This paper examines legal guarantees of freedom of religion through the vehicle of rights using a case study of a Jehovah's Witness member in Calgary, Alberta, Canada, who refused to receive blood transfusions prescribed as part of her cancer treatment. The paper examines the pervasive concept of risk of harm that has recently become part of legal discourse in the balancing of rights process. The notion of governance is used to examine the social control of the individual and the deviant population. Aspects of both governmentality and resistance are explored.  相似文献

Experimental philosophers have challenged friends of the expertise defense to show that (a) the intuitive judgments of professional philosophers are different from the intuitive judgments of nonphilosophers, and (b) the intuitive judgments of professional philosophers are better than the intuitive judgments of nonphilosophers, in ways that are relevant to the truth or falsity of such judgments. Friends of the expertise defense have responded by arguing that the burden of proof lies with experimental philosophers. This article sketches three arguments which show that both (a) and (b) are probably false. If its arguments are cogent, then shifting the burden of proof is a futile move, since philosophical training makes no difference so far as making intuitive judgments in response to hypothetical cases is concerned.  相似文献

“Black box argument” is a metaphor for modular components of argumentative discussion that are, within a particular discussion, not open to expansion. In public policy debate such as the controversy over abstinence-only sex education, scientific conclusions enter the discourse as black boxes consisting of a result returned from an external and largely impenetrable process. In one way of looking at black box arguments, there is nothing fundamentally new for the argumentation theorist: A black box argument is very like any other appeal to authority, and what might be said about any particular form of black box will turn out to be a particularized version of what might be said about evaluating arguments based on authority. But in another way of looking at black box arguments, they are a constantly evolving technology for coming to conclusions and making these conclusions broadly acceptable. Black boxes are to argumentation what material inventions are to engineering and related sciences. They are anchored in and constrained by fundamental natural processes, but they are also new things that require theoretical explication and practical assessment.  相似文献

Roughly three years after the creation of his mandate, United Nations Special Rapporteur Maina Kiai reflects on the global state of assembly and association rights. Although the mandate was created against the backdrop of shrinking space for civil society, a massive and growing global protest movement has grabbed most of the headlines since 2011. Kiai argues that the mandate has made a measurable impact – it has helped raise awareness of repressive NGO laws, provided technical assistance to governments to strengthen assembly and association rights and developed soft law. But perhaps, the most important work of the mandate has been its contribution to a better understanding of just how important the rights to freedom of peaceful assembly and association are. Assembly and association rights are a powerful tool to promote dialog, pluralism, broadmindedness, tolerance and civic participation; they satisfy people's fundamental desire to take control of their own destinies. And if anything, the past few years have taught us that the worst turmoil comes when this desire is suppressed. When people are denied something so fundamental, rage inevitably follows. When people have no outlet for that rage, it can ultimately manifest itself as something much more chaotic than a street protest.  相似文献

This article examines Martin Luther's two fundamental claims around Christian freedom. Drawing on Luther, I suggest three primary characteristics of Christian freedom that should be recovered and championed in our twenty‐first‐century context: it is relational, it is a gift; and it contains within it an ethical imperative for the sake of the neighbor. Together, these three characteristics point to the fact that in a Christian understanding, “freedom” is never considered by itself, but only in the larger context of “freedom from” and “freedom for.”  相似文献

In recent philosophical debates a number of arguments have been used which have so much in common that it is useful to study them as having a similar structure. Many arguments – Searle's Chinese Room, for example – make use of thought experiments in which we are told a story or given a narrative context such that we feel we are in comfortable surroundings. A new notion is then introduced which clashes with our ordinary habits and associations. As a result, we do not bother to investigate seriously the new notion any further. I call such an arrangement, which is perhaps a variation of the fallacy of presumption, a Steep Cliff argument. One remedy for the misdirection of a Steep Cliff argument is to tell a counterstory from the point of view of the rejected notion.  相似文献

Philosophers have tended to dismiss John Stuart Mill’s claim that ‘all silencing of discussion is an assumption of infallibility’. I argue that Mill’s ‘infallibility claim’ is indeed open to many objections, but that, contrary to the consensus, those objections fail to defeat the anti-authoritarian thesis which lies at its core. I then argue that Mill’s consequentialist case for the liberty of thought and discussion is likewise capable of withstanding some familiar objections. My purpose is to suggest that Mill’s anti-authoritarianism and his faith in thought and discussion, when taken seriously, supply the basis for a ‘public interest’ account of ‘freedom of expression as the liberty of thought and discussion’ which is faithful to Mill in spirit, if not to the precise letter. I outline such an account, which – as I say in conclusion – can serve as a valuable safeguard against ad hoc, reactive legislation, and the demands of a spurious communitarianism.  相似文献

This article starts from love as being a fundamental value, guiding modes of behaviour that establish a reliable framework and basis for the recognition of the rights and dignity of everyone in the community. The affirmation of justice and freedom based on love leads to corrective and transformative action in cases where life is threatened and rights are being violated. Drawing on the experience and witness of Martin Luther King Jr, the article underlines that love empowers the oppressed to stand up and becomes a moral imperative for change, against the background of the many forces promoting conflict and violence, division, and polarization. The power of love is a message to the world, to the powerful, and to the powerless – to all who long for a different reality from what we see in today’s world. This needs to be expressed in the quest for the unity of the church and the unity of humankind, serving the sustainability and unity of God’s creation.  相似文献

