes of exposition, each one is treated as a separate entity. For each of the four controversies, we review historical context, recommend compliance strategies and share best EEO practice recommendations for practitioners and employers.  相似文献

Acceptance is a key construct in both rational emotive behavior therapy (REBT) and acceptance and commitment therapy (ACT). The objectives of this study were to assess and compare the properties of ACT acceptance with those of REBT acceptance in predicting emotions. A sample of 112 subjects, comprising different educational and occupational status, completed three measures of acceptance (REBT and ACT), two of mindfulness, as well as completing depression and anxiety scales. Both ACT acceptance as process and REBT acceptance could predict significant ACT acceptance as outcome. Mindfulness as a trait also predicted the level of ACT outcome acceptance as well as the level of REBT acceptance, but mindfulness as process predicted only ACT outcome acceptance. The results show that REBT acceptance, ACT acceptance and mindfulness can explain anxiety and depression in different ways. The results show that the difference between ACT acceptance and REBT acceptance primary concern the process of acceptance, most likely due to the underlying cognitive processing. The outcome acceptance and emotional level are similar in the two conditions. Future research should employ multiple cognitive measurements.  相似文献

The aim of this study was to test the extent to which hope measure is equivalent to general self-efficacy measure. Questionnaire data on these two constructs and other external variables were collected from 199 Chinese college students. The factor analytic results suggested that hope and self-efficacy items measured the same construct. The unidimensional model combining hope items and GSE items fit the data as well as the bidimensional model, indicating that their corresponding items measured the same underlying construct. Further analyses showed that hope and GSE did not correlate with external variables differently in a systematic manner. Most of these correlational differences were non-significant and negligible. These findings suggested that the literatures studying GSE and hope could be considered to be integrated and that researchers need to recognize and acknowledge the conceptual and operational similarities among these constructs in the literature.  相似文献

The cognitive discrepancy model predicts that loneliness occurs when individuals perceive a difference between their desired and actual levels of social involvement. Using data from a sample of high school sophomore students, the present investigation was designed to go beyond previous research that has tested this model by examining the predicted nonlinear relationships between desired and actual social contact and feelings of loneliness. Analyses indicated that support for the cognitive discrepancy model of loneliness was found only for measures of close friendships. Specifically, the discrepancy between the students' ideal number and actual number of close friends was found to be related in a nonlinear fashion to feelings of satisfaction with close friendships and loneliness after control for the number of close friends. Implications of these findings for theoretical models of loneliness are discussed.  相似文献

This study further investigated the construct of courage in children. Children aged 8–13 years (n = 51) were interviewed about the most courageous action that they had ever performed during their life, and to retrospectively rate their level of fear and courage experienced during that event. On a separate occasion, children also completed the Courage Measure for Children (CM-C) as an index of children’s general level of personal courage, as well as scales for assessing anxiety symptoms and sensation seeking. Results indicated that almost all children (i.e., 94%) indicated that they had carried out a courageous action at some point during their life, although the levels of fear and courage associated with these acts varied considerably. Further, there was no relation between fear and courage reported for the courageous action, but these variables were significantly correlated with respectively anxiety symptoms and personal courage as indexed by the CM-C. Finally, a significant positive correlation was observed between sensation seeking and personal courage, indicating that children who are more thrill and adventure seeking are generally also more courageous. It is concluded that fear and courage in children are largely unrelated and not just two sides of the same coin. The implications of these results for the etiology and treatment of childhood anxiety problems are discussed.  相似文献

Play with toys provides children with theopportunity to practice behaviors that have relevance togender role development. By 18 months, toddlersconsistently choose to play with sex-appropriate toys. This study was designed to investigate parents'and toddlers' initiation of play with baby dolls and astuffed clown to determine whether boys are providedwith the same opportunity for feminine play as girls are when playing with the same type oftoys. 42 parent toddler dyads from Caucasianmiddle-class families were observed playing with twobaby dolls and a soft stuffed clown for four minutes.Parent toddler play was coded for doll appropriate andinanimate object-type play. The baby dolls and the clownelicited different play behaviors from both the parentsand the toddlers. Same-sex dyads engaged in different types of play than opposite-sexparent toddler dyads. Findings of this study lendevidence that not all dolls are alike. Consequently,parents who provide their toddlers with baby dolls are providing different experiences from parentswho provide soft stuffed toys. Drawing on the literature on emotional mimicry, we argue that attitude similarity between a sender and a receiver influences the social induction of affect. Studies 1, 2, and 3 supported this reasoning by showing that similarity fostered, whereas dissimilarity blocked concordant reactions to a happy sender (but not to a sad sender). We also examined the mechanism behind these effects and found that similarity influenced liking of the happy sender but did not affect liking of the sad sender. Study 4 provided causal evidence for this idea by showing that similarity influenced the induction of positive affect through liking.  相似文献

