Deliberative or discursive models of democracy have recently enjoyed a revival in both political theory and policy practice. Against the picture of democracy as a procedure for aggregating and effectively meeting the given preference of individuals, deliberative theory offers a model of democracy as a forum through which judgements and preferences are formed and altered through reasoned dialogue between free and equal citizens. Much in the recent revival of deliberative democracy, especially that which comes through Habermas and Rawls, has Kantian roots. Deliberative institutions are embodiments of the free public use of reason that Kant takes to define the enlightenment project. Within the Kantian model the public use of reason is incompatible with the use of rhetoric. While this paper rejects strong rhetorical criticisms of deliberative democracy which render all communication strategic, it argues that rhetorical studies of deliberation have highlighted features of deliberation which point to significant weaknesses in Kantian approaches to it. Two features are of particular importance: the role of testimony and judgements of credibility in deliberation; and the role of appeal to emotions in public discourse. Both from the Kantian perspective are potential sources of heteronomy. However, the appeal to testimony and emotion are features of public deliberation that cannot and should not be eliminated. For those committed to the enlightenment values that underlie the deliberative model of democracy the question is whether these rhetorical features of deliberation are incompatible with those values. The paper argues that they are compatible. It does so by defending an Aristotelian account of rhetoric in public deliberation which denies the Platonic contrast between reasoned discourse and rhetoric which the Kantian model inherits. This article proposes a novel justification for privacy rights based on the relationship between privacy and the democratic devices of voting and deliberation. Through an epistemic conception of democracy, I show that privacy, defined as epistemic inaccessibility, justifies a reliance on the vote as the voluntary mechanism of revealing citizen preferences, even in the face of theoretically more responsive methods. Respecting the inaccessibility of citizens' views ensures that democratic governments remain reliant on, rather than merely responsive to, the wills of their citizens. In addition, spaces of epistemic inaccessibility both motivate a basic form of deliberation between citizens and foster healthy deliberative practices by blunting the potentially corrosive effects of publicity. Privacy can thus be seen as a presupposition of core democratic institutions, and not just as an individual right possessed by members of a liberal-democratic polity. This new conceptualization provides a powerful additional justification for privacy rights and suggests an alternative approach to enacting privacy-protective measures.  相似文献

I aim to explain why majority voting can be assumed to have an epistemic edge over lottery voting. This would provide support for majority voting as the appropriate decision mechanism for deliberative epistemic accounts of democracy. To argue my point, I first recall the usual arguments for majority voting: maximal decisiveness, fairness as anonymity, and minimal decisiveness. I then show how these arguments are over inclusive as they also support lottery voting. I then present a framework to measure accuracy so as to compare the two decision mechanisms. I go over four arguments for lottery voting and three arguments for majority voting that support their respective accuracy. Lottery voting is then shown to have, compared to majority voting, a decreased probability of discrimination. That is, I argue that with lottery voting it is less probable under conditions of normal politics that if the procedure selects X, X is reasonable. I then provide two case scenarios for each voting mechanism that illustrate my point.  相似文献

Conversing with diverse points of view stands as the central tenet of deliberative democracy, yet empirical evidence has suggested mixed outcomes related to perspective change as a result of deliberative encounters. I propose a difference‐driven model that suggests individual predispositions moderate the processing of dissimilar views when changing policy preferences. My analysis is based on a random sample of over 400 voters at a California‐wide deliberative event, where participants discussed proposals for reforming the state politics. I find that encountering more and different arguments transforms policy attitudes. Yet it is more difficult for people to change their minds on issues about which they hold strong beliefs. Some evidence suggests that different psychologies are at play for people who enter deliberation with substantial or weak political knowledge and for those who deliberate while holding strong or moderate prior opinions. Well‐grounded strong opinions are resistant to change, while well‐grounded moderate opinions are persuadable in deliberative groups. Uninformed positions can become entrenched in like‐minded groups, yet they can be adjusted once participants deliberate with dissimilar views, especially opinions that are held strongly without good informational ground. The findings urge deliberative forums that introduce participants to diverse perspectives to foster a considered public opinion.  相似文献

The deliberative turn in political philosophy sees theorists attempting to ground democratic legitimacy in free, rational, and public deliberation among citizens. However, feminist theorists have criticized prominent accounts of deliberative democracy, and of the public sphere that is its site, for being too exclusionary. Iris Marion Young, Nancy Fraser, and Seyla Benhabib show that deliberative democrats generally fail to attend to substantive inclusion in their conceptions of deliberative space, even though they endorse formal inclusion. If we take these criticisms seriously, we are tasked with articulating a substantively inclusive account of deliberation. I argue in this article that enriching existing theories of deliberative democracy with Fricker's conception of epistemic in/justice yields two specific benefits. First, it enables us to detect instances of epistemic injustice, and therefore failures of inclusion, within deliberative spaces. Second, it can act as a model for constructing deliberative spaces that are more inclusive and therefore better able to ground democratic legitimacy.  相似文献

