Abstract

This experiment tested the hypothesis that jurors' preexisting biases (sentiments) toward an accused would have a much stronger impact on the sentences that jurors recommended than on the verdicts they rendered. Specifically, a balance theory analysis of juridic decisions specifies that predeliberation sentiments toward the defendant would have little if any direct effect on jury verdicts and would be associated with verdicts rendered only if the information establishing these sentiments also implied a unit relation between the defendant and the crime. Six-person juries deliberated the case of an accused robber and murderer who had no prior criminal record, a prior conviction for a dissimilar crime, or a prior conviction for a similar crime. While on the witness stand, the defendant either withheld information or provided answers for all questions. The results provided strong support for the hypothesis. In addition, jurors' predeliberation sentiments toward the accused were unrelated either to the tone of juridic deliberations or to postdeliberation assessments of the defendant's guilt. By contrast, juror sentiments toward the defendant were a solid predictor of the severity of sentences assigned by those who voted to convict the accused.  相似文献

Two studies were conducted examining voice recognition testimony and its impact on jurors. In the first experiment, subjects listened to a tape recording of a brief sales pitch. After a retention interval of either 0, 7 or 14 days, subjects were unexpectedly asked to pick the salesperson's voice out of a five-voice taped lineup. Retention interval did not have a significant effect on hit rates or false alarms. Accuracy and pre-lineup confidence were not significantly correlated, although accuracy was related to post-lineup willingness to testify. In the second experiment, undergraduate subjects were asked to read a summary of a trial, describing a situation similar to that studied in experiment 1; the independent variables were the presence of an earwitness, the gender and confidence of the earwitness, and the retention interval. Only the presence of an earwitness had a significant main effect upon mock jurors' verdicts. However, there was a significant interaction between witness confidence and witness gender when an earwitness identification was presented.  相似文献

Although the law assumes a close relation between the probability that a defendant committed the act in question and the ensuing verdict of the jurors, prior research has shown this assumption to be often violated. We present five experiments designed to show that factors that influence probability also influence verdict, but other factors are capable of directly producing changes in verdict without affecting probability. In Experiment 1, we replicated the Wells Effect; scenarios generating the same probability that the Blue Bus Company was to blame for the same accident, nevertheless, generated significantly different likelihoods of finding the defendant liable. In Experiment 2, we showed that equally diagnostic affirmative and negative evidence had differential effects on mock jurors' probability estimates and verdicts. In Experiment 3, we showed that a completely nondiagnostic witness, who either implicates the same bus company or a different bus company as did a diagnostic witness, significantly influenced mock jurors' verdicts. However, the nondiagnostic witness did not change the probability that the Blue Bus Company was responsible for the accident. In Experiment 4, we demonstrated that base rate and witness reliability information resulted in very similar probability estimates but radically different verdicts. In Experiment 5, we showed that a change in the diagnosticity of the evidence influenced both probability and verdict with the former mediating differences in the later. Because probability is only one of the several determinants of the verdict, the two dependent variables are not as closely related as the law presumes. The determinants of verdicts in a rape case were examined. Pretrial attitudes (rape empathy, juror bias, belief in a just world, and authoritarianism) were measured to ascertain both the intercorrelations among the attitudes and their predictive value of verdicts. The eye contact (staring, avoiding, or random) of the alleged rape victim with the defendant was also examined. Results showed that rape empathy was predictive of verdict. The eye contact of the alleged victim with the defendant also affected verdicts of female mock jurors. Specifically, when eye contact was avoided, more guilty verdicts were rendered. Furthermore, interpretation of eye contact was found to be a function of mock jurors' reported rape empathy. Specifically, subjects who reported empathy with the victim tended to interpret the victim's behavior as consistent with being raped. Finally, differences were found between high and low empathizers for the rape victim in what aspects of the trial were important to mock jurors' decisions.  相似文献

The present experiment investigated the impact of the Control Question Test (CQT) and the Guilty Knowledge Test (GKT) on the verdicts of mock jurors. Although studies have indicated that polygraph evidence has little influence on jurors' verdicts (Cavoukian & Heselgrave, 1980; Spanos, Myers, Dubreuil, & Pawlak, 1992–1993), no research has previously distinguished between the different types of polygraph tests and their impact on juror verdicts. In the present study, jurors were shown a videotape of a simulated rape-murder trial that contained either CQT polygraph evidence, GKT polygraph evidence, or no polygraph evidence. No differences were found among the 3 conditions for either jury verdicts or individual juror verdicts, and jurors tended to rate both forms of polygraph testimony below other forms of equally suspect evidence, such as eyewitness testimony, in its influence on their decision-making process.  相似文献

This article examines the separate and combined impact of hedges, hesitations, and intensifiers on perceptions of authoritativeness, sociability, character, and similarity, and the extent to which messages containing one or more of these language variables differs from a “prototypically” powerless message in evaluative consequences. A “prototypically” powerless message is one that contains not only hedges, hesitations, and intensifiers, but also contains polite forms and meaningless particles, such as “oh, well” and “you know.” Two studies indicated that hedges and hesitations individually affected perceptions of authoritativeness and sociability, but interactions among the variables were not found in the studies. Furthermore, only high intensifiers/low hedges/low hesitations and low intensifiers/low hedges/low hesitations messages differed significantly from the “prototypically” powerless message. The second study revealed that speaker status interacted to affect evaluative consequences. The results are discussed in terms of their implications for the power of speech style construct.  相似文献

