Juror reasoning and verdict choice have been explored variously as functions of argument skill and the overall story representation of the evidence on which verdict choices are based. This study investigates the proportion of testimony covered in the justification of a verdict choice and its relationship with argument skill, narrative explanation or evidence‐based argument, and certainty about verdict choice. Each of these variables was also compared with the verdict choice. People serving jury duty justified verdict choices in two abridged jury trials. Individuals were consistent in the relative amount of evidence used in both trials. Argument skills, evidence evaluation type, and evidence synthesis type all accounted for variance in the amount of evidence covered. Evidence coverage, along with argument skills, predicted verdict choice. As expected, those most certain about verdict choice did not use the most evidence. Implications regarding mediating factors in story construction and juror decision making are discussed. Copyright © 2004 John Wiley & Sons, Ltd.  相似文献

认知闭合需要是个体稳定的认知特征,描述了个体在面对模糊情境时是否愿意系统处理信息的动机。已有研究表明,认知闭合需要对个体的信息处理过程和决策结果有显著的预测能力。总体上说,高认知闭合需要的个体更容易利用启发式进行思考,因此此类个体更容易受到过度归因、首因效应等的影响。虽然大多数的研究表明认知闭合需要是个体稳定的认知特质,但也有研究者发现环境因素如噪音等可以在一定程度上、在短时期内改变个体的认知闭合需要的水平。因此,在相关研究中,认知闭合需要既可以通过量表测量,也可以通过在实验中改变环境噪音和时间压力等方法来操纵。已有的关于认知闭合需要的研究也有不足之处。首先,如何引导高认知闭合者克服匆忙做出决策的动机并采用分析式的方式处理信息和进行决策,目前的相关研究还很少;其次,已有的关于认知闭合的研究大都为实验室研究,因此这些研究的外部效度较低;第三,认知闭合需要在冲突研究领域的应用被忽略了。未来有必要针对这些不足之处进行相应研究  相似文献

Civil plaintiffs often seek compensation for their psychological injuries. Yet little is known about jurors' preconceived notions (or schemas) for a prospective plaintiff's pain and suffering. The present studies examined (a) whether jurors have psychological injury schemas (Studies 1 and 2), (b) whether their existence and development vary by the type of civil case (Studies 1 and 2) or its severity (Study 2), and (c) how psychological injury schemas compare with physical injury schemas on a number of theoretically and legally relevant judgments (e.g., injury severity, availability, and plaintiff credibility; Study 2). Study 1 (N = 233) presented undergraduate mock jurors with 2 negligence incidents (car accident and slip and fall) and 2 intentional tort incidents (sexual assault and kidnapping) and asked them to report the typical incident and injuries that would result from the defendant's conduct. Results supported the sparse existence of psychological injury schemas but found that they were more developed in the kidnapping and sexual assault incidents than in the car accident and slip and fall incidents. Study 2 (N = 288) additionally manipulated incident schema severity (mild vs. severe) while having participants separately report and rate their psychological and physical injury schemas on judgments of legal and theoretical interest. Results indicated that although mock jurors' psychological injury schemas contained fewer injuries than their physical injury schemas, the reported psychological injuries were rated as more severe than physical injuries. We discuss how schemas may underlie the disparate treatment of psychological and physical injuries by legal decision‐makers.  相似文献

Abstract

There is a paucity of research studying patients' decision making processes. Traditional normative approaches investigating human decision have presented rational, analytic processing as a ‘gold standard’ for decision making with decision aids developed to facilitate such thinking. This paradigm has been challenged by the recent emergence of naturalistic decision making. Naturalistic approaches argue for techniques modelled closer to how decisions are actually made in ‘real life’. Early work in this evolving field suggests the importance of more automatic, intuitive processing such as the use of heuristic short-cuts. This paper discusses the contribution of naturalistic decision theory and assesses its usefulness as an alternative to classical decision approaches in investigating patient decision making. Approaches for measuring underlying cognitive processes are also critically discussed.  相似文献