Deliberative democracy is often celebrated and endorsed because of its promise to include, empower, and emancipate otherwise oppressed and excluded social groups through securing their voice and granting them impact in reasoned public deliberation. This article explores the ability of Habermas’ theory of deliberative democracy to accommodate the demands of historically excluded social groups in democratic plural societies. It argues that the inclusive, transformative, and empowering potential of Habermas’ theory of deliberative democracy falters when confronted with particular types of historical injustices. It falters because it pays little attention to the historical dimension of injustices and the demands to which it gives rise. The historical dimension of longstanding injustices, it is argued, gives rise to a set of distinctive demands, such as collective memory of exclusion, acknowledgement of historical injustices, taking responsibility, and offering apology and reparations for causing these injustices, which go beyond the type of democratic inclusion that is often offered by deliberative democracy. Yet, the solution is not to abandon the model of deliberative democracy. Quite the contrary, it remains a valuable basis for forward-looking political decision making. The article concludes that in order to achieve inclusive, empowering and transformative deliberation in consolidated democracies that have experienced historical injustices, the politics of reconciliation is indispensable.  相似文献

Epistemic democracy is standardly characterized in terms of “aiming at truth”. This presupposes a veritistic conception of epistemic value, according to which truth is the fundamental epistemic goal. I will raise an objection to the standard (veritistic) account of epistemic democracy, focusing specifically on deliberative democracy. I then propose a version of deliberative democracy that is grounded in non-veritistic epistemic goals. In particular, I argue that deliberation is valuable because it facilitates empathetic understanding. I claim that empathetic understanding is an epistemic good that doesn't have truth as its primary goal.  相似文献

In recent years, "deliberation" has become the byword of many political theorists, most of whom identify deliberation with reasoned conversation. Among the most forceful advocates of deliberation as conversation are Jürgen Habermas and, to a greater or lesser extent, his successors who style themselves "deliberative democrats." For them, the more political decision-making approximates the ideal of a reasoned public conversation among free and equal individuals, the more legitimate and rational it will be. "Outcomes," they say are democratically legitimate if and only if they could be the object of a free and reasoned agreement among equals. Their deliberative model produces more rational decision-making, they say, because it conveys information, impels individuals to order their preferences coherently, and by making persons articulate good reasons in public leads them "to think from the standpoint of all involved."  相似文献

This paper develops a theory of civil disobedience informed by a deliberative conception of democracy. In particular, it explores the justification of illegal, public and political acts of protest in constitutional deliberative democracies. Civil disobedience becomes justifiable when processes of public deliberation fail to respect the principles of a deliberative democracy in the following three ways: when deliberation is insufficiently inclusive; when it is manipulated by powerful participants; and when it is insufficiently informed. As a contribution to ongoing processes of public deliberation, civil disobedience should be carried out in a way that respects the principles of deliberative democracy, which entails a commitment to persuasive, non-violent forms of protest.Civil disobedience is understood in this paper as public, illegal and political protest carried out against state laws or policies. Justification here is understood as a moral or political justification -- where civilly disobedient citizens claim that they are morally or politically entitled to disobey law. Deliberative decision strategies have historically been considered the surest path to sound decisions; however, recent evidence and theory suggest that affective strategies may be equally as effective. In four experiments we examined conditions under which affective versus deliberative decision strategies might result in higher decision quality. While consciously focusing on feelings versus details, participants made choices that varied in complexity, in extent of subsequent conscious deliberation allowed, and in domain. Results indicate that focusing on feelings versus details led to superior objective and subjective decision quality for complex decisions. However, when using a feeling-focused approach, subsequent deliberation after encoding resulted in reduced choice quality. These results suggest that affective decision strategies may be more effective relative to deliberative strategies for certain complex decisions.  相似文献

Decisions and judgments made after deliberation can differ from expert opinion and be more regretted over time than intuitive judgments and decisions. We investigated a possible underlying process of this phenomenon, namely global versus local processing style. We argue that deliberation induces a local processing style. This processing style narrows conceptual attention and can have detrimental effects on judgment and decision-making. Study 1 showed that intuitive judgments of quality of modern paintings were more accurate than were more deliberate, reasoned judgments. Study 2 showed that local versus global processing style is associated with accuracy of quality judgments of paintings, and Study 3 replicated this finding with an experimental manipulation of processing style. Finally, Study 4 showed that the effect of intuitive versus deliberative decision mode on quality judgments of poems is mediated by processing style.  相似文献