Do participants bring their own priors to an experiment? If so, do they share the same priors as the researchers who design the experiment? In this article, we examine the extent to which self‐generated priors conform to experimenters’ expectations by explicitly asking participants to indicate their own priors in estimating the probability of a variety of events. We find in Study 1 that despite being instructed to follow a uniform distribution, participants appear to have used their own priors, which deviated from the given instructions. Using subjects’ own priors allows us to account better for their responses rather than merely to test the accuracy of their estimates. Implications for the study of judgment and decision making are discussed.  相似文献

Generative thinking can be characterized as the development of novel instantiations of existing concepts. Using this framework, the present study examined the impact of three conditions on the way subjects generated ideas about imaginary extraterrestrials. Control subjects developed alien animals but were given no special instructions. Those in the Wildly Different Condition were asked to generate creatures that were as wildly different from Earth animals as they could be. Both groups were highly and equally likely to imagine creatures that were symmetric and possessed standard senses and appendages, but the latter introduced significantly more novel variations, particularly on the number of sense organs and appendages. A third group was asked to imagine and describe things that might live on another planet, but were not initially instructed to provide drawings or limit themselves to considering living things that would be considered to be animals. This last group also preserved symmetry, but was significantly more likely to develop creatures without standard senses and appendages. Even so, 75% of this group developed creatures with standard senses and appendages. The results are discussed in terms of constraints on innovation, ways of overcoming those constraints, and the general tendency for new ideas to preserve many of the central properties of existing concepts.  相似文献

Distress tolerance (DT) refers to an individual’s capacity to cope with aversive internal (e.g., physical, cognitive, emotional) states. A growing body of evidence suggests that there is a relationship between DT and the development and maintenance of problematic behavioral patterns. Despite emerging evidence for such associations, a number of issues remain unresolved. The results of recent studies suggest problems with the convergent validity of the primary measures used to assess DT, despite the fact that these measures are used interchangeably in the DT literature. In order to further examine the relationships among DT assessments, we evaluated intercorrelations among various self-report and behavioral measures of DT in an unselected undergraduate sample (n = 83). Results indicate that two self-report measures of DT were highly correlated with one another, but that neither measure was significantly correlated with the behavioral measures. The relationships among the behavioral measures and between self-report and behavioral measures were weak and non-significant. Correlations between self-report measures only were strong. The findings partially replicate prior research indicating weak correlations between certain, commonly used measures of DT, and raise questions about the current conceptualization of the construct.  相似文献

The therapeutic effects of words, rituals and, more in general, of the whole psychosocial context around the patient, have been investigated over the past few years by using the placebo response as a model. Today we are in a good position to study all these complex psychological factors by using a physiological and neuroscientific approach that uses modern neurobiological tools to probe different brain functions. Since a placebo is represented by the whole ritual of the therapeutic act, the main concept that has emerged today is that words and rituals may modulate the same biochemical pathways that are modulated by drugs. Most of our knowledge about these mechanisms comes from the field of pain, and represents a biomedical, psychological and philosophical enterprise that is changing the way we approach and interpret medicine, psychology and human biology. If on the one hand we know some of the mechanisms of drug action in the central nervous system, on the other we can now understand how the therapist’s words may affect different physiological functions. In fact, the placebo effect and the therapist–patient relationship can be approached by using the same biochemical, cellular and physiological tools of the materia medica. Although the responses to the therapist’s words cannot be reduced merely to the action of a single drug, this represents an epochal transition, in which the distinction between psychotherapy and pharmacotherapy is progressively getting thinner, and which helps us overcome the old dichotomy between psychology and biology.  相似文献

This paper will directly tackle the question of Benatar’s asymmetry at the heart of his book Better Never to have Been and provide a critique based on some of the logical consequences that result from the proposition that every potential life can only be understood in terms of the pain that person would experience if she or he was born. The decision only to evaluate future pain avoided and not pleasure denied for potential people means that we should view each birth as an unmitigated tragedy. The result is that someone who seeks to maximize utility could easily justify immense suffering for current people in order to prevent the births of potential people. This paper offers an alternative framework for evaluating the creation of people that addresses Benatar’s asymmetry without overvaluing the potential suffering of potential people.  相似文献

In this paper, I seek to caution the increasing number of contemporary sociologists who are engaging with continental phenomenological sociology without looking at the Anglo-American tradition. I look at a particular debate that took place during the formative period in the Anglo-American tradition. My focus is on the way participants sought to negotiate the disciplinary division between philosophy and sociology. I outline various ways that these disciplinary exigencies, especially the institutional struggles with the sociological establishment, shaped how participants defined phenomenological sociology. I argue that despite the supposed theoretical, methodological, and substantial differences between these waves of phenomenological sociology, the contemporary wave could benefit from some of the lessons that were learned by their predecessors.  相似文献

This article presents a methodology for a feminist theology of education based on reflection of women's educational experience in light of historical and contemporary theological works, especially the writing of Julian of Norwich.