It was predicted that preference factions within decision‐making groups would have greater influence to the extent that faction‐member preferences are based on a common pool of decision‐relevant information. Such factions are said to exhibit high informational commonality (IC). Four‐person groups decided how much money to invest in each of two pharmaceutical companies developing new cholesterol‐lowering drugs. Prior to discussion, information about these companies and drugs was distributed among members such that two would initially prefer investing in one company and two would initially prefer investing in the other company. Further, whereas half of the information held by members of one preference faction was held in common between them (high IC), almost none of the information held by those in the other faction was held in common between them (low IC). It was found that groups invested more money in a given company when that company was initially preferred by their high‐IC faction. Additionally, high‐IC factions exerted greater influence on members' private allocation preferences. These effects appear to have been due to the ability of members in the high‐IC factions to work together in a more coordinated manner to argue their position. As interest in the temporal dynamics of decision-making has grown, researchers have increasingly turned to computational approaches such as the drift diffusion model (DDM) to identify how cognitive processes unfold during choice. At the same time, technological advances in noninvasive neurophysiological methods such as electroencephalography and magnetoencephalography now allow researchers to map the neural time course of decision making with millisecond precision. Combining these approaches can potentially yield important new insights into how choices emerge over time. Here we review recent research on the computational and neurophysiological correlates of perceptual and value-based decision making, from DDM parameters to scalp potentials and oscillatory neural activity. Starting with motor response preparation, the most well-understood aspect of the decision process, we discuss evidence that urgency signals and shifts in baseline activation, rather than shifts in the physiological value of the choice-triggering response threshold, are responsible for adjusting response times under speeded choice scenarios. Research on the neural correlates of starting point bias suggests that prestimulus activity can predict biases in motor choice behavior. Finally, studies examining the time dynamics of evidence construction and evidence accumulation have identified signals at frontocentral and centroparietal electrodes associated respectively with these processes, emerging 300–500 ms after stimulus onset. These findings can inform psychological theories of decision-making, providing empirical support for attribute weighting in value-based choice while suggesting theoretical alternatives to dual-process accounts. Further research combining computational and neurophysiological approaches holds promise for providing greater insight into the moment-by-moment evolution of the decision process. The analysis of competing hypotheses (ACH) has been suggested to be a method that can protect against confirmation bias in the context of intelligence analysis. In the current study, we aimed to determine whether ACH could counter confirmation bias in the reasoning with evidence in the context of criminal law proceedings. Law students (N = 191) received information about the ACH method or general information about biases. They were given a case vignette with a main suspect and a list of 24 questions, 6 of which they could ask about the case. Half of the questions related to incriminating information, whereas the other half related to exonerating information. Contrary to our expectations, participants in both conditions favoured questions relating to exonerating information and rated the exonerating evidence as being more important for their decision. Despite the lack of bias observed, it seems participants failed to properly apply the ACH method.  相似文献

Weighted‐additive (WADD) strategies require decision makers to integrate multiple values weighted by their relevance. From what age can children make choices in line with such a WADD‐strategy? We compare multi‐attribute decisions of children (6–7; 8–10; 11–12‐year‐olds) with adults in an open information‐board environment without pre‐decisional information search. In two experiments, we classify decision strategies based on individual choice patterns and find that in all age groups the majority of participants are users of a WADD‐strategy. Simple decision heuristics such as lexicographic strategies were applied rarely by children and not at all by adults. In two additional follow‐up studies, we further investigate the underlying process of WADD‐application by analysing decision latencies in combination with a retrospective think‐aloud study. Results suggest that children did not apply WADD‐strategies in a deliberate fashion in our experiments. Overall, our findings demonstrate that the ability to make good and quick decisions by holistically integrating information is already present in young children. Memories affect nearly every aspect of our mental life. They allow us to both resolve uncertainty in the present and to construct plans for the future. Recently, renewed interest in the role memory plays in adaptive behavior has led to new theoretical advances and empirical observations. We review key findings, with particular emphasis on how the retrieval of many kinds of memories affects deliberative action selection. These results are interpreted in a sequential inference framework, in which reinstatements from memory serve as “samples” of potential action outcomes. The resulting model suggests a central role for the dynamics of memory reactivation in determining the influence of different kinds of memory in decisions. We propose that representation-specific dynamics can implement a bottom-up “product of experts” rule that integrates multiple sets of action-outcome predictions weighted based on their uncertainty. Conventional wisdom and studies of unconscious processing suggest that sleeping on a choice may improve decision making. Although sleep has been shown to benefit several cognitive tasks, including problem solving, its impact on everyday choices remains unclear. Here we explore the effects of ‘sleeping on it’ on preference‐based decisions among multiple options. In two studies, individuals viewed several attributes describing a set of items and were asked to select their preferred item after a 12‐hour interval that either contained sleep or was spent fully awake. After an overnight period including sleep, individuals showed increases in positive perceptions of the choice set. This finding contrasts with previous research showing that sleep selectively enhances recall for negative information. In addition, this increase in positive recall did not translate into a greater desire to purchase their preferred item or into an overall benefit for choice satisfaction. Time‐of‐day controls were used to confirm that the observed effects could not be explained by circadian influences. Thus, we show that people may feel more positive about the choice options but not more confident about the choice after ‘sleeping on’ a subjective decision. We discuss how the valence of recalled choice set information may be important in understanding the effects of sleep on multi‐attribute decision making and suggest several avenues for future research. Implicit measures have become very popular in virtually all areas of basic and applied psychology. However, there are empirical and theoretical arguments that might raise doubts about their usefulness in research on political attitudes. Based on a review of relevant evidence, we argue that implicit measures can be useful to identify distal sources of political preferences in domains where self‐presentation may bias self‐reports (e.g., influence of racial attitudes on voting decisions). In addition, implicit measures of proximal political attitudes can contribute to the prediction of future political decisions by virtue of their capability to predict biases in the processing of decision‐relevant information (e.g., prediction of voting behavior of undecided voters). These conclusions are supported by research showing that implicit measures predict real‐world political behavior over and above explicit measures. The reviewed findings suggest that implicit measures may serve as a useful supplement to improve the prediction of election outcomes. Open questions and potential directions for future research are discussed.  相似文献

