In the traditional order of the “rule of rites,” social status and relationships always held priority positions, which apparently went against the realization of social justice; Legalists thought highly of objectivity and avoided subjective randomness, and were more reasonable in this regard. However, following the integration of rites and law in the Han Dynasty, the technical aspect of Legalism emphasizing control of society and of the populace was strengthened, and in the meanwhile, their “true spirit” became concealed before long. The main signs of this are follows: (1) In the order of the “rule of rites,” the objectivity of law was gradually devoured by the subjectivity of human beings, thus the tradition where “human relationships replace law” came into being; (2) The law, which had shown the spirit of equality to a certain extent in the guise of Legalism, now degraded into a tool to maintain a hierarchy; (3) Rights were separated from duties, that is, some people enjoyed “rights without duties” as much as they wanted, while the rest were forced to carry out “duties without rights.” As history has warned us, in ruling a country, one cannot stake even the least bit of fortune upon human nature, and there can be only one bottom line and criterion, that is, common strict observance of and respect to “rules.” That should be the great value of the lesson that the pre-Qin Legalism has left for future generations. 相似文献

I argue that the degree to which a criminal should be punished is determined by three elements: a baseline amount that proportionally compensates the victim and an additional penalty that, first, reforms the criminal and, second, deters others from becoming unjust. My interpretation provides a solution to the interpretive puzzle that has most vexed commentators: the alleged tension between Plato's philosophical theory of punishment and the content of his penal code. I defend a two-step solution to the puzzle. First, on my interpretation, because of the broad role that deterrence must play, this alleged tension is—to a degree—merely apparent. Second, the actual tension can be explained by Plato's commitment to the rule of law, given the epistemic limitations of actual people. 相似文献

This paper offers a critical investigation of the theological assumptions that lie within three forms of modern feminist ethics, with a view to challenging feminist ethics to enter the new theological possibilities opened up in postmodernity for the conceiving of god. The first part of the paper considers the conceiving of god in modern feminisms, in which theology becomes ethics. The consequences of this development are considered. The second part of the paper investigates the turn into postmodernity which hears the saying of the death of god and the critique of onto-theology. This disturbance to the foundations of feminist ethics is understood as part of a wider critique of humanism manifest particularly in gender theory. That the end of the modern human subject might allow a conceiving of god through an understanding of the performative is the restored orthodoxy to which the paper points. 相似文献

A number of arguments against relativism are based on the concept of majority rule. Since, the arguments allege, on relativism moral truth is founded on majority opinion, relativism entails that (a) moral progress and reform are impossible, (b) propaganda, advertising, brainwashing, and high birth rates turn mistaken moral judgments into correct ones, (c) moral horrors, if enough people believe them acceptable, are not moral horrors at all, (d) finding out what’s right and what’s wrong is extremely easy, (e) moral reasoning is very different from what we normally take it to be, and (f) internal criticism of a moral code is impossible. These arguments get their due in this article, which first defines and explicates relativism and then exposes, explains, and criticizes the arguments. Especially important to understand about the relation between relativism and majority opinion is the notion of a convention. Accordingly, it is discussed at some length. 相似文献

In this paper, the relationship between territorial sense of community (SoC), perceived ethnic heterogeneity within the community and ethnic prejudice was analyzed. Specifically, the moderating role of perceived ethnic heterogeneity within the community on the SoC–prejudice relationship was tested in a sample of residents (N = 603) of the Salento region, Italy. Results showed that the relationship between SoC and prejudice was moderated by perceived contextual heterogeneity. For blatant and subtle prejudice, when perceived ethnic heterogeneity was low, SoC was negatively associated with prejudice. In the case of modern prejudice, SoC was positively associated with prejudice when perceived ethnic heterogeneity was high. Copyright © 2016 John Wiley & Sons, Ltd. 相似文献

The article deals with the relationship between theological ethics and moral philosophy. The former is seen as a theoretical reflection on Christian ethics, the latter as one on secular ethics. The main questions asked are: (1) Is there one and only one pre-theoretical knowledge about acting rightly? (2) Does philosophy provide us with the theoretical framework for understanding both Christian and secular ethics? Both questions are answered in the negative. In the course of argument, four positions are presented: theological ‘unificationism’, philosophical ‘unificationism’, theological ‘separationism’ and Lutheran ‘dualism’. It is argued that the latter position is most convincing. It is dual in the sense of being both a theory of Christian ethics and of including a recognition of natural law. Hence, it unites a particularistic and a universalistic point of view. In the last section a reformulation of the Lutheran position is attempted in making use of the ethical theory of Knud E. An interesting fact about customary international law is that the only way you can propose an amendment to it is by breaking it. How can that be differentiated from plain law-breaking? What moral standards might apply to that sort of international conduct? I propose we use ones analogous to the ordinary standards for distinguishing civil disobedients from ordinary law-breakers: would-be law-makers, like civil disobedients, must break the law openly; they must accept the legal consequences of doing so; and they must be prepared to have the same rules applied to them as everyone else. 相似文献
