We investigated the effects of post‐identification feedback and viewing conditions on beliefs and interviewing tactics of participant‐investigators, crime reports of participant‐witnesses and participant‐evaluators' credibility judgments of the witnesses. Study 1 participants assumed the roles of witness and investigator (N = 167 pairs). Witnesses' view of a simulated crime video was manipulated by distance from viewing monitor: 2 or 9 ft. Participants made a line‐up identification and received either positive feedback or no feedback. Significant effects for witnesses and investigators were associated with viewing condition and post‐identification feedback. Interviews between investigator‐witness pairs were videotaped. Investigators asked more positive, leading questions when they were led to believe that the witness had identified the suspect. In Study 2 evaluators (N = 302) viewed the witness‐investigator interviews. Viewing condition had no effect on judgments of witness credibility but positive post‐identification feedback led evaluators to judge witnesses as more credible than witnesses who received no feedback. How much a person is affected by postidentification feedback is dependent on the credibility of the person giving the feedback. Seven hundred and ninety participants across three experiments viewed a crime video, made judgments from a line‐up, were provided with co‐witness and/or outcome feedback (from police officers [high credibility] or children [low credibility]), and answered testimony‐relevant questions (e.g. How good a view did you get of the person in the video?). The aim was to find out how high versus low credibility co‐witness feedback affects a witness' retrospective judgments (Experiment 1) as well as estimations of these co‐witnesses' judgments (Experiment 2). Experiment 1 showed that the feedback effect was only observed when the co‐witness responses were attributed to a high credibility source. Experiment 2 showed that high credibility co‐witnesses were estimated to score higher on the testimony‐relevant questions as compared to low credibility co‐witnesses. Experiment 3 showed that outcome feedback (e.g. ‘you identified the suspect’) produces stronger effects on testimony‐relevant questions than co‐witness feedback. The implications of these findings are that when postidentification feedback is present, it is important to determine the source of this feedback. Copyright © 2008 John Wiley & Sons, Ltd.  相似文献

Two experiments are reported that test the idea that jurors perceive child witnesses in terms of a 2-factor model of credibility with the factors defined as cognitive ability and honesty (Leippe & Romanczyk, 1987; Ross, Millers, & Moran, 1989). In the first experiment, 300 mock jurors watched a realistic videotaped recreation of a sexual abuse trial and rated the credibility of the child witness. Mock jurors perceived the child witness in terms of 2 factors: cognitive ability and honesty. Only honesty predicted verdict. These findings were replicated in Experiment 2 ( N = 300) when only the child's testimony was presented and the perceptions of the child witness were not contaminated by the testimony of the other witnesses in the trial.  相似文献

In experiment 1, 267 undergraduates read a case summary and witness statement. Sex and age of the witness (49, 69, 79 or 89 years) were varied. Participants rated the witness's perceived convincingness, confidence, quality of observation, accuracy, honesty, competence, memory, suggestibility, and cognitive functioning. As well as an age effect for honesty, age by sex interactions were observed for several characteristics, particularly for comparisons of the 79-year-olds versus the 49-year-olds, and 89-year-olds versus the 49-year-olds. In experiment 2, 94 undergraduates read the same testimony given by a 79-year-old male or female witness, and completed the Fraboni Scale of Ageism and the Aging Semantic Differential. Participants who evidenced stronger aging stereotypes on these measures rated the witness less favorably than did participants who were less prejudiced. This experiment is the first to show a link between perceived credibility of older adults and ageist attitudes. Practical applications regarding how older witnesses are viewed by jurors, and the criminal justice system more generally, are discussed.  相似文献

The qualitative regulation of grain size allows witnesses to increase the accuracy of their reports by adding alternatives (e.g., “the robber concealed his face with a mask, with a stocking, or with a balaclava”). However, such answers may include incompatible alternatives which may make police officers and juries distrust witnesses. In four preregistered experiments, we tested the effect of information with incompatible alternatives on witness credibility. In Experiments 1a, 1b, and 1c, we presented two short testimonies, one with incompatible alternatives and another without and credibility was lower with incompatible alternatives. In Experiment 2, we told participants that witnesses could report several alternatives and the effect was reduced. We explain the effect of incompatible alternatives on credibility from participants' inferences that a witness producing an answer with incompatible alternatives is not confident in their memory and a failure to fully appreciate the advantages of adding alternatives.  相似文献