Two studies demonstrate the influence of lawyers' complex questions on mock‐witness accuracy, confidence, and reaction times and on the interpretation of witness accuracy by mock jurors. In study one, 32 mock witnesses were shown a short film and then questioned either with lawyers' complex questions or simple alternatives. In Study 2, 20 mock jurors viewed video footage of the mock witnesses assigned to each of the two previous conditions and were asked to rate their confidence in the witnesses' answers. The findings of the two studies indicated that lawyers' use of confusing questions reduce not only accuracy but also speed of response and both witnesses' and jurors' ability to determine accuracy. The effects of prejudicial pretrial publicity (PTP) from physical and witness evidence on decisions made by trained and untrained mock jurors were compared. Mock jurors viewed a videotaped rape trial and participated in jury deliberations. Training consisted of completion of a university course on psychology and law. As expected, physical evidence PTP produced more guilty votes than witness or no PTP. Both types of PTP influenced untrained mock jurors' punishment preferences and perceptions of satisfaction and fairness, whereas trained mock jurors' opinions on these measures were unaffected by PTP. Deliberations of trained mock juries were more task‐oriented and focused on relevant evidence and legal issues than that of their untrained peers. We examined the interaction of testimonial consistency and witness group identity on mock jurors' judgments of witness effectiveness, probability that the defendant committed the crime, and verdict. In a 3 × 2 (Witness Group Identity × Testimonial Consistency) between‐groups design, 180 mock jurors heard a trial of a person charged with assault. Although both variables affected judgments, group‐identity effects were weak when testimony was characterized by inconsistencies, and they were stronger when testimony was internally consistent but ambiguous. The judgment patterns were consistent with predictions from Chaiken, Liberman, and Eagly's (1989) heuristic‐systematic processing theory, suggesting that heuristic processing would bias systematic processing when the evidence was not decisive.  相似文献

Initial juror verdicts have been shown to predict final verdicts, leading researchers to conclude that jurors seek confirmatory information during trial (confirmation bias) or distort information to fit pre‐existing biases (pre‐decisional distortion). However, Information Integration Theory suggests that individuals are not distorting/ignoring this information, and instead, information influences judgments in the direction of the message. The current study sought to test these competing theories in a juror setting. Mock jurors were presented with the sentencing phase of a capital trial and were asked to give sentence recommendations at eight different time points. Additionally, they were grouped by their pretrial bias as being pro‐defense, neutral, or pro‐prosecution. Results showed support for Information Integration Theory; although jurors' pretrial bias predicted final sentence, sentence recommendations were affected in the direction of the testimony presented throughout the trial (e.g., pro‐defense testimony lowered death penalty decisions across all groups). The present research explored the influence of four factors on mock jurors' decisions in a homicide trial involving a battered woman who killed her abusive husband: (a) jurors' preexisting beliefs about wife abuse, (b) the presence of expert testimony on the battered woman syndrome, (c) jurors' beliefs in a just world, and (d) gender. Mock jurors listened to a trial involving a woman who had killed her abuser, which either contained expert testimony or did not, and then rendered various judgments about the case. Results indicated that those individuals who were more informed about the dynamics of abuse and those exposed to the expert testimony, compared to their respective counterparts, were more believing of the battered woman's account of what occurred. In general, weak believers in a just world were more lenient in their judgments, with verdicts of not guilty being associated with weaker beliefs in a just world than guilty verdicts. Weak believers in a just world also felt that the expert testimony applied more to the defendant than did strong believers. Finally, women who were weak believers in a just world were less likely to hold the defendant responsible for the events and to be more informed about the dynamics of abuse following the experiment.  相似文献

The purpose of the following study was to investigate the extent to which phoneme and grapheme‐phoneme contrasts between English and Spanish are associated with word‐decoding problems in Spanish‐speaking adults who are early readers of English. To test whether such a co‐occurrence exists, word‐decoding exercises were administered to four groups of Spanish‐speaking subjects. The groups were organized on the basis of English‐language proficiency. Significant differences in word‐decoding performance appeared between words containing letter‐sounds found in both Spanish and English and those with letter‐sounds not found in Spanish.  相似文献

This study examined the effect of a child passing or failing the UK truth and lies discussion (TLD) compared with the Canadian promise to tell the truth on mock jurors' decisions regarding witness credibility and truthfulness and defendant guilt. Ninety-two participants read a vignette that described a child witnessing his father physically attacking his mother. The vignette was manipulated for witness age (age 4 years and age 8 years) and TLD performance/promise. Supporting the hypotheses, participants rated the witness's credibility and truthfulness significantly higher after a witness passed a TLD and after promising to tell the truth. The age of the child witness did not significantly affect jurors' decision making. The results are discussed in relation to arguments regarding the abolition of the UK's TLD in favour of introducing a promise to tell the truth.  相似文献

Voluminous work has catalogued the utility of Rusbult's (1980) investment model of commitment processes in understanding why some relationships persist whereas others fail. To date this work has been conducted almost exclusively with samples of English‐speaking individuals. To facilitate testing novel hypotheses among Spanish‐speaking populations as well examining various cross‐cultural questions, we present a Spanish version of the Investment Model Scale (Rusbult, Martz, & Agnew, 1998). With a sample of Spanish‐speaking individuals from Chile, we demonstrate that our translation has the same structural properties as the English version (Study 1) and has good predictive validity (Study 2). The Spanish version of the Investment Model Scale will enable researchers to sample a larger subset of the population and allow for the examination of cultural influences on relationship processes.  相似文献
