Assistive technology patenting trends and the Americans with Disabilities Act

This article examines the ways in which the growing economic market for assistive technology (AT) may be analyzed in the context of effective implementation of the Americans with Disabilities Act (ADA). It summarizes the results of an ongoing study of patent data from the United States Patent and Trademark Office (PTO). The purpose of the study is to examine how the ADA is fostering innovation and economic opportunity for AT developers, manufacturers, and retailers. The findings suggest that evaluations of the ADA based on its perceived costs to society need to be balanced by the range of societal benefits accruing from the law, including those unanticipated economic benefits found in the present study.     

Politicizing Survivors of Incest and Sexual Abuse

Abstract

As both a feminist therapist and a survivor of incest, moving myself beyond therapeutic issues into an area of public education has been crucial to my own healing process. Receiving positive responses to my workshops and discussion groups, it became apparent that using a similar approach with clients who were survivors might be beneficial to their healing. As a member of The Counseling Center for Women, a feminist therapy collective in Israel, I suggested we sponsor a public exhibition and a series of programs of the topic of incest and abuse. The Municipality of Tel Aviv was approached to be its governmental sponsor. Entitled “Silent No More,” the program moved therapists and clients from working in the privacy of therapy to a public forum. What began as an uncomplicated educational program became an emotional process and a politicizing of individuals to help others as well as themselves. Moving from a feeling of shame to a sense of empowerment, the exhibition gave us a new sense of self-esteem and strength in our own abilities and our recovery process.     

Empirical study of the Americans with Disabilities Act: employment issues from 1990 to 1994

The Americans with Disabilities Act (ADA) of 1990 is the most comprehensive federal civil rights law addressing discrimination against one-fifth of the American population. This article is meant to contribute to the emerging dialogue on ADA implementation by presenting information from a longitudinal investigation of employment integration and economic opportunity under the employment provisions of the ADA, set forth in Title I of the act. The broader relevance of the investigation to emerging questions under Title I law is described. Thereafter, the investigation's seven core findings are presented, and then the implications for future investigation of the ADA are examined.     

Dis-Illusioning Psychology: Epistemology and the Contextual Psychology of Ellyn Kaschak

ABSTRACT

Ellyn Kaschak is a pioneer feminist therapist whose contributions to feminist theory, practice, education, and advocacy have spanned the globe over the past 40?+?years. From being a founder of one of the first feminist counseling services in the country in the early 1970s, Kaschak has influenced decades of feminist, family and multi-cultural therapists through her teaching and countless others through her feminist epistemology and theory development and the Mattering Map. This article describes Kaschak’s life and work and the lasting contributions she has made to the field of feminist psychology.     

Womanist Therapy with African American Women with Disabilities

Abstract

African American women are at increased risk for disabilities. There is very little information available, however, regarding psychological interventions with African American women with disabilities. The purpose of this article is to discuss psychological intervention in working with African American women with acquired disabilities from a womanist perspective. Themes and interventions will be discussed. Recommendations for working with African American women with disabilities in a therapeutic context will be offered.     

The Moral Imperative

Abstract

Given recent evidence concerning the prevalence of impairment in practitioners and its deleterious effects upon clients, therapist self-care must be viewed as a moral imperative. Despite the perception that self-care is especially problematic for women psychotherapists, research indicates that we are less ambivalent about practicing self-care and engaging in personal therapy than men practitioners (Mahoney, 1997). We propose a classification system based upon the dimensions of awareness of impairment and commitment to self-care and offer practical suggestions in order to create a climate more amenable for women therapists to engage in self-care activities.     

Special Rules for the Church: The “Ministerial” Exception under the Americans with Disabilities Act

Abstract : In the Hosanna‐Tabor case, the United States Supreme Court held that there is a broad exception under the Americans with Disabilities Act (ADA) for employees who are ministers. A Lutheran Church–Missouri Synod school could fire an elementary school teacher with a disability because she was a “called teacher,” even though the termination would otherwise have violated the ADA. The Evangelical Lutheran Church in America supported this decision, but this contradicts the ELCA's position with respect to persons living with disabilities. It also reflects an “idolatry of the call” inconsistent with the priesthood of all believers. A better course for the ELCA is to agree to be bound by those standards that it advocates for the secular world.     

Beyond the Frying Pan: Addressing Work Issues with Women in Therapy

In recent years, mental health practitioners have been exploring how women are balancing work and family. Given how this issue affects womens experiences in the corporate world and at home, marriage and family therapists are attempting to consider this concern as they treat female clients individually and within relational systems. Few articles and studies have examined the issues female employees face in the workplace and how the issues influence the therapeutic process. In this article, the authors examine the organizational, sociological, and cultural challenges women deal with at work and apply these areas to the therapeutic context. The authors present a case study of a female client enduring a difficult work situation, discussing how to view and approach this case from a feminist family therapy perspective.     

Feminist and Community Psychology Ethics in Research with Homeless Women

This paper presents a feminist and community psychology analysis of ethical concerns that can arise throughout the process of doing research with women who are homeless. The unique contexts of the lives of women who are homeless demand that researchers redefine traditional ethical constructs such as consent, privacy, harm, and bias. Research that fails to do this may perpetuate the stereotyping, marginalization, stigmatization, and victimization homeless women face. Feminist and community research ethics must go beyond the avoidance of harm to an active investment in the well-being of marginalized individuals and communities. Using feminist and community psychology ethics, this paper addresses some common problems in research with women who are homeless, and argues for the transformation of research from a tool for the advancement of science into a strategy for the empowerment of homeless women and their communities.     

