A survey of just war theory literature reveals the existence of quite different lists of principles. This apparent arbitrariness raises a number of questions: What is the relation between ad bellum and in bello principles? Why are there so many of the former and so few of the latter? What order is there among the various principles? To answer these questions, I first draw on some recent work by Jeff McMahan to show that ad bellum and in bello principles are not, as often portrayed, independent—the justice of conduct in war largely presupposes the justice of the recourse to war. Undermining this independence claim is one important step toward revealing the unified logical structure of just war theory. I then argue that we can see the dependence of the jus in bello upon the jus ad bellum, not just in the content of certain principles, but also in the structure of the two sets of principles: I construct a one-to-one mapping between ad bellum and in bello principles. In doing so, I argue also that the shared structure successfully finds place for the questions central to the evaluation of the morality of war: what is a sufficient provocation to use force, what objectives may be sought by force, why or for what ends, who has authority to decide to use force, and when or in what circumstances? Despite variations in expression, the theory allows for a coherent and comprehensive evaluation of morality in warfare.  相似文献

In a restorative classroom inspired by a vision of racial equity, race consciousness is a necessity and a restorative outcome is conceptualized in terms of a sustainable interdependent right-relation, a species of racial justice. Yet, regardless of intent, the constructed space is white. Race-based inequity is reproduced as White students get more of everything from class than do students of Color. What made the space white? How might hospitality affect the restorative possibilities of and in the space? I explore these questions and reconceptualize right-relation as that which necessitates hospitality.  相似文献

Amidst the burgeoning enthusiasm for mindfulness in the West, there is a concern that the largely secular ‘de-contextualized’ way in which it is being harnessed is denuding it of its potential to improve health and well-being. As such, efforts are underway to ‘re-contextualize’ mindfulness, explicitly drawing on the wider framework of Buddhist ideas and practices in which it was initially developed. This paper aims to contribute to this, doing so by focusing on Zen Buddhism, and in particular on Zen aesthetic principles. The article concentrates on the seven principles identified by Hisamatsu (1971) in his classic text Zen and the Fine Arts: kanso (simplicity); fukinsei (asymmetry); koko (austere sublimity); shizen (naturalness); daisuzoku (freedom from routine); sei-jaku (tranquillity); and yūgen (profound grace). The presence of these principles in works of art is seen as reflecting and communicating insights that are central to Buddhism, such as non-attachment. Moreover, these principles do not only apply to the creation and appreciation of art, but have clear applications for treating health-related issues, and improving quality of life more generally. This paper makes the case that embodying these principles in their lives can help people enhance their psychosomatic well-being, and come to a truer understanding of the essence of mindful living.  相似文献

What is the meaning of perestrojka? There is no doubt that it led to the end of the Cold War and had a huge impact on the international situation. Nevertheless, there is no consensus as to the outcomes of perestrojka. Perestrojka brought about the collapse of the Soviet Union. This fact might be interpreted positively: it opened the possibility to restore historical truth and to create independent democratic states. From another perspective, it can be conceived negatively as a destruction of the integrity of the Soviet Union and the loss of a part of the territory as well as the economy of Russia (according to the President of the Gorba?ev Foundation, Viktor Kuvaldin, during the conference “Revisiting Perestroika—Processes and Alternatives”). Perestrojka has no one definite general meaning, but it has a very specific one for Lithuania. In this paper I ask: What is the meaning of perestrojka for contemporary Lithuania and for post-Soviet life? Was perestrojka a failure or a success? I approach perestrojka from a moral point of view, suggesting that the perestrojka made possible a fundamental choice between several alternatives. Once the choice was made the specificity of future goals and evaluation of the past opened up. I concentrate on the moral value of the act of accommodation (and resistance) to the Soviet regime, on the conflict of values represented by the “nation’s own” and the goodness of the political order, and on the role of freedom and determinism in history. Immanuel Kant’s conception of duty and the categorical imperative is used as a model for the analysis of the situation of choice.  相似文献

What is ?Curriculum Theory articulates the problematic of difference, diversity, and multiplicity in contemporary curriculum thought. More specifically, this essay argues that the conceptualization of difference that dominates the contemporary curriculum landscape is inadequate to either the task of ontological experimentation or the creation of non-representational ways for thinking a life. Despite the ostensible radicality ascribed to the curricular ideas of difference and multiplicity, What is ?Curriculum Theory argues that these ideas remain wed to an structural or identitarian logic that derives difference from the a priori conditions of the possible. Further, this essay argues that the orthodox conceptualization of difference in contemporary curriculum studies is complicit with the capitalist commitment to quantitative multiplicity, or rather, the proliferation of ‘multiple consumer choices’. Following this problematic, the task of this paper is oriented to the conceptualization of difference adequate to the creation of a people yet-to-come, or rather, a people for which no prior image exists. To accomplish this, What is ?Curriculum Theory draws upon Deleuze’s Bergsonism in order to advance a conceptualization of difference that breaks from modes of dialectical negation and contradiction particular to the tyranny of representational thinking. Articulating an image of difference that no longer accords to the possible, this essay composes a thought experiment conceptualizing a pedagogical life in a manner that explicates the transversal relationship between the actual (what is) and the virtual (what is not-yet).  相似文献