Nonprobative but related photos can increase the perceived truth value of statements relative to when no photo is presented (truthiness). In two experiments, we tested whether truthiness generalizes to credibility judgments in a forensic context. Participants read short vignettes in which a witness viewed an offence. The vignettes were presented with or without a nonprobative, but related photo. In both experiments, participants gave higher witness credibility ratings to photo-present vignettes compared to photo-absent vignettes. In Experiment 2, half the vignettes included additional nonprobative information in the form of text. We replicated the photo presence effect in Experiment 2, but the nonprobative text did not significantly alter witness credibility. The results suggest that nonprobative photos can increase the perceived credibility of witnesses in legal contexts.  相似文献

This study examined the effect of a child passing or failing the UK truth and lies discussion (TLD) compared with the Canadian promise to tell the truth on mock jurors' decisions regarding witness credibility and truthfulness and defendant guilt. Ninety-two participants read a vignette that described a child witnessing his father physically attacking his mother. The vignette was manipulated for witness age (age 4 years and age 8 years) and TLD performance/promise. Supporting the hypotheses, participants rated the witness's credibility and truthfulness significantly higher after a witness passed a TLD and after promising to tell the truth. The age of the child witness did not significantly affect jurors' decision making. The results are discussed in relation to arguments regarding the abolition of the UK's TLD in favour of introducing a promise to tell the truth.  相似文献

The study is an experiment examining how different presentation modes (live vs. video) affect observers' perception, veracity assessments and memory of witnesses and their statements. Three weeks after seeing a staged accident, six truth telling and six lying witnesses testified about the event. Mock jurors (N = 122) viewed the witnesses' testimony either live or on video and rated their perception of the witnesses' statement and appearance as well as the credibility of the witnesses. Live observers rated the witnesses' appearance in a more positive way and perceived them as being more honest than did video observers. Truth tellers were rated as having to think less hard than liars. Moreover, observers were not better than chance in assessing veracity, regardless of presentation mode. Live observers incorrectly believed they had a better memory of the witnesses' statements than video observers. Observers who had watched truthful statements showed a significantly better memory performance than observers who had watched deceptive statements. Copyright © 2005 John Wiley & Sons, Ltd.  相似文献

The influence of emotions displayed by child witnesses during disclosure of abuse on judgments of credibility and guilt were examined. Eight mock police interviews with child actors, telling a story of physical abuse with different emotional expressions, were video‐recorded. In a between‐group design, jury eligible lay persons (n = 162) and professional child protective service (CPS) workers (n = 154) rated the credibility of the child witnesses and the probability that the alleged perpetrator was guilty of crime. The emotions displayed by the child witnesses strongly affected judgments of credibility and guilt. The patterns of ratings were closely similar in the two participant samples, but the overall ratings of the CPS workers were higher than those of the lay participants. Judgments of the probability of guilt followed a similar pattern with a correlation of .68 between the two variables. The theoretical and practical implications of the results are briefly discussed. Child‐witness presentation mode, judicial instructions, and deliberation stage effects on juror ratings of child witness and defendant were investigated Perceptions of the impact of presentation mode on witnesses, juror task, and justice also were explored. Participants (N= 108) viewed a simulated child sexual abuse trial videotape. Overall child‐witness credibility was significantly more positive with videodeposition or court‐given child evidence than with videolink. The defendant was seen as more definitely guilty when child testimony was court given than by videodeposition or videolink. Presentation mode also significantly influenced perceived impact on child witness, defendant case, and juror task. Judicial instructions interacted with presentation mode to affect perceptions of impact on child witness and juror task. Findings are discussed in relation to previous research, and implications for future research and practice are outlined.  相似文献