The philosophical debate over the compatibility between causaldeterminism and moral responsibility relies heavily on ourreactions to examples. Although we believe that there is noalternative to this methodology in this area of philosophy, someexamples that feature prominently in the literature are positivelymisleading. In this vein, we criticize the use that incompatibilistsmake of the phenomenon of ``brainwashing,' as well as the Frankfurt-styleexamples favored by compatibilists. There has been a recent surge of interest in ancient accounts of free will. It is surprising, then, that there have been virtually no attempts to discuss whether Plato had such an account. Those who have made an attempt quickly deny that such an account is present in the dialogues. I shall argue that if we draw a distinction between two notions of free will, it is plausible that some account of free will is, in fact, present in the dialogues, the Republic in particular. This is the first in depth search into the question and I demonstrate that the defender of a Platonic free will thesis has more resources than she first appears to. It also has the benefit of giving us an obvious source material for Augustine's discussion.  相似文献

This essay aims to review mainstream literature and research perspectives on the sociology of human rights with the further focus on relationship between human rights and religion. We consider the challenges of late engagement of sociology with human rights and current narratives of the relationship of human rights and religion that encompass normativity as the central category of historically oriented sociology. We discuss the contribution of two empirical research mainstreams on human rights and religion and focus on a new field of study—sociology of religious freedom. A detailed new agenda for sociological research on human rights and religion is explored in the final part of our assessment.  相似文献

Do the cognitive origins of our theistic beliefs debunk them or explain them away? This paper develops an empirically motivated debunking argument and defends it against objections. First, we introduce the empirical and epistemological background. Second, we develop and defend the main argument, the debunking argument from false god beliefs. Third, we characterize and evaluate the most prominent religious debunking argument to date: the debunking argument from insensitivity. It is found that insensitivity-based arguments are problematic, which makes them less promising than the debunking argument from false god beliefs.  相似文献

This study reports an empirical investigation into Bernstein's (1967) ideas that in the early stages of the acquisition of a movement skill the coordination problem is reduced by an initial freezing out of degrees of freedom, followed later in the learning process by the release of these degrees of freedom and their incorporation into a dynamic, controllable system. “Freezing” degrees of freedom was made operational both as a rigid fixation of individual degrees of freedom and as the formation of rigid couplings between multiple degrees of freedom. Five subjects practiced slalom-like ski movements on a ski apparatus for 7 consecutive days. Results showed that at the early phases of learning, the joint angles of the lower limbs and torso displayed little movement, as expressed by their standard deviations and ranges of angular motion, whereas joint couplings were high, as shown by the relatively high cross correlations between joint angles. Over practice, angular movement significantly increased in all joint angles of the lower limbs and torso, although the cross correlations decreased. Support for the processes of freezing and releasing degrees of freedom was thus given at both levels of operationalization. In addition, a consistent change from laterally symmetric to laterally asymmetric cross-correlation patterns were observed as a function of practice. Overall, the findings provide empirical support for Bernstein's ideas regarding the mastery of redundant degrees of freedom in the acquisition of coordination.  相似文献

ABSTRACT

This article examines the relationship between freedom of religion and freedom of speech and expression within contemporary multicultural liberal democracies. These two fundamental human rights have increasingly been seen, in public and political discourse, in terms of tension if not outright opposition, a view reinforced by the Charlie Hebdo killings in January 2015. And yet in every human rights charter they are proximate to one another. This essay argues that this adjacency is not coincidental, that it has a history and that, in illuminating this history, it is possible to explore how the contemporary framing of these two rights as being in opposition has come about. Looking back to the framing of the First Amendment of the US Constitution, the essay offers an historical perspective that, in turn, facilitates a reappraisal and re-evaluation of these two liberties that is the necessary, albeit insufficient, predicate to the task of addressing the problematic of multicultural ‘crisis' in the contemporary liberal democracies of Western Europe, North America and Australasia, in which the presence of certain religious communities (Muslims, in particular) and the role of religion in public and political life more generally (and, conversely, of secularism) has assumed a central importance.  相似文献

This study investigated the effect of general creative personality and freedom of task choice on the social creativity of adolescents. The results indicated, first, that senior high school students scored higher than junior high school students. Second, girls scored higher than boys on originality, fluency, flexibility, appropriateness, and utility with regard to creative social problem‐solving. Third, freedom of task choice and its interaction with creative personality had significant effects on the originality, appropriateness, utility, flexibility, and fluency of social creativity. Adolescents who completed the task voluntarily scored higher on these dimensions than adolescents who completed it reluctantly and, among the voluntary adolescents, those with high and medium creative personality scored higher than those with low creative personality, whereas no such difference was found among the reluctant adolescents. Adolescents were more likely to show social creativity, and their general creative personality was more likely to be brought into effect under the freedom of task choice condition.  相似文献

Trauma-related disorders and treatment have gained increasing attention in the last 3 decades, spurring the development of novel treatment approaches. Many of these are incorporated into clinical practice despite lacking a solid evidence base or unbiased analyses to facilitate interpretation of existing information. Although treatments might draw on elements from validated therapies, questions regarding the incremental efficacy of new approaches persist. Three novel therapies that might warrant further examination include energy psychology, yoga, and brainspotting. The emergence of novel, trauma-related therapies is examined, and the history, theory, practice, and evidence base of these 3 specific therapies are outlined. Directions for future work are discussed. Expositions such as this might serve as a helpful resource for clinicians seeking discernment regarding treatment for posttraumatic stress disorder.  相似文献