This paper outlines a model that captures the experiences of 28 Senior Officers who have managed some of the most significant police incidents in the UK in the past 5 years. The process for capturing the model rests on ‘pragmatic psychology’ (Fishman, 1999; Alison, West & Goodwill, 2003), a paradigm that recognizes practitioners' experiences as a central component of research and policy development. We utilized a set of connected electronic notebooks to enable each critical incident manager to log their experiences and views of the case that they managed. As each individual logs this information, it is simultaneously distributed to all participants. Thus, information is rapidly shared, stimulating further thought and discussion. Following the initial knowledge‐sharing phase, participants reorder the material into themed categories that can then be scored against specific criteria (in this case ‘impact’ and ‘ease’). This session revealed that senior officers consider a combination of two co‐occurring issues as most significant in defining the ‘criticality’ of the incident: (i) how direct an impact the facet has on the enquiry at hand; and (ii) whether that issue will influence how the service will be judged (by the community, the victims and the media). These issues were perceived as the most complex and difficult to deal with. We argue that this perception is a joint function of perceived lack of control alongside the belief that judgment and blame regarding the incident will ultimately reside with them as managers. Many studies have looked into the provisions of visual aids to multicriteria decision making. However, most of them have separated the display of alternative profiles and criteria weight information into two displays. This makes the analysis of the relationship between the criteria and alternatives and the effect of changing the criteria weights on the decision difficult. In this study, displays that can incorporate the display of both alternative profiles and criteria weight information for discrete alternative multicriteria decision-making problems are examined. The simple additive model is the multicriteria analysis method used. The result is two new visual aids for representing data of multicriteria decision-making problems, the modified star graph and the petal diagram. This paper discusses the two displays and compares their strengths and weaknesses. This paper addresses multicriteria decision problems in which only partial information is given in the decision-making process. We generalize existing results about preference relations induced by nonnegative inverse matrices, allowing linear relations on weights with upper and lower bounds. Decision-making groups prefer to discuss shared information that all members know instead of unshared information that a single member knows. This bias toward discussing shared information can lead groups to make suboptimal decisions when unshared information is critical for good decision making. This preference for discussing shared information may stem from group members' positive evaluations of each other's task capabilities when shared information is communicated. Members who already are perceived as capable (i.e., those high in status, experts, and leaders) need not bolster their image by communicating shared information. Instead, they discuss unshared information more than members perceived as less capable. As members low in status gain respect by communicating shared information, they may risk mentioning unshared information later during discussion. Assigning group leaders, informing members of their expert roles, and allowing ample time for discussion may increase groups' discussion of unshared information.  相似文献

Research has shown that decision-making groups with distributed information perform better when group members know which member is knowledgeable about what. Thus far research has been unable to identify the process responsible for this effect. In the present study, we propose that group members’ task representations mediate the effect of knowledge about the distribution of information on decision performance. Building on this proposition, we also propose that reflection about the task moderates the effect of knowledge about distributed information through its effect on task representations. These hypotheses were put to the test in an experimental study of decision-making groups (N = 125). As predicted, knowledge of distributed information interacted with reflection to affect decision quality. Findings confirmed the proposed mediating role of task representations and information elaboration.  相似文献

Decisions in front of a supermarket shelf probably involve a mix of visually available information and associated memories—and interactions between those two. Several cognitive processes, such as decision making, search, and various judgments, are therefore likely to co‐occur, and each process will influence visual attention. We conducted two eye‐tracking experiments capturing parts of these features by having participants make either judgments or decisions concerning products that had been previously encoded. Half the time, participants made their choices with full information about the available products and half the time with crucial task‐relevant information removed. By comparing participants' use of visual attention during decisions and search‐based and memory‐based judgments, we can better understand how visual attention is differently employed between tasks and how it depends on the visual environment. We found that participants' visual attention during decisions is sensitive to evaluations already made during encoding and strongly characterized by preferential looking to the options later to be chosen. When the task environment is rich enough, participants engage in advanced integrative visual behavior and improve their decision quality. In contrast, visual attention during judgments made on the same products reflects a search‐like behavior when all information is available and a more focused type of visual behavior when information is removed. Our findings contribute not only to the literature on how visual attention is used during decision making but also to methodological questions concerning how to measure and identify task‐specific features of visual attention in ecologically valid ways.