Although people generally endorse intrinsic goals for growth, intimacy, and community more than extrinsic goals for money, appearance, and popularity, people sometimes over-emphasize extrinsic goals, to the potential detriment of their well-being. When and why does this occur? Results from three experimental studies show that psychological threat increases the priority that people give to extrinsic compared to intrinsic goals. This was found in the case of existential threat (Study 1), economic threat (Studies 2), and interpersonal threat (Study 3). Discussion focuses on the possible reasons why threat breeds extrinsic orientations.  相似文献

In the Clinical Diary of Sándor Ferenczi, certain codes and abbreviations are used to refer to the eight patients Ferenczi was treating in 1932. The identities of two patients are known to us. Notably, Dm. (Clara Thompson), and R.N. (Elizabeth Severn), but the others have remained a mystery. This paper uncovers the identities of the other patients in the Diary, and, for the first time, reveals their identities and life stories. Biographical notes on these patients are provided to expand and contextualize our understanding of their lives—Who were they? What kind of families did they come from? And what happened to them after their analyses? The process of uncovering their identities and the ethics of writing about historical patients will also be addressed.  相似文献

I consider first the question What is moral phenomenology?, secondly the question How to pursue moral phenomenology?, and thirdly the question Why pursue moral phenomenology? What are moral principles? In particular, what are moral principles of the sort that (if they exist) ground moral obligations or—at the very least—particular moral truths? I argue that we can fruitfully conceive of such principles as real, irreducibly dispositional properties of individual persons (agents and patients) that are responsible for and thereby explain the moral properties of (e.g.) agents and actions. Such moral dispositions (or moral powers) are apt to be the metaphysical grounds of moral obligations and of particular truths about what is morally permissible, impermissible, etc. Moreover, they can do other things that moral principles are supposed to do: explain the phenomena “falling within their scope,” support counterfactuals, and ground moral necessities, “necessary connections” between obligating reasons and obligations. And they are apt to be the truthmakers for moral laws, or “lawlike” moral generalizations.  相似文献

Robert Kimball, in “What’s Wrong with Argumentum Ad Baculum?” (Argumentation, 2006) argues that dialogue-based models of rational argumentation do not satisfactorily account for what is objectionable about more malicious uses of threats encountered in some ad baculum arguments. We review the dialogue-based approach to argumentum ad baculum, and show how it can offer more than Kimball thinks for analyzing such threat arguments and ad baculum fallacies.  相似文献

In situated and embodied approaches it is commonly assumed that the dynamics of sensorimotor engagement between an adaptive agent and its environment are crucial in understanding natural cognition. This perspective permits to address the symbol grounding problem, since the aboutness of any mental state arising during agent-environment engagement is guaranteed by their continuous coupling. However, cognitive agents are also able to formulate representations that are detached from the current state of affairs, such as expectations and goals. Moreover, they can act on their representations before—or instead of—acting directly on the environment, for example building the plan of a bridge and not directly the bridge. On the basis of representations, actions such as planning, remembering or imagining are possible that are disengaged from the current sensorimotor cycle, and often functional to future-oriented conducts. A new problem thus has to be acknowledged, the symbol detachment problem: how and why do situated agents develop representations that are detached from their current sensorimotor interaction, but nevertheless preserve grounding and aboutness? How do cognitive agents progressively acquire a range of capabilities permitting them to deal not only with the current situation but also with alternative, in particular future states of affairs? How do they develop the capability of acting on their representations instead of acting directly on the world? In a theoretical and developmental perspective, we propose that anticipation plays a crucial role in the detachment process: anticipatory representations, originally detached from the sensorimotor cycle for the sake of action control, are successively exapted for bootstrapping increasingly complex cognitive capabilities.  相似文献

Faith‐based organizations might be ideal social service providers, claiming to transform clients’ lives with holistic support while meeting immediate needs. While organizations have such goals, their success is impacted by constituencies with differing goals for the organization. Clients with goals not commensurate with an organization's may compromise its ability to attain its goals. Three questions are examined here: What are the goals of faith‐based service providers? When asked what they think about the services, do clients share the organizational goals? Are organizations likely to meet either set of goals? Homeless persons patronizing faith‐based soup kitchens were interviewed; service activities of organizations were observed. Clients’ goals focused on survival in their current situation. Organizations’ goals ranged from meeting clients’ immediate needs to transforming clients through spiritual restoration. Congregations studied met clients’ immediate needs. However, clients’ accommodational goals were potentially problematic for organizations with spiritual goals.  相似文献

