abstract In this paper, we present a conditional argument for the moral permissibility of some kinds of infanticide. The argument is based on a certain view of consciousness and the claim that there is an intimate connection between consciousness and infanticide. In bare outline, the argument is this: it is impermissible to intentionally kill a creature only if the creature is conscious; it is reasonable to believe that there is some time at which human infants are not conscious; therefore, it is reasonable to believe that it is permissible to intentionally kill some human infants.  相似文献

This paper makes the case for the permissibility of post-conflict amnesties, although not on prudential grounds. It argues that amnesties of a certain scope, targeted to certain categories of perpetrators, and offered in certain contexts are morally permissible because they are an acknowledgment of the difficulty of attributing criminal responsibility in mass violence contexts. Based on this idea, the paper develops the further claim that deciding which amnesties are permissible and which ones are not should be decided on a case-by-case basis. Against what seems to be an increasingly popular assumption of some international actors, just as "blanket" amnesties (i.e. very broad and general amnesties that foreclose criminal prosecution for all kinds of perpetrators and all kinds of wrongdoing) are impermissible, so is an absolutist rejection of all types of amnesties.  相似文献

Aggressive techniques within casual sex encounters, such as taking sexual liberties without permission or ignoring rejection, can, perhaps unintentionally, complicate consent. Passive recipients may acquiesce out of fear, which aggressors may not realize. Some philosophers argue that social norms are sufficiently well known to make this misunderstanding unlikely. However, the chance of aggression leading to non-consensual sex, even if not great, is high enough that aggressors should work diligently to avoid this potentially grave result. I consider how this problem plays out in the common mating ritual of hooking up. I argue that aggressive hook ups can only be permissible if they are modeled on BDSM encounters: the participants must obtain prior consent and prepare safe words for voiding that consent during the hook up. While this solution removes the spontaneity of aggressive sex, I argue that spontaneously aggressive hook ups with strangers cannot be permissible.  相似文献

From a logical point of view, permissibility can be reduced to possibility by introducing demands which can be met. The alleged reduction is circular from a philosophical perspective, however, because demands are fundamentally deontic. This paper solves this problem by replacing demands which can be met with rules which can be satisfied and violated.

The paper presents two groups of objecting Israeli reserve soldiers who chose to resolve their dilemmas with the morally controversial war in Lebanon (1982–1985) in line with two different morally preferred actions. These soldiers either refused to join their unit on its assigned mission in Lebanon and paid the price of court martial and imprisonment, or chose to continue their military service but made extra sacrifices to preserve their moral principles on the battlefield, as well as voiced their objection via a protest group. The relationship between the objectors' hypothetical and actual moral knowledge is discussed.  相似文献

T. M. Scanlon has argued that the intentions with which one acts, or more specifically, one’s reasons for acting, are non-derivatively irrelevant to the moral permissibility of one’s actions. According to one of his arguments in favor of that thesis, it can be permissible to act for one reason rather than another only if one can choose to act for a reason but, since that choice is impossible since believing as will is impossible, one can be permitted to act but one cannot be permitted to act for a reason. This paper aims to show that that argument is unsound. It first argues that the assumption that choosing an action is necessary for it being an object of a moral duty or permission cannot be made consistent with Scanlon’s idea that the same does not hold for an action being an object of blame. It then argues that even if direct control over forming beliefs is impossible, it is not impossible to choose one’s reason for action and, therefore, to be permitted or forbidden to act for it.  相似文献

It is clearly impermissible to kill one person (or refrain from giving him treatment that he needs in order to survive) because his organs can be used to save five others who are in need of transplants. It has seemed to many that the explanation for this lies in the fact that in such cases we would be intending the death of the person whom we killed, or failed to save. What makes these actions impermissible, however, is not the agent's intention but rather the fact that the benefit envisaged does not justify an exception to the prohibition against killing or the requirement to give aid. The difference between this explanation and one appealing to intention is easily overlooked if one fails to distinguish between the prospective use of a moral principle to guide action and its retrospective use to appraise the way an agent governed him or herself. Even if this explanation is accepted, however, it remains an open question whether and how an agent's intention may be relevant to the permissibility of actions in other cases.  相似文献

ABSTRACT

The present experiment was designed to establish the effects of acts of kindness and acts of novelty on life satisfaction. Participants aged 18–60 took part on a voluntary basis. They were randomly assigned to perform either acts of kindness, acts of novelty, or no acts on a daily basis for 10 days. Their life satisfaction was measured before and after the 10-day experiment. As expected, performing acts of kindness or acts of novelty resulted in an increase in life satisfaction.  相似文献

This study analyzes cognitive responses to explore a dual processing perspective of ethical judgment formation. Specifically, the study investigates how two factors, judgment task difficulty and moral intensity, influence the extent of deontological and teleological processing and their effects on ethical judgments. A single experiment on 110 undergraduate research participants found that judgment task difficulty affected the extent of deontological and teleological processing. Although moral intensity affected ethical judgments, it did not produce effects on either deontological or teleological cognitive responses. Results did not support the hypotheses that deontological and teleological cognitive responses would mediate the relationships between the experimental factors and ethical judgments. Overall, the results support continued research of factors that affect the nature of information processing in ethical decision situations and the use of cognitive response analysis as a tool for conducting this research.  相似文献

Marya Schechtman has raised a series of worries for the Psychological Continuity Theory of personal identity (PCT) stemming from what Derek Parfit called the ‘Extreme Claim’. This is roughly the claim that theories like it are unable to explain the importance we attach to personal identity. In her recent Staying Alive (2014), she presents further arguments related to this and sets out a new narrative theory, the Person Life View (PLV), which she sees as solving the problems as well as bringing other advantages over the PCT. I look over some of her earlier arguments and responses to them as a way in to the new issues and theory. I will argue that the problems for the PCT and advantages that the PLV brings are all merely apparent, and present no reason for giving up the former for the latter.  相似文献