Applicability of the ADA to "Ticket to Work" employment networks. Americans with Disabilities Act

This article examines the applicability of the antidiscrimination provisions of the Americans with Disabilities Act (ADA) of 1990 to The Ticket to Work and Work Incentives Improvement Act (TWWIIA) passed in 1999. Among other policy changes, under the Ticket to Work program, eligible recipients of disability insurance (SSDI) and supplemental income (SSI) receive a voucher or "ticket" to obtain services from qualified employment networks (ENs). ENs provide employment services and supports to designated beneficiaries and must meet certain qualification requirements. The ADA is applicable to ENs in several ways: primarily, in the EN's responsibility to provide appropriate access and services to program participants. This article discusses application of the ADA to the Ticket Program as ENs begin to serve program beneficiaries.     

Narrative Practices and Positive Aging: A Reflection about Life Celebration in a Group of Old Women

The main objective of this article is to address the impact of narrative practices in life celebration after the age of 80 and in the co-construction of a community-positive future. We share here an exploratory reflection about the narratives of a group of older women integrated in a community project. The Wednesday Tea Project (Chá das Quartas) has been ongoing for 4 years, and involves a group of old women experiencing high levels of loneliness and isolation in their small village in Portugal. The Wednesday Tea Project is based on positive psychology methodologies and consists of ritualized sessions that encourage participatory group dynamics. To describe how this project has highlighted the benefits of narrative practices, we utilized a series of scaffolding questions. Some of the most relevant outcomes of this project are: (a) the deconstruction of the dominant social discourse; (b) the publication of a book; (c) the reduction of loneliness feelings by re-membering significant figures; and (d) new levels of action both to women and the community as a consequence of a re-authoring process. Narrative practices seem to have contributed to the consolidation of all time dimensions, giving these women the opportunity to celebrate life after the age of 80, while also allowing the community to be part of and to benefit from the process. A reflection about the contributions of this article to a paradigm change toward positive aging is presented.     

To test or not to test: The status of psychological testing under the Americans with Disabilities Act (ADA)

The Americans with Disabilities Act (ADA) serves as a safeguard that employers are using only nondiscriminatory and valid selection measures. This article clarifies the point that preemployment psychological tests are not usually medical in nature and thus can continue to be used once the ADA becomes effective.

Genetic Discrimination and the Employment Provisions of the Americans with Disabilities Act: Emerging Legal,Empirical, and Policy Implications

The Americans with Disabilities Act of 1990 (ADA) is the most comprehensive federal civil rights law addressing employment discrimination against potentially millions of Americans. The Human Genome Project (HGP) is a federally funded research effort that seeks to map and sequence every human gene. This article is meant to contribute to the emerging dialogue on the interplay between the HGP and the employment provisions of the ADA, set forth in Title I of the act. The relevance of the HGP to emerging legal questions, including those arising under Title I and recent EEOC guidelines, is described. Thereafter, empirical issues are discussed, and directions for future investigation of genetic discrimination under the ADA are explored.     

A feminist psychotherapeutic approach to working with women who eat compulsively1

Feminist psychoanalytic theorists argue that eating problems demonstrate ways in which conscious and unconscious gendered feelings about women are split off and projected on to their bodies. As such, they are complex ways in which women attempt to negotiate and express their identities within their paradoxical social position in contemporary western society. They are not just consumers but also objects of consumption. This paper explores material from a feminist psychodynamic therapy group for women with a variety of eating problems, focusing on how interweaving both discursive and unconscious approaches to understanding the gendered function of weight can facilitate change. Feminist psychodynamic therapists work with the concept that the body is an interface between conscious and unconscious mind within both an internal and a social world. This framework enables the client to understand the connections between socially constructed frameworks of femininity, emotions and bodily sensations, rather than to act on them through some form of bodily abuse. This approach is based on my adaptation of Susie Orbach's (1978) ‘Fat is a Feminist Issue’ therapeutic model for working with compulsive eaters. While arguing that a feminist psychoanalytic framework is crucial in this type of work, I suggest that it is essential to combine this with cognitive and behavioural therapeutic interventions in order to provide a pedagogic structure in which food, eating and body size come to be seen as meaningful.

The Middle Passage,Trauma and the Tragic Re-Imagination of African American Theology

African American Christian consciousness developed in response to the traumatic field in which African American subjectivity took shape. The expression of the faith in the African American tradition is fundamentally tragic as a consequence. The Middle Passage is the existential and symbolic nodal point of this experience. There is a sense in which African Americans remain very much on the water; marginalized and suspended between worlds. There is a deeper sense in which the African American situation and response reflects the condition of modernity and post-modernity in the sense that it is hardly more than modernity becoming conscious of itself. A thorough examination and exploration of its significance is essential to developing a theology that adequately expresses African American Christian consciousness. This paper is an attempt to lay out, what I think, are some of the basic components of the experience and the bare outlines or orientation of such a theology grounded in it.