In The Crisis of the European Sciences and Transcendental Phenomenology, Husserl argues that the only way to respond to the scientific Krisis of which he speaks is with phenomenological reflections on the history, method, and task of philosophy. On the assumption that an accurate diagnosis of a malady is a necessary condition for an effective remedy, this paper aims to formulate a precise concept of the Krisis of the European sciences with which Husserl operates in this work. Thus it seeks an answer to the question: What exactly, according to Husserl, is “the ‘crisis’ [Krisis] of the European sciences”? There are two different tendencies in the literature on this question. According to the traditional interpretation, the Krisis of the European sciences lies not in the inadequacy of their scientificity but in the loss of their meaningfulness for life. According to an innovative suggestion, the Krisis lies not in the loss of their meaningfulness for life but in the inadequacy of their scientificity. These readings are mutually exclusive because each claims that the other misidentifies the Krisis as something that it is not. The argument of this paper, however, is that, given the many different senses of Krisis in The Crisis, an adequate understanding of the Krisis that Husserl identifies requires not a disjunctive but an inclusive approach. Therefore the paper proposes that Husserl’s Krisis of the European sciences is both a crisis of their scientificity and a crisis of their meaningfulness for life. The relevance of this result to Husserl’s philosophical and historical sense-investigations in The Crisis—as well as to the present critical situation of philosophy—is self-evident.  相似文献

The present work is motivated by two questions. (1) What should an intuitionistic epistemic logic look like? (2) How should one interpret the knowledge operator in a Kripke-model for it? In what follows we outline an answer to (2) and give a model-theoretic definition of the operator K. This will shed some light also on (1), since it turns out that K, defined as we do, fulfills the properties of a necessity operator for a normal modal logic. The interest of our construction also lies in a better insight into the intuitionistic solution to Fitch’s paradox, which is discussed in the third section. In particular we examine, in the light of our definition, DeVidi and Solomon’s proposal of formulating the verification thesis as \(\phi \rightarrow \neg \neg K\phi\). We show, as our main result, that this definition excapes the paradox, though it is validated only under restrictive conditions on the models.  相似文献

What do we learn when we find out that an argument is logically incorrect? If logically incorrect means the same as not logically correct, which in turn means not having a valid logical form, it seems that we do not learn anything too useful—an argument which is logically incorrect can still be conclusive. Thus, it seems that it makes sense to fix a stronger interpretation of the term under which a logically incorrect argument is guaranteed to be wrong (and is such for purely logical reasons). In this paper, we show that pinpointing this stronger sense is much trickier than one would expect; but eventually we reach an explication of the notion of (strong) logical incorrectness which we find non-trivial and viable.  相似文献

Research indicates that health care professionals’ attitudes may affect patients’ decisions regarding prenatal Huntington Disease testing, but few studies have sampled genetic counselors. In this qualitative study, genetic counselors described their experiences counseling individuals at risk for HD regarding reproductive decision-making. Five major research questions were investigated: 1) What are genetic counselor responsibilities? 2) What issues arise for patients and counselors? 3) How do counselors reconcile prenatal testing with presymptomatic testing? 4) To what extent are counselors’ initial expectations of at-risk patients’ beliefs and behaviors met? and 5) What advice would counselors offer to novice practitioners about working with this patient population? Fifteen genetic counselors experienced in counseling individuals at risk for HD participated in a semi-structured phone interview that yielded several themes. For example, participants identified their primary responsibility as information provision; less prevalent were psychosocial support and facilitating decision making. The most common ethical challenge was testing prenatally for HD which also results in presymptomatic testing of minors. Participants were divided about how directive to be in response to this ethical issue and about termination of a gene positive pregnancy.  相似文献

Throughout its fifty-year history, the role of the medical humanist and even the name “medical humanities” has remained raw, dynamic and contested. What do we mean when we call ourselves “humanists” and our practice “medical humanities?” To address these questions, we turn to the concept of origin narratives. After explaining the value of these stories, we focus on one particularly rich origin narrative of the medical humanities by telling the story of how a group of educators, ethicists, and scholars struggling to define their relatively new field rediscovered the studia humanitatis, a Renaissance curriculum for learning and teaching. Our origin narrative is composed of two intertwined stories—the history of the studia humanitatis itself and the story of the scholars who rediscovered it. We argue that as an origin narrative the studia humanitatis grounds the medical humanities as both an engaged moral practice and pedagogical project. In the latter part of the paper, we use this origin narrative to show how medical humanists working in translational science can use their understanding of their historical roots to do meaningful work in the world.  相似文献

According to one argument for Animalism about personal identity, animal, but not person, is a Wigginsian substance concept—a concept that tells us what we are essentially. Person supposedly fails to be a substance concept because it is a functional concept that answers the question “what do we do?” without telling us what we are. Since person is not a substance concept, it cannot provide the criteria for our coming into or going out of existence; animal, on the other hand, can provide such criteria. This argument has been defended by Eric Olson, among others. I argue that this line of reasoning fails to show Animalism to be superior to the Psychological Approach, for the following two reasons: (1) human animal, animal, and organism are all functional concepts, and (2) the distinction between what something is and what it does is illegitimate on the reading that the argument needs.  相似文献
