The current study examined offence and offender characteristics in female and male offenders claiming no, partial or complete homicide-related amnesia. Pre-trial file information consisting of forensic examination reports and crime reports of all female (n = 79) and male (n = 577) offenders subject to forensic psychiatric examination in 1995–2004 and convicted of homicide were retrospectively analysed. The Psychopathy Check List Revised (PCL-R) was used for scoring psychopathy. Claiming homicide-related amnesia was significantly more frequent in female (60.7%) than male (42.1%) offenders. Findings indicate that in males the use of sharp instrument, intoxication, staying at the scene and feeling regret for the killing accompany claims of crime-related amnesia. In females, personality disorder and criminal history were significantly more frequent in offenders claiming crime-related amnesia. Analysis of intelligence, psychopathology or psychopathy indicated no significant relationship with claims of amnesia in either gender groups.  相似文献

The present study examined whether mock offenders, who were instructed to falsely deny crime details or to simulate amnesia, would consequently experience impaired memory. Ninety‐three university students were first asked to commit a mock crime and were then assigned to three different conditions (i.e., false denial, simulated amnesia, and truth telling) and then received the first memory test. The following day, participants completed a second memory test. Results showed that the memory impairment was not observed in participants in the false denial condition. However, in the simulated amnesia group, memory about being interviewed in the first session was impaired. The simulated amnesia group also had lower recollection and belief ratings in the occurrence of true details for the mock event. Findings suggest that after simulating amnesia, offenders can forget details related to the interview and exhibit diminished ratings for the recollection of and belief in their memory for experienced events.  相似文献

Research suggests that both internal (i.e., lying) and external (i.e., misinformation) factors can affect memory for a crime. We aimed to explore the effects of post-event misinformation on crime-related amnesia claims. We showed participants a mock crime and asked them to either simulate amnesia (simulators) or confess to it (confessors). Next, some participants were provided with misinformation. Finally, all participants were requested to genuinely recollect the crime. Overall, simulators reported less correct information than confessors. Moreover, these two groups were equally vulnerable to misinformation. In addition, exploratory analyses on strategies adopted by simulators revealed that those who previously, mostly omitted information while simulating amnesia exhibited the lowest amount of correct details. Simulators who instead used a mixed strategy disclosed more fabricated memory errors. Findings suggest that legal professionals and jurors should take into account that even offenders, irrespective of confessing or simulating memory loss for a crime, can be susceptible to post-event misinformation.  相似文献

The group of the over 60-years-old does only contribute a relatively small part to the registered crime – compared to their continuously growing percentage in the population. Crimes committed by elderly persons are predominantly property offences with shoplifting playing an outstanding role. Elderly persons are also overrepresented concerning offences of insult, (negligent) arson and environmental offences whereas violent crimes are rare. Elderly men are also slightly overrepresented concerning sexual abuse of children, but this is very rare, too. As a whole, the fear that Germany will be overrun by a wave of old-age crime does not seem to be confirmed. Elderly offenders are still very rare and the offences committed are significantly less heavy than those committed by younger offenders.  相似文献

Alcohol-induced amnestic periods (blackouts) are common to alcoholic and nonalcoholic drinkers. The use of alcoholic amnesia as evidence of incompetence to stand trial or in mitigation of criminal responsibility hinges upon the reversibility of amnesia and upon the voluntariness of intoxication and of the ensuing blackout. After discussions of the phenomenology of alcoholic blackouts and the role of alcoholic and nonalcoholic amnesia in criminal law, it is argued that the voluntary nature of alcohol consumption should not mitigate behavioral consequences in any drinker.  相似文献

