Ontology and human rights

This paper examines the question of whether human rights are related to ontology. It examines perspectives on this question from human rights theories in the Western and African traditions of philosophy and defends the thesis that a good account of human rights requires an explicit ontology of the human, and that taking this seriously engenders divergent conclusions about what rights are. It then proceeds to claim that the African Charter on Human and Peoples’ Rights adds substantive features to the International Bill of Human Rights, and that the Charter expresses Kwame Gyekye’s ontology of the human being.     

Carl Cohen's 'kind' arguments for animal rights and against human rights

Carl Cohen's arguments against animal rights are shown to be unsound. His strategy entails that animals have rights, that humans do not, the negations of those conclusions, and other false and inconsistent implications. His main premise seems to imply that one can fail all tests and assignments in a class and yet easily pass if one's peers are passing and that one can become a convicted criminal merely by setting foot in a prison. However, since his moral principles imply that nearly all exploitive uses of animals are wrong anyway, foes of animal rights are advised to seek philosophical consolations elsewhere. I note that some other philosophers' arguments are subject to similar objections.     

The globalization of human rights

The argument of this article is that what I term generic globalization has created unprecedented opportunities for advances in human rights universally, but that the dominant actually existing historical form of globalization – capitalist globalization – undermines these opportunities. Substantively, I argue that taking the globalization of human rights seriously means eliminating the ideological distinction that exists between civil and political rights on the one hand, and economic and social rights on the other. Doing this systematically undermines the three central claims of capitalist globalization – namely, that globalizing corporations are the most efficient and equitable form of production, distribution and exchange; that the transnational capitalist class organizes communities and the global order in the best interests of everyone; and that the culture-ideology of consumerism will satisfy our real needs.

UNESCO, genetics, and human rights

In response to a mandate conferred on the International Bioethics Committee (IBC) of UNESCO in November 1993, the IBC has drafted a "universal declaration on the human genome and human rights," which will be considered by the General Conference of UNESCO in November 1997. This article discusses the development of the document and provides the text of the "revised preliminary draft" of the declaration.     

Human rights without human supremacism*

Early defenders of the Universal Declaration of Human Rights invoked species hierarchy: human beings are owed rights because of our discontinuity with and superiority to animals. Subsequent defenders avoided species supremacism, appealing instead to conditions of embodied subjectivity and corporeal vulnerability we share with animals. In the past decade, however, supremacism has returned in work of the new ‘dignitarians’ who argue that human rights are grounded in dignity, and that human dignity requires according humans a higher status than animals. Against the dignitarians, I argue that defending human rights on the backs of animals is philosophically suspect and politically self-defeating.     

UNESCO conference on human rights and bioethics.

UNESCO's Division of Human Rights and Peace, together with the USSR Academy of Science and the USSR Academy of Medicine, held an international bioethics conference in Moscow May 13-15, 1991. Twenty participants from the United States, Europe, Asia, and South America participated....The Moscow conference, which took place on the new campus of the USSR Academy of Social Sciences, addressed four topics: (1) organ transplantation; (2) informed consent; (3) bioethics and the law; and (4) institutionalization of bioethics....     

International relations and the universality of human rights as a background for Islam's predicament with the western concept of human rights

The author argues that individual human rights are an originally Western concept which has become universal. The concept of human dignity which exists in Islam must not be confused with that of human rights, as secular entitlements, which are lacking in Islam. Human rights are a common concern for all humanity. In admitting that the origin of the concept of human rights is Western, this author — who is a Muslim — emphasizes the universality of human rights and questions cultural relativism. However, he does not argue for an imposition of these rights on non‐Western cultures. There is a basic need for establishing cross‐cultural foundations of human rights. Without these, human rights cannot thrive in cultures in which they did not grow.
