This paper develops a theory of civil disobedience informed by a deliberative conception of democracy. In particular, it explores the justification of illegal, public and political acts of protest in constitutional deliberative democracies. Civil disobedience becomes justifiable when processes of public deliberation fail to respect the principles of a deliberative democracy in the following three ways: when deliberation is insufficiently inclusive; when it is manipulated by powerful participants; and when it is insufficiently informed. As a contribution to ongoing processes of public deliberation, civil disobedience should be carried out in a way that respects the principles of deliberative democracy, which entails a commitment to persuasive, non-violent forms of protest.Civil disobedience is understood in this paper as public, illegal and political protest carried out against state laws or policies. Justification here is understood as a moral or political justification -- where civilly disobedient citizens claim that they are morally or politically entitled to disobey law. Deliberative or discursive models of democracy have recently enjoyed a revival in both political theory and policy practice. Against the picture of democracy as a procedure for aggregating and effectively meeting the given preference of individuals, deliberative theory offers a model of democracy as a forum through which judgements and preferences are formed and altered through reasoned dialogue between free and equal citizens. Much in the recent revival of deliberative democracy, especially that which comes through Habermas and Rawls, has Kantian roots. Deliberative institutions are embodiments of the free public use of reason that Kant takes to define the enlightenment project. Within the Kantian model the public use of reason is incompatible with the use of rhetoric. While this paper rejects strong rhetorical criticisms of deliberative democracy which render all communication strategic, it argues that rhetorical studies of deliberation have highlighted features of deliberation which point to significant weaknesses in Kantian approaches to it. Two features are of particular importance: the role of testimony and judgements of credibility in deliberation; and the role of appeal to emotions in public discourse. Both from the Kantian perspective are potential sources of heteronomy. However, the appeal to testimony and emotion are features of public deliberation that cannot and should not be eliminated. For those committed to the enlightenment values that underlie the deliberative model of democracy the question is whether these rhetorical features of deliberation are incompatible with those values. The paper argues that they are compatible. It does so by defending an Aristotelian account of rhetoric in public deliberation which denies the Platonic contrast between reasoned discourse and rhetoric which the Kantian model inherits. This article aims to explore the argumentative lines employed in an online public deliberation concerned with legislation on same-sex civil union in Greece. Drawing on rhetorical and discursive developments in political social psychology and sexual citizenship debates, the article focuses on arguments regarding the relevance and the implications of public deliberation on the construction of LGBTQI+ claims and rights. The analytic corpus consisted of 1,000 comments, analyzed with the concepts and tools of Rhetorical and Critical Discursive Social Psychology. A recurring line of arguing against the legislation questioned the democratic quality of public deliberation, representing it as a means used to legitimize predetermined decisions. Moreover, overtly discriminatory arguments were predicated on the values of participatory democracy. Accounts in favor of the legislation, though, challenged public deliberation on the grounds that it allows room for the dispute of universal human rights. The potential contribution of these findings to the understanding of the dilemmas of participatory democracy, the reproduction of heteronormativity, and the assimilation of LGBTQI+ claims is discussed.  相似文献

Critics of deliberative democracy theory have argued that deliberation should be supplemented with forms of emotional expression to eliminate the inequalities of gender, race, and class which are reproduced in deliberations that privilege rational discussion. This article presents results from a qualitative empirical study on emotion work in deliberations. Emotional expression requires emotion work on the part of the participants. The capacity for such emotion work appears to depend on the individual participant's emotional capital. The results show that, given the participants' varying levels of emotional capital, an emphasis on emotion work tends to reproduce inequalities, rather than to eliminate them.  相似文献

This paper explores the role of deliberation in the context of the capability approach to human well-being from the standpoint of the individual doing the reflecting. The concept of a ‘strong evaluator’ is used develop a concept of the agent of capability. The role of values is discussed in the process of deliberating, particularly the nature of and difference between prudential values and intrinsic values. Some consideration is given to the limits and constraints on deliberation and finally a brief example of deliberation is considered—that of occupational choice.  相似文献

The paper has two goals. First, it defends one type of subjectivist account of reasons for actions—deliberative accounts—against the criticism that they commit the conditional fallacy. Second, it attempts to show that another type of subjectivist account of practical reasons that has been gaining popularity—ideal advisor accounts—are liable to commit a closely related error. Further, I argue that ideal advisor accounts can avoid the error only by accepting the fundamental theoretical motivation behind deliberative accounts. I conclude that ideal advisor accounts represent neither a substantial departure from, nor a substantial improvement upon, deliberative accounts.  相似文献

There is a great deal of plausibility to the standard view that if one is rational and it is clear at the time of action that a certain move, say M1, would serve one’s concerns better than any other available move, then one will, as a rational agent, opt for move M1. Still, this view concerning rationality has been challenged at least in part because it seems to conflict with our considered judgments about what it is rational to do in cases of temptation that share the structure of Warren Quinn’s self-torturer case. I argue that there is a way to accomodate our considered judgments about the relevant cases of temptation without giving up the standard view or dismissing, as in some way rationally defective, the concerns of the agents in the relevant cases. My reasoning relies on the idea that, at least in some cases, whether an action serves one’s concerns well depends on what action(s) or course(s) of action it is part of. In the final section of the paper, I explain how this idea sheds light on an important source of frustration in collective decision-making.  相似文献

Was Luther avowing a genuine moral incapacity when he claimed that he could do no other? Bernard Williams has distinguished moral from psychological incapacity in terms of deliberation. There are three particular difficulties for the notion: in addition to (1) scepticism about whether the agent is genuinely incapable, there are (2) the possibility of conflicting moral incapacities, and (3) apparent cases where there is no actual or possible deliberation. If (1) can be countered, (2) can be met by ceteris paribus clauses, and it is shown that these do not remove the element of necessity. And (3) can be met by showing how possible deliberation is involved in putative counter-examples. Williams' account needs to be augmented to deal with cases of the morally unthinkable, and refined to allow for incipient attempts to do the morally impossible  相似文献

The question of how to reason well is an important normative question,one which ultimately motivates some of our interest in the more abstracttopic of the principles of practical reason. It is this normative questionthat I propose to address by arguing that given the goal of an importantkind of deliberation, we will deliberate better if we develop certainvirtues. I give an account of the virtue of stability and I argue thatstability makes reasoners (of a certain sort) reason better. Further,I suggest at the end of the paper that an account of virtues thatconduce to good reasoning might go a long way toward answering someof the traditional questions about the principles ofpractical reason.  相似文献

Most people in countries with the highest climate impact per capita are well aware of the climate crisis and do not deny the science. They worry about climate and have climate engaged attitudes. Still, their greenhouse-gas emissions are often high. How can we understand acting contrary to our knowledge? A simple answer is that we do not want to give up on benefits or compromise our quality of life. However, it is painful to live with discrepancies between knowledge and action. To be able to avoid taking the consequences of our knowledge, we deal with the gap by motivating to ourselves that the action is still acceptable. In this article, we use topical analysis to examine such processes of motivation by looking at the internal deliberation of 399 climate engaged people’s accounts of their reasoning when acting against their own knowledge. We found that these topical processes can be described in at least four different ways which we call rationalization, legitimization, justification and imploration. By focusing on topoi we can make visible how individual forms of reasoning interact with culturally developed values, habits and assumptions in creating enthymemes. We believe that these insights can contribute to understanding the conditions for climate transition communication.