Recent literature suggests that different ‘styles’ of homicide will most appropriately be reflected in the different types of behaviours committed by offenders during the crime. In the last few years, there has been a move to standardise classification systems of single homicides and establish their cross‐national generalisability. Literature on serial homicide to date has mostly centred on homicides occurring in the US. However, national differences due to factors such as culture, national identity, political, and socio‐economic circumstances may decrease the applicability of these models or certain aspects thereof in other countries and thus must be evaluated. The present study tested the applicability in the South African context of a recently developed US‐based serial homicide crime scene classification framework. Specifically, this study compared the thematic differentiation in planning and violent behaviours that the offenders engage in and how this differentiation compares with that in the US. The sample consisted of 25 homicides that were in total responsible for the murder of 267 victims. Results indicated that overall, the framework is useful and applicable in the South African sample, but important environmental and contextual constraints must be taken into account. Can we tell where an offender lives from where he or she commits crimes? Journey-to-crime estimation is a tool that uses crime locations to tell us where to search for a serial offender's home. In this paper, we test a new method: empirical Bayes journey-to-crime estimation. It differs from previous methods because it utilises an ‘origin–destination’ rule in addition to the ‘distance decay’ rule that prior methods have used. In the new method, the profiler not only asks ‘what distances did previous offenders travel between their home and the crime scenes?’ but also ‘where did previous offenders live who offended at the locations included in the crime series I investigate right now?’. The new method could not only improve predictive accuracy, it could also reduce the traditional distinction between marauding and commuting offenders. Utilising the CrimeStat software, we apply the new method to 62 serial burglars in The Hague, The Netherlands, and show that the new method has higher predictive accuracy than methods that only exploit a distance decay rule. The new method not only improves the accuracy of predicting the homes of commuters—offenders who live outside their offending area—it also improves the search for marauders—offenders who live inside their offending area. After presenting an example of the application of the technique for prediction of a specific burglar, we discuss the limitations of the method and offer some suggestions for its future development. The criminal career paradigm focuses on the prevalence and frequency of crime along with an emphasis on offense specialization, age of onset and desistance, offense seriousness, and career length. Coinciding with the criminal career framework, developmental/life-course criminology offers more complex theoretical explanations for crime which highlight the importance of age-graded developmental risk factors that affect offending over the course of a criminal career. This review provides a systematic examination of the role of violence in criminal career and developmental/life-course research with a specific focus on its prevalence and frequency and its share of the offense repertoire. The results show that the incidence of violence is rare in one's criminal career except for a small group of chronic offenders who are responsible for a majority of the violent offenses. Regarding specialization, evidence suggests that offenders are spectacularly non-specialized and violent offenders can primarily be characterized as frequent offenders who offend more often and thereby have a higher probability of committing a violent offense in their criminal career. Crime linkage and the investigation of behavioural consistency amongst serial offenders has been a flourishing field of research over the past decade or so, especially with respect to serial sex offenders. The emerging research in this field has often portrayed serial sex offenders as a single, distinct, and homogeneous group. Such an assumption, however, has never been empirically examined. Using a criminal career approach and a sample of 72 serial sex offenders who have committed a total of 361 sexual assaults on stranger victims, the current study aims to examine and describe subgroups of crime series patterns amongst serial sex offenders in terms of duration and frequency of offending. The level of environmental consistency display (i.e. offender's choice of crime location and characteristics of the crime site selected) across subgroups of crime series patterns is also examined. Study findings suggest the presence and heterogeneity of crime series patterns amongst serial sex offenders, advocating for the consideration of subgroups of crime series patterns when studying serial sex offenders. Moreover, the offenders' level of environmental consistency varies across the different crime series patterns identified, allowing for the identification of subgroups of offenders showing a higher or lower level of environmental consistency. Cybercrime research suggests that, analogous to traditional crime, victims are more likely to be offenders. This overlap could be caused by shared risk factors, but it is unclear if these are comparable to traditional risk factors. Utilizing a high risk sample of computer-dependent cyber-offenders and traditional offenders (= 535) we compare victimization, offending, and victimization-offending between cybercrime and traditional crime. Cybercrime results show a considerable victim-offender overlap and correlates like low self-control and routine activities partly explain differences in victimization, offending, and victimization-offending. Some cybercrime correlates are related to the digital context, but show similar patterns for cybercrime and traditional crime.  相似文献