Realizing the ideal of democracy requires political inclusion for citizens. A legitimate democracy must give citizens the opportunity to express their attitudes about the relative attractions of different policies, and access to political mechanisms through which they can be counted and heard. Actual governance often aims not at accurate belief, but at nonepistemic factors like achieving and maintaining institutional stability, creating the feeling of government legitimacy among citizens, or managing access to influence on policy decision-making. I examine the traditional relationship between inclusiveness and accuracy, and illustrate this connection by discussing empirical work on how group decision-making can improve accuracy. I also advance a Generic Epistemic Principle that any evidence-based decision-making procedures must embrace. Focusing on policy-making, I then measure the distance between these standards and the ones actually implemented in U.S. political settings. Psychological research on individual and group decision-making is a source of normative assessment for existing policy judgment, but it neither rationalizes nor legitimates the actual and typical processes used in U.S. institutions of political decision making. To establish this point, I focus on one characteristic government institution—the U.S. House of Representatives Committee on Science, Space, and Technology—that displays deliberative processes at odds with the sciences they advocate, and with the Generic Epistemic Principle. I explain this discouraging condition in terms of several inveterate factors in U.S. politics: a limitlessly money-driven and endless campaigning process that effectively forces elected representatives to align themselves with money and vote strategically, the use of procedural arrangements known to make people feel politically included when they are not, and the unresponsiveness of a majoritarian (vs. consensus) democracy.  相似文献

In this paper, the authors argue for two main claims: first, that the epistemic results of group deliberation can be superior to those of individual inquiry; and, second, that successful deliberative groups depend on individuals exhibiting deliberative virtues. The development of these group‐deliberative virtues, the authors argue, is important not only for epistemic purposes but political purposes, as democracies require the virtuous deliberation of their citizens. Deliberative virtues contribute to the deliberative synergy of the group, not only in terms of improving the quality of the group's present decisions, but also improving the background conditions for continued group deliberation. The authors sketch a preliminary schedule of these group‐deliberative virtues modelled on Aristotle's conception of virtue as the mean between two extreme vices. The virtues discussed in this article include deliberative wit, friendliness, empathy, charity, temperance, courage, sincerity, and humility.  相似文献

The relationship between representative democracy and conflict in John Stuart Mill’s political philosophy has been interpreted in very different ways. While some scholars claim that Millian democracy is incompatible with political conflict, others identify in Mill a radical political agonism that would offer a non-consensual model of deliberative democracy. This paper argues that neither of these views is exactly accurate: although he highlights the centrality of conflict in political life, Mill believes that democratic deliberation presupposes a minimal level of consensus regarding the formal value of democracy’s basic principles, viz. the principles of individual freedom and equality. Initially, I shall reconstruct the relationship between conflict and consensus in Mill’s conception of representative democracy. I shall then investigate his association of representation and advocacy and show that Mill’s encomium on political conflict was influenced by Guizot’s work. Finally, I shall explain how a democratic debate riven with conflict is conducive to individual freedom.  相似文献

The idea of deliberative democracy is based upon an implicit and questionable assumption that the ability for a meaningful participation in deliberation is a common characteristic of citizens of democratic countries. This paper discusses that assumption and describes the results of empirical research aimed at finding out (1) whether ordinary people are able to solve important ideological and moral controversies by means of deliberation, (2) what factors may facilitate this process, and (3) what are the effects of the deliberation. The research consisted in studying 20 small groups of parents of school-aged children who were asked to participate in a debate about sex education in Polish schools (N  =  195). The debates were conducted by a facilitator. Before and after the debate participants filled out questionnaires testing their attitudes and some psychological variables. The debates were recorded on videotapes. We found that it is possible to conduct a debate on ideologically contentious issues that meets some criteria of the deliberative functioning and such a debate may have some of the effects postulated by deliberative theorists.  相似文献

A plausible constraint on normative reasons to act is that it must make sense to use them as premises in deliberation. I argue that a central sort of deliberation – what Bratman calls partial planning – is question‐directed: it is over, and aims to resolve, deliberative questions. Whether it makes sense to use some consideration as a premise in deliberation in a case of partial planning can vary with the deliberative question at issue. I argue that the best explanation for this is that reasons are contrastive or relativized to deliberative questions.  相似文献

It is common to interpret Kant’s idea of public reason and the Enlightenment motto to ‘think for oneself’ as incompatible with the view that testimony and judgement of credibility is essential to rational public deliberation. Such interpretations have led to criticism of contemporary Kantian approaches to deliberative democracy for being intellectualistic, and for not considering our epistemic dependence on other people adequately. In this article, I argue that such criticism is insufficiently substantiated, and that Kant’s idea of public reason is neither at odds with deference to a certain kind of authority, nor with making judgements of character in rational deliberation. This view is corroborated by recent work on Kant’s epistemology of testimony.  相似文献