Videotaping depositions may protect a child witness from the stress of testifying in court but also may influence jurors’ perceptions of the child and the defendant, and jurors’ verdicts in systematic ways. The present study examines several psychological hypotheses that emerge from the controversy over the use of videotaped depositions of child witnesses in child sexual abuse trials. We predicted that student jurors viewing a videotaped deposition would be more proprosecution and less prodefense than those who did not receive testimony in such a form. Thus, it was predicted that jurors viewing a videotaped deposition would perceive the prosecution witnesses and their testimonies more favorably, the defense witnesses and their testimonies less favorably, and give more guilty verdicts than jurors who viewed identical testimony during the course of a trial. We also predicted that females would be more proprosecution and less prodefense than males and that this gender difference would be accentuated by the medium of presentation. The medium of presentation had only a few effects on jurors’ responses. However, when differences emerged, they generally provided support for the predicted main effects. The implications of these findings for the use of videotaped depositions of child sexual abuse victims are discussed.  相似文献

Witness shyness was examined to determine its impact on recall accuracy in two experiments. It was hypothesized that shyness would facilitate witness accuracy, under some conditions. In Experiment 1, witnesses were asked to respond to directed recall questions probing crime event and culprit details. Non-shy and shy witnesses produced comparable accuracy rates when describing the culprit. In contrast, non-shy witnesses were more accurate when describing crime environment details than shy witnesses. In Experiment 2, arousal was manipulated and a free recall approach was used to assess recall accuracy. Under low arousal, shy witnesses were more accurate at describing the culprit than non-shy witnesses, whereas, non-shy witnesses were more accurate at describing crime details than shy witnesses. Under high arousal, differences in accuracy were not observed across shy and non-shy witnesses.  相似文献

Children's testimony often plays a central role in prosecutions of child sexual abuse. Nevertheless, research on jurors' perceptions of the credibility of child sexual assault victims remains limited. In three experiments, we examined mock jurors' reactions to children's testimony about sexual abuse. Participant jurors were exposed to videotaped or written scenarios of child sexual abuse trials and then rated victim credibility and defendant guilt. Analyses indicated that: (a) victim age was either inversely related or unrelated to perceptions of victim credibility, (b) women were more likely than men to find child victims credible, (c) corroborating testimony from a child victim increased the credibility of another child victim, and (d) exposure of participants to past criminal acts and other negative defendant character evidence heightened perceived victim credibility and defendant guilt. Implications for understanding jurors' reactions to child witnesses are discussed.  相似文献

Given the often crucial role of witness evidence in occupational health and safety investigation, statements should be obtained as soon as possible after an incident using best practice methods. The present research systematically tested the efficacy of a novel Self‐Administered Witness Interview Tool (SAW‐IT), an adapted version of the Self‐Administered Interview designed to elicit comprehensive information from witnesses to industrial events. The present study also examined the effect of schematic processing on witness recall. Results indicate that the SAW‐IT elicited significantly more correct details, as well as more precise information than a traditional incident report form. Contextual information about a worker's safety history biased the reports of participant witnesses, confirming that witnesses should be shielded from extraneous post‐event information prior to reporting. Importantly, these results demonstrate that the SAW‐IT can enhance the quality of witness reports.  相似文献

Undergraduate participants who conducted a simulated police investigation were presented with either a child (6 years old) or adult (25 years old) alibi witness, who was either the son or neighbor of the participant's suspect. Replicating previous research, participants were more likely to believe the adult neighbor alibi witness than the adult son. In fact, an alibi provided by the adult son actually proved detrimental to that suspect, as participants thought the suspect was more likely to be guilty after viewing an alibi provided by the adult son. However, child‐provided alibis reduced perceptions of suspect guilt, regardless of that child's relationship to the suspect. Witnesses often meet with an attorney or witness preparation specialist before trial to review, discuss, and sometimes modify the substance and delivery of their anticipated testimony. This process is commonly referred to as witness preparation. During witness preparation, witnesses are taught to use effective testimony delivery skills (e.g., verbal and nonverbal communication skills) so that they will be perceived as being credible and persuasive in the courtroom. Although social scientists know much about communication skills, credibility, and persuasion, few published studies have attempted to determine whether or not these factors can be modified through witness preparation training. The present article reviews the psychological literature pertaining to witness preparation and makes recommendations for needed witness preparation research.  相似文献