This study examines the crime patterns of 76 New Zealand serial sexual offenders in order to determine the extent to which offenders display locational consistency in their choice of crime locations. More specifically, the hypothesis was that there would be intraseries consistency in the distances travelled (spatial consistency) and the characteristics of the crime sites selected (environmental consistency) by serial sexual offenders. For spatial consistency to be tested, the distances travelled from home to offend and the criminal range for each offence series were analysed. Support was found for spatial consistency, and, in line with much overseas research, it was also found that the offenders typically did not travel very far from home to offend (median distance of 3 km). The environmental consistency measure was made up of various physical, temporal, and contextual variables that described the environmental characteristics of an offence. As hypothesised, it was found that offenders displayed intraseries environmental consistency in offence site selection beyond the level of that expected by chance. Research on hate crime has largely been limited to official statistics collected by the Federal Bureau of Investigation and some independent scholarly research of hate crime victims. Few, however, have studied hate crime offenders. Offender narratives of hate crime participation are the focus of this study. Further, few have studied hate crimes against the Amish and their offenders. This study examines hate crime against the Amish with a particular focus on the bias motivation that generates anti-Amish hate crime. To accomplish this task, non-Amish hate crime offenders were enlisted to share their experiences and stories about anti-Amish hate crime. A total of eight subjects were interviewed; the subjects supplied over 16 hours of audiotaped narrative describing acts of "Claping" they had committed against Old Order Amish. The data were transcribed and an analysis of the interview data revealed that themes emerged from offender narratives within each element of routine activities theory. The data support that the subjects were motivated offenders, the Amish were perceived as suitable targets, and there was a perception that guardians were lacking within the community to discourage anti-Amish hate crime. However, it is important to consider the themes that emerged within each dimension of routine activities when applying the theory to anti-Amish bias crime.  相似文献

Six cases of serial murder by children and adolescents spanning the past 150 years are presented. The available literature pertaining to this area is reviewed. Each of these six offenders committed sexually homicidal behavior as demonstrated by their expression of erotic interest or engagement in overt sexual behavior at the crime scenes. From a DSM-IV-TR perspective they all exhibited signs of sexual sadism, and their crime characteristics reflected behavior of a more predatory than affective nature. Hands on methods of killing were preferred, i.e., cutting, stabbing, or strangulation. These crimes are extremely rare. Case reports in this area are encouraged to advance our knowledge of these youths.  相似文献

Fish and wildlife crime is an understudied area of criminology and criminal justice and when it is the focus of research, studies tend to be characterized by small samples and a lack of multivariate analyses. This study examines the nature and extent of cited fish and wildlife offenses and characteristics of offenders through quantitative analysis of 15,657 incidents of cited fish and wildlife offenses in Florida. The results indicate that a viable typology of wildlife crime is emergent and that there are important racial and ethnic differences across types of wildlife offenses.  相似文献

Why is it that some serial offenders are arrested quickly and others only after a long period, or never at all? What characterises offenders who continue to escape arrest despite their continued involvement in crime? To be able to answer these questions, arrested (identified) offenders must be compared with never arrested (unidentified) offenders. In this paper, data from the Dutch DNA database are used to assess which characteristics of the criminal behaviour of unidentified offenders influence the probability that they will subsequently be arrested. DNA data offer a unique opportunity to compare crime series of identified offenders with crime series of yet unidentified offenders. Using the Cox proportional hazards model, we tested whether the number of crimes committed, offence specialization, and offence seriousness affect the probability of arrest of serial offenders. Results showed that as an offender commits more crimes, the probability that he will be arrested increases and that offence specialization decreases the probability of arrest. Another conclusion drawn is that DNA traces offer unique opportunities for criminological research. We discuss the limitations of this new data source and make suggestions for future research using DNA traces and for future research that might improve the current study. Criminal investigative case analysis is a method for identifying the perpetrator of a crime based on an analysis of the nature of the offence and the manner in which it was committed. Various aspects of the criminal’s personality makeup are determined from the choices before, during and after the crime. In German criminal procedural law it is a new investigative tool in preliminary proceedings to give the prosecutor extensive assistance to the police to profile unknown criminal subjects or offenders and to supply more evidence. The Federal High Court has decided that police officers who use this method are not expert witnesses whose evidence can be challenged in the main proceedings by the state attorney.  相似文献

Participants who are asked to simulate amnesia for a mock crime have a weaker memory for this event when they have to give up their role as a feigner, than those who are not asked to feign memory loss. According to the source monitoring framework (SMF), this memory-undermining effect of simulating amnesia for a crime would be due to misattribution of the right source of information. However, we know that the content of self-generated information (e.g., feigned version of the crime) might be preserved and recognised over time as a result of elaborative cognitive processing. In the present study, we aimed to contrast these two explanations. We showed participants a mock crime video and we instructed them to either feign amnesia (simulators) or confess the mock crime (confessors). Next, a free recall memory test was administered. After one week, participants were asked to perform a personalised source monitoring task using the autobiographical Implicit Association Test (aIAT). As predicted, we found that simulators were able to discriminate the content of their self-generated feigned story of the crime from the original version. Moreover, simulators were quicker than confessors at the aIAT task. Practical and theoretical implications of our results are discussed.  相似文献
